VACo staff comments on

As part of the ongoing effort tostrengthen state oversight of alternativeonsite sewage systems, VACo staffrecommended 10 specific changes tostrengthen the proposed final AOSSregulations in a Jan. 10, 2011 letter tothe Virginia Department of Health.

This was done during the publiccomment period for those regulationsthat began on Dec. 6 and closes Feb. 4.

The proposed regulations, whichwere published in the edition of TheVirginia Register (Vol. 27, Issue 7),signal the end of a comprehensiverewrite of the Commonwealth's rulesgoverning these alternative systems thatbegan in 2009.

The Virginia General Assembly has issued a joint resolution commending the Virginia Certified CountySupervisor Program--an endeavor of the Virginia Associationof Counties (VACo) in partnership with Virginia CooperativeExtension. The resolution also encouraged all county supervi-sors in Virginia to participate in the 18-month training pro-gram to enhance their leadership and decision-making skills.

"We are thankful that the Virginia Senate and House ofDelegates has recognized how the Virginia Association ofCounties and Virginia Cooperative Extension have workedtogether to bolster community viability efforts and provideleadership education to Virginia's local leaders," said BrianCalhoun, associate director of community viability forExtension.

In 2005, Virginia Cooperative Extension developed thecurriculum for the County Supervisor Certification Programfollowing requests by VACo members for more in-depthknowledge about local government operations. So far, fiveclasses have completed the program.

"After six years, the program continues to be popularamong supervisors," said James D. Campbell, executive director of VACo. "I've been told several times that earning acertification is somewhat like earning a master's degree.Supervisors have commented that the course work is just aschallenging and the completion of the program is just asrewarding. I'm proud that VACo and the Virginia CooperativeExtension have been able to grow the program into somethingspecial."

The certification program provides an overview of thebasic issues, expectations, and practices associated with serving as a county supervisor, as well as detailed informationabout local government. Both Extension staff members andcontracted personnel provide the training.

Each participant completes five core courses featuringboth classroom instruction and self-directed learning on

leadership development, duties and responsibilities of publicofficials, community planning, local government finance, andcollaborative governance. Participants also select three elective courses on topics such as conflict resolution and dispute management, team building, technology in local gov-ernment, decision-making, and intergovernmental relations.

Extension's community viability program also providesleadership development opportunities for local leadersthrough the Innovative Leadership: Building CommunityConnections program, which encourages participants tobuild leadership skills, increase awareness of communityissues, network with other leaders, and become moreengaged in community, civic, and governmental activities.There are no requirements for participants to hold electedoffice, and the program is flexible enough to meet community and participant needs.

Virginia is updating its RuralTransportation Consultation Processesdocument. Rural local officials whohave transportation planning interestsmust submit their review and commentson the draft document no later thanMarch 25.

Once every five years, state depart-ments of transportation are federallyrequired to formally review and solicitcomments on the effectiveness of thestatewide rural transportation consultation process and any proposedchanges for improving the process.

We're happy to report that we'veenjoyed some key early successes, likewhen VACo sent out a Capitol ContactALERT! detailing our opposition to SB1277 (Obenshain). You took action andthe senator eventually removed hisproblematic bill from the docket of theSenate Health Care Subcommittee. Hedid this in part because members of thesubcommittee were inundated with callsand e-mails from VACo membersexpressing opposition.

To this and other similar situations,we thank you for being a part of thelegislative process. By responding quick-ly and effectively to our Capitol ContactALERTS!, your voices of support oropposition do make a difference.

There's another sticky bill that we'd

like to address. As many of you know,VACo strongly opposes HB 1588(Iaquinto). This bill would shift the burden of proof in real estate tax assess-ments from a citizen or corporation tothe local government, creating a danger-ous and costly precedent. The valuationprocess used by local government asses-sors is developed through well docu-mented, market-based methods whichare completely open to the taxpayerupon request. In fact, taxpayer access toassessment information was strength-ened just last year in the 2010 Session.

If you aren't aware of this bill,please read VACo's talking points onHB 1588.

We want to thank the more than 20counties that have contributed funds insupport of consultants specially hired tofight this bad bill. Your assistance ismuch appreciated. We're hopeful morecounties will join the fight and

contribute to the process.Again, we thank you for making

Comments sought on the draft 2011 RuralTransportation Consultation Processes

with non-metropolitan local officials inthe Virginia Department ofTransportation (VDOT) andDepartment of Rail and PublicTransportation (DRPT) planning andprogramming of highway, transit, andpassenger rail improvements in statelong range transportation plans andshort range transportation programs.

Proposed revisions include, but arenot limited to, discussion on:

• Virginia's transportation oversightboards and agencies, including theCommonwealth Transportation Board,VDOT and DRPT

• The development of the Six YearImprovement Program (SYIP), includ-ing specific roles for rural transportationofficials in developing urban, secondary,and/or specialized VDOT programs

• The DRPT coordination with theSYIP, including DRPT's coordinatedhuman service mobility plans andOnline Grant Administration system

• The Rural TransportationPlanning Program, and the development of Regional Long RangePlans, including Transit DevelopmentPlans, in Planning DistrictCommissions with rural areas

Bear Creek Lake State Park islocated less than an hour west ofRichmond and nestled in the heart ofCumberland State Forest. It is the perfect getaway for the outdoor enthusiast.

The 29th annual edition of this important reference book contains detailedinformation on tax rates and fees in all of Virginia's 95 counties and 39 cities. Also,there is information for all of the state's 36 large towns and for 113 of the remaining 154 smaller towns.

The study is based on a comprehensive survey conducted by the Center forEconomic and Policy Studies at UVA's Weldon Cooper Center for Public Service.

Virginia Local Tax Rates, 2010Now Available

On Feb. 14 at 4:30 p.m., educationadvocates will hold a rally at theVirginia Capitol near the bell tower.

The rally will be in support ofincreased state funding for K-12 education.

Currently, state funding for education is lower than it has beensince FY 2007. Moreover, Gov. RobertF. McDonnell's budget amendmentsreduce state funding for public education despite approximately $400million in surplus revenue.

Local officials are urged to attendthe rally and to encourage others intheir communities to take part.

Further, this rally will present agood opportunity to visit your local delegates and senators at the GeneralAssembly building.

Virginia Cooperative Extension restructuring updateDear Colleagues,

As many of you know, the discussionsinvolving Virginia Cooperative Extensionrestructuring are being met with significantopposition from various stakeholders. Therestructuring process has been an attemptto develop an organizational structure thatmeets the needs of Extension clientelewithin an environment of diminishingresources. However, it is clear that variousstakeholders want to be much moreengaged in the planning process. In fact,this contentious situation is leading somestakeholders and employees to questionVirginia Tech's commitment to Extension.

Therefore, in consultation with Dr.Steger, the decision has been made toimmediately suspend the work of the VCErestructuring implementation teams, so thatwe can step back and begin a process inwhich internal and external stakeholderscan be more engaged. We will be askingour partners to be further engaged in thisprocess and assist us in our mandate fromthe General Assembly to restructureExtension.

I recognize and I am very appreciativeof the efforts that many of you have devoted to this issue, and I am confidentthat your ideas and past efforts will be very

useful in developing a process to move usforward.

Our goal is to develop an Extensionsystem that meets the present and futureneeds of all Virginians while recognizingthe reality of reduced state support. We arecommitted to a collaborative process thatengages our many stakeholder groups aswe accomplish this task.

Because AOSS can be complex tooperate and require regular mainte-nance, county officials need assurancesthat the systems do not pollute groundand surface water resources.

While the proposed regulations areintended to protect public health andthe environment, there is no easy wayfor counties to measure the effectivenessof the rules as written.

VACo also emphasized in its comments that the regulatory provi-sions requiring all AOSS owners tomaintain a relationship with a state-licensed operator and to have the AOSSvisited on a regular basis, as well as theperformance standards, must not be

compromised under any circumstances.Following the close of the comment

period, the Virginia Department ofHealth is required to "consider" each ofthe comments received before adoptingthe final regulations and submitting therules for review by the ExecutiveBranch.

After Executive Branch review, thefinal regulations will be published inThe Virginia Register followed by anadditional 30-day public input period.Only then will the final AOSS regulations become effective.
