Major problems such as damp, mould,electrical hazards, gas leaks and animalinfestation have been experienced by61% of tenants renting in the private

sector, according to a new report released byShelter and British Gas.

The report largely points the finger at ill-informed, amateur and accidental landlords whoare far more numerous than rogue landlords.According to the report, more than a quarter oflandlords have no previous experience of lettingout a property, and almost half (43%) do notregard renting as a proper business.

Carole Charge, Leaders’ Technical & ComplianceDirector says: “This research emphasises how vitalit is for tenants to be selective. Most tenantschoose their agent or landlord by default, based onthe property that best fits their requirements, andare not aware that landlords and agents do not allabide by the same standards.

“This is because there is still no formalregulation in place to prevent landlords and agentswho have no experience, qualifications, clientmoney protection or knowledge of the law frompracticing. Ironically, there are 100+ rules andregulations that a property has to pass to be letlegally, yet there is no legal requirement for thepeople actually carrying out the letting to prove

is to rent through an agent that is a member of aprofessional, self-regulating organisation such asARLA, RICS or NAEA, which requires members toabide by a strict code of conduct.

This includes making sure thatrented property is safe and in goodcondition and that all relevantlegislation is fully complied with. Inaddition, it means the agent willhold tenants’ deposits and allclient money safely in a protectedaccount, be trained and qualifiedin lettings law and abide by rulesand regulations.

“The lack of regulation of themarket allows unscrupulousagents and landlords, as well asnaïve ones, to providesubstandard properties andcharge extortionate fees andrents in areas of short supply,”says Ms Charge. “The public isvery vulnerable to bad practise.”

Unregulated agents are ableto offer lower commission ratesbecause they do not have totrain staff or invest in the resources needed tomaintain high standards. As a result they attractlandlords and tenants with low fees because mostpeople are not aware of the risks they face.

To help tenants protect themselves, Leaders’advice is to make sure that a chosen agent will doall the following, as part of their standard service:

– Ensure that the property has passed anelectrical safety and gas safety inspection and givethe tenant a copy of the Gas Safety Record.

– Check the property is free from mould, damp,blocked drains or sewage issues.

– Check that all soft furnishings comply with firesafety regulations.

– Carry out health and safety checks andminimise potential hazards.

– Give prospective tenants a copyof the Energy PerformanceCertificate (EPC) so they can makean informed decision.

– Provide Tenancy Agreementswritten in plain English, with nounfair T&Cs, as determined by theCompetition and Markets Authority(CMA).

– Hold the deposit in accordancewith the Tenancy Deposit Scheme

(TDS) and have Client MoneyProtection in place.

– Draw up a detailed Inventory& Schedule of Condition at thestart of the tenancy, agreed byboth tenant and landlord.

– Ensure that the tenant’srights are protected during thetenancy, this includes the right toquiet enjoyment of the propertywith at least 24 hours’ written

notice given before a visit by the letting agent orlandlord, except in an emergency.

Love it or hate it, the i360 project promises to be one of the biggestengineering spectacles that we have seen in Brighton and Hove foryears, and the build promises to be fascinating throughout.

I will be covering the project as itprogresses, and am particularly lookingforward to seeing how Brighton’smain sewer (perhaps the greatest ofall local engineering feats) isdiverted in January. This week’snews is the release ofphotographs of the principalcomponents of the tower – 33giant flanges and 17 steel cans.

Euskal Forging, based betweenBilbao and Pamplona in north-eastSpain, has forged the 33 giant flangesthat will be used as connecting pieces foreach of the 17 steel cans that will become thetower itself. The flanges are machined to make a flat surface and then boltedinside each end of the steel cans. Accordingly, there are two flanges per can(except on the uppermost can where there is one). Each flange is forged froma single ingot of steel.

The flanges were approved in early December by steel specialistsHollandia and are now to be transported to Sif Group in Roermond in thesouth-eastern Netherlands, where the steel cans will be bolted to them. Thesteel cans will be finished inside and out at Hollandia’s factory in Rotterdam,where they will also be sprayed with molten zinc and painted before beingdelivered to the UK by boat in 2015.

As it goes, I have supported the i360 project since discussions began in2006. If the figures are correct, it will bring tourism and regeneration to awhole part of town that has been forgotten for years – and joy to hundreds ofthousands of visitors who will get to see Brighton, Hove and its surroundingsin a most exhilarating manner.www.buildingopinions.com [email protected]

Over the past 13 years, I reckon Imust have been to Hastings onbusiness – if you can call hooveringthe communal hallway business –

more than 200 times on the train. Only twiceout of those 200 times have I had to take aladder with me. The first time, I was paintingmine and Katy’s flat and needed the ladderin order to reach the very high ceilings. Iseem to remember that the journey back toBrighton with my ladder and painting

materials was fairly traumatic, due to my train being replaced by a bus.Infuriatingly, the bus driver initially refused to let me on with the ladder,which I had slung over my shoulder in the style of a very unglamouroushandbag. It was not bothering anyone, apart from me, but he kicked up afuss nonetheless.

This morning, having returnedfrom a lovely trip to Marrakech lastnight, I realised that I had notcleaned the communal hallway inHastings for over a month.Furthermore, I was about to bebusy for the next fortnight andtoday was the only day I wouldhave enough time to do it.

On this outing, I knew I also hadto replace some of the lightbulbsand replace a couple of thelampshades that someone hadpinched, although it beggars belief that someonewho could afford a ladder would feel it worthwhileto ascend it in order to pinch someone else’sproperty. I therefore had to take my ladder.

I rushed, handbag ladder slung over shoulder tocatch the 11.32am train ... which shuddered tohalt just after Eastbourne in a very alarmingmanner. I could feel a replacement bus comingon.

After an hour and a half on the track and afurther hour at the next station, thereplacement bus arrived. Both the vessel andthe driver were so old that I feared they mayhave driven me on an ice skating trip with theBrownies in 1972. The replacement bus wasin need of a replacement bus.

Although the ancient driver let me on with noobjection, it’s the last time I’m taking that evil,portentous ladder anywhere ...

Over 5,000 estate agents entered the annual Estate Agency of the YearAwards, and over 600 leading agents from across the countryattended the ceremony at the Lancaster London Hotel oppositeHyde Park, in association with the Sunday Times and The Times,

on Friday 5 December. The winners of the most highly regarded awards in theestate agency industry were presented by Michelle Mone OBE of UltimoBrands International, as well as TV newsreader Penny Smith, Alex Lowe ofGoogle, James Micklethwaite of Rightmove and other guest speakers.

The awards ceremony was the culminating event of an extremelythorough judging process by a panel of 20 industry experts, who assessedinitial entry submissions before conducting an extensive review of theentrants, which included over 150 hours of telephone interviews and mysteryshopping exercises. The whole of the judging process was overseen by TheProperty Ombudsman.

With rents ranging from£95 to £110 per week per room, and tenanciesrunning for the whole twelve months of theyear, you can get a fantastic return, but youmust be aware that they are high maintenanceproperties – like anything in life, you will have towork hard to get the big bucks, and theseproperties are no different.

First things first: location is always key. Eventhough we have always managed to let everysingle student house, the firstones to go are always those inthe key positions. For us, this isanything in and around theLewes Road area, or close to ouroffice. This is the first area to go.

Secondary areas are Elm Groveand Hollingbury, and the thirdarea is Coldean andMoulscoombe. You will get thehighest rents in the first area, andthen, intuitively, it will dropslightly for the others.

Next you must make sure thatit is furnished correctly. We always recommendthat good quality furniture is installed – thiswould include a 4ft bed, wardrobe, desk andchair in each room. Anything over and abovethat should be down to the student. Plumbing

should be provided for a washing machine,however we recommend that you do notprovide one. They break down regularly, andbetween the students they can club togetherand buy one to be delivered; they will have awarranty and they can always sell this on at theend of their tenancy to recoup some of themoney.

We suggest a simple white colour schemethroughout, making it easier for either thestudents or your contractors to repair betweentenancies. For our landlords we insist that theyhave a week’s void period every year – theseproperties have a lot of traffic, especially the 6/7bedroom properties, and you will havemaintenance to do both during the tenancy andin the void period.

Of course, you will needyour HMO (House in MultipleOccupation) Licence. Overthe past three years we’veoverseen hundreds oflicence applications, andthey can be a bitcomplicated, but if you haveany concerns do give us acall, and we’ll happily comeover and give our opinion onwhat will bring yourapplication up to speed.

From a lettings point ofview, the bigger the bedrooms, the easier it is tolet. But most houses have bedrooms of varioussizes, and the students are left to tier the rentsthemselves. Remember, you are letting thehouse as a whole unit, not individual rooms,
