AsChairmanofRBCCIwasfortunatetobeoneof20Businessmen andWomen to accompany the BritishPrimeMinister,DavidCameron,onhisrecentvisittoMoscow. Led By the Trade Minister, Lord Green, we
wereadiversegroupfromgiantsofBritishindustrysuchasShellandBPtosmallturnovercompaniesjuststartingtheirRussianenterprise.
ThemediaheadlinesmayhavebeenaroundtheLitvinenkoaffairortheallegedattemptbytheKGBtorecruitDavidCameroninthe1980’s;buttherewas, infact,realsubstancebehindthephotoopportunities.ThePrimeMinisterandtheRussianPresident, DmitryMedvedev, obviouslygot on wellonapersonalbasis.Differenceswereexplicitlyrecognisedandnotglossedover,butbothsideswereexplicitintheirdesiretomoveonfromtheoldagenda.Thosepresentatthemeetingwith the Russian Prime Minister,Vladimir Putin, said thatthosethemeswerereemphasised.Thevisitdidundoubtedlyimprovethepoliticalclimate.
Important Business agreements were signed – a positivesignal forall commentators.YetRBCCmembersknowthat,inanycase,therehasbeenverylittleevidencethatthechillypolitical climateof recentyearshasworkedagainstbilateralbusiness.RecentincreasesinexportsfromtheUKandregularinvestmentdecisionsbearwitness to that.Thechallenge formostUKbusinesseshaverevolvedaroundconvincingboardsof directors and senior management to ignore the often

adverseheadlinesand lookmorecloselyat therealbusinessopportunitiesinRussia,andthevisitwillhavehelpedagreatdealinthatregard.
Twoissues thatcameupfrequentlyandopenlywere theUKvisaregimeandthechallengesposedbyRussianbureaucracy. Mr Cameron clearly received the message from bothRussians and the UK business teamon visas. Let'shope wegetsomepracticalimprovementsasaresult.EquallytheUKdelegationwasforthrightwiththeRussiansideonthebureaucracy and administrative burdens that the state imposes onallcompanies,Russianandforeign.TheRussiansrecognisedexplicitlytheopportunitythatthoseregulationsgiveforcorruption.
Mr Cameron could easily have avoided this visit. It carriedpoliticalrisksathome;hecouldhavetravelledwithoutabusinessdelegation;hecouldhaveavoidedtherealissues.Allmembersof theChambershouldbegrateful that thePrimeMinister committed to the trip with such enthusiasm andwithsuchsuccess.

рона в его недавнем официальном визите в Москву.Делегацию,вкоторуювошлисамыеразныекомпанииоттакихгигантов,какShellиBP,донебольшихкомпаний,только начинающих свой бизнес в России, возглавилЛордГрин, государственныйминистрторговли и инвестиций.
Хотя прессу больше интересовало дело Литвиненко,а также возможная попытка КГБ завербовать ДэвидаКэмерона в 1980х, на самом деле за кулисами официальнойпрограммывизитастоялонечтобольшее.МеждуПремьерминистроми российскимпрезидентомДмитрием Медведевым явно установился хороший личный
контакт. Они прямо признали разногласия, не пытаясьих умолчать, но обе стороны также выразили желаниедвигатьсядальше,несмотрянастарыепроблемы.Те,ктоприсутствовалинавстречесроссийскимпремьерминистромВладимиромПутиным,сказали,тоэтитемыбыливновь подняты, но, тем не менее, визит, несомненно,улучшилполитическийклиматмеждудвумястранами.

Двамоментаупоминалисьособенночастоиоткрыто – это британский визовый режим и проблемы, возникающиевсвязисроссийскойбюрократией.ГосподинКэмерон услышал мнение российских и британскихкомпанийпоповодувиз,такчтобудемнадеяться,чтовэтойобластибудетощутимоеулучшениеситуации.Какбританская,такироссийскаястороныбылисолидарнывотношениибюрократическогоиадминистративногобремени,котороеиспытываютвсекомпании,ироссийскиеииностранные.Российскаясторонаоткрытопризнала,чтоэтапроблемадаетвозможностьпроцветатькоррупции.

koinLondoninNovember2006putpoliticalrelationsbetweenourtwocountries intodeepfreeze, inreality therelationshiphadbeengettingdecidedlycoolersincetheheadydaysof2003whenthethenRussianPresident,VladimirPutin,wasaccordedastatevisittotheUK.Shortlyafterthis,theBritishPrimeMinisterat the time,TonyBlair, seemed todecide thatMrPutinwasn’t the friend that he had imagined him to be, and theLitvinenkoaffairservedtomakemattersevenworse.
ButhorrificthoughthemurderofLitvinenkowas–theideathatrelationswithRussiashouldbeheldtoransombecauseofitdoesnotmake sense.RelationswithLibyawere frozen formanyyearsbecauseoftheLockerbietragedy(theblowingupofanairlinerovertheScottishtownofLockerbiein1988)andyetwenowlearnthatMrBlairandhisgovernmentwereinsecretnegotiationswithMuammarGaddafilongbeforeofficialrelationswerereestablished.

Whilstitisencouragingtothinkthatevenindifficulttimesgovernmentscontinuetospeaktoeachother?CertainlyinthecaseofRussiaithascertainlybeeneasiertodobusinessknowingwhere thingshavebeenpolitically, even thoughrelationshavebeenstrained.
WhattheperiodofpoorpoliticalrelationsbetweenLondonandMoscowhasshownisthatthemaxim,“businessisbusiness”hasneverbeenmoretrue.TheLitvinenkoaffairbarelyruffledthefeathersofthebusinessrelationshipbetweentheUKandRussia.Some–forexample,journalistswhoarenotinvolvedwithbusiness–regardedthisasshocking,sayingthatBritainshouldtakeamoralstanceoversuchissues.Thisisnaiveintheextreme.
Firstly,it isstillnotknownwhowasbehindthemurderofLitvinenko.Secondly,ifBritishcompanieshadpulledoutofRussiaasaresult,competitors fromothercountrieswouldsimplyhavesteppedintothegap.Businessisbusiness.Insomecasesitmaybenobletotakeamoralstanceovercertainissues.Butif,asaresult,youmakeyourfellowcountrymenunemployedbecauseyoulosethemarketforyourgoods,howmoralisthatstance?
Nevertheless,businessiscertainlybetterwhenpoliticalrelationsbetweencountriesarehealthy.AndsothebusinesscommunitiesinbothBritainandRussiashouldbeencouragedbyMrCameron’svisittoMoscow.Hedidn’tavoidtheLitvinenkoaffair;buthewentwithastrongbusinessdelegation,signallingthat theRussoBritishbusiness relationship is aliveandwell.Andforthosewhothinkthatthatmeansjustbigbusiness,thepresenceof theRBCCChairman, theRtHonTimEggar, inthedelegationwasaverypositivesignthatsmallandmediumbusinesseshaveanessential role toplay in relationsbetweenourtwocountries.

Конечно,несколькоуспокаивает,чтодажевсложныевременаправительствапродолжаютобщаться.ЧтокасаетсяРоссии,конечно,прощебыловестибизнес,учитываявсеполитическиеперипетии,дажехотяотношениябылиоченьнатянуты.
ЭтотсложныйпериодмеждуЛондономиМосквойпоказал,чтоориентир«бизнесестьбизнес»болеечемоправдан.ДелоЛитвиненкоедвалиповлиялонаделовыеотношениядвухстран.Некоторые,например,журналисты,незанимающиесяделовойтематикой,былишокированытакимподходом,заявляя,чтоВеликобританиядолжназанятьболеепринципиальнуюпозицию.Этоввысшейстепенинаивно.

Темнеменее,здоровыеполитическиеотношенияопределенноспособствуютделовымконтактам,ивизитКэмеронадолженбылвоодушевитьбританскоеироссийскоебизнессообщества.ОннеушелотвопросовподелуЛитвиненко,затопривезссобойпредставительнуюбизнесделегацию,темсамымподтвердив,чтороссийскобританскиеделовыеотношениявпрекраснойформе.Идлятех,ктосчитаетэтоделомлишьбольшогобизнеса,участиевделегацииТимаЭггара,председателясоветадиректоровРБТП,даловажныйсигнал,чтоинтересымалогоисреднегобизнесатакжебудутигратьзаметнуюрольвотношенияхдвухстран.

ThosewhofollowedtheBritishPrimeMinister’sofficialvisittoRussiaonTVwillhaveseenonlythetipoftheiceberg. Traditionally, the country’s major newsprovidersfocusonthepoliticalanddiplomaticagenda,
andalmostthemainintrigueofthevisitwasspeculationastowhether the senior officials of the two states would discusshighprofile political issues and, if so, whether they wouldcometoanyformofagreement.
Infact,effortsto"warmup"theextremelycooledofficialrelationshipbetweenthetwocountriesarelongoverdueand,ashasmore thanoncebeenstressedbybothsides, there isamutualwilltodevelopthisrelationshipinapositivedirection.Perhapsthemostpositiveareasofdevelopment–throughoutthehistoryofrelationsbetweenthetwocountries–havebeencultureandbusiness/trade.WhileTVscreensweretakenupwithshotsoftheKremlinandtheMoscowStateUniversity,handshakes,memoranda signingsandannouncementson the tradebalance, themembersofthetradedelegationwhichaccompaniedthePrimeMinisteronhisvisitwerebusymakingdealswithlocalpartners.

Thetotalvalueoftheresultingcontractscomesto£250million,andtimewilltellastotheirusefulnesstobotheconomies.WhiletheRussianmediatypicallymadeabigdealofBPCEOBobDudley’spresenceinthedelegation,thecontractssignedinfactrelatetocompletelydifferenteconomicsectors.Overall,onlythreecompaniesworkingwiththeextractionandprocessingofrawmaterialswererepresentedinthedelegation.
Ontheonehand, it isencouragingthathightechbusinessopportunitieswithRussianpartnersfindapositiveresponsewithintheBritishbusinesscommunity;thatBritishcompaniesarewillingtoshareknowhowinthefieldsofconstruction,environmentalprotection,energyefficiency,pharmacology,andsoon.TheirenthusiasmcoincideswithRussia’sdesiretodiversifyandmoderniseitseconomy.Ontheotherhand,itisclearthattheoilandgasbusinessinRussia–aparticularandcomplexart–isnotcedinganyground.TheannulledRosneftBPdealwasanunpleasantepisodeforbothparties.However,theRussiansidehasnotabandoneditsambitionstodeveloparcticoilfields,andRosneft’spartnerinthis,asweknow,willbeExxonMobile.Overall,theenergysectorhasbecomenolessimportanttotheeconomy,andwithrespecttothelatestincreaseincrisisexpectations,itsroleisevengrowing.Paralleltothemodernisationofothersectorsandintroductionofinnovativetechnologiesinvariousfieldsofeconomicdevelopment,theenergysectorshouldalsobedevelopedincompliancewithcurrentenvironmentalrequirementsandthelatesttechnology.
RussianeedscuttingedgetechnologiestodeveloptheArcticresources.So,mostcertainly the futurewill seemore internationalcooperationagreementsinsimilarprojects.AndasitcanbeseenattheNordStreamexample,alldisputesandlegalissuescanbesettleddownifthereisgoodwilltodoso.
С одной стороны, отрадно, что возможности высокотехнологического бизнеса сроссийскими партнераминаходят отклик в британском деловом сообществе, чтобританскиекомпанииготовыподелитьсяноухаувобласти строительства, охраны окружающей среды и энергоэффективности, фармакологии и т.п. Это полностьюотвечаетвзятомукурсунадиверсификациюитехнологизациюроссийскойэкономики.Сдругойстороны,очевидно,чтонефтегазовыйбизнесвРоссии–особоеисложноеискусство – не теряет своих позиций. Несостоявшаясясделка«Роснефти»иВРбыланеприятнымэпизодомдляобеихсторон.Однакороссийскаясторонанеотказаласьотсвоихамбицийвобластиразработкиарктических углеводородныхместорождений,ипартнером«Роснефти»вэтом,какизвестно,станетExxonMobile.Ивцелом,секторТЭКнепотерялсвоегозначениядляэкономикистраны,асучетомновогоростакризисныхожиданий,егорольлишькрепнет.Параллельносмодернизациейпрочихотраслейивнедрением инновационных технологий в самых разныхобластяхэкономики,должнопроисходитьиразвитиеТЭК,причемссоблюдениемсовременныхэкологическихтребованийиприменениемновейшихтехнологий.

"AworkinggroupofRosneft andExxonMobil isdrawingupadetailedplanofjointprojectsandwillcompletethespecificsby the end of the year," Khudainatov told journalists. Russia’sNaturalResourcesMinistryhasproposedamendingthelawonmineralresourcestointroducenormsthatwouldstimulate the processingof mineral resources in Russia, theministry’sdraftpublishedonitswebsitesays.Ithasalsoproposed reviewing the licensing conditions, the procedure foramending mineral production licences and the reasons forterminating them. Sberbank intends to spend €585 million to secure a 100%stake in the Eastern European division ofAustrian bankinggroupOesterreichischeVolksbankenAG(OVAG)VolksbankInternational(VBI),accordingtoSergeiGorkov,theDeputyPresidentoftheRussiancreditorganisation.Itwasreportedearlierthatthedeal–dependingontheoutcomeoftheVBI–will be between €585 and €645 million. What has changed in the RFCCI since you were elected President in March 2011? Some big changes have taken placebecauseweareintheprocessofmakinga thorough overhaul of the chamber’sorganisation. We have established newdivisions, in particular a departmentfor investment support, and an expertand analysis centre.We are optimisingthe staff numbers and have registereda new draft of the chamber’s charter.The RFCCI has decided to establish anoncommercial partnership with theNationalMediators’Organisation,andanew listof arbitrationcourt judgeshasalsobeendrawnup.ProposalshavebeendraftedforestablishinganexpertcouncilattachedtotheRFCCItocarryoutfeasibilitystudiesofinvestmentprojects,anda consultative council attached to thechamber’s investmentpolicycommitteeto evaluate projects’ commercial effectivenessandcreateadatabaseofpriorityregionalprojectssentinfromthechamber’s regional branches and so on. TheRFCCI is a living organism and it willcontinuetoimproveanddevelopsoastokeepupwiththedemandsofthetimes.
What do you see as the RFCCI’s main goal in Russia at its current develop-ment stage? Our job is to representandprotect theinterestsofsmall,medium,andbigbusinessbeforetheauthorities,butonconditionthattheseinterestsdonotconflictwith the interests of society in general.Our area of responsibility extends toall fields of business and industry, foreign and domestic trade, agriculture,the financial system, services etc. Russia is still in the process of building afullyfledged market economy. Russia’s
laws,therelationsbetweenbusinessandgovernment,ourtraditionsandspecificnational characteristics and business’socialresponsibilityareallpartofaliving fabric that isgrowinganddeveloping.Thus,wehavealotofworkbeforeustoday,butitisaveryinterestingprocesstoseehowthecountryischangingandtakepartinthesetransformations.
Timedictates itspriorities.Thepriority now is to modernise the countryandsetitonaninnovativedevelopmenttrack. The chamber’s strategic prioritynowistohelpattracttheinvestmentthatisessentialforresolvingalloftheothertasks.Competitionforinvestment,technology and information are the basisof the economic struggle in the worldtoday.Ourcountryisnotyetinthebestpositioninthisrespect.Ithinkthatifwewanttochangethissituation,wefirstofall need to put the right legal environment inplaceandensurethatour lawsare properly enforced. Investors needtoseethatworkinginRussiaissafeandprofitable.
We have drawn up a project forinvestment support infrastructure thatwillgivethebestprojectsthebackingtheyneed,findinvestorsforthem,andensurethe best possible conditions, removingthevariousobstaclesintheway.Wehavechosen 15 pilot regions and hope thatthisprojectwillbeasuccessandsetanexampleofhowwecangoaboutthings.This isnotan impossible task, afterall.Look at Kaluga Region, for example. Itwasavery‘average’ region thatdidnothave a strong industrial base, but nowit hasbecome a fastgrowing industrialcluster. One of the conditions for the successful social and economic development of Russian society is often said to be the support given to independent institutions and their work in various aspects of life in the country. In Russia, these institutions are traditionally weak, and their role is generally taken on by organisations promoting business activity – such as the Chamber of Commerce and Industry of the Russian Federation. The RFCCI works actively with partners in Britain, as far as we know. Yes, this is indeed the case. We workactively with the RussoBritish ChamberofCommerce,whichthisyeariscelebrating its 95th anniversary. I want tostressthatdirecttradetiesbetweenRussiaandBritainhavea longhistoryandrichtraditions.BritainisoneofRussia’sbiggest trade and investment partners.In 2010, according to Russian customsstatistics,ourbilateraltradecameto$16billion, which was an increase of 26%compared to2009.Britainwas thebiggest investor in the Russian economylastyear.RussianandBritishcompanies,including SMEs, are realising the needto diversify cooperation, includingin the hightechnology sectors of oureconomies,especiallynow,whenRussiaisopeninguptheopportunitiesforcooperation in innovative development. Isee big opportunities for cooperationat regional level, too, in comprehensiveregional development efforts, implementingSMEsupportprogrammes,andcarryingouttransportandsocialinfrastructureprojects.
What particular role can the RFCCI play in achieving Russia’s economic modern-isation and innovative development goals? Russiareallyhasabsolutelynochoicebutto develop the kind of advanced technology needed to ensure the country’seconomic competitiveness and defencecapability. In the1990s, themarketwasachaoticfreeforallandnoonethoughtabout these things then. Russia lostgroundasaresult.Now,theglobalmarketforscienceintensivegoodscomestoaround$3trillion,ofwhich39%isproducedintheUSA,30%inJapan,and16%inGermany.AsforRussia’sshareinthisproduction–itcomestoamere0.3%.
We take the view that Russia stillhas tremendous scientific and indus
trialtechnological potential in manyfields.But thecurrent legalandregulatoryenvironmentdoesnotyetmeetthedemandsofinnovativedevelopment.Weneedtobuildanationalinnovationsystemthatencompassesthelegal,administrative and organisational, financial,infrastructure, and information andmediacomponents.TherearenumeroushighlyinterestingdevelopmentsinRussiatoday,butmanyofthemarestillonlyintheideastageandfarfromreadyforpractical implementation.We thereforeneed effective instruments to supportandpromotetheseinnovationprojects.
DemandforinnovationisstilllowinRussia.Only10%ofcompanieshereareintroducing innovative technology. Bycomparison,5070%ofbusinessprojectsinGermanyandBelgiumareinnovativeinnature.Oursmallandmediumsizedenterprises simply do not have a bigenoughturnoverandborrowingmoneyisstilltooexpensiveanoptionforthem.Big businesses do not see the point ofspendingoninnovationatthemoment,as there is little competition compelling them to do so. State mechanismsto encourage innovative developmentthroughtaxincentives,customsandtariffs regulation, and technical standardsare stillonly in theprocessof creation.Of course, the business community’sviews,asrepresentedbytheRFCCI,aretakenintoaccountinthisprocess.
It is important to adopt, as soon aspossible, the federal law on state support for innovativeactivity in the RussianFederation,whichwill laythelegalfoundation for the Russian economy’smodernisationandtechnologicaldevelopment.This lawneeds tobebolsteredby a fundamental law on industrialpolicy, and we have already made a lotof progress in outlining a policy concept in this area. The legislative frameworkisstillweakwhenitcomestolawsregulatingcivilised trade of intellectualpropertyand,asa result,Russian intellectual achievements and Russian ideasoftenendupbeingturnedintoproductsin other countries, which then presentthemastheirownknowhow.
Ourpriority is therefore to create amodern legalenvironment(rulesof thegame)thatwillencourageinvestmentininnovation (raisedemand)anddevelopthe mechanisms for commercialisinginnovativedevelopments(marketoffer).
We think that the RFCCI does indeedhaveauniqueparttoplayinthisrespect.No other nonstate organisation hassuchanextensivenetworktaking intheentirecountryasthesystemofchambersof commerceand industry.TheRFCCIunites 174 chambers representing 81regionsand93municipalities,themembersofwhicharemorethan47,000companiesandindividualentrepreneurs.Ourmembersalsoinclude207businessassociations, unions and other groups. Wehave16offices abroad, and66councilsfor business cooperation with foreigncountries.We have 34 RFCCI committeesandmorethan1,000expertgroups,setupbytheregionalchambers,dealingwith the most important areas of production and business. The members ofthesecommitteesincludebusinessrepresentatives, representativesof the scienceandexpertcommunities,andstateagency representatives.TheRFCCI’sunifiedsystemandwellorganisedinfrastructureinRussiaandabroad,itsabilitytocarryout quality selection and expert evaluationofprojects, its lobbyingandpartnership possibilities, and its recognisedbrandall combine to create apowerfulresourcethatmakesanidealsupportbasefor helping to implement the nationalinnovativedevelopmentstrategy.
How do you use this resource and what results do you want to achieve? We sign tripartite agreements with theregions (the regional authorities andthe regional and municipal chambersof commerceand industry)on facilitationinvestmentandinnovationactivity.TheRFCCItakesonthecommitmentoforganising the necessary database andhelping to attract Russian and foreigninvestors to the region, helps to draftand implement business plans, makenew business contacts, organise jointexhibitionsandfairs,andholdbusinessdevelopment seminars in the region. Italsohelpstoestablishamodernproduction, financial and trade infrastructureintheregion,helpingtoestablishdirectties between businesses and facilitatingactivation of foreign and interregionaleconomictiesandexportdevelopment.We have already signed such agreements with the Republic of Chuvashia,StavropolTerritory,andIvanovo,Kursk,Nizhny Novgorod and NovosibirskRegions.

For example, we havesigned an agreement with the FoundationforDevelopingtheNewTechnologies Development and CommercialisationCentre(SkolkovoFoundation).Thereal difficulties that small innovativebusinessesfaceincommercialisingtheirintellectualpropertyproductsincitedustosetupanetworkofregionaltechnology commercialisation centres (TCCs).The main goal of the Skolkovo andRFCCI networks is to create a regionalinnovation infrastructure to search for,analyse, select and develop innovativeprojects, study the sales markets, andprovide various consulting and engineering services to help commercialisethe fruits of intellectual activity andensurethatventurepartnersprovidetheongoingsupporttheseinnovativeprojectsneed.
It isourgoal tohelpestablishbusiness incubators and technology parksin the regions, and we encourage theregional authorities to get the regionalchambers of commerce and industryinvolvedasacoexecutoroftheseprojects. The regional chambers, backed bythe RFCCI’s methodological, information and organisational support, canofferawiderangeofservicesinthisarea,from helping to select resident companies according to business incubators’andtechnologyparks’profile,toprovidingmarketing support forprojectsandhelpingtocommercialisethefinalproducts,helpingtoraiseinvestmentthroughexisting development institutions, andtaking part in training and retrainingprogrammes. This kind of support canboost the reputation of business incubators and technologyparks, as well astheirresidents,withinthebusinesscommunity.Thisisespeciallyimportantforsupportingsmallinnovationbusinesses:asweknow,85%ofinnovativegoodsinthe world are produced by small businesses.
The regional chambers’ importance is set to increase then? Absolutely.WethinkthetimehascomefortheRFCCItogetbroaderpowerstocarryoutthebusinesssupportmeasuresthat the regional executive authoritiesare implementing today. These powers
could extend to developing innovativebusiness, industrial production, artisanal production, training personnel,above all in SMEs, providing supporttoSMEs,carryingoutforeigneconomicactivity, offering information and consulting support for businesspeople andsoon.Ofcourse,notalloftheregionalauthorities – and indeed, not all of theregional chambers of commerce andindustry–arereadytotakethisstepyet,because by getting broader powers, thechambers take on new responsibilities,and will also need to receive the corresponding funding from the regionalbudgets. But we are working togetherwith the regional authorities and reorganisingtheCCIsystem,andwebelieveinoursuccess.
What kinds of problems do people from big and small businesses come to you with? Is there any change in the nature of the problems they encounter? Businesses come to us for services, insearchofpartners,andwithcomplaints.Wehaveseenanoticeableincreaseinthenumber of people coming to us aboutthe way laws are being enforced. Forexample,thelawonpublicprocurementstates that not less than 10% of publicprocurementordersmustbeplacedwithsmall businesses, but in reality, smallcompaniesoftenhavenoaccesstopublic procurement tenders.We get informationaboutproblemswithparticularlaws, and about which legal provisionsareactuallyusefultobusinessandwhicharenot.Manylawshavebeenamendedor are in the process of amendment asaresultofentrepreneurs’appealstothechamber.
Thekind of problems that businessfaces is slowly changing. At one time,smallbusinesshadhardlyanystatesupportatall,butnowtherearequiteafewdifferentkindsofstatesupportandsmallbusinessescometoustohelpthemstudythedifferentoptionsandworkoutwhatwouldbethebestprogrammesfortheirparticularcase.Oneofthebiggestproblemsinthepastwasconstantinspectionsofbusinesses,withtheinspectorsusuallywantingmoneyinordertoissueapositive report. Now, the law sets limits onthenumberofinspections,andalthoughthere are still plenty of infringementsin practice, business can nonethelessbreatheabitmorefreelytoday.
Therearealsothe‘eternalproblems’such as corruption.At the RFCCI’sVICongressinMarchthisyear,82%ofdelegatessurveyednamedcorruptionasthebiggest problem obstructing business.SMEsalso suffergreatly fromadministrative barriers, corporate raiders, andcomplaints about counterfeit goods.There are a lot of complaints aboutunlawfulactiontakenbythelawenforcement agencies. Overall, the number ofappeals from businesspeople and theheadsoftheregionalchambersonvarious economic security issues increasedoverthefirsthalfof2011incomparisontothefirsthalfof2010:from314to368.Businesspeoplestillhaveadifficulttimeworkinginourcountry.
Defending entrepreneurs’ lawfuleconomicinterestsisoneoftheRFCCI’sbiggestareasofwork.TheRFCCIhasabusinesseconomicsecuritydepartment,and more than 100 subdepartmentshave been established by the regionalchambers.Twoyearsago,wesignedacooperation agreement with theProsecutorGeneral’sOffice.Theregionalchambersalsohavethepossibilityofworkingtogether with the prosecutor’s office.Thismakesitpossibletoreactfasterandmore objectively to appeals from businesses and inform business people andsocietyingeneralabouttheseviolations.
These days, when you can find practi-cally any information you need on the Internet, what can organisations such as the RFCCI offer foreign companies? OfcourseyoucanfindeverythingontheInternet these days, but only organisationssuchasours,andnotawebsite,cangettheoriginalsourceinformation,prepare and filter it and guarantee itsauthenticity,assistbusinessesinsettlingbigproblems,representand,whenneeded, defend their interests, offer a broadrange of services and guarantee theirquality,andactasaguideinacomplexand changing market. Что изменилось в структуре и работе ТПП РФ с момента Вашего избрания президентом палаты в марте 2011 года?Изменения существенны, так какмы серьезно совершенствуем структуру палаты. В ней были созданыновые подразделения, в частности,департамент содействия инвестициям, экспертноаналитический центр.Мы оптимизировали численностьаппарата и зарегистрировали новуюредакцию Устава палаты. ТПП РФприняла решение об учреждениинекоммерческогопартнерства«Национальнаяорганизациямедиаторов»,атакжебылсформированновыйсписоксудейТретейскогосуда.Подготовлены предложения по созданию приТППРФЭкспертногосоветапотехнологической оценке инвестиционныхпроектов,атакжеКонсультативногосоветаприКомитетеТППРФпоинвестиционной политике по оценке коммерческой эффективностипроектов, формируется база данныхприоритетных региональных проектов,полученныхоттерриториальныхТПП и т.д. Но палата – это живойорганизм, и ее совершенствованиебудетпродолжаться, чтобыотвечатьтребованиямновоговремени.
Как бы Вы сформулировали основную цель существования такого органа в стране на данном этапе ее развития? Мыкакпалатапредставляемиотстаиваемпередвластьюинтересымалого, среднего и крупного предпринимательства, но при условии, что этиинтересынепротиворечатинтересамобщества. В нашу «зону ответственности» входят все области предпринимательства:промышленность,внутренняя и внешняя торговля, сель
скоехозяйство,финансоваясистема,услуги. Становление полноценнойрыночнойэкономикивРоссииещенезакончено;российскаязаконодательная база, взаимоотношения бизнесаивласти,наконец,традицииинациональнаяспецифика,вопросысоциальнойответственностипредпринимательства–всеэтоживаяткань,онарастетиразвивается.Такчтоработыунас сегодняоченьмного.Ноэтоиинтересно:видеть,какменяетсястранаиучаствоватьвэтом.
Приоритетыженамдиктуетвремя.Сегодня это модернизация страны,переводеенаинновационныерельсы.Важнейшаястратегическаязадачадляпалаты–привлечениеинвестицийкакнеобходимоеусловиерешенияостальныхзадач.Сегоднявмиреконкуренциязаинвестиции,затехнологии,заинформацию стали основой экономическойборьбы.Здесь,ксожалению,унаскакустраныпоканесамыелучшие позиции. На мой взгляд, чтобыизменитьэтуситуацию,надо,преждевсего, сформировать в стране соответствующие законы и добиться ихбезусловногоисполнения.Инвесторудолжно быть выгодно и безопасноработатьвРоссии.
Мыразработалипроекттакназываемой инвестопроводящей инфраструктуры, чтобы поддерживатьлучшие проекты, искать для нихинвесторов и создавать наилучшиеусловия для реализации. Мы выбрали пятнадцать пилотных регионови верим, что все получится и этобудетпримертого,чтоможноделать.Ведь все абсолютнореально: например,Калужскаяобластьбылавесьма«средним» регионом со слабой промышленностью,атеперь–этомощ

В чем Вы видите уникальные возмож-ности ТПП РФ в достижении основных экономических целей России – модер-низации ее экономики и развития инновационных подходов?Альтернативы переходу на технологии шестого технологического уклада,которыемогутобеспечитьэкономическуюиобороннуюсилустраны,у России попросту нет. В 90е годы,когда«дикий»рынокправилбал,обэтом не думали, и передовые позиции были потеряны. В результате,объем мирового рынка наукоемкойпродукциисоставляетсегодняоколо$3триллионов:39%–этопродукцияСША,30%–Японии,16%–Германии.ДоляРоссии–всего0,3%.Мысчитаем, что Россияпопрежнему обладает огромным научным и производственнотехническим потенциаломво многих отраслях. Но существующая нормативноправовая системаеще не соответствует потребностяминновационного развития. Нужновыстроить национальную инновационную систему как совокупностьзаконодательных, административноорганизационных, финансовых,инфраструктурных, информационномедийныхкомпонентов.Встранесегоднямногоинтереснейшихразработок,однакомногиеизнихнаходятсянауровнеидейислабоподготовлены для практического внедрения.Именно поэтому нужны эффективныеинструментыподдержкиипродвиженияинновационныхпроектов.
Спрос на инновации в странесегодняневысок.ВРоссиитолько10%предприятий внедряют инновации.Длясравнения,вГерманиииБельгиина инновационные проекты приходится порядка 5070% проектов. Унашихмалыхисреднихпредприятий,какправило,элементарнонехватаетсобственных оборотных средств, азаемныесредствадлянихпокадоро
ги. Крупные предприятия не видятсегодня в расходах на инновациипрактическогосмыслаиззаслабостиконкуренции.Покатолькосоздаютсягосударственные механизмы экономического стимулирования инновационного развития через налоги,таможеннотарифноерегулирование,технические регламенты.Безусловно,приэтомучитываетсямнениебизнеса,представленноеТППРФ.
Очень важно поскорее принятьфедеральный закон «О государственной поддержке инновационнойдеятельности в Российской Федерации», который стал бы правовойбазой модернизации и технологического развития российской экономики. Он должен быть подкрепленфундаментальнымзаконодательнымактом о промышленной политике,у нас есть серьезные концептуальныенаработкивэтомплане.Слабовзаконодательстве прописаны такженормы,регулирующиецивилизованныйоборотинтеллектуальнойсобственности. В результате, очень частодостижения российского интеллектавоплощаютсявразработкахвдругихстранах и представляются ими ужекаксобственноеноухау.
Итак, наши приоритеты – этоформированиесовременногоинновационногозаконодательства (правилаигры), стимулирующего вложения винновации (обеспечение спроса) инаращиваниемеханизмовкоммерциализацииразработок(рыночноепредложение).Мыубеждены,чтонаэтомнаправлении именно у нас имеютсяуникальныевозможности.Нетвстране другой негосударственной структуры,имеющейтакуюразветвленнуюи охватывающую всю территориюРоссии сеть, как система торговопромышленныхпалат.СегодняТППРФобъединяет174территориальныеторговопромышленныепалаты:81всубъектахРФи93вмуниципальныхобразованиях.Впалатывходятболее47 тысяч компаний и индивидуальных предпринимателей. Члены ТППРФ–207союзов,ассоциацийидругихобъединений предпринимателей. Унас16представительств зарубежом,66деловыхсоветовпосотрудничествусзарубежнымистранами.Интересы важнейших сфер производства ипредпринимательства представляют
34 комитета ТПП РФ и более 1000общественных экспертных формирований, созданных территориальнымипалатами.Всоставекомитетовработают представители предпринимателей, научного и экспертногосообщества,органовгосударственнойвласти. Единая система ТПП, отлаженнаяделоваяинфраструктураТППРФ в России и за рубежом, возможности экспертизы и качественногоотборапроектов,лоббистскиеипартнерскиевозможностиипризнанныйбрендТППРФсоставляютсерьезныйресурс,которыйидеальноподходитвкачестве«опорнойсети»дляреализации национальной инновационнойстратегии.
Как Вы используете этот ресурс и каких результатов удается достичь? Мызаключаемтрехсторонниесоглашения с регионами(администрациясубъекта РФ, ТПП РФ, территориальнаяТПП)осодействииразвитиюинвестиционной и инновационнойдеятельности.ТППРФберетнасебясоздание необходимых информационных баз данных, содействуетпривлечениюроссийскихииностранныхинвестицийврегион,участвуетвподготовкеиреализациибизнеспланов,помогаетустановитьделовыеконтакты,проводитьсовместныевыставкиярмарки,семинарысцельюразвитияпредпринимательстваврегионе.Онатакже содействует формированиюсовременной производственной,финансовойиторговойинфраструктурырегиона,помогаетвустановлениииразвитиипрямыхсвязеймеждупредприятиями, содействует активизации внешнеэкономической имежрегиональнойдеятельности,развитиюэкспортарегиона.Такиесоглашения уже заключены в ЧувашскойРеспублике, Ставропольском крае,Ивановской, Курской, Нижегородской,Новосибирскойобластях.

инновационные предприятия привнедрениирезультатовинтеллектуальнойсобственности,подтолкнулинасксозданиюсетирегиональныхЦентровкоммерциализациитехнологий(ЦКТ).Основная задача сети ЦКТ «Сколково–ТППРФ»–созданиерегиональнойинновационнойинфраструктурыдляпоиска,анализа,отбораидоработкиинновационныхпроектов,исследованиярынковсбыта,предоставленияразличных консалтинговых и инжиниринговыхуслугдлякоммерциализации результатов интеллектуальнойдеятельности и дальнейшей поддержки инновационных проектов венчурнымипартнерами.
ТППРФставитпередсобойзадачуорганизоватьработупосозданиюбизнесинкубаторов и технопарковв регионах России, предлагая региональной администрации привлечьтерриториальную ТПП в качествесоисполнителя проекта. При этомтерриториальная палата, опираясьна методическую, информационнуюиорганизационнуюподдержкуТППРФ, способна предложить широкийспектруслуг–отсодействиявподборе компанийрезидентов по профилю бизнесинкубаторов и технопарков, маркетингового сопровожденияпроектоввплотьдоэтапареализацииконечной продукции, привлеченияфинансирования резидентов существующимиинститутамиразвитияиучастиявподготовкеипереподготовкекадров.Такаяподдержкапозволитполучитьопределенныерепутационныепреимуществасоответствующимбизнесинкубаторам, технопаркам иих резидентам в предпринимательскойсреде.Этонаправлениеособенноважновпланеподдержкималогоинновационного бизнеса: известно,что85%инновационнойпродукциивмирепроизводитсяименнонамалыхинновационныхпредприятиях.
Надо полагать, одновременно растет роль и значение территориальных палат? Безусловно. Мы считаем, пришловремя,чтобыТППполучилидополнительные полномочия по реализациимерподдержкипредпринимательства,осуществляемые сегодня региональнойисполнительнойвластью.Конечно,сегоднядалеконевовсехрегионах
власть,какисамиТПП,готовыктакойпостановке вопроса, ведь передачаполномочийпредполагаетипередачучастисредстврегиональногобюджета и соответствующих обязательстви ответственности. Но мы работаемс администрациями регионов, перестраиваемсоответствующимобразомсистемуТППиверимвуспех.
С какими вопросами обращаются представители крупного и малого биз-неса? Меняется ли характер проблем, с которыми они сталкиваются?Кнамобращаютсязауслугами,впоискахпартнеров,сжалобами.Заметновозросло число обращений по практикеприменениязаконодательства.К примеру, закон о госзакупках гласит,чтонеменее10%госзаказанужноотдавать малому бизнесу, а в реальностинебольшиепредприятиякгосзаказу нередко просто недопускают.Идетинформацияонедостаткахправовыхактов,отом,чтовновыхзаконахполезнобизнесу,ачтоемувредит.Это нормальная «обратная связь».Многие законы были изменены илисейчаснаходятсявпроцессеизмененияименноврезультатеобращенияпредпринимателейвпалату.
Характер проблем, с которыми сталкивается бизнес, понемногуменяется. В свое время, например,малый бизнес практически не имелподдержки от государства; сейчасформподдержкидостаточномного,ималыепредпринимателиобращаютсяспросьбойпомочьразобратьсясвозможностямиивыгодамидлянихтехилииныхпрограмм.Раньшеоднойизострейших проблем были постоянныепроверкибизнеса,причемобычноонибылипродиктованыжеланиемпроверяющихполучитьденьгизаположительное заключение. Сейчасчастота проверок законодательноограничена,ихотянапрактикенарушенийещепредостаточно,всеравнобизнесвздохнулчутьсвободнее.
Есть и «вечные вопросы», как,например, коррупция. НаVI СъездеТППРФвмартеэтогогода82%опрошенных делегатов съезда именно еепоставилинапервоеместовперечнетого, что мешает предпринимательству. Донимают малый и среднийбизнес и административные барьеры, рейдерские захваты и случаи
подделки продукции. Есть немалопретензий к неправомерным действиям правоохранительных органов.В целом число обращений предпринимателей, руководителей территориальных палат по различнымвопросам обеспечения экономическойбезопасности бизнеса впервойполовине нынешнего года вырослопо сравнению с первым полугодием2010года:стало368,абыло314.Бизнесменамвнашейстранепокаработатьбываетвесьманепросто.
Защитазаконныхэкономическихинтересов предпринимателей – этоочень важное направление деятельности системы российских ТПП. ВТППРФестьдепартаментэкономической безопасности предпринимательства.Втерриториальныхпалатахсоздано более сотни соответствующих подразделений. Два года назадмыподписалисоглашениеосотрудничествесГенпрокуратуройРФ.Возможность взаимодействовать с прокуратурой получили и территориальные палаты. Это помогает болееоперативно и объективно реагировать на обращения предпринимателейиинформироватьделовыхлюдейиобществоонарушениях.
В наше время, когда почти всю инте-ресующую информацию можно найти через Интернет, что может предло-жить иностранным компаниям органи-зации типа ТПП РФ?Конечно, обо всем сегодня можноузнатьвИнтернете.Новотполучитьисходнуюинформацию,подготовить,отфильтровать,обеспечитьеедостоверность, содействовать бизнесу врешенииострыхвопросов,представлятьи,еслинадо,защищатьегоинтересы, предложить огромный спектруслугигарантироватькачество,бытьпроводником на сложном меняющемсярынкеможетименнопалата,ане электронная страница. Но электронныйресурсникакнеможетподменитьединуюсистемуторговопромышленных палат, деловую инфраструктуру ТПП РФ в России и зарубежом,гарантироватьэкспертизуикачественный отбор проектов и т.д.Наконец, сам бренд «ТорговопромышленнаяпалатаРоссийскойФедерации» коечто значит – надеюсь, ясумелВасвэтомубедить.

Doubtswerevoicedregardingtheeconomicviabilityoftheproject;itsenvironmentalsustainabilityandsafetyin terms of the environment and ecosystems of theBaltic Sea; the danger of European dependence on
Russian energy sources; the project’s supposed politicalmilitarynature;andevenRussia’ssupposeduseofthepipelineforespionagepurposes.
Whatisthecurrentstatusoftheproject?Constructionofthe firstof the twinpipelines isalready100%completeandwill become operational in November this year; the secondlineisalready65%complete.Whenfullyoperationalin2012,thetwinpipelineswillhavethecapacitytotransportacombinedtotalofabout55bcmofgasayear–thatisasubstantialcontributiontothesecuresupplyofenergyforEurope.
“NordStreamhasbecomeapartofEuropeangas infrastructure,”EuropeanEnergyCommissionerGüntherOettingerisquotedassayingsoonafterRussianPrimeMinisterPutinstartedtheflowoftechnicalgasintotheNordStreampipelineon6September.
Environmentaldamageisoutofquestion.Throughouttheconstruction, Nord Stream has been carrying out extensiveenvironmental monitoring. The company has just releaseda report summarising the environmental monitoring of thepipeline’s construction in2010, the contentsofwhich showthat not only has there been no substantial environmentalimpact, but that the impact has in some aspects been evenlowerthanexpected.
EnergysecuritypolicyMost analysts in the energy industry believe that in thecoming decades the EU will have a substantial shortage ofnaturalgasimports(duetotheincreaseingasconsumptionandthedeclineindomesticproduction),whichwillneedto
becompensatedbycreationofnewinfrastructure.Thistrendisevenmoreimportantinconnectionwiththeforthcomingchanges in the energy sector in a number of EU countriesthat recognized the important role of natural gas as anenvironmentally safe source of energy. (See the report‘TheGoldenAgeofGas’bytheInternationalEnergyAgency,IEA).
The Nord Stream pipeline will provide the most directandefficientroutefordeliveringgastothegrowingEuropeanmarketandtoensurethesafetyandtechnicalflexibilityofgassupplies.
Inconjunctionwiththelongtermdevelopmentofthegasmarket,RussiaisdevelopingnewgasfieldsintheNorth–ontheYamalPeninsulaandtheShtokmanfield.SuppliesfromtheYuzhnoRusskoefieldhavebeenalreadystarted.ThepurposeofNordStreampipelineistodelivertheseadditionalvolumesofgastotheEU.NordStreamisalsotheshortestandthemostefficientgassupplyroutefromthenewfieldstothekeymarketsofNorthernEurope.
In addition to this longterm task, there is another onewhich ismorevital– toprovidesecurityand technical flexibility of gas transportation. Additional infrastructure willensuresafetybyminimizingtheriskofanydisruptioninthetransportationofgas. Italsoallows the flexibleandefficientmanagementoftheflowofRussiangastospotmarketsintheliberalizedgasmarketintheEU.

The Nord Stream pipeline, 1220 kilometres long and giving Russia direct access to the EU energy market via the Baltic Sea, is not only the longest offshore gas pipeline in the world; it is also a piece of strategically important infrastructure which should help guarantee reliable, long-term energy supplies and which represents a significant milestone in the Russia-EU partnership. The EU has given the Nord Stream project priority status and designated it as being of “European interest” according to the European Union’s TEN-E Guidelines. Despite this, the project came up against severe criticism and opposition from many countries for a wide variety of reasons in the planning phase.

route passes through the territorial waters of five countries(Russia, Finland, Sweden, Denmark and Germany), whichhad togive specialpermission–althoughonly twoof thesecountrieshadadirectinterestintheproject.Inaddition,othercountrieson theBaltic coast (Estonia,Latvia,LithuaniaandPoland)werealso involved in theconsultationandapprovalprocess.Withsomanycountriesinvolved,thiswasthelargestconsultationprocessforacommercialprojectinhistory.
From thevery start of the project,Nord StreamAGwasengaged in an open dialogue with the authorities, environmentalorganisations andgeneralpublicof all the countriesintheBalticregion,whointurnofferedtheirownopinionsregarding the potential impact of the pipeline on the environment. All nine countries bordering the Baltic Sea, andconsequently affected inonewayor anotherby theproject,tookpartintheseinternationalconsultations.Overthecourseof a three and a half year process, each of the participatingcountriesdevelopedanapproachfor theevaluationofenvironmental impacts – allworking towards the commongoalofensuringtheenvironmentalviabilityoftheprojectforthewholeBalticregion.
Afteraperiodofintensenegotiation,thecountriesoftheBaltic came to more or less the same understanding of theapproachtoevaluatetheNordStreamproject.Thecompany’sreportonthetransborderenvironmentalimpactofthepipeline (Nord Stream Espoo Report) was recognised as fulfilling the requirementsof the Espoo Convention. This reportpromotesacoordinatedapproachtoprotectingtheenvironment,andgivesallpartiesinvolved(includingthepublicandotherstakeholders)avoiceintheprocess.ThecomprehensivedebateontheNordStreamprojecthasprovedtobeavaluableexperienceforthecountriesoftheBalticregioninevaluatingmajortransborderprojects.
FocusontheenvironmentalsafetyBefore the start of construction Nord Stream invested €100million in environmental studies and planning to ensurethat the design and routing of the pipeline is safe andenvironmentallysound.
Thisresearchcoveredthreebroadareas:1)theseabed,thewatercolumnandtheatmosphere;2)thebiologicalenvironment and nature conservation areas, including analysis ofwater and soil samples andobservationof thebehaviourof
fish,marinemammalsandbirds;3)thesocioeconomicenvironment, which includes fisheries, shipping and navigation,tourism and recreation, maritime cultural heritage, militaryoperationsandoffshoreindustries,suchaswindfarms.
NordStreamusedstateofthearttechnology,equipmentand methods to collect comprehensive information on theBalticSea.Forexample,theyusedremotelycontrolledunderwatervehicles fittedwithhighaccuracypositioningsystems,cameras,powerfulunderwaterlighting,sonar,cabledetectorsand gradiometers (metal detectors). Research vessels wereequipped with highly accurate global and underwater positioning systems, multibeamdepth sounders, seismic sensorsandsidescansonar.
EnvironmentalmonitoringprovessafetyAfter the start of construction in April 2010, a new stageof environmental research began. In order to avoid anyunexpectedimpactontheenvironmentduringconstructionandoperation,andalsotoensurecompliancewithitspermits,Nord Stream has developed a system of environmental andsocioeconomic monitoring along the entire length of thepipeline.Foreachofthecountriesthroughwhosewaterstheroute passes, a separate programme has been created thattakesintoaccountnationallegalrequirementsandthepermitsissued,thetypeofconstructionandthelocationofsensitiveareasnearthepipelineroute.
Sixteen subjects are being monitored, including waterquality – both of seawater and fresh water in coastal areas;bottomcurrents;marineresources;thefloraandfaunaoftheBalticSea;andseabedrecovery.Themonitoringprocessalsohasasocioeconomicperspective,lookingatpotentialimpactsonculturalheritageandcommercial fishing.Reportson theresultsofenvironmentalmonitoringareregularlysenttothenationalenvironmentalauthoritiesofeachcountryinvolved.
NordStreamwillconductdetailedenvironmentalmonitoringthroughoutconstruction,aswellasinthefirstyearsofoperationofthepipelinealongthewholeroute.Basedontheresultsofenvironmentalmonitoringsofar,itcanbeconcludedthat,givenallthemeasuresinplacetoprotecttheenvironment, Nord Stream will have no significant environmentalimpact.Itcannowbesaidwithconfidencethattheenvironmental impact of the pipeline really is minimal or virtuallynonexistent. Moreover, actual impact levels as shown byresearchhavebeenbelowthelevelsestimatedinthepreconstructionenvironmentalimpactassessments.

Экологическиймониторинг–доказательствобезопасности
С началом строительства в апреле 2010 года начался иновый этап исследования окружающей среды. Чтобыисключитьлюбоенепредвиденноевоздействиенаокружающую среду при строительстве и эксплуатации, атакже для выполнения требований выданных разрешений,NordStreamразработал«Системуэкологическогоисоциального мониторинга» по всей трассе газопровода.Длякаждойизстран,черезводыкоторыхпроходитмаршрут,быласозданаотдельнаяпрограмма,учитывающаятребования национального законодательства и выданныхразрешений,видстроительныхработирасположениеуязвимыхзонвблизитрассыгазопровода.
Отслеживаниефактическоговоздействиянаокружающуюсредуведетсяпо16компонентам,такимкакпараметрыморскойводыипресныхводбереговогоучастка,придонныетечения,водныебиоресурсы,флораифаунаБалтийскогоморя,атакжевосстановлениеморскогодна.Отчеты по результатам экологического мониторингарегулярнонаправляютсянациональнымприродоохранныморганамкаждойизстран.

Despitethefactthatdevelopedstateshavebeenrecentlypracticingthe“knowledgeeconomy”approach,naturalresources are still vital for their prosperity andindependent sustainable development. The Arctic
region is considered abound in mineral and biologicalresources2,soitcameasnosurprisetoanyonewhentheArcticcoastal states (Russia, Canada, Denmark and Greenland,Greenland,Norwayand theUSA)expressed theirparticularinterestindelimitationofareascoveredwithiceandsnowformostoftheyear.However,thereisamajordifferencebetweenthepositionsoftheArcticcoastalstatesinrelationtothelegalgroundsforclaimingrightsovercertainareasintheArctic:
■■ thosewiththelongestcoastlines(RussiaandCanada)■■ thosewitharelativelyshortcoastline(Denmark,Norway
andtheUSA).Thisdifferenceaddsuptotwolegalconceptstobeapplied
tolegaljustificationofterritorialclaimsintheArctic–conceptoftheArcticsectorsandconceptdisregardingit.
CanadaCanada was one of the first countries that clearly declaredits rights over the respective Arctic sector and the sectorboundarieswhentheywerelegallyestablishedin1925(suchsector is formed by an Arctic state’s coast, bordering theArcticOcean,andtwomeridiansoflongitudedrawnfromtheEasternmostandWesternmostpointsof suchacoast to theNorthPole).NowadaysCanadacarriesoutarathercautiouspolicywithrespecttoitsrightswithinthelimitsofitsArcticsector;thusithasnotyetexerciseditsrighttofileanofficialclaimtoanextendedcontinentalshelfwiththeCommissionand abstains from both direct claims of sovereignty andsovereignrightsandwaivers.
RussiaTherearetwolegalpositionsinRussia.Adherentsofthefirstposition insisted on the“sector” delimitation principle oftheArcticregion.andtheyrefertothefollowing:(i)nationallegislative and treaty practice; (ii) acquiescence or consentwithsuchpracticesonbehalfofthemajorityofstatesfromthe15thto20thcenturies,andtheabsenceofrelevantpersistentobjectionsduringthementionedperiod.3
Russia, as well as Canada, may also rely on historic titleininternationallawasapplicable.OnApril151926,thePresidiumoftheSupremeSovietoftheUSSRdeclaredtheterritorybetweentwolines(35°Eand170°W)drawnfromMurmansktotheNorthPoleandfromtheChukchiPeninsulatotheNorthPoletobeSovietterritory.Someauthorsunderlinealinkbetweentheconceptofhistoricaltitleandtheconceptof“Arcticpolarsectors”.
Adherents of the second position considered it reasonable toclaimtoanextendedcontinental shelfwith theUNCommission on Continental Shelf Limits (“Commission”).ItwasthesecondpositionwhichwasadoptedbytheofficialauthoritiesandonDecember202001,Russiamadeanofficial submission to the Commission in accordance with theConvention(Art.76,paragraph8).AccordingtothesubmissionitwasproposedtoestablishtheouterlimitsofthecontinentalshelfofRussiabeyondthe200nauticalmileexclu

With the advent of global climate change causing the polar ice to recede at a rate higher than expected due to global warming, the Arctic Ocean has been widely recognised as a major potential resource space and a vital world ecosystem. The adoption of the United Nations Convention on the Law of the Sea of 10 December 1982 (the “Convention”) has prompted several countries to claim or to reinforce pre-existing claims to the waters or seabed of the polar region.

Itshouldbenotedthattheabovementionedsubmissionhas been heavily criticised by many Russian specialists asimproperandvicioustothestrategicinterestsofRussiaintheArctic.SincefilingthisclaimRussiahasagreedtotheextensionoftheinternationaljurisdictionontheArcticOceanbedandvoluntarilylimiteditsrightsintheArcticsector(thebordersofwhichwereestablishedonApril151926bythePresidiumoftheSupremeSovietoftheUSSR),thoughotherstates(suchastheUSAandCanada)haven’tlimitedtheircontinentalshelfundertheConvention.
OnAugust22007,theRussianexpedition“Arktika2007”descendedtotheoceanbedattheNorthPole,plantedtheRussianflagandtookwaterandsoilsamplesforanalysisinorderto provide additional evidence related to the Russian claimtothemineralrichesoftheArctic.Theexpeditionaimedtoestablish that the eastern section of seabed passing close tothe North Pole, known as the Lomonosov Ridge, is in factanextensionofRussia'slandmass.AccordingtorecentcommentsfromRussianofficialrepresentatives,RussiaisplanningtoextenditsclaimandfilenewevidencewiththeCommissionin2012.
NorwayNorwaywasthesecondcountrytofileasubmissionwiththeCommission on November 27 2006. There were argumentsprovided toextend theNorwegianseabedclaimbeyondthe200nauticalmile exclusive economic zone in three areas oftheNortheasternAtlanticandtheArctic.Thesubmissionalsostated that an additional submission for continental shelflimits in other areas may be posted later. The Commissionhasapprovedthesubmission,slightlydiminishingNorwegianterritorial claims. However, territorial claims of Norwaymustbeconsideredsubject to theprovisionsofSpitsbergen(Svalbard)Treaty.AccordingtothisTreatyNorwayisentitledto exercise its sovereignty over the Spitsbergen only underthe conditions of the Treaty, which limits the mentionedrightstolandandtheterritorialseaofSpitsbergen.Thus,twodifferenttermsmustbedistinguished,i.e.limitsofNorwegiansovereignty over the Spitsbergen established by the Treaty,and the territorial scopeof theTreaty.Norwaypermanentlyattemptstoovercometheseexistingdiscrepanciesbyrespectivenationallegislationacts,aswellasinterstateagreements(e.g.withRussia).
DenmarkTerritorial claims of Denmark in the Arctic region werejustifiedin1933whenthePermanentCourtofInternationalJusticeadmittedDenmark’ssovereigntyoverGreenland.TheDenmarkpositionwaslateronstrengthenedbythedecisionof the UN International Court in 1993 in the dispute withNorway.
While officially claiming no position on the “sector”approachtotheArcticregion,Denmarkactuallymakesuseoftheconsequencesprovidedbythisconcept.In2005Denmarkalso declared that the Lomonosov Ridge is connected withGreenlandandinfact isanextensionof the latter.Howeversuch a position can’t be considered as reasonable since thecontinentalshelfistheextensionofacontinentitselfandnotofthenumerousArcticislandsperse.
TheUSATerritorial claims of the USA have been rather inconsistent.InitiallytheUSA,aswellasCanada,declaredtheirrightswithrespecttotheArcticsectortothenorthfromAlaska.Hencelateron this concept was consideredasunreasonable andabsurd(mostlyinordertowithstandCanada’sinterestsintheArcticregion).TheUSAdidn’tratifytheConvention,thusit isnotobligedtodetermineorlimititsterritorialrightsaccordingtotheprovisionsofArt.76oftheConventionasRussiadid.BeingthepartytotheConventionontheContinentalShelfof1958,theUSAmayclaim its sovereign rightsover the continentalshelfuptotheNorthPoleaslongasitispracticable.
Therefore thereareanumberofdifferentapproaches todefineandestablishthelegalregimeoftheArcticOceanbedbeyond200nauticalmilesfromthecoastalbaselines,including,interalia,thefollowing:
■■ the continental shelf is to be delimitated between theArcticcoastalstatesaccordingtoArt.6oftheConventionontheContinentalShelfof1958(inrelationtotheUSA)oraccordingtoArt.83oftheConvention(inrelationtotheotherfourArcticcoastalstates)
■■ thecontinentalshelfistobedelimitatedbetweentheArcticcoastalStatesandtheAreatobedelineatedaccordingtoArt76oftheConvention
■■ there should be a legal dichotomy in delimitation of acontinentalshelf,i.e.forstatespartiestotheConventionitshouldbedelimitedbetweentheArcticcoastalstates(plustheareatobedelineated);andfortheUSAandotherstates(nonpartiestotheConvention)itshouldbedelimitatedaccordingtotheConventionontheContinentalShelfof1958.Tosumup,therearenostaticanduniquecustomaryinter
nationalruleswithrespecttoterritorialandresourceclaimsoftheArcticcoastalstatesintheArcticregion.Otherstates,inparticularIndiaandChina,havealsodeclaredtheirinterestsin theArctic region. But it needs to be taken into accountthat,accordingtothepositionoftheUNInternationalCourtofJustice, theequitydoesnotnecessarilymeantheequality.Therefore,equitydoesnotrequirethatstateswithoutaccesstotheArcticOceanshouldbeallottedanareaofacontinentalshelfanymorethantherecouldbeaquestionofrenderingthesituationofastatewithanextensivecoastlinesimilartothatofastatewitharestrictedcoastline.

Приэтомнеобходимоотметить,чтопозицииарктическихгосударстввотношенииихправовогоположениявАрктикезначительноразличаютсямеждугосударствами с наибольшей протяженностью побережья в СеверномЛедовитомокеане(РоссияиКанада)исотносительнонебольшимипобережьями(Дания,НорвегияиСША).
Указанные различия, во многом, обусловлены наличием двух подходов в обосновании территориальных
правопритязаний арктических государств: разделениеАрктикипосекторамиразделениебезучетасекторальногопринципа.
КанадаКанада–однаизпервыхстран,котораяпрямозаявилаосвоихправахнасоответствующийарктическийсектор,границыкоторогобылиофициальнозакрепленыв1925году(такназываемыйарктическийсекторвключаетвсебяпространство, образованное побережьем соответствующегоарктического государства и сходящимися на Северномполюсе меридианами, проведенными от крайних точекзападнойивосточнойоконечностейтакогопобережья).
ВнастоящеевремяКанадапроводитпродуманнуюивесьмааккуратнуюполитикувзащитусвоихправнатерриториивпределахсоответствующегоарктическогосектора.Вчастности,странаещеневоспользоваласьсвоимправомустановитьвнешниеграницыконтинентальногошельфа, подав официальную заявку в Комиссию ООНпограницамконтинентальногошельфа(далее–«Комис-сия ООН»),ивоздерживаетсякакотпрямогопровозглашениясвоегосуверенитетанадканадскимсектором,такиототказаоттакихпритязанийнасуверенитет.

В связи с глобальным потеплением на фоне масштабных климатических изменений, заставляющих полярные льды все быстрее отступать на север, Северный Ледовитый океан привлекает все больше внимания как крупнейший потенциальный источник природных ресурсов и важнейшая экосистема. Принятие Конвенции ООН по морскому праву 10 декабря 1982 года (далее – «Конвенция») побудило ряд стран предпринимать активные действия в защиту своих притязаний на воды и морское дно Арктики.

Вобоснованиесвоейпозицииавторызаявки,помимопрочего,ссылалисьнатотфакт,чтохребетЛомоносова,подводныйхребет,простирающийсякСеверномуполюсу, и хребет Менделеева являются продолжением Евразийскогоконтинента.В2002годуКомиссияООНтакине приняла окончательного решения, порекомендовавпровестидополнительныеисследованияипредоставитьдостоверныедоказательства.
Следует добавить, что указанная заявка подвергласьсущественной критике со стороны многих российскихспециалистовкакошибочнаяинаносящаяущербстратегическиминтересамРоссиивАрктике.Вчастности,ониотмечали,что,подавзаявку,Россияфактическисогласилась на распространение юрисдикции международного
органанадноСеверногоЛедовитогоокеанаидобровольно ограничила свои права в арктическом секторе (границы которого были установлены 15 апреля 1926 годаПрезидиумомЦИКСССР),тогдакакдругиегосударства(такие как США и Канада) протяженность своего континентальногошельфавсоответствиисКонвенциейнеограничивали.
2августа2007годаучастникиРоссийскойэкспедиции«Арктика2007»спустилисьнадноокеанавгеографической точке Северного полюса, установили Российскийфлаг,атакжесобралиобразцыводыипочвыдляполучения дополнительных доказательств правомерностипритязанийРоссиинаминеральныебогатстваконтинентальногошельфаАрктики.Цельэкспедициибыла,втомчисле,доказать,чтозападнаячастьморскогодна,включающаяхребетЛомоносоваипростирающаясякСеверномуполюсу,являетсяпродолжениемроссийскойчастиконтинента.Согласнопоследнимкомментариямофициальныхроссийских представителей,Российская Федерация планирует расширить свою заявку и предоставитьновыедоказательствавКомиссиюООНв2012году.

ВтожевремяприоценкетерриториальныхправопритязанийНорвегиинеобходимотакжеучитыватьположения Шпицбергенского трактата (договора). Этот документустанавливает,чтоНорвегиявправеосуществлятьсвой суверенитет над Шпицбергеном (Свальбальдом)в соответствии сусловиями данного договора,которыеопределяют распространение суверенитета НорвегиитольконасушуитерриториальныеводыШпицбергена.Такимобразом,необходиморазличатьдвапонятия:границы реализации суверенитета Норвегии по договоруитерриториальныеграницырайонадействиядоговора.Норвегия постоянно предпринимает попытки преодолетьэтипротиворечиякакпутемпринятиянациональныхзаконодательныхактов,такизаключениямеждународныхсоглашений(например,сРоссией).
ДанияТерриториальные правопритязания Дании в АрктикебылиподтвержденывсилурешенияПостояннойпалатымеждународного правосудия, которая в 1933 году признала осуществление суверенитета Дании над Гренландией. Решение Международногосуда ООН, принятое в1993годувотношенииспорасНорвегией,ещебольшеукрепилопозицииДанииврегионе.
Также следует отметить, что Дания фактическииспользует правовые последствия секторального деленияАрктики,хотядонастоящеговремениофициальнонезаявилаосвоейпозициивотношениитакогоподхода.Крометого,в2005годуДаниятакжеподнялавопросо своих правах на хребет Ломоносова, который, по еесловам,соединенсГренландиейи,посути,представляетсобойеепродолжение.Однакотакаяпозициянеможетсчитаться обоснованной, так как континентальныйшельфпосуществуявляетсяпродолжениемконтинента,анемногочисленныхострововвАрктике.
СШАТерриториальныеправопритязанияСШАдонастоящеговременибылинаиболеенепоследовательны.ИзначальноСША,такжекакиКанада,заявилиосвоихправахнасоответствующий арктический сектор к северу от Аляски.Впоследствии такой подход был признан несостоятель
ным и даже абсурдным (в основном в целях противостояниятерриториальнымпритязаниямКанады).СШАдонастоящеговременинератифицировалиКонвенцию,поэтому они не обязаны устанавливать или ограничивать свои территориальные права на континентальныйшельфвсоответствиисост.76Конвенции,как,например,этосделалаРоссия.Болеетого,являясьучастникомКонвенцииоконтинентальномшельфе1958года,СШАмогутзаявитьсвоисуверенныеправанаконтинентальныйшельфвплотьдоСеверногополюсавлюбоевремявтечениесрокадействияуказаннойКонвенции1958г.
Таким образом, существует несколько различныхподходов к определению правового режима дна СеверногоЛедовитогоокеаназапределами200морскихмильотисходныхлиний,включая,средипрочего,следующиепозиции:
■■ границыконтинентальногошельфаприарктическихстран должны определяться в соответствии со ст. 6Конвенцииоконтинентальном шельфе1958 года (вотношенииСША)иливсоответствиисост.83Конвенции(вотношенииостальныхчетырехприарктическихгосударств);
■■ границыконтинентальногошельфаприарктическихстраниРайона3должныопределятьсявсоответствиисост.76Конвенции;или
■■ предлагается установить два различных правовыхрежима,аименно:границыконтинентальногошельфа странучастниц Конвенции и Района должныопределяться в соответствии с положениями Конвенции, а границы континентального шельфа СШАи других государств, не участников Конвенции, – всоответствиисусловиямиКонвенцииООНоконтинентальномшельфе1958года.Подводя итоги необходимо отметить, что в настоя
щее время не существует единых и общепризнанныхмеждународныхправилдляопределенияправомерностиправопритязанийприарктическихстраннатерриториюинедраАрктики.Крометого,другиегосударства,вчастности,ИндияиКитай,такжезаявляютосвоихинтересахв арктическом регионе. Однако следует учитывать, чтосогласнопозицииМеждународногосудаООН,справедливостьнеобязательноподразумеваетравенство.Инымисловами, принцип справедливости не требует, чтобыгосударство,неимеющеевыходакСеверномуЛедовитомуокеану,былобынаделенокакимлиборайономконтинентальногошельфа,такжекакинепредполагаетединогоподходакгосударствамспротяженнымпобережьемигосударствамсограниченнымдоступомкморю.
Следуеттакжеотметить,чтонесмотрянато,чтодвеизчетырехприарктическихстран(участницКонвенции)ужепредпринялипопыткизакрепитьсвоиправанадноСеверногоЛедовитогоокеанавсоответствиисКонвенцией,двадругихгосударства(КанадаиДания)необязаныпоступатьтакже.Болеетого,границыРайонавпределахСеверногоЛедовитогоокеанамогутбытьопределенытолькоприсовместномучастивсехпятиприарктическихстран,втовремякакСШАдаженеявляютсяучастникомКонвенции.

Issuing permits to foreign companies and organisations to open representative offices in Russia is one of the key ser-vices provided by the RFCCI, and over the past 20 years, more than 5,500 foreign companies from 98 countries have received accreditation.
A representative office allows international companies operating in Russia to minimise their expenditure while still maintaining constant market presence, conducting market research, establishing business contacts, as well as nego-tiating agreements and undertaking specific projects. Permits can be issued by the RFCCI for a term of one, two or three years, and the company may subsequently extend the term of accreditation for one, two or three years.
International companies accredited by the RFCCI have the opportunity to use our unique structure to help establish business contacts with Russian partners across the entire territory of the Russian Federation.
The RFCCI’s integrated business services infrastructure comprises 174 territorial Chambers of Commerce and Industry, 204 national business as-sociations, more than 60 Business Councils for promoting external eco-nomic relations with foreign countries, and 34 sector-based Committees.
Aside from legalising the presence of UK companies in Russia, the RFCCI provides a wide range of services to foreign companies in finding business partners, establishing contacts with the authorities and business struc-tures in the regions. These services include economic security services, arbitration, issuing Certificates of Origin and ATA Carnets, exhibition sup-port through the Moscow EXPOCENTER, and office rental through the Moscow World Trade Centre. The RFCCI can also help with conducting independent inspections through Soyuzexpertisa and offers patent legal services through Soyuzpatent.
The RFCCI can also help with the day-to-day operation of representative offices of foreign companies, issuing individual accreditation ID cards for, rendering visa support and assistance in obtaining multiple working visas for both foreign staff and their family members, and providing visa support to foreign business associates.

Pushkin’s strange and enchanting novella, The Queen of Spades, has always lived something of a double life. It is a classic of Russian literature and the subject of much scholarly work. Yet it is also a story that continues to evolve on the stages of opera houses around the world as well as on our cinema screens. As a vivid tale of the imagination that plays with a variety of styles and genres it is hardly surprising that The Queen of Spades has proved so irresistible to film-makers, stage directors, conductors, composers and choreographers.
StageIncarnationsofTheQueenofSpadesTchaikovsky,nostrangertoadaptationsofPushkin,chosetocreateanoperaoutofThe Queen of Spadeswithalibrettobyhisbrother,Modest.ItpremieredattheMariinskyTheatrein1890andhasremainedastapleoftheoperaticrepertoireinRussia ever since. The score is arguably Tchaikovsky’s mostadventurous – but the cynical character of Pushkin’s storygiveswaytoamoreromanticconceptionoftherelationshipbetweenHermannandLiza.ThisisoneofmanychangestheTchaikovsky brothers made that has proved the subject ofmuchcontroversyandcriticismsince itspremiere.TchaikovskyrecastsHermann,fromsomeonewhodeceivesLizacruellyandcoldly,assomeonewholovesLizadeeply,butisdriventowardshisowndestructionbyafatalobsessionheisunabletocontrol.
The record ofdirectors and theatrical practitioners whohave staged the operaisimpressive.Inaproduction at the MalyOpera, Meyerholdclaimed his primaryaim was to be faithfulto Pushkin and takeaway sentimental elements of the libretto.The young Shostakovich, however, commentedthatweshouldaccept the opera forwhat it is – not anattempt to present afaithfuladaptationofthePushkin,butrathersomethingthatstands on its own terms. Even now, the Mariinsky favoursYuri Termikanov’s static production from the 1980’s over amorerecent,abstractvisionofthepiece,directedbyAlexander Galibin in 1999. Internationally however, imaginists inthe theatre likeRichard Jones, inhisWelshNationalOperaproduction,havecreatedoriginal, lively interpretations thatmaximisethedarker,lessrationalelementsofthestory.
In the late eighties the eminent theatre director, PyotrFomenko,createdatheatricalversionthatstayedfaithfultotheoriginaltotheextentthatcharacterswouldwalkonstagewith the book in their hands reading the story aloud. Thiswould appear to be the only straighttheatre adaptation tohavebeenbroughttolife.

The Queen of SpadesisaproductionbyanewcompanyIsetupearlierthisyear,Fusebox,dedicatedtoanewtheatreofcolour,soundandmotion.Wewanttopresentworkthatexperimentswithheightenedlanguage,physicality, imageryandmusictocreateaformofstylisedstorytelling.I’madaptingTheQueenofSpadeswithRaymondBlankenhorn.
We’re telling the story as a series of dreams through acombination of tableaux, original music and text, delvinginto the minds of the two main characters, Hermann andLiza.Wecanbelievethatthefantasticaleventsonstageariseout of these characters’ deepest fantasies and needs. Thisapproach,Ihope,staystruetothespiritoftheoriginal.Afterall,Pushkin’sopennessof form,senseof ironyandplayfulnesscontinuetomakehisworkfeelradicaltoday.

ARCHBRITEXPO-92Sales of over $1 million from the stands alone was the impressive result of the British Woodworking Exhibition, Archbritexpo 92 – held in Archangel in early September. This success was backed up by a number of repeat orders and a wealth of enquiries which auger well for the future of trade relationships between British manufacturers of tim-ber processing machinery and the Russian wood industry.
Sponsored by the British Manufacturers of WMSA and the Russian Group comprising the Russian Wood Agency, Joint Stock Company Exportles, Severoles and Nauchdrevprom, the event took place at Number 3 Mill, Archangel on September 7–13 and was attended by visi-tors from Russia and adjacent states, those with buying power numbering over 1,000. As the UK′s largest manu-facturer, Wadkin spearheaded the effort with outstanding results. ″We sold over £400,000 of machines from our stand, including all the moulders, we have a number of repeat orders and a mountain on enquiries and quotes to deal with″ said Fabio Milone of Wadkin.
Among others who sold all or most of the contents of their stands were Rye, Fell, Ryburn, Sedgwick, DCS, Talbott, P&J, Autool, Timber Techniques and SMS. Every exhibitor came away with orders or firm enquiries, and the future of UK-Russian trade in the area seems to be confirmed.
As the Chairman of the organising committee Mike Visram of Forestor said, ″The exhibition lived up to most people′s expectations…it has opened up market for Brit-ish equipment and will translate into future profits for the UK and a modern industry for Russia″.
Archbritexpo 92 attracted a great deal of attention in Russia, with the opening covered by the Mayor of Arch-angel, Mr Yuri Guskov, Timber Industry Leaders, a large number of journalists and two TV crews.
The essence of the exhibition was that it was a live one, covering 2,000 sq metres, with machines there to be seen. The visitors found this more appropriate than other events, where the majority of stands had only illus-trations of machinery. The combination of the working nature of each stand and the ready supply of timber from the host mill enabled exhibitors to show their wares to best advantage. A number of projects were carried out using the machines, with tooling, extraction and handling expertise present to provide tangible examples of how the machines operate, and to what quality.
The Russian woodworking industry is vast, and Arch-angel is at the centre. The industry recognises the need to invest in new machinery and representatives were keen to re-establish old trading links by buying British. But the criterion was that they were only prepared to buy the best machinery-the orders and enquiries confirm that the market is happy that the British suppliers could provide what was required.
The follow-up plans are in place with a buyer′s consor-tium from Russia coming to the UK later this year.

Siberian and UR partners in timber jv Interles, a Siberian-UK joint venture for the production of timber, chipboard and wooden furniture, has been established as the first venture with UK participation in the Commonwealth of Inde-pendent States timber industry. The London-based trade and consultancy сompany, Swan Overseas, has a 31% equity stake in Interles. The Siberian partner is the timber-cutting production association, Sovietsky LDK, in the autonomous district of Khan-ty-Mansiysk in western Siberia. The new firm, capitalised at 900,000 roubles, will be authorised to process timber in an area with an estimated 3.5 million cubic metres of timber reserves. Swan Overseas is contributing its share of the venture form its own resources by transferring $250,000 in hard currency. Interles at present operates a production complex process-ing annually 30,000 cubic metres of chipboard, 100,000 cubic metres of timber and wooden furniture. The venture plans an investment of $12 million to modernise the chipboard plant and increase its capacity to 120,000 cubic metres of timber, all of which will he scheduled for export to Western markets. The Siberian plant has been selling chi- to Italy, Germany, France, North Africa and the UK since 1970. These countries are regarded as a ready market for Interles, and sales will be increased by recent orders from Iran. According to Masoud Alikhani, chairman of Swan Overseas, it intends to raise the necessary funds for updating Interles' facilities through its own resources and international finance. During the first three years of operation, 100% of export earnings will be paid towards reimbursement of the loan for supplies of technology and equipment for the modernisation scheme. After that period the profits will be shared according to the equity holding.
