The Minister for Infrastructure to move - That Tynwald approves the Department of Infrastructure incurring expenditure not exceeding £631,000 in respect of the Southern Salt Barn Scheme. [Reference scheme code G18-086 item no 34 under the heading ‘DOI Snow Plan – Southern Salt Barn’ on page 27 of the Isle of Man Budget 2012-13 and as detailed in the Estimates of Capital Payments 2012-13 to 2016-17 under the heading ‘Infrastructure, Operations Division New Schemes’ on page 72 of the Isle of Man Budget 2012-13]

10. Ballure Cliff Stabilisation Scheme Phase 1

The Minister for Environment, Food and Agriculture to move - That Tynwald approves the Department of Environment, Food and Agriculture incurring expenditure not exceeding £565,000 in respect of Ballure Cliff Stabilisation Construction Scheme Phase 1. [Reference scheme code G11-009 item no 4 under the heading ‘Environment, Food and Agriculture’ on page 25 of the Isle of Man Budget 2012-13 and as detailed in the Estimates of Capital Payments 2012-13 to 2016-17 under the heading ‘New Schemes’ on page 68 of the Isle of Man Budget 2012-13]

11. Select Committee on Civil Legal Proceedings Statement by the Chairman of the Committee (Mr Houghton) 12. Standing Committee of Tynwald on Emoluments

The Chairman of the Standing Committee of Tynwald on Emoluments (Mr Speaker) to move - That the First Report of the Standing Committee of Tynwald on Emoluments 2012/13 [PP 0106/12] be received and that the following recommendation be approved -

That the Tynwald Membership Pension Scheme 1995 be amended as follows:

CLAUSE A2

In Clause A2, for the definition of “reckonable service”, substitute:

“reckonable service” has the meaning assigned to it by Clause C1(2);

CLAUSE C1

Renumber the existing Clause C1 as C1(1) and insert at the end:

(2) “Reckonable service” means service whether continuous or otherwise as a

Member of Tynwald in respect of which the Member has paid contributions

at the rate prescribed in Clause C1(3).

(3) The prescribed rate of contributions is:

Here A is the total sum payable to the member under sections 1 and 2 of the 1989

Act during the period concerned and P is the relevant percentage.

(4) The relevant percentage is:

nil in respect of any period before 1st November 2012;

3% from 1st November 2012 to 31

st March 2013;

4% from 1st April 2013 to 31

st March 2014; and

5% from 1st April 2014.

but that, despite these amendments, a person who is a Member of Tynwald on the date the amendments are made is not obliged to make a contribution until he goes out of office (whether by the expiry of his present term of office or for any other reason) and is to be treated as if until that time he had made the contributions which would otherwise have been required by virtue of the amendments.

13. Select Committee of Tynwald on Local Authorities: Members’ Interests (Petition for Redress)

The Chairman of the Select Committee on Local Authorities: Members’ Interests (Petition for Redress) (Mr Ronan) to move - That the Report of the Select Committee on Local Authorities: Members’ Interests (Petition for Redress) [PP 0107/12] be received and that the following recommendations be approved -

Recommendation 1 That the Department of Infrastructure should introduce legislation to require all members of local authorities to register any interest which could reasonably be regarded as bearing upon the way in which a member may carry out his or her duties. Recommendation 2 That the definition of “relevant interest” applicable to members of local authorities should be the same as that applicable to Members of Tynwald except that shares in a UK company need not normally be declared unless and until they become relevant to a matter under consideration.

Recommendation 3 That the Department of Infrastructure should introduce legislation to require that the registers (or “books”) currently maintained by local authorities under section 13 of the Local Government Act 1985, together with the registers of interests declared under Recommendations 1 and 2 above, must be made open to inspection by the public. Recommendation 4 That the Department of Infrastructure should consider as part of any wider review of local authorities whether it should be given an express statutory power to issue guidance to local authorities, with local authorities being placed under an express statutory duty to follow such guidance.

14. Economic Committee

The Chairman of the Economic Committee (Mr Singer) to move - That the First Report of the Economic Committee 2012-13 [PP 0109/12] be received and that the following recommendation be approved -

That the matter of powers of Tynwald and its Committees to send for persons and papers be referred to the Standing Orders Committee for examination and report; and that the Committee be empowered to take written and oral evidence pursuant to sections 3 and 4 of the Tynwald Proceedings Act 1876, as amended.

15. Second Interim Report of the Boundary Review Committee

The Chief Minister to move - That the second Interim Report of the Boundary Review Committee dated September 2012 [GD 0043/12] be received and the following recommendations be approved - (a) Tynwald accepts that the twenty four seats of the House of Keys be divided into

twelve constituencies of two members each; and (b) Tynwald directs the Boundary Review Committee to complete its Report by

defining and delineating the boundaries of such constituencies in accordance with paragraph (a) above and to report back no later than the June 2013 sitting of Tynwald.

16. Election for Public Accounts Committee

To elect a Chairman to serve during the term of the House of Keys notwithstanding Standing Order 5.5. (Under the Schedule to Standing Orders, paragraph 3.3, the following members are not eligible for membership of this Committee: the President, members of the Council of Ministers and members of the Treasury. Current members of the Committee are: Mr Cannan (Vice-Chairman), Mrs Cannell, Mr Corkish and Mr Singer. The effect of paragraph 3.2 is that the offices of Public Accounts Committee Vice-Chairman and three Policy Review Committee Chairmen must be filled by four different Members. If a member of the Committee is elected as Chairman or Vice-Chairman, there will be consequential elections (see below).) If necessary Public Accounts Committee To elect a Vice-Chairman to serve during the term of the House of Keys notwithstanding Standing Order 5.5. If necessary A Policy Review Committee To elect a Chairman to serve during the term of the House of Keys notwithstanding Standing Order 5.5. 50. End of Life Care (Adjourned Debate from the July 2012 Sitting)

Motion made –

That Tynwald is of the opinion that the Department of Health should investigate the benefits of using the Welsh system of End of Life Care instead of the system currently being used, the Liverpool Care Pathway; and that it should report to Tynwald by October 2012.

51. Bio-Energy Recovery The Hon. Member for Onchan (Mr Karran) to move -

That Tynwald is of the opinion that there should be a full investigation of the value for money to be obtained from bio-energy recovery before further public money is spent on the sludge drying process which is being developed as part of the IRIS project; and calls on the Council of Ministers to re-affirm its commitment to the principle set out in the Report of the Public Accounts Committee on the renewal of the Island’s infrastructure for the collection and treatment of sewage (IRIS), 1991 to 2007 [PP 0083/10] that before any proposal is put before Tynwald for a capital infrastructure project designed to be delivered over a period of ten years or more, the proposal should include a strategic review at least once every five years to be carried out by an independent person appointed by the lead Department and that that review should be reported to Tynwald.

52. Open Skies Policy The Hon. Member for Garff (Mr Speaker) to move - That the Economic Committee should examine whether –

(a) the current ‘Open Skies’ policy is, in the light of changing circumstances, still in the best interests of the Isle of Man in preserving and encouraging an adequate, frequent and long-term network of scheduled air services between the Island and major business and social destinations; and

(b) the determination of the Island’s civil aviation policy should properly be

in the remit of the Department of Economic Development, with the operation and management of the Airport the responsibility of the Department of Infrastructure;

and report to Tynwald Court no later than the April 2013 sitting.

53. Public Broadcasting

The Hon. Member for Garff (Mr Speaker) to move - That Tynwald receives the Treasury Report on Public Broadcasting Subvention of July 2012 [GD 0034/12]; and – (a) reaffirms its commitment to public service broadcasting in the Isle of Man; (b) endorses Manx Radio as the Isle of Man’s national broadcaster and the

current interpretation of its public service broadcasting requirement; (c) is of the opinion that Manx Radio should receive a level of Government

support necessary to allow it to continue to deliver public service broadcasting over the next three years; and

(d) is of the opinion that independent advice should be obtained to allow

Tynwald to decide the service it requires from its public broadcasting service and to assess the cost of the options available.
