PCOT works with any Insurors member, without a contract and premi- um volume commitment, allowing even the smallest agency the ability to provide work comp solutions for their clients. Feds Still Discussing Work Comp OversightA recent report from the U.S. Depart-ment of Labor (DOL) criticizes state workers compensation systems and sug-gests increased federal oversight may be necessary. The Big “I” opposes federal regulation of insurance, including fed-eral regulation of state workers' compen-sation systems.

The report contends that state work-ers compensation systems are failing to provide workers with adequate benefits. It further suggests a race to the bottom in state laws, citing recent legislative ef-forts in some states to restrict workers compensation benefits, including Opt-Out bills in Tennessee and South Caro-lina – neither of which were passed.

While the report suggests considering in-creased federal oversight, it does not out-line specific plans. However, Sen. Sher-rod Brown (D-Ohio) told NPR that he will work with his colleagues on legislative options, such as possible minimum stan-dards for work comp systems, to address the DOL’s findings in the next Congress. Dept. Bulletin on GLBA Annual Privacy NoticesLast month, the Tennessee Department of Commerce and Insurance released a Bul-letin clarifying their views on the changes to the Gramm-Leach-Bliley Act (GLBA) which eliminated the need for annual pri-vacy notices with certain exceptions.

It is the Department's opinion that licens-ees of the Department are subject to the GLBA do not need to provide annual pri-vacy notices, unless they:

• Provide information to third parties not in accordance with TN Regula-tions, or

• Change their policies and practices regarding releasing personal info.
