POST-ELECTION PLANNING – A ROADMAPTO WHERE?

What are the implicationsof a new Conservativegovernment forplanning policy? SHW’s

Alex Bateman investigates.Firstly, let’s look at key points of

the Conservative manifesto. Forinstance: "When new homes aregranted planning permission, wewill make sure local communitiesknow up-front that necessaryinfrastructure such as schools androads will be provided.”

The manifesto also pledged toprotect the green belt. It said thatbrownfield land would be used "asmuch as possible" and localauthorities would be required tohave "a register of what isavailable" and ensure "90 per centof brownfield sites have planningpermission for housing by 2020". 

A new London LandCommission will also be created"with a mandate to identify andrelease all surplus brownfield landowned by the public sector" and

said Housing Zones would create95,000 new homes. TheConservatives would also create a£1 billion "BrownfieldRegeneration Fund" designed tounlock the construction of homes.

The Conservative manifestoalso pledged:

• To "build more homes thatpeople can afford", including200,000 new Starter Homesexclusively for first-time buyersunder 40 over the course of thenext parliament

• To deliver 275,000 additionalaffordable homes by 2020

• To extend Help to Buy to coveranother 120,000 homes

• Extend the Right to Buy totenants in housing associations,funding the replacement ofproperties sold under the Rightto Buy "by requiring local

authorities to manage theirhousing and assets moreefficiently, with the mostexpensive properties sold offand replaced as they fallvacant"

• A new "Right to Build, requiringcouncils to allocate land to localpeople to build or commissiontheir own home, as you can doin most of Europe"

• To support BusinessImprovement Districts and"other forms of business-ledcollaboration on high streets -giving more say to local traderson issues such as minorplanning applications, cleaningand parking"

• To "build new roads andrailways in a way that limits, asfar as possible, their impact onthe environment" This includesinvesting £300 million in"cutting light pollution fromnew roads, doing moretunnelling, building better noisebarriers and helping restore losthabitat"

• To create a "Blue Belt" aroundthe UK’s 14 Overseas Territoriesand a network of marineconservation zones off UKcoasts

Separately, Prime MinisterDavid Cameron has pledged tointroduce a new Enterprise Bill tocut red tape for businesses withinthe first 100 days of his newgovernment.

In addition to that above, we allneed to ready ourselves for theresult of the AirportsCommission’s study on the choiceof an extension to eitherHeathrow or Gatwick. We alsohope that further clarification onthe Office to Residential PermittedDevelopment Rights as to whetherthey will be extended and what ismeant by “implementation”.

“For several weeks leading upto the 2015 general electionhouses didn't seem as safe as theymight be. Across the country,house buying and selling activitystalled as people awaited theresult. So the announcement thatthere would be a winner with aclear if perhaps only slendermajority was met by those in thehousing industry with a collectivesigh of relief.

It wasn’t necessarily thepolitical stripe of the party thatwon but the fact there was at leasta clear result and the propertymarket would not be left in limboduring weeks and possibly monthsof political horse-trading and in-fighting.

Also, there will be anacknowledgement that the threatof mansion tax has gone. This wasa significant concern towards theupper end of the market. Anotherworry was the threat of rentcontrol. This would potentiallyhave affected the buy-to-letmarket dramatically.

So there is a mandate from the

electorate. The city has respondedfavourably. The pound is up;shares in major house buildingfirms are up and at least 37 percent of the population feel a littlemore confident about theimmediate future – buoyed by atrend of improving trade,employment and cost of livingfigures.

But let us all hope – no matterwhich party we supported – thatthe next government, besidesdealing with a small majority, alarge deficit, Europe, devolution,world hot spots and many otherincredibly important issues, will atlast get to grips with an effectiveand sustainable housing policy inthe UK. Ican’t help but chat with people about buildings. The subject comesup in conversation so easily, especially with strangers. Why talkabout the weather when we are surrounded by such intriguingarchitecture?

Regular readers are probably now aware that I have just been electedonto Brighton & Hove City Council. It has been a long slog but well worththe years of effort. My greatest passion is of course the builtenvironment and, as a Councillor, I would hope to have positiveinfluence here.

My first foray into King’sHouse, the council’sheadquarters on Hoveseafront, was inevitably achaotic experience. There is alot to take in. There are tensof council officers whom Ineed to get to know, who arescattered around the vastoffice complex. My tourinevitably led to me asking tosee some of the hiddenareas. I can’t help but talkarchitecture.

King’s House is actually acollection of buildings,unbeknownst to mostresidents. It was originallydesigned as a terrace of sevenhouses. Corridors have beenknocked through the thickparty walls to make oneintegrated space (similar to theway in which four terracedhouses became the oldSackville Hotel).

The south-west corner was most interesting to me. Its tower iscertainly the most important feature. There are no other eight storeysstructures in Hove in fact. The tower office is home to the council’smajor projects team – who have the best jobs and views in the council,but the largest number of steps.

In an ideal world...In an ideal world everything would run just as it should.

Tenants wouldn’t struggle to meet the rent, landlords would be paid everymonth without fail, fish would leap out of the streams onto our plates and Zaynwould have never left One Direction.

In the meantime we just have to deal with things as they are.

Back in the real world rent arrears can be a very real problemTry as we might, falling behind with rent happens.

Every landlord has to deal with it at some point. Even the preventativemeasure of setting up a standing order offers very little guarantees. Contractscan be broken – and I’m not still harping on about Zayn here.

So what can you do? Do you make an exception? Should you allow the debt to accumulate in thehope that it will be paid at a later date? Do you deal with it informally? Or do youstart the legal proceedings as soon as you can?

Section 8 NoticesA Section 8 Notice can be used by landlords to regain possession of a property

that has fallen into rent arrears of more than two months. You theoretically onlyneed to give the tenant 14 days’ notice but again there is no guarantee thateverything will run just as it should.

Wouldn’t it be perfect...?Wouldn’t it be perfect if all of this hassle and trouble could be taken away with aclick of your magical heels?

Dealing with rent arrears is at best a hassle. At worst it can be downrightunpleasant and stressful.

How about if I offered to take away the prospect of ever having to deal withrent arrears? I would not charge you a management or anadministrative fee.
