presence and grace. In keeping with the coupe-inspired styling, the rear door handles are clever-ly concealed in the C-pil-lar. The all-glass tailgate opens wide to reveal a highly functional cargo space with integrated under-floor storage. The prototype is finished off with stylish dual chrome exhaust outlets and 9-spoke machined wheels fitted with 20-inch Michelin tires.

“From the very first sketch of the ZDX, I wanted to create an emotional vehicle that challenged con-

ing of what a sports coupe should be,” said Michelle Christensen, ZDX exterior designer. “My goal was to create a strik-ingly beautiful exterior, and use that attraction to help draw you into the rich interior.”

Inside, the ZDX exudes modern luxury while focusing on pampering the front passengers. The cabin is enveloped in leather, which gives the interior a luxu-rious and inviting feel. The hand-stitched leather dash and instrument panel sweep down to form a dual cockpit layout, cre-ating a personal and intimate experience for the front seat occupants. The pre-mium leather seats are highly bolstered to support the passengers during sporty driving and at the same time provide comfort during a long getaway. A black monochromatic center stack leads to the

textured metallic center console, which complements the black and pearl white

leather trim. The thick leather wrapped steering wheel provides ample grip and is framed by racing-inspired paddle shift-ers for the ultimate in driver control. The cabin is enclosed by a panoramic glass roof which runs the entire length of the v e h i c l e , providing occu-pants with a breath-t a k i n g v i e w of the w o r l d around them.

The Buick LaCrosse was named Best in Show and the Cadillac SRX was chosen the Best 2010 model at the AJC International Auto Show by the Greater Atlanta A u t o m o t i v e M e d i a A s s o c i a t i o n (GAAMA).

A f ive-person panel of GAAMA judges chose the GM models over dozens of other candidates and presented the "GAAMA Peach" awards prior to the auto show opening March 13.

The Society of Collision Repair Specialists (SCRS) is in full support of any effort(s) that would require first or third party claimants to receive written disclosure that any damage assessment provided by the insurer is not a written estimate of repair costs, and that the actual cost of repair may differ from the amount reflected in the insurer's damage assessment. We believe this is in the best interest of the consumer because cur-rently, the insurer damage assessments are based only on a "visual inspection" of the damage, and in many cases a visual inspection alone cannot identify the full

We contend that only the auto body professional performing the repair is in a position to thoroughly inspect, diag-nose and identify the methodology and true cost of the vehicle damage repair. Both the auto body repair facility and the technician have the appropriate training and equipment that allow for a detailed analysis of the damage. By requisite of the training and investment in the equip-ment, it is the auto body repair shop who is able to disassemble or "tear down" the vehicle, when applicable; thereby

allowing the repair professionals to cap-ture enough information to document a thorough written estimate of repair that reflects the true extent of the damage and the cost to repair the vehicle's damage.

SCRS believes a written disclosure to the insurance company's claimant that the insurance assessment is not a written estimate for repair, but is in fact a dam-age assessment that may not reflect the actual cost of the repair is a positive step forward for the consumer and the small businesses throughout the country that perform these types of repairs for the consumer.n

Cash for Clunkers would prema-turely destroy vehicles and their valu-able parts and components, denying more affordable used vehicles to mil-lions of low- and middle-income fami-lies who cannot afford to purchase a new car even with a $3,000 to $5,000 government voucher.

"For families that cannot afford the price of a new vehicle even with a gov-ernment voucher, the Cash for Clunkers program would limit their access to affordable transportation, a must for most working Americans," said Aaron Lowe, vice president of government affairs for the Automotive Aftermarket Industry Association. "Cash for Clunkers may sound good at first, but when you take a closer look, it is clear that the Cash for Clunkers proposal will nega-

tively impact car owners, wasting bil-lions of taxpayer dollars."

Steven Levitt, a University of Chicago professor of economics and author of the best-seller Freakonomics, recently wrote about Cash for Clunkers on his New York Times blog: "It also seems to me that any effect on the demand for new cars would be extreme-ly limited. People who drive clunkers are generally not in the market for new cars. Presumably their replacement car will be a used car. The increased demand for used cars will lead to higher prices for used cars, which will push some buyers towards a new car, but the likely impact on new cars would be small."

Congress and states have con-sidered Cash for Clunkers proposals in the past and in many cases have

decided against them. Many legislators have come to realize the unintended consequences of these programs and that they are not a cost-effective use of government money.

"Providing incentives for individu-als to purchase fuel efficient vehicles or to have their current vehicle main-tained would be a better use of fed-eral money," continued Lowe. "The bot-tom line is that Cash for Clunkers is a bad idea and should be rejected by Congress."

The Automotive Service Association (ASA) has announced another new tool to assist its members who specialize in collision repair. Under the leadership of Carroll Proctor of A.C. Proctor’s Paint & Body Inc., in Augusta, Ga., ASA’s Collision Division has cre-ated two Stripe Damage Sheets to assist repairers in photographing and docu-menting subtle or minute finish flaws and small dents on vehicles.

Similar to others being distribut-ed around the industry, the ASA Stripe Damage Sheets are designed for use

“It is exciting to see such a simple tool that works and doesn’t cost a lot of money. Especially during these times, it’s important to document repairs and receive the correct compensation for those repairs,” said Denise Caspersen, ASA Collision Division manager. “These ASA Stripe Sheets are another tool for ASA members that aids in accuracy and acquiring fair compensation.”

The sheets are the latest addition

to ASA’s growing collection of collision tools designed to assist collision repair professionals in their day-to-day opera-tions. Several communication fliers have been created to help ASA collision repair members educate their local insurance representatives and adjustors about cor-rect procedures. These free documents include the “Repaired vs. New Panel,” the “LKQ vs. New Panel” and the “Blend vs. New Panel” and the “Raw vs. Primed Bumper Cover” fliers. Other free items in ASA’s Collision Division Toolbox include a Quarter Panel Refinish Operations

Much like the nation's overall economy, the auto-physical damage industry saw a 2008 filled with change, most notably by a global recession and harsh weather. These factors had a major downstream impact on things like erratic fuel pricing and overall driving habits, helping create a 'Perfect Storm in 2009,' the apt subtitle for this year's edition of CCC Information Services Inc.'s Crash Course. "Companies will need to be even more aware of variances among their customer base (by age, demograph-ics, employment situation and geog-raphy) than potentially ever before," added Gotsch. "Using this information to change and grow their business will help companies in this very difficult economic environment."n

The California Air Resources Board (CARB) has adopted the Tire Pressure Program, which is part of the California Global Warming Solutions Act, A.B. 32. The Act creates a long-term plan for California to reduce green-house gas emissions.

According to CARB, the Tire Pressure Program, which will go into effect July 1, 2010, will annually:

• Eliminate 700,000 met-ric tons of greenhouse gas emissions

• Reduce the state’s fuel consumption by 75 million gal-lons

• Extend the average tire’s useful life by 4,700 miles

The California Air Resources Board (CARB) states this program will save money, gas and lives. This program will require California’s auto-motive repairers to check the tire pressure of every vehicle they service. The tire pressure check requirement will apply to smog check stations, engine repair and oil service provid-ers. Collision repair, glass and car wash facilities are excluded from compliance.n

The Automotive Service Association (ASA) has announced a new and timely tool to help explain extended service plans to consum-ers. “Extended Service Plans (ESPs)/Extended Warranties - Consumers’ Guidelines to ESPs” is available for free to consumers at www.ASAshop.org. With research indicating that more motorists are keeping their cars longer and getting them serviced, as opposed to purchasing new vehicles, this docu-ment helps educate motorists about the different types of extended service plans and how to select the right one to meet their needs.

ASA Publishes Consumer Guidelines for Extended Service Plans“Before making a decision on

whether an extended service plan is right for your vehicle, consumers need to do their homework. ASA’s ‘Consumers’ Guidelines to ESPs’ is designed to help today’s motorists be proactive in their vehicle maintenance and coverage choices, and better understand their options,” said Robbie Addison, ASA’s Mechanical Division manager.

The association created this document under the guidance of ASA’s Mechanical Division Operations Committee and its Extended Service Plan Advisory Subcommittee. Designed to educate consumers who may be con-

sidering the purchase of an ESP for their vehicle, the brochure addresses such topics as finding the right coverage and repair facility, when to purchase an ESP, types of coverage available and how the claims process typically works. These topics, along with many other tips, are included in the free document.

S u b a r u is revving up p e r f o r m a n c e and handling in its iconic All-Wheel Drive Impreza WRX model for 2009. P e r f o r m a n c e is boosted to a new level in the 2009 WRX thanks to a 265 h o r s e p o w e r turbocharged i n t e r c o o l e d Boxer engine, retuned suspen-sion and wider, l o w e r- p r o f i l e summer per-formance tires. WRX enthusi-asts will quickly identify the 2009 models by the STI-type grille and standard Aero Package. The 2009 Impreza WRX is available with a 5-speed manual transmission only.

The goal of the 2009 WRX team was termed “Kyo-Ka” (translated from Japanese as “strengthening”). To achieve this goal, Subaru engineers thoroughly revamped the performance character of the WRX for 2009. A larger turbocharger increases boost to 13.3 psi from 11.4 psi in the 2008 model, and a new larger-diameter exhaust uses a low-density catalyst for reduced back-pressure. As a result, the 2009 WRX engine produces 265 horsepower at 6,000 rpm and 244 lb.-ft. of peak torque at 4,000 rpm – significant increases from the 224 horsepower and 226 lb.-ft. in the 2008 version. Fuel economy is an EPA-estimated 18 mpg city / 25 mpg highway, compared to 19/24 for the 2008 WRX model.

The Impreza WRX debuted an all-new platform for the 2008 model year, featuring a longer 103.1-inch wheel-base and an all-new double-wishbone rear suspension system. Revised sus-

pension tuning for 2009 further bol-sters WRX’s street performance creden-tials. The standard 17 x 7-inch alumi-num alloy wheels now wear 225/45R17 summer performance tires, compared with 205/50R17 all-season tires used on the 2008 WRX. Vehicle D y n a m i c s Control (VDC), a stability and traction con-trol system, is standard on all Impreza models for 2009.

S u b a r u s i g n i f i c a n t l y re-tuned the suspension on the 2009 WRX, resulting in sharper turn-in and more responsive handling overall. Front upper strut mounts are adopted from the STI. The front spring rate is 43-percent stiff-er, and the rear spring rate is 42-percent stiffer. Diameter of the stabilizer bars is

also increased, from 20 mm to 21 mm in front and from 15 mm to 16 mm in the rear. S u s p e n s i o n damping was also re-tuned. Because the wider tires used on the 2009, a new damper valve was also added to the steering gear-box to ensure a smooth and high quality steering feel-ing.

P l a c i n g the engine slightly lower in the chas-sis than in the previous-gen-

eration Impreza models helped lower the center of gravity in the new Impreza platform, enhancing steering response. With the Subaru Dynamic Chassis Control Concept (DC3), Subaru opti-

mized all e l e m e n t s of the I m p r e z a ’s chassis to deliver a better bal-ance of h a n d l i n g r e s p o n s e , ride qual-ity, quiet-ness and overall trac-tion per-

formance than offered by competitive vehicles.

But perhaps the most unique cars at the show weren’t for sale at all, and were so small that chil-dren were heard asking their parents for one of the “toy cars”. The 2009 Atlanta Journal-Constitution International Auto Show featured a unique exhibit of antique European “microcars”. These tiny cars

2009 marked the 100th anniver-sary of the first Auto Show in Atlanta and the Southeast. Appropriately, the 2009 Atlanta Journal-Constitution International Auto Show moved back into its accustomed space in Hall B of the Georgia World Congress Center. Held March 14-22, the show was one of the larg-est in the country. While last year’s show was displaced by the tornado which ripped through downtown Atlanta, this year’s show seemed determined to fight off the inclement eco-nomic weather that has struck the automotive industry.

Over 35 manufactur-ers were represented at the show, including Acura, Audi, BMW, Buick, Cadillac, Chevrolet, Chrysler, Dodge, Ford, GMC, Honda, Hummer, Hyundai, Infiniti, Jeep, Kia, Land Rover, Lexus, Lincoln-Mercury, Mazda, Mercedes-Benz, Mini, Nissan, Pontiac, Saab, Saturn, Scion, Smart Car, Subaru, Toyota, Volkswagen and Volvo.

With over 600 new cars, trucks and SUVs, the Atlanta Journal–Constitution International Auto Show featured new models for 2010, such as the Cadillac SRX Crossover & CTS Sport Wagon, Chevrolet Equinox, the highly customizable KIA Soul, Lincoln MKT, Ford Fusion Hybrid, and the redesigned Buick LaCrosse. Other models of note were the Ford Taurus, F-150 Raptor, the revamped Ford Mustang, the Mercury Milan Hybrid and new Mazda 3 models rounded out the selection.

Of particular interest were the 2010 Buick LaCrosse, which received the Greater Atlanta Automotive Media Association’s Best in Show award, and the Cadillac SRX Crossover, which garnered the Best 2010 Model award. Other 2010

models which drew a “Wow” response were the redesigned Ford Taurus, whose sleek new lines and available S.H.O. (Super High Out-put)options may propel it to the top of the “must have” list for Ford aficionados.

One design standout was Nissan’s Cube

Krom model, which fea-tures an asymmetri-

cal rear “fridge” type door, over 40 available accessories, and available 122 h.p. CVT. Aimed at the under 30 group, the Cube also has a 20 color interior illumination system.

Hyundai’s sleek new flagship model, the 2009 Genesis, comes in both a coupe and a sedan. The Genesis, named 2009 North American Car of the Year, has also won awards from Fortune magazine, among others. The coupe, with 306 hp and rear-wheel-drive archi-tecture, is geared to give more expensive cars a run for their money.

As always, trucks and SUVs came in for their fair share of attention, too. Chrysler’s 2010 Dodge Ram Heavy Duty model has upgraded interior materi-als and more options that ever before,

During the seventh International Car Training Institute (CTI) Symposium for Innovative Automotive Transmissions in Berlin, over 40% of participants responding to an on-site survey pre-dicted dual-clutch technology will be the leading transmission by the year 2020. The California Air Resources Board (CARB) hearing to consider the Cool Cars and Test Procedures regulation of Assembly Bill 32 has been rescheduled for June 25-26, 2009. It was originally scheduled for March 26-27, 2009.

Assembly Bill 32 - the California Global Warming Solutions Act - was

The provi-sion of the legislation referred to as the Cool Cars and Test Procedures regula-tion is to be in place by Jan. 1, 2010. air conditioning, thus decreasing carbon dioxide emissions.

The hearing will discuss several different approaches, some of which include reformulation of paint, parked car ventilation and solar reflective win-dow glazing.n

and for 2009 it gains new WRX-exclusive carbon black check-ered upholstery accented by red stitching. The standard tilt and telescoping leather-wrapped steering wheel is accented by red stitching and standard aluminum-alloy pedal covers now include the driver’s footrest.

P e r f o r m a n c e - d e s i g n front seats integrate the back-rest and head restraint into a single structure. The sporty instrument panel features elec-troluminescent gauges with indicator needles that sweep the gauge faces upon engine

startup. The compact layout of the double-wishbone con-

figuration helps to minimize intrusion into the cargo area, providing a wider and deeper luggage compart-ment. On the 5-Door WRX, the wide and flat load floor can accommodate two Tour-size golf bags with the rear seat backs in the upright position. In the WRX sedan, which is 4.5-inches longer than the previous-genera-tion Impreza sedan and 6.5-inches longer than the new 5-Door models, the extra space provides for a larger, deeper trunk that can accommodate three Tour-size golf bags. In all WRX models, a 60/40-split folding rear seat further boosts cargo capacity and convenience.

Standard Symmetrical All-Wheel Drive, which forms the common core technology on all Subaru models, gives the Impreza WRX a significant handling perfor-mance advantage over front-wheel drive competitors. Symmetrical All-Wheel Drive is a complete system com-prised of the Boxer engine and the full-time power distri-bution system (which varies by model and transmission). The aluminum Boxer engine and simple, symmetrical drivetrain layout help to lower the car’s center of gravity, which in turn contributes to its handling characteristics.

The 2009 Impreza WRX employs a viscous coupling locking center differential that distributes torque 50:50 front:rear. Should slippage occur, this system transfers more power to the wheels with the best traction.

The available navigation and information center in Impreza WRX is the focal point of the center console. The navigation screen is located at the top of the dash-board for improved visibility and ease of use. With the navigation system, the center console provides an input for MP3 players as well as RCA-type video jacks that can accommodate portable gaming devices. All 2009 Versas feature a stan-dard 16-valve 1.8-liter DOHC 4-cylinder engine and a choice of three transmis-

sions: an available Nissan Xtronic CVTÔ (Continuously Variable Transmission) (Hatchback SL model), available 4-speed electronically controlled automatic with overdrive (optional on Hatchback and Sedan S models, standard on Sedan SL) or 6-speed manual transmission (Hatchback and Sedan S models).

With 122 horsepower and 127 lb-ft of torque, the 1.8-liter engine is power-ful and responsive, while also delivering excellent fuel economy. EPA fuel econ-omy is rated at 27 mpg City/33 mpg Highway with the CVT transmission; 24 mpg City/32 mpg highway with the 4-speed automatic transmission; and 26 mpg City/31 mpg Highway with the 6-speed manual transmission.

The Xtronic CVT, unlike conven-tional stepped gear automatics, oper-ates as essentially “one gear” through use of a belt and two pulleys. The Cash for Clunkers bill (H.R. 1550), which is touted as having long-term environmental benefits, could actually do much more harm than good to the environment if the bill is passed, according to Aaron Lowe, vice president of government affairs for the Automotive Aftermarket Industry Association (AAIA).

“Proponents of the Cash for Clunkers bill say that it will benefit the environment because it will take older cars off the road, replacing them with new, more fuel efficient vehicles,” said Lowe. “However, there is an inherent problem associated with this theory. What will become of all these old cars? The answer you don’t hear from the backers of Cash for Clunkers is that these scrapped vehicles will more than likely be sent to landfills, creating more pollution, not less.”

Congress and states have con-sidered Cash for Clunkers proposals in the past and in many cases have decided against them. Many legisla-tors have come to realize the unin-tended consequences of this program and that they are not a cost effective use of government money. In fact, the Cash for Clunkers amendment to the United States Senate stimulus pack-age was withdrawn from the bill prior to its passage.

“Providing incentives for motor-ists to have their current vehicles maintained for fuel efficiency would be a better use of federal money that would also benefit the environment,” continued Lowe. “Cash for Clunkers might look good on paper, but in reality it has many unintended, irre-versible consequences and should be rejected by Congress.”

passed since Sons Honda moved into its all-new store situated on 12 acres along Highway 81 in McDonough, Georgia in late November of last year, but in that time Kevin Kraus and his dedicated parts-department team have been breaking sales record after sales record. The current economic conditions notwithstanding, the wider variety of parts and the greater depth of inventory are trans-lating into big sales gains for his tight-knit crew. Where the parts department of the previ-ous location was maxed out at $150,000 of inventory, the new, larger warehouse of 10,000 square feet created an oppor-tunity for expanding inventory and wholesale service area.

A 10-year veteran of the automotive industry, Kraus rose through dealership ranks learn-ing the business from the bot-tom up. All but the first year of his experience has been with Honda where he began as a parts delivery driver and steadi-ly climbed the ladder. “In six months I made counterman,” he explained, “then assistant parts manager and finally parts manager.” His promotion from counterman to assistant man-ager required just 90 days – a meteoric rise by any measure.

Having trained and worked with Kraus at Sons Honda’s previous Griffin loca-tion, assistant manager Bryan Moody and seasoned counter-man John Freeman were well prepared for the additional workload and responsibility the larger facility entails. Kraus’s praise for this energetic duo reflects the pride he takes in the

team spirit he has developed. Both Moody and Freeman have completed all the off-site and in-store classes and instruction, as well as passed the battery of exams necessary to place them among the elite of Honda associates as Honda Platinum Certified. Of Moody Kraus said, “Bryan is a hard worker and has evolved into an excellent parts per-son who could easily work his way into managing his own parts department.”

Freedman, who had logged counter time at another Honda store before join-ing Sons Honda, has a grasp of the Honda wholesale parts business that only comes with years of experience. “John possesses an abundance of Honda knowledge and does whatever is needed to get the job done,” Kraus said.

Rising to the challenge the larger parts department presents – its 10,000 square feet of space is four times that of the previous location’s parts department – Kraus’s team has taken full advantage of some new tools to grow the busi-ness. A new bar coding system allow-ing the scanning of parts has signifi-cantly streamlined inventory oversight and ordering. “Scanning parts provides improved accuracy,” Kraus said. “We’ve got a better handle on what we have and what we need.”

A second delivery driver has also joined the team. Because Sons Honda co-ops its drivers with Sons Acura and Sons BMW, its delivery fleet is, in essence, three trucks rather than two. Early each morn-ing Kraus’s two delivery drivers meet with the driver from Sons BMW at Sons Acura where they rearrange their cargo based on delivery areas. Each truck delivers wholesale parts for all three dealerships into a pre-assigned area. “That means we don’t have two trucks delivering to the same shop,” Kraus explained. “It’s more efficient and we cover more ground that

way.”One of the advantages of the deal-

ership’s relocation, in Kraus’s estimation, is that it is now much closer to metro Atlanta. This not only makes it more con-venient for customers to visit, but serves to expand the parts department’s prima-ry service area. It is a region that includes metro Atlanta, Macon, Madison and as far north as Kennesaw. Kraus is determined to leverage his larger inventory and more centralized location to expand his market and ultimately sales.

“Since we’ve been in our new loca-tion,” he said, “We’ve doubled our sales. I am convinced there is unlimited poten-tial for growth. The current economy is making things a little tougher, but we are overcoming that. We have been increas-ing the wholesale business; that’s been the key. Here’s a good example of what’s been going on: In March 2009 we did nearly eight times the wholesale busi-ness that we did in April 2008. The sky is the limit.”

The expanded inventory has posi-tively affected the fill rate. When we last visited with Sons Honda the fill rate was around 92 percent. “We have better than a 96 percent next-day fill rate for any part that is ordered from us as late as 4:00 PM,” Kraus stated.

Of course, success is based on much

more than square footage and shelves of inventory; it requires solid customer ser-vice. To this end Kraus has ensured that each team member can fill in at any posi-tion in the department. Everyone pulls parts, everyone delivers parts, and every-one is able to service customers.

With the relocation the entire ser-vice department has grown. Where there were only 10 service bays at the old store, there are 24 at the new location. There is also a two-lane quick-lube center that can accommodate up to four vehicles at a time. “This means the service department can handle a lot more vehicles per day. Not only is that good news for our service customers, it’s good for the parts depart-ment,” Kraus added.

Kraus believes he has been given an unsurpassed opportunity to succeed. For him and his well-trained team, the more centralized location, new store, larger parts department and expanded inven-tory combine to provide unlimited poten-tial. “All of the elements are in place,” he said. “The Sons Automotive Group gives us all the tools we need to succeed.” This includes the new 678-572-1011 dedicated parts line that simplifies the customer’s efforts to get his questions answered and his parts needs fulfilled.n

House Bill 1880, the National Insurance Consumer Protection Act, has been introduced in the U.S. House of Representatives. Reps. Melissa Bean, D-Ill., and Ed Royce, R-Calif., co-wrote the bill to create a uniform, modernized fed-eral insurance system.

The purposes of this Act are:• to ensure the financial stability

and integrity of national insurers, nation-al insurance agencies and national insur-ance producers through a comprehen-sive system of national supervision and

• to ensure the fair and equitable treatment of policyholders, claimants and other consumers served by national insurers, national insurance agencies and national insurance producers.

Fundamentally, H.B. 1880 would establish a national system of regulation and supervision for insurers, insurance agencies, and agents and brokers. Insurers, agencies, agents and brokers would be able to elect national or state regulation, charters and licenses. An independent

Office of National Insurance would be created within the Department of the Treasury, and a commissioner would be appointed by the president.

The national insurance commis-sioner would issue charters for national insurers for life insurance, property and casualty and reinsurance. The underwrit-ing of life insurance and property and casualty would become separate, though holding companies would be allowed to own both types of insurers.

All state and national insur-ance commissioners would be required to share information with a systemic risk regulator. The sys-temic risk regulator would make corrective action recommenda-tions to the commissioner or state commissioner to take action to mitigate or avoid actions taken by an insurer or affiliate that would have adverse effects on economic conditions and financial stability. The national insurance commis-sioner would be able to require that an insurer is nationally char-tered.

“This is one of the more aggressive insurance reform bills introduced in the Congress,” said Bob Redding, the Automotive Service Association’s (ASA’s) Washington, D.C., representative. “This bill continues to push insur-ers to be regulated at the fed-eral level. The Automotive Service Association supports the federal regulation of the insurance indus-try. ASA will continue to work with the House Financial Services Committee toward a federal insurance regulatory system that includes property and casualty insurance.”

Bean said, “The complex-ity of the modern financial sys-tem of insurance conglomerates and holding companies cannot be adequately overseen by the state-based system, as shown by recent events. Insurance regula-tion reform that protects consum-ers and investors must be included as Congress moves ahead on com-prehensive regulation reform of the financial services sector.”n

The American Recovery and Reinvestment Act of 2009 provides a number of provisions intended to jump-start lending to small businesses. However, as Rep. Nydia M. Velázquez, D-N.Y., chairwoman of the House Committee on Small Business, pointed out in her letter to Karen Gordon Mills, the new head of the Small Business Administration (SBA), "It has now been 51 days since the president signed these measures into law. Given the current economic climate, it is critical that these programs get under way."

Congress estimated that cer-tain programs would be up and run-ning between 15 and 30 days after President Barack Obama signed the Stimulus Plan of 2009. In response to Velázquez's letter, an SBA spokesman said that the SBA is moving as quick-ly as possible to get these programs moving.

The American Recovery and Reinvestment Act of 2009 provides several different options for small busi-nesses to benefit from the stimulus package. It specifically includes:

• Fee Reductions.• Economic Stimulus Lending

Program: For a period of 12 months from the date of enactment of the leg-islation, the amount of a loan that the SBA may guarantee is increased up to 90 percent of a qualifying loan made to an eligible small business.

• Secondary Market Guaranty Authority: For a period of two years from the date of enactment of the legislation, the SBA may guarantee pools of first mortgage loans made in conjunction with SBA-guaranteed Community Development Lending Program financing if the pools are to be sold to third-party investors.

• Community Development Lending: This section authorizes the SBA to refinance a limited amount of existing debt with SBA-subsidized community development loans if the project being financed involves expan-sion of a small business.

• Small Business Investment Company Program Amendments: This

section provides that effective on its enactment, an individual small busi-ness investment company may have an outstanding amount of SBA leverage equal to the lesser of $150 million or 300 percent of its private capital, which is an increase from the current limit.

• Small Business Stabilization Loan Program: Small businesses experienc-ing immediate financial hardship and experiencing difficulty repaying an exis-tent SBA-guaranteed loan. These loans would have 100 percent SBA guarantee, have interest fully subsidized and be amortized over five years with the first

payment not due until one year after the loan is disbursed.

• Secondary Market Loans.Although all of these measures

are aimed at jump-starting lending to small businesses, they have not been issued yet. Velázquez empha-sized urgency in her letter: "Given the unprecedented size and scope of the problems in our credit markets, it is doubtful that these steps alone will be sufficient. For that reason, the SBA must expeditiously implement these provisions as Congress intended and instructed in the Stimulus Act."n
