(Sec. 100) INTRO DUC TIONOn September 17 , 199 6 the Board of Supervisors of the Co unty of Santa Barbara adop tedOrdinance No . 96-382 approving the proposed boundaries for the G oleta Old Town Project Areaas described in the Bou ndary D escription (Legal Descrip tion) attached hereto a s Exhibit " A" andincorporated herein.     5. Construction and im provement of recreational facilities, comm unity facilities, parkingfacilities and other public facilities;6. Acquisition, construction or rehabilitation of housing for low and moderate-incomefamilies, seniors and handicapped individuals within the com munity of Go leta Old To wn;7. Financing o f the construction of residential, commercial and industrial buildings and themortgage financing of residential, comm ercial and industrial buildings, as permitted byapplicable State and local laws, to increase the residential, com mercial and industrial baseof the Coun ty and th e number of temporary and permanent jobs within the County;8. In ap propriate cases, rehabilitation of comm ercial, residential and industrial structures andimprovements or develop men t of vacant land by present owners, their successors and theAgency for uses in accord ance with this Plan;9. The upgrading and modernization of the existing comm ercial center to serve the needs ofGoleta Old Town and the surrounding area;10 . Increasing the existing level of commercial facilities in the Pro ject A rea to serve GoletaOld Town and the surrounding community; and11. Such other action a s may be permitted by law.

    The Agency shall not acqu ire real property t o be retained by an owner pursuant t o a participationagreem ent unless provision for such acquisition is made in the agreement.The Agency is authorized to acquire structures without acquiring the land upon w hich thosestructures ar e located. The Agency is also authorized t o acquire any other interest in real propertyless than a fe e interest.Th e Agency shall not acquire real property on w hich an existing building is t o be continued on itspresent site and in its present form and use with out the consent of the owner.

    2. (Sec. 404) Acquisition of Personal P ro ~ e rt yGenerally, personal property shall not be ac quired, unless such acquisition is necessary inconnec tion with the acquisition of real property. How ever, where necessary in the exe cution ofthis Plan, the Agency is authorized to acquire personal property in the Project Area by any l a d lmeans, not including the use of eminent domain.

    C . (Sec. 405) Participation by Own ers and Tenants1. (Sec. 406) Owner and Tenant Participation

    As provided for in sections 33339 and 3333 9.5 o f the California Health and S afety Cod e, theAgency shall extend a reasonable opportunity to the present o wners in the Project Area, t oparticipate in th e Redevelopment of the Pro ject Area if they otherwise meet th e requirements

    2. (Sec. 407 ) Participation Agreements

    The Agency may enter into binding agreements with own ers o f property within the Project A readesiring to participate in redevelopment pursuant to th e Redevelopm ent Plan by which th eparticipant agrees to rehabilitate, develop o r use property in conformance with the Plan and b esubject to th e provisions hereof and such other provisions and conditions to which the parties m ayagree. In the agreement, when ever it is appropriate t o d o so , participants who retain real propertyshall be required to join in the recordation of such docum ents a s are necessary to make th eprovisions of this Plan applicable to their properties. Such agre eme nt may include provisions thatin the event participant defaults under the terms of the o wn er participation agreement, the Agencymay terminate the ag reement and purchase the reai property. I n the event that the Agency is notdirectly involved in the developm ent of a particular prop erty, a participation agreement may notbe required. The determination of whether o r not a participation agreement is required shall bemade by the Executive Directo r of the Agency or his designated representative whose decision,subject to an appeal to the Agency Bo ard, shall be final.Whether or not a potential participant enters into a participation agreement with the Agency, theprovisions of this Plan are applicable to all public and private prope rty in the Project Area.

    D. (Sec. 408) C ooperation with Public BodiesCertain public bodies are autho rized by the St ate law to aid and cooperate, with or withoutconsideration, in the planning, undertaking, construction, or operatio n o f this Project. T he Agency

    As provided for in Health and Safety Co de Section 33401, the Agency may pay an amount ofmoney in lieu of taxes in any year during wh ich it ow ns property in the Pro ject A rea, Suchpayment shall be m ade directly to a Cou nty, or special district, including, but not limited to, aschool district, or other public corporation for whose benefit a tax would have been levied uponsuch property had it not been exemp t.The A gency may also pay to any taxing A gency with territory located within the Project Areaother than the County, any amounts of mon ey which in the Agency's determination is appropriateto alleviate any financial burden or detriment caused to the taxing A gency by the Project.

    F. (Se c. 41 0) Relocation o f Perso ns D isplaced by the Pro-iect1. (Sec. 4 1 1) Relocation Hou sing Requirements

    N o pe rson s or families of low and m ode rate incom e shall be displaced unless and until there is asuitable housing unit available and ready f or occup ancy by such displaced person or family at rentscomparable t o tho se at th e time of their displacement. Such housing units shall be suitable to t heneeds of such displaced persons or families and must be decent, safe, sanitary and otherwisestandard dwellings.Perm anent housing facilities shall be m ade av ailable within three years from t he time occ upantsare d isplaced. Pending the development o f su ch facilities, there will be available t o such displacedoccup ants ade quate temporary housing facilities at rents comparable to thos e in the com munity at

    from the low and moderate incom e housing market until the Agency has by resolution adopted areplacement housing plan.Noth ing in this section shall prevent the Agency fr om destroying or removing from th e low an dmo derate income housing mark et a dw elling unit which the Agency ow ns and which is animmed iate danger to h ealth and safety. The A gency shall, as soon as practicable, ado pt byresolution a replacement housin g plan with respect t o such dw elling unit.

    3. (Sec. 413) Assistance in Finding Other Loc ationsTh e Agency shall assist in th e relocation of all persons (including families, businesses and others)displaced by Agency acquisition of property in the Project A rea. Th e Agency intends toaccomplish all redevelopment pursuant t o this Plan with as little displacement of persons frombusinesses or residences as is feasible. In orde r to carry out th e Project with a minimum o fhardship to persons displaced f rom their homes, t he Agency shall assist individuals and families infinding housing that is de cent, safe, sanitary, within their financial means, in reasonably convenientlocations, and otherwise su itable to their needs. T he Agency is also authorized to prov ide housingoutside the Project Area f or displaced persons.

    4. (Sec. 414) R elocation Benefits and AssistanceIn accordance with the provisions of the California Relocation Assistance Act (Government Code

    2. (Sec. 4 17) Public Improvements

    To th e extent perm itted and in the mann er required by law, the Ag ency is authorized t o install andconstruct o r to cause t o be installed and construc ted the public improvemen ts and public utilities(within or outside th e Project A rea) necessary to carry out this Plan. Such public improvementsinclude, but ar e not limited to the following: parking lots or structu res, over o r underpasses,bridges, streets, cu rbs, gu tters, sidew alks, street lights, sewers, stor m drains, traffic signais,electrical distribution systems, flood control facilities, natural ga s distribution systems, wate rdistribution systems, landscaping, parks, plazas, playgro unds, and any buildings, struc tures orimprovements necessary and convenient to the f ill development of any of the above. S ee thePreliminary Report for a list of proposed Public Improvements.Public improvem ents of the n ature as hereinafter set forth, may be constructed or installed, orcause to be c onstructe d o r installed, in whole o r in part by the A gency with twenty percent (20%)of the tax increment moneys that would otherwise be set aside pursuant to Health and SafetyCode S ection 33334 .2 provided that such public improvements, pursuant t o said Section 3 3334.2of the Red evelop men t Law will be for the pu rposes of, directly and specifically, increasing and/orimproving the supply of low and moderate income housing available at affordable housing costswithin the County t o persons and families of low or mo derate income and very low incom ehouseholds, o r the A gency finds that the imp rovements are necessary to eliminate a specificcondition that jeopardizes the health or safety o f existing low or moderate income residents.The Agency presently contemplates paying all or p art of the co st of and the acquisition,

    community or othe r public corporation, the A gency may enter into a contract with the communityor other public corporation under which it agrees to reimburse the community or other pubiiccorporatio n for all or part of the value of such land or all or part of the co st of such building,facility or other improvement, or both, by periodic p ayments over a period of years. Anyobligation of the Agency under such contract shall constitute an indebtedness of the A gency forthe purpose of carrying out the Project.

    3. (Sec. 4 18) Preparation of Building SitesTh e Agency may develop as a building site any real property ow ned o r acquired by it. Inconnection with such development it may cause, provide or undertake or make provision withoth er ag encies for the installation, or c onstructio n o f parking facilities, streets, utilities, parks,playgrounds and other public improvements necessary for carrying ou t this Plan in the ProjectArea. The Agency may construct foundations, platforms, and other like structural forms necessaryfor t he provisions or utilization of air rights sites for buildings.

    H. (Sec. 419) Rehabilitation and Moving of Structures by the Agency1 (Sec. 420) R ehabilitationTh e Agency is authorized and directed to advise, encourage, and with the consent of the owner,assist in the rehabilitation of property in the Proje ct Area no t ow ned by the A gency. Th e Agencyis also authorized t o rehabilitate, or to cause to b e rehabilitated, buildings or structures in theProject Area.

    To the extent permitted by law, the Agency is authorized to dispose of real property by leases orsales by negotiation w ithout public bidding.All real property acquired by the A gency in the Project A rea shall be sold o r leased to persons orentities for development fo r the uses permitted in this Plan. Rea l property may be conveyed by theAgency to the County or any other public body without c harge.The Agency shall reserve such powers and controls in the disposition and development documentsas may be necessary to prevent transfer, retention, or use o f property for speculative purposes andto insure that development is carried out pursuant to this Plan .All purchasers or lessees of property shall be obligated to u se t he prope rty for the purp osesdesignated by this Plan, t o begin and com plete development of the prop erty within a period o ftime which the Agenc y fixes as reasonable, and to com ply with o ther conditions which the A gencydeems necessary to carry ou t the purposes of this Plan.In the manner required and t o the extent perm itted by law, be fore any property of the Agencyacquired in whole or in part, directly or indirectly, with ta x increm ent moneys is sold o r leased fordevelopment pursuant t o this Plan, such sale, lease or ot he r disposition shall first be approv ed bythe Board of Supe rvisors after a public hearing held in acco rdan ce with the provisions of Hea lthand Safety Code Section 33433.

    or contracts for th e sale, lease, sublease, or o the r transfer of land in the Project A rea shall containsuch nondiscrimination and nonsegregation clau ses as are required by law, including Hea lth andSafety Code S ection 33436.

    d. (Sec. 427) Developm ent of Publiciy Owned Improvem entsTo the greatest extent now or hereafter permitt ed by law, the Agency is autho rized to pay for,develop, or construct any building, facility, structure, or other publicly owned improvementhereto either within o r outside the Project Are a f or itself or for any public body or entity to theextent that such improvement would be o f primary benefit to the Project Area.Th e Agency is authoriz ed to financially, and oth erwise, assist any public entity in the co st ofpublic land, buildings, facilities, structure s or ot he r improvements (within o r outside th e ProjectArea) to th e extent permitted by law.During th e period of development in the Pro ject Area, the Agency shall insure that ail provisionsof this Plan and other documents formulated pursua nt to this Plan are being observed, and thatdevelopment of the Project A rea is proceeding in accordance with development docum ents andtime schedules.All developm ent must conform to this Plan an d all applicable federal, state, and local laws,including without limitation, the Co unty Zoni ng Ordinance, building, environmental and other

    2. (Sec. 43 1) Authoritv Generally

    Th e Agency may, inside or outside t he Project Area, acquire land, do nate land, improve sites, orconstru ct or rehabilitate structures in order to provide housing for persons and families of low ormo derate income. The Agency m ay also provide subsidies to, or fo r the benefit of, such personsand families or households to assist them in obtaining housing within the County.

    3. (Sec. 432) Replacem ent HousingT o the extent required by Health and Safety Cod e Section 33413 and 33413.5, whenever dwellingunits housing persons and families of low or m oderate income are destroyed or removed from thelow and moderate income housing m arket a s part of a Redevelopmen t Project which is subject toa written agreement with th e Agen cy or w here financial assistance has been provided by th eAgency, t he Agency shall, within fo ur years of such destruction or rem oval, rehabilitate, developor co nstruct, or cause to be rehabilitated, developed or constructed fo r rental or sale to personsand families of low or mod erat e incom e an equal number of replacement dwelling units ataffordable housing costs as defined by Section 50052.5 of the He alth and Safety Code, within theterritorial jurisdiction of the Agency. Seventy-five percent (75% ) of th e replacement dwellingunit s shall replace dwelling uni ts available at affordable housing c osts t o the same income level ofvery low income households, lowe r incom e households and persons and families of low andmo derate income as the persons displaced from those destroyed or removed units.

    5. (Se c. 434) D uration of Dwelling Unit AvailabilityThe Agency shall require th at the a ggrega te number of dwelling units rehabilitated, developed orconstructed pursuan t t o Section s 433 an d 434 shall remain available for persons and families t othe extent and for the period(s) required by Health and Safety Cod e Sections 33 3 3 4 .3 0 and33413.

    6. (Sec. 43 5) Relocation H ousingIf insufficient suitable housing units ar e available in the Co unty for us e by persons and families oflow and moderate income displaced by the Project, the Agency may, to th e extent of thatdeficiency, direct o r cau se the d evelopment, rehabilitation or co nstruction o f housing units withinthe County, both inside and outside of the Project Area.

    7. (Sec. 436 ) Tax Increment FundsExcept as otherwise provided in Health and Safety Co de Section 33334.2 and, to the ex tentapplicable, Health and S afety Code Se ction 33334 .6, not less than twenty percent (20%) of alltaxes which are allocated to the Agency pursuant t o Health and Safety Cod e Section 33670 shallbe used by the A gency fo r the purpo se of increasing, improving and preserving the Co unty'ssupply of housing for persons and families of low or m oderate income and very low incomehouseholds in acco rdance with the provisions of Health and Safety Code Section 33 334 .3.

    Str eets and alleys may be widened, altered, aband oned, repaired, or closed a s necessary for properdevelopment of th e Project.It is contemplated that the Agency will co nstruct, o r aid in the construction o f, certain streetsdesignated in the Plan which are not now co nstructed o r which may require hr t h e r widening orimp rovem ent. T he public rights-of-way may b e used for vehicular andlo r pedestrian traffic, as wellas for public im provem ents, public and p rivate utilities, and activities typically foun d in publicrights-of-way. In add ition, all necessary e asem ents for public uses, public facilities, and publicutilities may be retained or erected.

    2. (Sec. 504) O ther Public UsesPark ing, ope n space, public and semipublic uses m ay be interspersed with oth er uses in any area.

    C. (Se c. 505) Other Public. Semi-public, Institutional and No nprof it Use sIn any area the Agency is authorized t o permit the maintenance, establishment o r enlargement ofpublic, sem ipublic, institutional or nonprofit uses, including park and recreatio nal facilities,parkin g facilities, libraries, educational, fratern al, em ployee, philanthropic, and charitableinstitution s, utilities, multi-model transit facilities, and facilities of othe r similar purpo ses,associatio ns o r organizations. All such uses shall conform so far as possible to th e provisions ofthis Plan applicable to the uses in the specific area involved. The Agency m ay im pose such other

    tim e to time. Off-street parking spaces and loading facilities shall be designated to comply withth e County's Zoning Ordinance, as amended from time to time.T h e number of OR-street parking spaces required shall be regulated by the County's ZoningOrdinance, as amended from time t o time. All off-street parking sp aces and loading areas shall bepaved, lighted and landscaped in accordance with the County's Zoning Ordinance, or otherapplicable County regulation, as amended from time to time.

    2. (Sec. 5 08) Existing Nonconforming UsesSubject to the requirements of th e C ounty Zoning Ordinance, existing nonconforming uses mayrema in in an existing building, provided tha t such use is generally compatib le with thedevelopments and uses in the Project Area.

    3. (Sec. 509) RehabilitationT h e Agency is authorized t o rehabilitate and conserve o r cause to be rehabilitated and conserved,buildings and structures in the Project Area. Any existing structu re within the Project Area whicht h e Agency shall approv e for retention and rehab ilitation shall be repa ired, altered, reconstructed,o r rehabilitated in such manner that it will meet th e following requiremen ts: (i) be safe and soundin all physical respects, and (ii) be attractive in appearance and no t detrimen tal to the surround ing

    1. Th e application of certain prov isions of this Plan would result in practicaldifficulties or unnecessary hardsh ips inco nsistent with the g eneral pur pose andintent o f this Plan.

There are exceptional circumstances or conditions applicable t o the property orto t he intended development o f the property which do no t apply generally toother properties having the same standards, restrictions and controls.3. Permitting a variation will no t b e materially detrimental t o th e public welfareor injurious to property or imp rovements in the area.4. Permitting a variation will not be contrary to the objectives of this Plan or ofthe G eneral Plan of the C ounty.

    In perm itting any such variation, the A gency shall impose such conditions as are necessaryto protec t t he public health, safety, and w elfare, and to assure compliance with thepurpo se o f this Plan. Any variation permitted by the Agency hereunder shall not supersedeany other approval required under C ounty cod es and ordinances.14. (Sec. 520) C onsistency with General Plan and Zoning O rdinance

    A.(Sec. 601) Gen eral Description of the Proposed Financing Me thodsUpo n ad option of this Plan by the Board o f Supervisors, the Agency is authorized t ofinance the Project with prope rty tax increments, interest income, Agency bonds, loansfrom p rivate institutions, proce eds from th e sale or lease of property, financial assistancefrom the County, St ate of C alifornia, federal government, or any o ther public agency, orany other legally available source.Th e County may, in accord ance with the law, make advances and expend money asnecessary to assist the A gency in carrying ou t this Project. S uch assistance shall be o nterms established by an ag reement between the Co unty and the Agency.As available, gas tax fun ds from th e S tate of California and the County will be used f or thestree t system. As available, federal loans and gran ts will be used t o finance portions ofProject costs.Th e Agency through itself and through a joint p owers authority in which the Agency may

    paid into, the fund of that taxing Agency. This paragraph shall only apply totaxe s levied to repay bonded indebtedness approved by the voters o f saidtaxing Agency or agencies on or after January 1, 199 0.

    2. That po rtion of tax revenues allocated t o the A gency pursuant t o Section3367 0 which is attributable to increases in the rate of tax imposed fo r thebenefit of any affected taxing Agency w hos e levy occurs after the tax yea r inwhich th e ordinance adopting this Plan becomes effective, shall be alloc ated t osuch affected taxing Agency t o the extent the affected taxing Agency h aselected in the manner required by law t o receive such allocation.3 . Any advanced moneys are hereby irrevocably pledged for the payment of theprincipal of and interest on th e advance of moneys, or making of loans, o r theincurring of any indebtedness (whethe r funded, refunded, assumed, o rotherw ise) by the Agency t o finance or refinance the Project in who le o r inpart.4. Th e Agency is authorized to make such pledges as to specific advances, loans

    and indebtedness as approp riate in carrying out the Project. Taxes shall beallocated and paid to the Agency consistent with the provisions of this Planonly to pay the principal of and interest on loans, moneys advanced to, orindebtedness (whether funded, refunded, assum ed or otherwise) incurred bythe A gency to finance or refinance, in whole o r in part, the Project.

    8. All debt to be repaid with tax increment revenues must be repaid within 45years from the adoption o f this plan.C. (Sec. 603) Other Loans and Grants

    Any o ther loans, grants, guarantees or financial assistance from the Un ited States or anyother public or p rivate so urc e will be utilized if available as appro pria te in carrying out theProject.VII. (Sec. 700) ACTIONS BY THE COUNTYThe County shall aid and co operate with the A gency in carrying out this Plan and shalltake all actions necessary to ensure the continued hlfillment o f the purp oses of this Planand to prevent the recurrence or spread in the area of conditions causing blight. Action bythe County may include, but not be limited to, th e following:

    A. Institution and completion of proceedings for opening, closing , vacating,widening, or changing the gr ade s of streets, alleys, and o the r public rights-of-way, and for other necessary modifications of the streets, th e street layout, andother public rights-of-way in the Project A rea. Such action by th e County shallinclude the requirem ents o f abandonme nt and relocation by t he public utilitycompanies of their operations in public rights-of-way as appro priate to carryout this Plan.

    VIII. (Sec. 800) ADM INISTRATION, ENFORC EMEN T AND AMENDMENT OFTHE PLAN

    A. The administration and enforcement o f this Plan or other documentsimplementing this Plan shall be perfo rmed by the A gency. The Board ofSupervisors of the County constitutes the Agency B oard.B . Th e provisions of this Plan or other docu men ts entered into pursuant to thisPla n may also b e enforced by c our t litigation instituted by either the Agency or

    th e County. Such remedies may include, but are no t limited to, specificperformance, damages, re-entry, injunctions, or any other remedies appropriateto the purpo ses o f this Plan. In addition, any recorded provisions which areexpressly for the benefit of ow ners o f property in the Project Area may beenforced by such owners.C.
