NERR Continued to provide the SONDE in Little Bay. As costs have increased significantly a new arrangement is being discussed which will eliminate real time data reporting but will capture data for use in future studies.

Developed Lawn Care Certification Program.

Establish a Certification Program for companies engaged in lawn care,

landscaping and tree trimming which will reduce the amount of unwanted

material migrating to our bays.

Continue the monitoring program to measure nutrient and other materials

flowing in Tule Creek and other watersheds as may be deemed appropriate

by City Council.

Perform an enhanced monitoring program before and after completion of

the planned modifications of the Sewer Treatment Plant to determine the

effectiveness of the modifications.

Continue and improve the Outreach Program established in 2010-2011.

Continue to monitor the Texas Beach Watch results.

Continue to participate in the development of City ordinances and

AGENDA ITEM “B” Update, presentation and general discussion of Aransas County Juvenile Case Management Program Report for 2010-2011 School Year. SUBMITTED BY: City Secretary Irma Parker Finance Director Jacky Cockerham FISCAL ANALYSIS: APPROVED FOR INCLUSION ON AGENDA: STATEMENT: A request was made to the City by Aransas County in 2008 to assist with the funding of a Juvenile Case Manager. A juvenile case manager primarily works with at-risk youths and their families. These children have mostly committed misdemeanors such as vandalism, truancy or alcohol consumption. However, more serious and violent offenders also go through a juvenile case manager's case load. In reviewing the Interlocal Agreement at the August 16, 2011 Meeting, the City Council requested a report on the effectiveness of this program. BACKGROUND: The goal of the juvenile case manager is long-term rehabilitation of at-risk youth. A juvenile case manager works to assure the judge and the judicial system that juveniles are working in compliance with their court orders. In Aransas County, the juvenile case manager is an employee of the County.

FISCAL ANALYSIS: The City Council adopted Ordinance No. 1507 in July 2010 which created and authorized a $5.00 court fee to be assessed on every individual convicted of a fine-only misdemeanor offense in municipal court. The $5.00 fee is placed in a municipal court juvenile case manager fund trust account to be administered by the city's finance department. The funds may be expended only for the salaries and benefits of juvenile case managers employed by the county whose work primarily relates to city municipal court school attendance cases involving either children or parents. The municipal court judge is authorized to waive the juvenile case manager fund court cost in cases of financial hardship.

SUBMITTED BY: City Secretary Irma Parker Finance Director Jacky Cockerham FISCAL ANALYSIS: APPROVED FOR INCLUSION ON AGENDA: SUMMARY STATEMENT: The City of Rockport’s Code of Ordinances, Chapter 18 was updated in 2000. An Animal Control Ordinance Committee was established to develop a policy for the City. Members of the Committee were citizens of the City, members of the Humane Society, Animal Control employees, and Police Department. BACKGROUND: During budget workshop, Council Member Lippke inquired about city license fees for all dogs and cats in the City of Rockport and asked that this ordinance be reviewed. In addition, during meetings with Aransas County for approval of the Animal Control Interlocal Agreement a request was made for all entities to charge the same impoundment fees - a flat $35.00. Staff is seeking direction from Council. 1. Section 18-29 – Licensing & registration. Licensing of kennels, breeders, and animal

fanciers was needed to identify those facilities and insure that these facilities met all state health and safety codes. In addition, the registration of livestock section was established to control a facility adjacent to the Country Club where livestock were being kept. [Delete both sections?]

Sec. 18-29 – Licensing and registration.

(a) Licensing required for all dogs and cats.

(1) No person shall own, keep or harbor any dog or cat over the age of four months within the city limits unless such dog or cat is licensed as provided in this section. Written application for such license shall be made to the municipal court or such agents of the animal control department as shall be designated by the city, and shall state the name and address of the owner and the name, breed, color, age and sex of the dog or cat and shall be accompanied by a current rabies certificate issued by a licensed veterinarian or anti-rabies clinic. The license fee shall be paid at the time of making application; a numbered receipt given to the applicant and a numbered metallic tag shall be issued to the owner.

(2) The yearly fee shall be $5.00 for each dog or each cat over the age of four

months. The fee shall be $2.00 for spayed and neutered animals. Note: If veterinarians are allowed to provide city license tags within their facilities, they shall retain $1.00 from each licensing transaction.

(3) Every person, group of person or corporation affiliated with any place of

business at which more than four dogs and/or cats, more than four months of age, are kept for the sale breeding, boarding, training, or other commercial purposes to include, but not limited to, retail or wholesale trade, shall pay an annual permit fee of $100.00 dollars. a. Every person, owning, keeping, or harboring more than four dogs

and/or cats, more than four months old, shall pay an annual animal fancier permit fee of $25.00, and in addition shall pay a license fee for each individual dog and/or cat as provided in subsection (2) above.

(4) All dog or cat licenses and kennel licenses shall be issued for one calendar

year and renewed each January. If a metallic license tag issued for a dog or cat shall be lost, the owner may obtain a replacement tag upon the payment of $1.00.

(5) If there is a change in ownership of a dog or cat or kennel during the

license year, the new owner may have the current license transferred to his name upon the payment of a transfer fee of $1.00.

(6) No person shall use for any dog or cat a license receipt of license tag

issued for another dog or cat.

(b) Registration of livestock and their habitat required. All pastures, feed lots, or other facilities where livestock is kept as well as all livestock kept in the city limits are required to be registered. Written application for such registration shall be made to the city or such agents of the animal control department as shall be designated by the city, and shall state name, address and notification telephone number of the landowner and description of the exact legal location of the facility to be registered as well as all livestock kept at the facility and shall include color, breed, identification markings, (tattoos, brands, ear tags), and sex (altered/unaltered) of livestock. The registration fee shall be paid at the time of making application; a numbered receipt given to the applicant and a numbered metallic tag shall be issued to the owner. (1) [There shall be a] Registration fee of $20.00 per facility per year to be

renewed each January. (2) The city or such agents of the animal control department prior to issuance

of registration must inspect all livestock. (3) Any person, firm or corporation violating any portion of this section shall

Sec. 18-30. - Issuance, wearing of tag and collar.

(a) Upon complying with the provisions of section 18-29, there shall be issued to the owner a numbered metallic tag stamped with the number and the year for which issued. The shape or design of the tag shall be changed from year to year.

(b) Every owner is required to see that the tag is securely fastened to a dog's choke

chain, collar or harness, which must be worn by the dog at all times. Cats shall not be required to wear tags, but the owner shall keep such tag with the written license.

Sec. 18-31. - Unauthorized removal of collar or tag.

It shall be unlawful for any person, other than the owner or keeper of a dog, to remove the collar or license tag attached to such dog as required by this article.

Sec. 18-33. - Impoundment.

(a) Unlicensed dogs or cats found running at-large shall be taken up by the agents of the animal control department and impounded in the shelter designated as the city animal shelter, and there confined in a humane manner for a period of not less than four days, and may thereafter be disposed of in a humane manner if not claimed by their owner. Dangerous animals shall be confined in a humane manner for a period of not less than three days. Dogs and cats not claimed by their owners shall become the property of the animal control department and be disposed of at the discretion of the department, except as provided in the cases of certain dogs and cats. In calculating the length of this time period, the day of impoundment shall not be considered day one. (b) The animal control department may transfer title of all animals held by its animal shelter to the Humane Society after the legal detention period has expired and the animal has not been claimed by its owner. In the event of such transfer of title, it is expressly understood that the Humane Society shall pay for each animals' food until it shall be removed from the animal shelter. (c) When dogs are found running at-large and their ownership is known to the agents of the animal control department, such dogs need not be impounded; but the agent may, at his discretion, cite the owner of the dog to appear in court to answer to charges of violation of this article. (d) Immediately upon impounding dogs or other animals, the agents of the animal control department shall make every reasonable effort to notify the owners of such dogs or other animals so impounded, and inform the owners of the conditions whereby they may regain custody of the animals. (e) No unspayed or unneutered dog or cat which has been impounded by reason of its being a stray shall be allowed to be adopted from the animal shelter unless the prospective owner shall agree to have such animal spayed or neutered, or the Humane Society agrees to do so.

Sec. 18-34. - Redemption of impounded animals.

(a) The owner shall be entitled to resume possession of any impounded dog or cat, except as provided in the cases of certain dogs, upon compliance with the license provisions in section 18-29 and the payment of impoundment fees set forth in this article. (b) Any other animal impounded under the provisions of this article may be reclaimed by the owner upon the payment of impoundment fees set forth in this article. (c) Any animal not reclaimed by its owner, other than dangerous or wild animals, may be humanely euthanized by the animal control department after being impounded for four days, after a reasonable effort has been made to identify and notify the owner of such dogs or other animals impounded and inform such owners of the conditions whereby they may regain custody of such animals, or placed in the custody of some person deemed to be a responsible and suitable owner who will agree to comply with the provisions of this article and such other regulations as shall be fixed by the animal control department. Provided, if the animal is one as to which the respective rights of the owner and the person in possession or custody are determined by state law, such law shall be complied with. In calculating the length of this time period, the day of impoundment shall not be considered day one.

Sec. 18-35. - Impoundment fees.

(a) Impoundment fees shall be $35.00 as follows:

If the impounded animal is bearing a valid city registration tag, the first impoundment fee will be waived. If proof of surgical sterilization is provided within 15 days from the date an animal is registered, the difference in impoundment and other fees between a sterilized and an unsterilized dog or cat will be refunded. Dogs or cats under the age of six months shall be charged the sterilized dog or sterilized cat impoundment fee. Animals may be exempted from sterilization upon written recommendation from a licensed veterinarian that such alternatives would be harmful or dangerous to the animals. Owners of such animals shall be charged the lower impoundment fees for sterilized animals.

Animals not listed above shall be disposed of at the discretion of the animal control officer.

(b) Daily handling fees: a daily handling fee shall be charged for every day or fraction thereof, that an animal is at the animal shelter. Daily handling fees shall be as follows:

(c) Quarantine fee: The owner of a dog, cat or ferret held in quarantine for observation purposes shall be charged $10.00 dollars for every day or fraction of a day the animal is at the animal shelter.
