The Ministry of Environment, Forests & Climate Change has considered the application. It is noted that the proposal is for grant of amendment to Environmental Clearance granted vide letter no. SEAC SEAC-2010/CR-675/TC-2 dated 07.05.2013 by SElAA, Maharashtra for Proposed construction of residential - cum commercial building project with municipal parking at CTS No. 5530/ A, 5530/A-l to 3 of Village Kolekalyan, Santacruz, Mumbai, Maharashtra by MIs Ultra Space Developers Pvt. Ltd. The proposal was considered by the EAC in 144th its meeting held on 28 th - 30 th January, 2015. The proponent has informed that: 1. Environmental Clearance for the project was granted by SEIAA, Maharashtra vide letter no. SEAC-2010/CR-675/TC-2 dated 07.05.2013. 11. It is proposed to modify project as scheme change from DC rule 35 to 33 (24). Amendment in environmental clearance is required as proposed built up area is changing from 80,711.02 sqm to 94,311.88 sqm. 111. The proposal involves construction of residential - cum commercial building project with municipal parking at CTS No. 55301 A, 55301 A-I to 3 of Village Kolekalyan, Santacruz, Mumbai, Maharashtra by Mis Ultra Space Developers Pvt. Ltd. The location of the project is at 19°04'20.78" N Latitude an 72°52'04.91" E Longitude. IV. The total plot area is 9874 sqm. FSI area will be 37102 sqm. and total construction area will be 94311.88 sqm. The proposed project will comprise a residential building + shop line & Municipal Parking comprising of wing A, B, C, E & F. The configuration of all the wings is: 3 basements + lower ground + upper ground + podium floor + 13 upper residential floors. Except wing D is of 12 upper residential floor (duplex flat). This has reference to your application Nil dated 30.10.2014 seekingamendment to Environmental Clearance on the above-mentioned subject.

2. The Ministry of Environment, Forests & Climate Change has considered theapplication. It is noted that the proposal is for grant of amendment toEnvironmental Clearance granted vide letter no. Ltd. The location of the project is at 19°04'20.78" N Latitude an72°52'04.91" E Longitude.

IV. The total plot area is 9874 sqm. FSI area will be 37102 sqm. and totalconstruction area will be 94311.88 sqm. The proposed project will comprise aresidential building + shop line & Municipal Parking comprising of wing A, B,C, E & F. The configuration of all the wings is: 3 basements + lower ground +upper ground + podium floor + 13 upper residential floors. Except wing D is of12 upper residential floor (duplex flat). Total 244 flats shall be developed. The

total height of the building will be 46.7 m. The details of the proposed projectis as follows:

v. During construction phase, total water requirement is expected to be 50 KLDwhich will be met from MCGM. During the construction phase soak pits andseptic tanks will be provided for disposal of waste water. Temporary sanitarytoilets will be provided during peak labor force.

VI. During operational phase, total water demand of the project is expected to be247 KLD which will be met by MCGM and recycled water. Waste Watergenerated (215 KLD)uses will be treated in STP of 220 KLD capacity. 194 KLD

. of treated wastewater will be recycled 69 KLD for flushing and 4.6 KLDrecycled water for gardening. About 12.04 KLD will be disposed in tomunicipal drain.

vn. About 667 kg/ d solid waste will be generated in the project. The biodegradablewaste (367 kg/d) will be processed in OWC and the non-biodegradable wastegenerated (300 kg/ d) will be handed over to authorized local vendor.

V111. The total power requirement during construction phase is 100 kVA which willbe met from Reliance Energy Ltd and total power requirement duringoperation phase is 3036 kVA which will be met from Reliance Energy Ltd.

IX. Two D.G. sets of capacity 750 KVAand 210 kVA respectively, will be providedfor emergency.

x. 1 No. of Rain water Harvesting Tank of 75 Cum capacity is provided belowBasement 3.

Xl. Parking facility for 652 nos. four wheelers for Sale and 412 nos. four wheelersfor MCGM is proposed to be provided against the requirement of 650 nos. and409 nos respectively (according to local norms).

xu. Proposed energy saving measures would save about 10 % of Flat demand loadof power.

X111. The total cost of the project is Rs. 442 Crore.XIV. Wildlife issues: The proposed project is 7.5 km away from Sanjay Gandhi

National Park (Eco-Sensitive Zone).xv. Forest land: No forest land involved in the project.

XVI. Court case: Maharashtra Pollution Control Board (MPCB)has filed a case ondated 16.07.2013 against Project Proponent according to MoEF OM dated12.12.2012 as they has started construction activities at site withoutobtaining EC.

3. The proposal was considered by the Expert Appraisal Committee (EAC) andrecommended in its 144th EAC meeting held on 28th - 30th January, 2015 forgranting amendment to Environmental Clearance dated 07.05.2013. The Ministry ofEnvironment, Forests & Climate Change hereby accords amendment to

Environmental Clearance dated 07.05.2013 for the above-mentioned Proposerconstruction of residential - cum commercial building project with municipaparking at CTS No. 5530/ A, 5530/ A-I to 3 of Village Kolekalyan, SantacruzMumbai, Maharashtra by M/ s Ultra Space Developers Pvt. Ltd. under theprovisions of the Environment Impact Assessment Notification, 2006 anramendments thereto and Circulars issued thereon and subject to the compliance 0

the following specific conditions, in addition to the general conditions mentionecbelow:

PART A - SPECIFIC CONDITIONS

I. Construction Phase

(i) The Project Proponent shall insure that the guidelines issued vide thi:Ministry's OM No. 19-2/2013-IA.III dated 09.06.2015, to be followecfor building and construction projects to ensure su stainabkenvironmental management in pursuance of Notification No. 3252 (Edated 22. 12.2014 under the EIA Notification, 2006, as applicable, artfollowed in this project.

(ii) The Project Proponent shall obtain all necessary clearance/ permissiofrom all relevant agencies including town planning authority beforcommencement of work.

(iii) "Consent for Establishment" shall be obtained from State PollutioControl Board under Air (Prevention and Control of Pollution) Act, 198and Water (Prevention and Control of Pollution) Act, 1974.

(iv) The environmental clearance is subject to obtaining prior clearancefrom wildlife angle including clearance from the Standing Committee 0

the National Board for Wildlife as applicable.

(v) Grant of environmental clearance does not necessarily implies thaWildlife Clearance shall be granted to the project and that theirproposals for Wildlife Clearance shall be considered by the respectiveauthorities on their merits and decision taken.

(vi) The total plot area is 9874 sqm. FSI area shall be 37102 sqm. and toteconstruction area shall be 94311.88 sqm. The proposed project wicomprise a residential building + shop line & Municipal Parkincomprising of wing A, B, C, E & F. The configuration of all the wings is:basements + lower ground + upper ground + podium floor + 13 u pperesidential floors. Except wing D is of 12 upper residential floor (dupleflat). Total 244 flats shall be developed. The total height of the buildinshall be 46.7 m.

(vii) During construction phase, total water requirement is 50 KLD whicshall be met from MCGM. During the construction phase soak pits aniseptic tanks shall be provided for disposal of waste water. Temporarsanitary toilets shall be provided during peak labor force.

(viii) During operational phase, total water demand of the project is 247 KLIwhich shall be met by MCGM and recycled water. Waste Water generate

(215 KLD)uses shall be treated in STP of 220 KLD capacity. About 12.04KLD shall be disposed in to municipal drain.

(xi) Two D.G. sets of capacity 750 KVAand 210 kVA respectively, shall beprovided for emergency. D.G set shall be at least 6 m away from theboundary.

(xii) 1 No. of Rain water Harvesting Tank of 75 Cum capacity shall beprovided below Basement 3.

(xiii) Parking facility for 652 nos. four wheelers for Sale and 412 nos. fourwheelers for MCGM shall be provided against the requirement of 650nos. and 409 nos respectively (according to local norms).

(xiv) The project proponent shall obtain comply with the conditions ofNOC/Clearance from Fire Department.

(xv) All the construction shall be in accordance with the local buildingbyelaws. The Project Proponent shall obtain all necessary clearances.

(xvi) The project proponent shall put in place a credible enforcementmechanism for compliance of energy conservation measures with itsallottees, as projected, in perpetuity. This would be monitored by thedesigned Energy Conservation/ efficiency Authority in the State.

(xvii) Temporary toilets will be provided for all construction labour.

(xviii) Suitable toilet fixtures for water conservation shall be provided.

(xix) Proponent shall obtain permission for ground water withdrawal fromState Ground Water Authority.

(xx) The rainwater harvesting plan should be incorporated by the CGWA.

(xxi) Provision shall be made for the housing of construction labour within thesite with all necessary infrastructure and facilities such as fuel forcooking, mobile toilets, mobile STP, safe drinking water, medical healthcare, creche etc. The housing may be in the form of temporary structuresto be removed after the completion of the project.

(xxii) A First Aid Room will be provided in the project both during constructionand operation of the project.

(xxiii) All the topsoil excavated during construction activities should be storefor use in horticulture/landscape development within the project site.

(xxiv) Disposal of muck during construction phase should not create anadverse effect on the neighbouring communities and be disposed takinthe necessary precautions for general safety and health aspects (people, only in approved sites with the approval of competent authority.

(xxv) Soil and ground water samples will be tested to ascertain that there is nthreat to ground water quality by leaching of heavy metals and othetoxic contaminants.

(xxvi) Construction spoils, including bituminous material and other hazardoumaterials, must not be allowed to contaminate watercourses and thdump sites for such material must be secured so that they should ncleach into the ground water.

(xxvii) Any hazardous waste generated during construction phase, should bdisposed off as per applicable rules and norms with necessary approvaJof the State Pollution Control Board.

(xxviii)The diesel generator sets to be used during construction phase shoulbe low sulphur diesel type and should conform to Environmer(Protection) Rules prescribed for air and noise emission standards.

(xxix) The diesel required for operating DG sets shall be stored in undergrountanks and clearance from Chief Controller of Explosives shall be takeras applicable.

(xxx) Vehicles hired for bringing construction material to the site should be igood condition and should have a pollution check certificate and shoulconform to applicable air and noise emission standards and should boperated only during non-peak hours.

(xxxi) Ambient noise levels should conform to residential standards bot"during day and night as per Noise Pollution (Control and RegulatiorRules, 2000. Incremental pollution loads on the ambient air and noisquality should be closely monitored during construction phase. Adequatmeasures should be made to reduce ambient air and noise level durinconstruction phase, so as to conform to the stipulated standards bCPCB/ SPCB.

(xxxii) Fly ash should be used as building material in the construction as pethe provisions of Fly Ash Notification of September, 1999 and amende,as on 27th August, 2003.

(xxxiii)Ready mixed concrete must be used in building construction.

(xxxiv) Storm water control and its re-use as per CGWB and BIS standards fovarious applications.

(xxxv) Water demand during construction should be reduced by use of premixed concrete, curing agents and other best practices referred.

(vii) The installation of the Sewage Treatment Plant (STP) should be certifiedby an independent expert and a report in this regard should besubmitted to the Ministry before the project is commissioned foroperation. Treated affluent emanating from STP shall be recycled/reused to the maximum extent possible. Treatment of 100% grey water

(xxxvi) Permission to draw ground water shall be obtained from the competentAuthority prior to construction/ operation of the project.

(xxxvii) Separation of grey and black water should be done by the use of dualplumbing line for separation of grey and black water.

(xxxviii) Fixtures for showers, toilet flushing and drinking should be of low floweither by use of aerators or pressure reducing devices or sensor basedcontrol.

(xxxix) Use of glass may be reduced by up-to 40% to reduce the electricityconsumption and load on air-conditioning. If necessary, use high qualitydouble glass with special reflective coating in windows.

(xl) Regular supervision of the above and other measures for monitoringshould be in place all through the construction phase, so as to avoiddisturbance to the surroundings.

(xli) Under the provisions of Environment (Protection) Act, 1986, legal actionshall be initiated against the project proponent if it was found thatconstruction of the project has been started without obtainingenvironmental clearance.

II. Operation Phase

(i) The quantity of fresh water usage, water recycling and rainwaterharvesting shall be measured and recorded to monitor the waterbalance as projected by the project proponent. The record shall besubmitted to the Regional Office, MoEF&CC along with six monthlyMonitoring reports.

(ii) The treated wastewater of 194 KLD shall be recycled and reused forflushing (69 KLD) and gardening (4.6 KLD) to reduce the demand offresh water, as committed.

(iii) Solid waste management shall be collected, treated disposed inaccordance with the Municipal Solid Waste (Management & Handling)Rules, 2000. No municipal waste should be disposed off outside thepremrses.

(iv) The Operation and Maintenance of STP shall be made in the MoU withSTP supplier. Project Proponent shall ensure regular operation andmaintenance of the STP.

(v) Parking facility with 9 m clear driveway shall be provided as committed.

(vi) The Project Proponent shall explore the possibilities of reusing thetreated wastewater from nearby projects.

by decentralized treatment should be done. Discharge of unused treateraffluent shall conform to the norms and standards of the State PollutioiControl Board. Necessary measures should be made to mitigate th:odour problem from STP.

(viii) The solid waste generated should be properly collected and segregatedWet garbage should be composted and dry/inert solid waste should hidisposed off to the approved sites for land filling after recoverirurecyclable material.

(ix) Diesel power generating sets proposed as source of back-up power foelevators and common area illumination during operation phase shoukbe of enclosed type and conform to rules made under the Environmen(Protection) Act, 1986. The height of stack of DG sets should be equato the height needed for the combined capacity of all proposed DG setsUse low sulphur diesel. The location of the DG sets may be decided wit!in consultation with State Pollution Control Board.

(x) Noise should be controlled to ensure that it does not exceed theprescribed standards. During night time the noise levels measured athe boundary of the building shall be restricted to the permissible levelsto comply with the prevalent regulations.

(xi) The green belt of the adequate width and density preferably with locaspecies along the periphery of the plot shall be raised so as to provideprotection against particulates and noise.

(xii) Rain water harvesting for roof run- off and surface run- off, as plarsubmitted should be implemented. Before recharging the surface ruroff, pre-treatment must be done to remove suspended matter, oil anegrease. The borewell for rainwater recharging should be kept at least ~mts. above the highest ground water table.

(xiii) Energy conservation measures like installation of CFLs/TFLs for thelighting the areas outside the building should be integral part of theproject design and should be in place before project commissioning. UseCFLs and TFLs should be properly collected and disposed off/ sent fOJrecycling as per the prevailing guidelines/rules of the regulatoryauthority to avoid mercury contamination. Use of solar panels may bedone to the extent possible.

PART - B. GENERAL CONDITIONS

(i) A copy of the environmental clearance letter shall also be displayed OJthe website of the concerned State Pollution Control Board. The EC letteshall also be displayed at the Regional Office, District Industries centrand Collector's Office/ Tehsildar's office for 30 days.

(ii) The funds earmarked for environmental protection measures shall bkept in separate account and shall not be diverted for other purposeYear-wise expenditure shall be reported to this Ministry and itconcerned Regional Office.

13. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shall update thesame periodically. It shall simultaneously be sent to the Regional Office of MoEF&CC,the respective Zonal Office of CPCB and the SPCB. The criteria pollutant levelsnamely; SPM, RSPM, S02, NOx (ambient levels as well as stack emissions) or critical

4. Officials from the Regional Office of MoEF&CC, Nagpur who would bemonitoring the implementation of environmental safeguards should be given fullcooperation, facilities and documents/data by the project proponents during theirinspection. A complete set of all the documents submitted to MoEF&CC should beforwarded to the CCF, Regional office of MoEF&CC, Nagpur.

5. In the case of any change(s) in the scope of the project, the project wouldrequire a fresh appraisal by this Ministry.

6. The Ministry reserves the right to add additional safeguard measuressubsequently, if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection) Act,1986, to ensure effective implementation of the suggested safeguard measures in atime bound and satisfactory manner.

7. All other statutory clearances such as the approvals for storage of diesel fromChief Controller of Explosives, Fire Department, Civil Aviation Department, ForestConservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, asapplicable by project proponents from the respective competent authorities.

8. These stipulations would be enforced among others under the provisions ofWater (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and controlof Pollution) act 1981, the Environment (Protection) Act, 1986, the Public Liability(Insurance) Act, 1991 and EIA Notification, 2006.

9. The project proponent should advertise in at least two local Newspapers widelycirculated in the region, one of which shall be in the vernacular language informingthat the project has been accorded Environmental Clearance and copies of clearanceletters are available with the State Pollution Control Board and may also be seen onthe website of the Ministry of Environment, Forests & Climate Change athttp://www.envfor.nic.in. The advertisement should be made within Seven days fromthe date of receipt of the Clearance letter and a copy of the same should be forwardedto the Regional Office of this Ministry at Nagpur.

10. This Clearance is subject to final order of the Hon'ble Supreme Court of Indiain the matter of Goa Foundation v/ s. Union of India in Writ Petition (Civil)No.460 of2004 as may be applicable to this project.

11. Any appeal against this clearance shall lie with the National Green Tribunal, ifpreferred, within a period of 30 days as prescribed under Section 16 of the NationalGreen Tribunal Act, 2010.

12. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla Parisad z Municipal Corporation, Urban Local Body and the LocalNGO, if any, from whom suggestions/ representations, if any, were received whileprocessing the proposal. The clearance letter shall also be put on the website of thecompany by the proponent.

14. The environmental statement for each financial year ending 31st March iForm-Vas is mandated to be submitted by the project proponent to the concerneState Pollution Control Board as prescribed under the Environment (ProtectiorRules, 1986, as amended subsequently, shall also be put on the website of thcompany along with the status of compliance of EC conditions and shall also be serto the respective Regional Offices of MoEF&CC bye-mail.
