Executive Summary

National ATM Context

Montenegro is a member of ECAA, ICAO, ECAC, NATO and EUROCONTROL.

In the context of this document, there are three main stakeholders in Montenegro: Civil Aviation Agency (CAA), Serbia and Montenegro Air Traffic Services SMATSA llc and Montenegro Airports.

The CAA has the role of the competent authority.

SMATSA is a common air navigation services provider for two states: Serbia and Montenegro.

Traffic and Capacity

Traffic in Serbia & Montenegro increased by 10.1% during Summer 2018 (May to October), when compared to the same period during 2017 (the fifth consecutive year of increase). The EUROCONTROL Seven-Year Forecast predicts an average annual increase between 1.8% and 5.1% during the planning cycle, with a baseline growth of 3.4%.

Progress per SESAR Phase

The figure below shows the progress made so far in the implementation of the SESAR baseline and the PCP elements. The percentage is calculated as an average of the relevant objectives as shown in Chapter 6.1 (PCP objectives are marked as such, the rest are considered SESAR baseline); note that two objectives – AOM19.1 and FCM05 – are considered as both part of the SESAR baseline and PCP so their progress contributes to the percentage of both phases.

The objectives declared ‘Achieved’ in previous editions (up to, and including, ATM MP L3 Edition 2011-2017) are also taken into account for as long as they were linked to the Level 2 of the ATM Master Plan and implemented by the State.

The figure below shows the progress made so far, per SESAR Key Feature, in the implementation of the SESAR baseline and the PCP elements. The percentages are calculated as an average, per Key Feature, of the same objectives as in the previous paragraph.

LSSIP Year 2018 Montenegro 4 Released Issue

Introduction

The Local Single Sky ImPlementation (LSSIP) documents, as an integral part of the Master Plan (MP) Level 3 (L3)/LSSIP mechanism, constitute a short/medium term implementation plan containing ECAC States’ actions to achieve the Implementation Objectives as set out by the MP Level 3 and to improve the performance of their national ATM System. This LSSIP document describes the situation in the State at the end of December 2018, together with plans for the next years.

Chapter 1 provides an overview of the ATM institutional arrangements within the State, the membership of the State in various international organisations, the organisational structure of the main ATM players - civil and military - and their responsibilities under the national legislation. In addition, an overview of the Airspace Organisation and Classification, the ATC Units, the ATM systems operated by the main ANSP are also provided;

Chapter 2 provides a comprehensive picture of the situation of Air Traffic, Capacity and ATFM Delay per each ACC in the State. It shows the evolution of Air Traffic and Delay in the last five years and the forecast for the next five years. It gives also the achieved performance in terms of delay during the summer season period and the planned projects assumed to offer the required capacity which will match the foreseen traffic increase and keep the delay at the agreed performance level;

Chapter 3 provides a set of conclusions extracted from the MP L3 Implementation Report 2018, which are relevant to the State/stakeholders concerned. The State reports how they have handled those conclusions and the actions taken during the year to address the concerns expressed by those conclusions;

Chapter 4 provides the main Implementation Projects (at national, FAB and regional level) which contribute directly to the implementation of the MP Operational Improvements and/or Enablers and Implementation Objectives. Level 1 document covers high level list of the projects showing the applicable links. All other details like description, timescale, progress made and expected contribution to the ATM Key Performance Areas provided by the State per each project are available in Level 2 document;

Chapter 5 deals with other cooperation activities beyond Implementation Projects. It provides an overview of the FAB cooperation and also all other regional initiatives which are out of the FAB scope. The content of this chapter generally is developed and agreed in close cooperation between the States concerned;

Chapter 6 contains aggregated information at State level covering the overall level of implementation, implementation per SESAR Key Feature and implementation of ICAO ASBUs. In addition the high-level information on progress and plans of each Implementation Objective is presented. The information for each Implementation Objective is presented in boxes giving a summary of the progress and plans of implementation for each Stakeholder. The conventions used are presented at the beginning of the section.

Level 1 document is completed with a separate document called LSSIP Level 2. This document consists of a set of tables organised in line with the list of Implementation Objectives. Each table contains all the actions planned by the four national stakeholders to achieve their respective Stakeholder Lines of Action (SLoAs) as established in the European ATM Master Plan L3 Implementation Plan Edition 2018. In addition it covers detailed description of the Implementation Projects for the State as extracted from the LSSIP Data Base.

The information contained in Chapter 6 is deemed sufficient to satisfy State reporting requirements towards ICAO in relation to ASBU (Aviation System Block Upgrades) monitoring.

Airspace Classification and Organisation

The Montenegrin airspace is generally divided into uncontrolled and controlled portions according to the By-law on conditions of use and classification of airspace in Montenegro published in the Official Gazette of Montenegro No. 52/17.

ICAO classes C, D, E and G apply to Montenegrin airspace in the following manner:

a) Class C applies to all TMAs and to airspace above 10000 ft AMSL; b) Class D applies to all CTRs; c) Class E applies to airspace between 1500 ft AGL and 10000 ft AMSL except TMAs and CTRs; and d) Class G applies to airspace from the ground up to 1500 ft AGL, except CTRs.

The Montenegrin airspace is sub-divided into:

a) en-route (FL145 – FL660) for which the responsibility rests upon ATCC Beograd,

b) two TMAs and CTRs for which the responsibility rests upon the Approach Offices located at the respective airports. The lower limit of TMAs is 1500ft AGL while the upper limit is FL145 for Podgorica TMA and 7500 ft AMSL for Tivat TMA, Tivat TMA being included within the Podgorica TMA.

The Civil Aviation Agency of Montenegro is founded by the Government as a public agency (Article 5 of the Aviation Act, “Official Gazette of Montenegro” No30/12 and 30/17) and entrusted with the tasks of regulation, oversight, certification, licensing and record keeping in the civil aviation in Montenegro, as well as cooperating with the international aviation organizations.

Bodies of the CAA are the Council and the Executive Director. The Council, consisting of five members, manages the Agency. The CAA is headed by the Executive Director.

CAA is the competent authority and as such issues certificates and performs safety oversight over ANSPs.

As the ANS provision is separated from the Regulator, the CAA, apart from the above, is responsible for rule making, collection, analysis, keeping and distribution of occurrence reports; safety performance monitoring and other tasks defined in the transposed SES legislation.

2. Traffic and Capacity

The information related to the en-route traffic and capacity can be found in the LSSIP of the Republic of Serbia.

Montenegro and Serbia have founded a common ANSP organisation (SMATSA – Serbia and Montenegro Air Traffic Services llc) whose principal place of operations is in Belgrade, namely Beograd ATCC.

3. Master Plan Level 3 Implementation Report conclusions

Conclusions issued from the European ATM Master Plan Level 3 Implementation Report 2018 applicable to Montenegro for all items that require corrective actions and improvements.

5. Cooperation activities

Regional cooperation

Regional cooperation initiatives

ECAA (European Common Aviation Area) is a project initiated and managed by the European Commission, aiming at the establishment of equal conditions of competition and common rules in aviation, including ATM and environment. As for ATM, the project will seek the highest degree of cooperation with the view to extending SES among the States concerned.

Montenegro ratified the ECAA Agreement in November 2007.

In January 2011 the Government of Montenegro promulgated the Law amending the Law on Ratification of ECAA Agreement allowing a whole set of SES regulatory acts listed in Annex I of the Agreement to be transposed into national legislation and published in Montenegrin (Official Gazette of Montenegro No 1/11, January 10 2011). In June 2012 the Government of Montenegro promulgated new Aviation Act that is fully compliant with the provisions of ECAA Agreement and it’s Annex I (“Official Gazette of Montenegro” No30/12. June 8 2012). The Aviation Act was amended in 2017 to incorporate changes to ECAA Annex I regulations and other EC regulatory acts (“Official Gazette of Montenegro” No 30/17),

Along the lines of SES, specific and effective actions forward fulfilling operational requirements resulted in signing the agreements on operational-technical cooperation between SMATSA and other ANSPs in the region.

Agreements have been signed with NATA (Albania) and Slovenia Control (Slovenia) in 2010 and with HungaroControl (Hungary), BULATSA (Bulgaria) and MK CAA (FYROM) in 2011, as well as with ROMATSA (Romania) in 2012.

Agreements will consecutively contribute to airspace usage, increased capacity and ensure safe and efficient flow of air traffic with minimum delays.

Montenegro had an active role in ISIS programme (Implementation of the Single European Sky in the South East Europe) which provided support to ISIS Beneficiaries in transposing the European regulations and developing institutional capacity to implement those regulations. The ISIS Programme has come to a finish at the end of 2012.

As a beneficiary of ISIS II, Montenegro receives technical assistance based on the Performance Scheme Pillar. CAD (The Republic of Serbia), SMATSA and the CAA have jointly set up a Performance Roadmap in cooperation with ISIS II, containing plan and steps towards implementing performance regulations by the end of the Reference Period 3.

Following High Level Meeting, held under auspices of the Regional Cooperation Council in Sarajevo on April 29th 2013, gathering national regulatory and supervisory authorities and air navigation service providers of Western Balkans states, regional DGs and CEOs have agreed upon the stepwise development of a Joint Service Provision Area Initiative (hereafter as: JSPA Initiative) in the South East Europe.

The aim of JSPA Initiative is to provide benefits for its participants and their stakeholders through agreed projects whilst creating proactive relationships between regional CAAs and ANSPs. Agreed scope of JSPA Initiative activities is in line with European key performance areas (KPAs): safety, capacity, environment and cost efficiency. The support and participation to the JSPA Initiative is currently given by Albania, Kosovo*, Hungary3, Macedonia and Montenegro.

“EGNSS Building Capacity on EU Neighbouring multimodal Domains” i.e. BEYOND project is a project financed by the European Commission with the objective to promote the use of EGNSS in countries neighbouring the EU and encourage investment in the implementation of EGNSS, to prepare project participants to optimize the adoption of EGNSS outside the EU by contributing to increasing knowledge about EGNSS, and to support networking between EU and non-EU players and to create a basis for cooperation and business opportunities for aviation in the countries neighbouring the EU.

Since the beginning of 2015 Montenegro participates in the work program named “Capacity building in Eastern Europe”, which is particularly dealing with improving knowledge, and building technical and operational capacity for the use of the EGNOS system in the Eastern Europe and was finished in 2017.

“Capacity Building for aviation Stakeholders” i.e. CaBilAvi project is a project financed by the European Commission that aims to share awareness and experience on the implementation of instrument flight procedures based on satellite technologies with the objective of performing a series of working groups covering activities such as PBN, procedure design and safety related activities among other topics.

Since the beginning of 2015 Montenegro participates in this project working, particularly, on implementation of a PBN instrument flight procedure based on SBAS technology at Tivat Airport. The project is in final phases of producing deliverables based on the working groups’ activities performed during the last 3 years.

* This designation is without prejudice to positions on status, and is in line with UNSCR 1244 and the ICJ Opinion on the Kosovo declaration of independence. 3 Hungary is invited to participate, as appropriate, in the JSPA Initiative based on the temporary role allocated by NATO for the normalization of the upper airspace over Kosovo*.
