personality has earned you a spot at your neighbour’s

politely say “Good morning” (when you wake up drunk

on your door step). You’re constantly having parties and

neighbour’s nor do you have any intentions of inviting

i have lived in many, many apartments over the years – renting has offered me a fabulous lifestyle. I have enjoyed numerous housemates and had some wonderful landlords. There are a few stand-out moments, but for

the most-part, being a renter accommodated my needs perfectly.

While I found out early on that I hated living alone, I learned quite quickly what qualities I like in the person with whom I’ll be sharing a space.

Some roommates were friends – and it was a lot of fun to live with people I’d always been close to, however, it was often easier to live with people who had a similar lifestyle. While I was a student, for example, it was easier to live with people who were also students and appreciated the need for quiet study time. When I was working nights it wasn’t easy to live with a person who had a day job since their alarm clock went off at 6am – just a couple of hours after I’d come home from a long night at work. But the one thing I found most important was to live with someone who appreciated the same level of cleanliness. I remember interviewing potential roommates, one looked at my sink – we’d left our breakfast dishes there. I can still hear her say “Oh no, that’ll never do when I move in, I’m a clean freak!” She was adamant, and I knew I could never meet her expectations. That was a battle waiting to happen.

1. CONSTRUCTION NOISE. If you are moving into an area that has properties under construction, or scheduled construction, be prepared to experience long-term noise.

2. BUSES. Find out where the local public transit routes are and their schedules.

3. NEIGHBOURS. Seniors tend to be quiet, working professionals tend to be working, resting or out of the house while students and families with children are more generally active in the home and hence make more noise. Note neighbours with swimming pools, trampolines and other outdoor play areas.

4. COMMERCIAL ZONING. If you live in a mixed-use area, there may be businesses that stay open late, like bars with loud music playing. Consider the associated rambunctious crowd.

5. CHURCHES AND TOWN HALL CLOCKS. Historic and melodic as these bells are, consider if their clanging is what you want to listen to on a regular basis.

6. SCHOOLS. Be aware that playground noise may reduce or cease in summer, but some school bells ring all year round.

7. FIRE DEPARTMENT. On one hand it’s comforting to know that the fire department will be at your service almost instantly should you need them, on the other hand, you may not want to hear that siren on every call they receive.

8. AMBULANCES AND HOSPITALS. Being close to a hospital may have its advantages for a senior population, however, as with the fire service, weigh this advantage with the disadvantage of hearing sirens several times a day.

9. TRAINS. This includes long distance, subway and streetcars. They sure can screech. Again, check their schedules.

10. PLANES. Is your new home on a flight path to a major airport? Or a minor one with small planes that have loud engines? Find out the flight schedule because late-night wakeup calls may become tiresome after awhile.

YOU’VE FOUND YOUR IDEAL HOME…you think. You’ve made your checklist of needs and wants and this place meets all your needs. And yet, you may not have thought of everything. If living in peace and quiet is important to you, consider these ten sources of noise before you sign on the dotted line.

1. CONSTRUCTION NOISE. If you are moving into an area that has properties under construction, or scheduled construction, be prepared to experience long-term noise.

2. BUSES. Find out where the local public transit routes are and their schedules.

3. NEIGHBOURS. Seniors tend to be quiet, working professionals tend to be working, resting or out of the house while students and families with children are more generally active in the home and hence make more noise. Note neighbours with swimming pools, trampolines and other outdoor play areas.

4. COMMERCIAL ZONING. If you live in a mixed-use area, there may be businesses that stay open late, like bars with loud music playing. Consider the associated rambunctious crowd.

5. CHURCHES AND TOWN HALL CLOCKS. Historic and melodic as these bells are, consider if their clanging is what you want to listen to on a regular basis.

6. SCHOOLS. Be aware that playground noise may reduce or cease in summer, but some school bells ring all year round.

7. FIRE DEPARTMENT. On one hand it’s comforting to know that the fire department will be at your service almost instantly should you need them, on the other hand, you may not want to hear that siren on every call they receive.

8. AMBULANCES AND HOSPITALS. Being close to a hospital may have its advantages for a senior population, however, as with the fire service, weigh this advantage with the disadvantage of hearing sirens several times a day.

9. TRAINS. This includes long distance, subway and streetcars. They sure can screech. Again, check their schedules.

10. PLANES. Is your new home on a flight path to a major airport? Or a minor one with small planes that have loud engines? Find out the flight schedule because late-night wakeup calls may become tiresome after awhile.

RENTING OUT A ROOM IN A PRIVATE HOUSE OR CONDO AND SHARING THE HOME WITH THE OWNER is a lot like having a roommate – except for the legal implications.

Living with someone can be a great way to save on expenses, make your housing budget go further and enjoy a type of home you wouldn’t normally rent on your own. But unlike a typical roommate, where both of you rent from the owner, living with the landlord doesn’t offer you the same legal protection through the Residential Tenancies Act (RTA) It’s important to know the regulations and limitations that this type of tenancy has.

You may be surprised to find that, in most provinces, if a tenant shares the kitchen or bathroom with the landlord or the landlord’s immediate family (parent, child or spouse), then the Residential Tenancies Act (RTA) or Landlord and Tenant Act does not apply.This means the landlord can raise the rent, change the locks or do a number of other things a landlord would be prohibited from doing under the RTA.

It works both ways - a tenant can also jump ship without notice and the landlord does not have the same protection covered by the RTA. It is implied that treatment should be fair, but there are no legal regulations or support for either the landlord or the tenant in a home shared with the owner.

In order for both landlord and tenant to protect themselves and have clear expectations, there should be a written roommate/rental agreement. This kind of agreement is a contract and can be enforced through contract law. You may want some legal guidance on creating a proper contract. That agreement should include, but is not limited to:

• Rent amount and other costs like utilities, Internet, cable, etc • How the property will be shared • How the chores will be split • How notice of termination and length of notice should be

given

• If there will be a damage or last month’s rent deposit

The landlord and tenants can add to the contract, as long as it is agreed upon. Although you won’t be protected by the RTA, having a written contract will give both the landlord and tenants some protection.
