Board Meeting Information for Members of the Public
Public Inspection of Documents In compliance with Government Code 54957.5, agenda-related documents that have been distributed to the Board less than 72 hours prior to the board meeting are available for inspection at the Goleta Union School District, 401 North Fairview Avenue, Goleta.
Public Comment Items not on the action agenda: The public may address the Board on any matter pertaining to the school district that is not on the agenda. Speakers are limited to five (5) minutes. The Board is generally prohibited from discussing items not on the agenda. Under limited circumstances, the Board may discuss and act on items not on the agenda if they involve an emergency affecting safety of persons or property, or a work stoppage, or if the need to act came to the attention of the district too late to be included on the posted agenda.
Items on the agenda: The public may address the Board on any item on the agenda as it is taken up. Unless otherwise determined by the Board, each person is limited to three (3) minutes per item. If a large number wish to speak on a specific item, the Board may limit total input to 30 minutes on any item.
The Board shall not prohibit public criticism of policies, procedures, programs or services of the school district, or the acts or omissions of the Board. Persons appearing before the Board are reminded, as a point of information, that members of the Board are without authority to act independently, as individuals, in official matters. No speaker is granted privilege by the Board to make statements, which may be considered defamatory or otherwise actionable by other persons, including district officers and employees. The Goleta Union School District Board of Trustees has adopted Board Policy 1312.1, Complaint Procedures, for addressing complaints against district employees. Complaints must be processed in accordance with procedures outlined in this policy.
Consent Items All matters listed under Consent are those on which the Board has previously deliberated or which can be classified as routine items of business. An administrative recommendation on each item is contained in the agenda supplements. There will be no separate discussion of these items prior to the time the Board of Education votes on the motion unless members of the Board, staff, or public request specific items to be discussed or pulled from the consent items. To address an item on the Consent Calendar, please follow the procedure described under Hearing of the Public.
Closed Session The Board may meet in Closed Session to consider qualified matters of litigation, employee negotiations, student discipline, employee grievances, personnel qualifications, or real estate negotiations.

Executive Summary: As part of the regular meeting agenda, this item will focus on topics most closely related to the Goleta Union School District’s vision and goals as outlined in the District’s Strategic Plan, Local Control Accountability Plan (LCAP), and other strategically important programs, initiative and documents. Topics that will be covered at the current meeting include:
1. Each year the California Legislature proclaims April as Public School Month. The GUSD School Board has also adopted a resolution designating the week of April 18-22, 2016 as Public School Volunteer Week. Together these two designations provide a yearly opportunity for schools and families to honor and highlight the powerful contributions parents and caregivers provide at school and home to support student success. The Board would like to recognize those parents who have volunteered for six or more years and whose youngest child is now graduating from elementary school.

Budget Development for Fiscal Year 2016-17

Executive Summary:
Discussion continues into the Adopted Budget development process for the 2016-17 fiscal year. The governor has released his fiscal budget proposals for next year, and at this time there are still significant uncertainties with regards to revenues that will limit the ability to make any significant expansions to non-revenue producing programs within the 2016 Adopted Budget process.
The recently negotiated salary increase for District employees will begin to spend down district reserves. Much care is needed over the next year to manage the budget around what could potentially be no growth in property tax revenue due to the impact of the oil pipeline closure.
Some of the areas to discuss that will impact the 2016-17 budget include: 1. Expansion of the District After School Program2. Expansion of the District Preschool Program3. Status of Transitional Kindergarten classes.4. Deferred Maintenance projects5. Fiscal Priorities associated with LCAP goals
Board discretion over certain one-time discretionary funding spending priorities and the use of Educator Effectiveness grant funds will also be important items to address. While we have these amounts in our General Fund Balance reserves there is the potential of more one-time discretionary money in 2016-17 with the amount proposed to be significantly less than what was provided in 2015-16. There is no certainty in receiving this money until the state adopts its budget in June.

Executive Summary:
California Education Code 48010 states: (a) A child shall be admitted to the first grade of an elementary school during the first month of a school year if the child will have his or her sixth birthday on or September 1 of the 2014-15 school year and each school year thereafter. (b) For good cause, the governing board of a school district may permit a child of proper age to be admitted to a class after the first school month of the school term.
Currently there are seven students enrolled in GUSD Kindergarten classes who entered Kindergarten at the age of six. Parents and teachers have requested that the Board of Trustees consider a procedure for considering and allowing children to be parentally placed in Kindergarten at the age of six.
Education Code allows for Kindergarten Continuance when the parents and the District agree that a child who has completed kindergarten would benefit from a second year of kindergarten before matriculation to first grade.
The Board of Trustees will discuss options for considering development of a process for allowing children to begin Kindergarten at the age of six years old.

Executive Summary: After a successful year of program development, the @Afterschool program will move into year two at the start of the 2016-2017 school year. The attached job description is presented here as an alternative to the current Coordinator position. This modification creates a classified program supervisor position in place of the certificated position now in place. With the initial business planning and program creation largely complete, the program supervisor position will allow cost savings while maintaining competitive salary for job responsibilities that are commensurate with other local child care supervision employment opportunities.

Executive Summary: A recent contract settlement in the Santa Barbara Unified School District is expected to yield a change to their school year calendar for 2016-2017. The change would move the student start date for the back from August 24 to August 22, 2016. It would also add a professional development day on November 1, 2016, and another on March 3 or 10, 2017.
A revised calendar that mirrors the new start and end dates for SBUSD is attached for Board consideration. The SBUSD Board is expected to review and approve calendar changes at their meeting on April 12.

WHEREAS, The safety of our children rests in the hands of trained school bus drivers for up to two to three hours each school day, and,
WHEREAS, Great amounts of personal time and energies for bus drivers’ initial training and maintaining current licensing, skills and knowledge of school bus laws through continuing education classes are expended by drivers, and,
WHEREAS, School bus drivers often face hazards in the performance of their duties, and,
WHEREAS, School bus drivers frequently assist students in learning and growing in appropriate interactive peer and adult behaviors through counseling and/or disciplinary techniques, and

Executive Summary: As part of its “United for Literacy” Campaign, United Way of Santa Barbara County (UWSBC) is proposing a Memorandum of Understanding (MOU) that would financially support a three-year districtwide implementation of Lexia Core 5 Reading Instruction Software.
Several schools are currently using this software to support reading instruction and reporting positive results with exceptional student engagement. The software is individualized and provides access to lessons on any computer with browser-based Internet access. Currently, licensing is limited to students most in need of intervention. The proposed MOU would establish a goal of underwriting unlimited three-year school site licenses allowing all district pupils in grades K-3 access to this online learning resource.
The MOU has previously been presented for information and discussion including the terms of the agreement has resulted in proposed changes, which are included as comment on the draft MOU included here. Board approval will allow finalization of the MOU, which will be presented as information upon completion of revisions and specific terms.

MEMORANDUM of UNDERSTANDING Updated: February 11, 2016
This Memorandum of Understanding (MOU) establishes the working relationship between
United Way of Santa Barbara County (UWSBC) and Goleta Union School District (GUSD)
regarding the implementation of the GUSD Literacy Partnership. United Way is committed to
collaborative partnerships which will maximize our efforts in realizing the Community’s Goals of
increasing the percentage of students reading at or above grade level by 50% and to increase
by 50% on time high school graduation rates. The GUSD Literacy Partnership is a 3-year
collaborative between UWSBC and GUSD which would allow for every school within the district
the use of Lexia Core 5, ensuring that every eligible child will receive unlimited access to the
program.
A. Fundraising Campaign:
1. GUSD will work in collaboration with UWSBC in the fundraising efforts for the GUSD Literacy
Partnership
2. UWSBC will recruit and manage the fundraising leadership team.
3. The initial fundraising phase will begin in March 2016 through August 2016 with a goal of raising
$200,000 for the GUSD Literacy Partnership.
a. If the $200,000 goal has not been achieved by August 2016, a second phase will begin
and continue until $200,000 has been pledged and confirmed.
4. UWSBC staff, GUSD Superintendent and GUSD administrators will make themselves available to
meet with donors and speak at fundraising events.
5. GUSD will provide UWSBC with access to Lexia data from all participating schools, allowing data to
be shared with donors to support fundraising efforts.
6. GUSD will facilitate tours for current and prospective donors as needed.
7. GUSD will commit $________________to the GUSD Literacy Partnership.
8. UWSBC will commit $______________ to the fundraising of the GUSD Literacy Partnership.
9. GUSD will allow for naming opportunities for major donors at the school sites.

4. Assist school administration in the online enrollment process as necessary for all students.
5. Assist in fundraising for UFL activities as appropriate.
6. Maintain ongoing communication with all partners.
7. Maintain accurate partner information in UFL publications and on the website.
8. Provide UFL graphic images to use in the partners’ publications and on the partner’s website.
9. Serve as a clearinghouse for information and resources.
10. Maintain confidentiality and security of all student, administrator and parent information at all
times.
E. Co-Marketing agreements:
1. GUSD will assist UWSBC in advocacy efforts to support literacy initiatives.
2. GUSD will allow UWSBC to list your organization’s name as a Partner in UFL publications,
marketing materials and on the website.
3. GUSD will share relevant information with UWSBC (success stories, funding opportunities, contact
info, etc.)
4. GUSD will display the UWSBC’s and UFL logo and name at physical facilities housing or promoting
programs.
5. GUSD will identify organization as a "UFL Partnership Site” in printed materials, news releases, etc.
6. GUSD will include a thank you and acknowledgement for UWSBC and UFL support
and/or funding in any literacy-related efforts that the organization may undertake.
7. GUSD provide UWSBC’s “model release” forms to all families for the use of images in UWSBC
marketing materials making sure UWSBC received all signed copies.
F. Terms:
1. The term of this agreement shall commence on the date signed below.
2. During the term of this agreement, each party will protect, defend, indemnify and hold harmless
the other party and its agents, officers and employees from all claims and suits including court
costs, attorney fees and other expenses, caused by any act or omission of either party and/or its
subcontractors, agents and employees.

Executive Summary: The District’s current contract for automated phone, text, and email alerts is expiring at the end of this year. Service with the current vendor, which was purchased by a larger company last year, has been less than satisfactory. ParentSquare, Inc. has implemented a new “Smart Alert” functionality equivalent to that of our current vendor within its other online parent communication functionality. The attached contract offers the addition of automated notifications at a cost commensurate with our current vendor and integrates two integral systems of parent communication under one program. Note that the contract approval will include a 3-month implementation window at no cost to the District and that this agreement will reduce costs to individual schools for the currently implemented portions of ParentSquare from $2.00 to $1.50 per student.

ParentSquare Multi-Year Service Agreement

OBLIGATION
The School warrants that a) it will use best efforts in providing complete and accurate recipient data b) it has met all contractual, regulatory, and legal requirements in providing, and using, the recipient data, including, but not limited to, obtaining necessary consent to send texts and voice messages (if applicable) to the recipient. If the recipient incurs additional charges for receiving notifications, such as text message fees or data fees, then additional charges are payable by the recipient or School c) it will fully cooperate during the implementation process.
TERMS AND TERMINATION
This Agreement’s Term will commence on ___________________ (“Term Start Date”) and it will end on ________________ (“Anniversary Date”). Thereafter, the Agreement will automatically renew for one-year, each year, unless contract is renegotiated or either party provides written notice of non-renewal at least 30 days prior to the end of the then-current Term. The conditions of a Renewal Term shall be the then-existing ParentSquare standard terms, rates and charges.
ON-BOARDING FEE AND SUBSCRIPTION FEES

In no event shall ParentSquare be liable to the School or any third party for any injury, loss, claim, damages, or any special, incidental, consequential, exemplary or punitive damages of any kind. The School agrees that ParentSquare Service is not intended or designed for use in high-risk activities, or in any situation where failure of delivery or performance or any error in ParentSquare could lead to death, damage to property, personal injury, or where other damages could result if an error occurred.

Executive Summary: Terms of an amendment to the Superintendent’s contract were discussed in closed session after the regular meeting of the Board of Trustees on March 16, 2016. The terms outlined at that time are presented here for approval.
Terms of the attached amendment include a salary adjustment, adjustments to annual vacation accrual, and a one-year extension of the contract term through June 30, 2018. In addition the amendment includes new “termination without cause” language that is legally required for any Superintendent employment agreement signed after January 1, 2016.

TheGoletaUnionSchoolDistrict(“District”)andSuperintendentWilliamBanning(“Superintendent”)agreetoamendtheoriginalEmploymentAgreementbetweentheDistrictandSuperintendent.
A. TheSuperintendent’semploymentrelationshipwiththeDistrictisgovernedbyanEmploymentAgreementdatedJune13,2012.
B. TherehavebeenamendmentstotheEmploymentAgreementdatedSeptember19,2012,June26,2013,May24,2014,andSeptember17,2014.
C. TheSuperintendenthasreceivedasatisfactoryevaluationforthe2014-2015schoolyear.
1. Recitals.Therecitalssetforthabovearetrueandcorrect.
2. Term.TheSuperintendentisherebyemployedforathree(3)yeartermfromJuly1,2015untilJune30,2018,unlessterminatedearlierorextendedasprovidedbythetermsoftheEmploymentAgreementorasrequiredbylaw.
3. Salary.ForandinconsiderationoftheservicesrenderedbySuperintendent,Superintendentshallreceivethefollowingcompensation:
a. 2015-2016.EffectiveJuly1,2015,forthe2015-2016schoolyear,theSuperintendent’sannualsalary,exclusiveofanydeferredcompensationorotherbenefits,shallbeonehundredeightyninethousand,sevenhundredthirteendollars($189,713.00).
7. Vacation.The Superintendent shall, during the term of this Agreement, earn and accruetwenty-five (25) days of vacation leave with pay per year. Utilization of accrued vacationleave shall be subject to approval of the Board. The Superintendent shall annually beallowed to convert up to two days of accrued vacation to payment equivalent to thecurrent daily rate of salary. The Superintendent shall not accrue more than forty (40) daysof vacation. If earned and accumulated vacation days reach a total of forty (40), furtheraccrual of vacation will cease until accumulated vacation is used and at that time vacationaccrual commences. In the event of the termination or expiration of this Agreement forany reason, the Superintendent shall be entitled to compensation for no more than forty(40) days of accrued and unused vacation leave at the Superintendent’s then current dailyrate of salary.
19. Termination.
e. TerminationWithoutCause.TheBoardmay,foranyreason,withoutcauseorahearing,terminatethisAgreementatanytime.Inconsiderationforthe

exerciseofthisright,theDistrictshallpaytoSuperintendentfromthedateofterminationuntiltheexpirationofthisAgreement,orforaperiodoftwelve(12)months,whicheverisless,theSuperintendent’ssalaryattherateineffectduringtheSuperintendent’slastmonthofservice.
ForpurposesofthisAgreement,theterm“salary”shallincludeonlytheSuperintendent’sregularmonthlybasesalaryandshallnotincludethevalueofanyotherstipends,reimbursementsorbenefitsreceivedunderthisAgreement.Allpaymentsmadepursuanttothisterminationwithoutcauseprovisionshallbesubjecttoapplicablepayrolldeductionsandshallbetreatedascompensationforstateandfederaltaxpurposes.Nopaymentsmadepursuanttothisterminationwithoutcauseprovisionshallconstitutecreditableserviceorcreditablecompensationforretirementpurposes,butinsteadshallbeconsideredasfinalsettlementpay.Therefore,paymentsmadepursuanttothisterminationwithoutcauseprovisionshallnotcountforretirementpurposesandnodeductionsshallbemadeforretirementpurposes.
IfthisAgreementisterminatedwithoutcause,theSuperintendentshallbeentitledtotheDistrictcontributiontowardhealthbenefitsassetforthinparagraph4oftheEmploymentAgreementuntiltheexpirationofthisAgreement,orforaperiodoftwelve(12)months,whicheverisless.NothinginthisprovisionshallpreventtheSuperintendentfromelectingtoresignandretirepriortobeingreleasedwithoutcause.IftheSuperintendentresignsandretires,thepartiesagreethatthisterminationwithoutcauseprovisiondoesnotapplyandtheSuperintendentwouldnotbeentitledtothesalarypaymentsorhealthbenefitssetforthinthisprovision.
ThepartiesagreethatanydamagestotheSuperintendentthatmayresultfromtheBoard’searlyterminationofthisAgreementcannotbereadilyascertained.Accordingly,thepartiesagreethatthepaymentsmadepursuanttothisterminationwithoutcauseprovisionconstitutereasonableliquidateddamagesfortheSuperintendent,fullycompensatetheSuperintendentforalltort,contractandotherdamagesofanynaturewhatsoever,anddonotresultinapenalty.ThepartiesagreethattheDistrict’scompletionofitsobligationsunderthisprovisionconstitutestheSuperintendent’ssoleremedytothefullestextentprovidedbylaw.Finally,thepartiesagreethatthisprovisionmeetstherequirementsgoverningmaximumcashsettlementsassetforthinGovernmentCodesections53260,etseq.
AllothertermsandconditionscontainedwithintheoriginalEmploymentAgreement(datedJune13,2012)andthosecontainedwithinotherarticlesamendedonSeptember19,2012,June26,2013,May21,2014,andSeptember17,2014shallremainunchanged,andinfullforceandeffect.
