आवण ज्याअथी, महाराष्ट्र शासनाच्या शासन वनणवय, वदनांक 25/2/2004 अन्र्ये वनवचचत केलेल्या िोरणानुसार पर्न ऊजा प्रकल्पासाठी स्थळे वनवचचत करण्याचे ठरवर्ण्यात आले र् 2007 पयंत पर्न ऊजेद्वारे 750 मे.रॅ्. ऊजा वनर्ममती करण्यात यार्ी असे ठरवर्ण्यात आले आवण राज्यातील वर्जेच्या मागणीतील कमतरता दूर करण्यासाठी खाजगी वर्कासकांना सौर तसेच पर्न ऊजेद्वारे अपारंपावरक ऊजा वनर्ममतीचे प्रकल्प उभारण्यास अनुमती देण्यात आली. यायाअनुगंगाने मे.पनामा वर्ड एनजी प्रा.वल., पुणे यांच्याकडून सातारा वजल्हयामध्ये पर्न ऊजा प्रकल्प वर्कवसत करण्याचा प्रस्तार् प्राप्त झाला वक ज्या

अन्र्ये वनमाण झालेली र्ीज सर्वसािारण जनतेच्या उपयोगासाठी महाराष्ट्र राज्याच्या ऊजा ग्रीडमध्ये देण्यात येणार आहे. म्हणजेच हा प्रकल्प एक जनवहताथव प्रकल्प असून, भारत सरकारच्या र्न (संर्िवन) अविवनयम,1980 च्या मागवदशवक सूचनानुसार हा प्रकल्प स्थळ वर्र्वक्षत (site specific) आहे, तसेच या पर्न ऊजा प्रकल्प उभारणीसाठी पयायी र्नेत्तर जवमन उपलब्ि नसल्याची बाब वर्चारात घेण्यात आली.

आवण ज्याअथी, महाराष्ट्र शासनाने या प्रस्तार्ाची काळजीपूर्वक छाननी केल्यानंतर र्न (संर्िवन) अविवनयम, 1980 च्या कलम-2 अन्र्ये 19.61 हेक्टर र्नजवमन र्ळती करण्याची भारत सरकारला वशफारस केली आहे.

आवण ज्याअथी, भारत सरकारने या प्रस्तार्ार्र नीट वर्चार कन,न, राज्य शासनाने र्न (संर्िवन), अविवनयम, 1980 च्या कलम-2 खाली सादर केलेल्या प्रस्तार्ास र्रील अ.क्र.-3 अन्र्ये तयार्त: मंजुरी वदलेली असून, ही मंजुरी भारत सरकारच्या वदनांक 20/06/2013 च्या पत्रात नमुद केलेल्या अटींची पूतवता प्रकल्प यंत्रणा करेल याच्या अिीन राहून प्रदान केली आहे.

आवण ज्याअथी, प्रिान मुख्य र्नसंरक्षक (र्नबल प्रमुख), महाराष्ट्र राज्य, नागपूर यांनी यायांच्या र्रील अ.क्र.-4 येथील पत्रान्र्ये अटी पूतवता अहर्ाल अवतवरक्त प्रिान मुख्य र्नसंरक्षक (कें द्रीय), के्षवत्रय कायालय, पयार्रण र् र्न मंत्रालय, भारत सरकार, भोपाळ यांना सादर केला होता.

आवण ज्याअथी, के्षवत्रय मुख्य र्नसंरक्षक, प्रादेवशक कायालय, पयार्रण र् र्न मंत्रालय, भारत सरकार, भोपाळ यांनी सातारा वजल्हयातील 19.61 हेक्टर इतकी र्नजवमन उपरोक्त प्रकल्पासाठी काही अटींसह र्रील अ.क्र.-5 येथील पत्रान्र्ये र्ळती करण्यास अंवतम मान्यता वदली आहे.

म्हणून आता महाराष्ट्र शासन याद्वारे असे वनदेश देत आहे की, प्रकल्प प्राविकरण म्हणजेच मे.पनामा वर्ड एनजी प्रा.वल., पुणे यांना पर्न ऊजा प्रकल्प उभारणीसाठी प्रिान मुख्य र्नसंरक्षक (र्नबल प्रमुख), महाराष्ट्र राज्य, नागपूर यांच्या पत्रासह जोडलेल्या प्रकल्प प्रस्तार्ात अविक तपवशलात नमुद केलेले आवण खाली वदलेल्या अनुसूचीमध्ये नमूद केलेली, ज्यामध्ये, राखीर् र्नजवमन समावर्ष्ट्ट आहे, अशी एकूण 19.61 हेक्टर र्नजवमन या प्रस्तार्ासाठी र्ळती करण्यात यार्ी. हे र्ळतीकरण भारत सरकारच्या वदनांक 05/03/2014 च्या पत्रातील अटी र् शतीच्या पूतवतेच्या अिीन राहून तसेच खालील अटींच्या पूतवतेनंतर पूणव करण्यात यार्े.

1) र्नजवमनीचा र्ैिावनक दजा बदलणार नाही. 2) सदरची मंजुरी ही र्न(संर्िवन) अविवनयम, 1980 अंतगवत 30 र्गासाठी असेल. 3) र्र नमुद केलेल्या भारत सरकारच्या तयार्त: मान्यता र् अंवतम मान्यतेच्या पत्रातील वर्वहत

केलेल्या सर्व अटींचे प्रकल्प यंत्रणा अनुपालन करेल. प्रकल्प यंत्रणा सर्व अटींचे तंतोतंत अनुपालन करेल याची मुख्य र्नसंरक्षक (प्रा), कोल्हापूर हे खात्री करतील. मुख्य र्नसंरक्षक (प्रा), कोल्हापूर याबाबतचा अहर्ाल र्ेळोर्ेळी अपर प्रिान मुख्य र्नसंरक्षक तथा कें द्रस्थ अविकारी, महाराष्ट्र राज्य, नागपूर यांना सादर करतील.

4) र्न (संर्िवन) अविवनयम, 1980 र् यायाअंतगवत केलेले वनयम आवण मागवदशवक सूचना र् या आदेशातील अटींपैकी कोणयायाही अटींचे अनुपालन न करणे हे र्न (संर्िवन), 1980 चा भंग ठरेल आवण यायाप्रमाणे याबाबत र्ैिावनक कारर्ाई करण्यात येईल.

Order :-

Whereas Principal Chief Conservator of Forests (Head of Forest Force) Maharashtra State, Nagpur vide his letter referred at sr. no. 1 above, has submitted a proposal to the State Government that has been received from M/s Panama Wind Energy Private Ltd., Pune for diversion of 19.61 ha. of forest land in Satara District of Maharashtra for installation of wind

power project.

AND whereas, as per the policy of Maharashtra State Government G.R.dated 25/2/2004 by which it was resolved to identify sites of wind power generation and 750 M.W. of wind project be commissioned by the year 2007 and for this private operators have been allowed to generate power through renewable energy sources like solar and wind power to cater the shortfall of overall power demand in the State. As such M/s Panama Wind Energy

Private Ltd., Pune has proposed to develop a wind power project in Satara District that will evacuate

the generated power to the Maharashtra State Grid which will be for the benefit of the general public of the State. Hence it is, in other words, a project of public importance and as per Government of India, Forest (Conservation) Act, 1980 guidelines the project is site specific and in non availability of alternative non forest land for wind power project was considered.

AND whereas, Government of Maharashtra after careful scrutiny and consideration has recommended it to the Government of India to divert the 19.61 ha. of forest land for the above project under section 2 of Forest (Conservation) Act, 1980.

AND whereas, Government of India after due consideration, granted in-principle approval to above proposal submitted by Government of Maharashtra for diversion of forest land under section 2 of Forest (Conservation) Act, 1980, vide its letter referred at sr. no. 3 above. Government of India accorded approval subject to fulfillment of certain conditions mentioned in its letter dated 20/06/2013, by the User Agency.

AND whereas, Principal Chief Conservator of Forests (Head of Forest Force) Maharashtra State, Nagpur vide letter referred at sr. no. 4 above, has submitted compliance of those conditions to the Additional Principal Chief Conservator of Forests (Central), Regional Office, Government of India, Bhopal.

AND whereas Chief Conservator of Forests, Regional Office, Ministry of Environment & Forests, Government of India, Bhopal accorded formal approval under section 2 of forest (Conservation) Act, 1980, for the diversion of 19.61 ha. of forest land in Satara District of Maharashtra for the purpose of installation of wind power project with certain conditions, vide its letter referred at sr. no. 5 above.

NOW, therefore, Government of Maharashtra hereby directs that the forest land area of 19.61 ha. consisting of Reserved Forest, more specifically described in the proposal submitted vide letter mentioned at sr. no.-1 here in above from Principal Chief Conservator of Forests (Head of Forest Force), Maharashtra State, Nagpur and as per details given in the Schedule given below, be diverted to the User Agency, i. e. M/s Panama Wind Energy Private

Ltd., Pune for installation of wind power project. The diversion shall be effected subject to the compliance of terms and conditions mentioned in the letter dated 05/03/2014 of Government of India. This approval for diversion of forest land is also subject to compliance of following conditions by the User Agency-

1. Legal status of the forest land shall remain unchanged.

2. This approval under Forest (Conservation) Act, 1980 shall initially be for a period of 30 years.

3. The User Agency shall comply with all the conditions stipulated in the in-principle and final approval letters of Government of India, referred above. The Chief Conservator of Forest (Territorial), Kolhapur shall ensure the strict compliance of the conditions by the User Agency. CCF will furnish the report in this regard to Additional Principal Chief Conservator of Forests and Nodal Officer, Maharashtra State, Nagpur from time to time.

4. Non compliance of any of the conditions mentioned in this order and Rules and Guidelines made / issued under Forest (Conservator) Act, 1980, shall amount to violation of Forest (Conservator) Act, 1980 and action would be taken accordingly.

5. In case of non-compliance of any of the above conditions, the concerned Divisional Forest Officer shall report through the State Govt. to Regional Chief Conservator of Forests, Government of India, Ministry of Environment & Forests, Bhopal as per procedure laid sown in the clause 1.9 of guidelines on 25/10/1992 under the Forest (Conservation) Act, 1980.
