6-21 Primary 6 Theme 1 Unit 2 Theme 1 Unit (2) Protecting Our Home and Nation In this unit, the Basic Law Smartie Kids joined a Planting Day. This allows students to understand that the Central People’s Government is responsible for the defence of the Hong Kong Special Administrative Region (HKSAR). Theme 1 Unit (2) Protecting Our Home and Nation

In this unit, the Basic Law Smartie Kids joined a Planting Day. This allows students to understand that the Central People’s Government is responsible for the defence of the Hong Kong Special Administrative Region (HKSAR). 1. Do you still remember the meaning of “one country, two systems”? (“One country, two systems”. One country means the People’s Republic of China; two systems mean that the People’s Republic of China continues to practise the socialist system, while the HKSAR continues to practise the capitalist system.)

2. Did you see any soldier of the State? On what occasions? (e.g.: The National Day military parade/Labour Day on 1 May / Barracks Open Day on the Army Day on 1 August / Flag raising ceremony at Tiananmen Square)

(2) Development➢ Watching the PowerPoint:

1. Students watch the PowerPoint, “Basic Law Smartie Kids’ Planting Day” (see Appendix 1 for the contents).

2. When teachers explain the story, students discuss the questions on the PowerPoint in groups or in class.

➢ Class Discussion:1. The People’s Liberation Army is responsible for the defence of the

HKSAR. Why are there regulations stated in the Basic Law and the Garrison Law?

(3) Brief Summary➢ The Central People’s Government and the Government of the HKSAR

clearly play different roles to protect the HKSAR – the Central People’s Government is responsible for the defence with the Hong Kong Garrison of the People’s Liberation Army; the Government of the HKSAR is responsible for keeping public order with the disciplinary forces.

➢ The Hong Kong Garrison of the People’s Liberation Army must strictly obey the Basic Law and the Garrison Law. Also, they cannot interfere in the local affairs of the HKSAR, and they must follow the law of the HKSAR.

➢ The Government of the HKSAR does not pay tax or pay for the expenditure for the garrison to the Central People’s Government.

• Appendix:Know more about the Hong Kong Garrison of the People’s Liberation Army

Tips for Teachers:1. If students are curious about the barracks, military equipment, organization and the life of the

Hong Kong Garrison of the People’s Liberation Army, teachers may collect relevant information beforehand according to the students’ interest and share with them.

2. Teachers may give students the information about the opening of the barracks or ask students to search for the information on their own. Interested students may ask their families to visit the barracks with them.

3. The school may, depending on the situation, arrange for students to join the military summer camp in Hong Kong or on the mainland. This will increase students’ knowledge about the People’s Liberation Army.

• Article 14The Central People’s Government shall be responsible for the defence of the Hong Kong Special Administrative Region.

The Government of the Hong Kong Special Administrative Region shall be responsible for the maintenance of public order in the Region.

Military forces stationed by the Central People’s Government in the Hong Kong Special Administrative Region for defence shall not interfere in the local affairs of the Region. The Government of the Hong Kong Special Administrative Region may, when necessary, ask the Central People’s Government for assistance from the garrison in the maintenance of public order and in disaster relief.

In addition to abiding by national laws, members of the garrison shall abide by the laws of the Hong Kong Special Administrative Region.

Expenditure for the garrison shall be borne by the Central People’s Government.

• Article 18The laws in force in the Hong Kong Special Administrative Region shall be this Law, the laws previously in force in Hong Kong as provided for in Article 8 of this Law, and the laws enacted by the legislature of the Region.

National laws shall not be applied in the Hong Kong Special Administrative Region except for those listed in Annex III to this Law. The laws listed therein shall be applied locally by way of promulgation or legislation by the Region.

The Standing Committee of the National People’s Congress may add to or delete from the list of laws in Annex III after consulting its Committee for the Basic Law of the Hong Kong Special Administrative Region and the government of the Region. Laws listed in Annex III to this Law shall be confined to those relating to defence and foreign affairs as well as other matters outside the limits of the autonomy of the Region as specified by this Law.

In the event that the Standing Committee of the National People’s Congress decides to declare a state of war or, by reason of turmoil within the Hong Kong Special Administrative Region which endangers national unity or security and is beyond the control of the government of the Region, decides that the Region is in a state of emergency, the Central People’s Government may issue an order applying the relevant national laws in the Region.

• Article 106The Hong Kong Special Administrative Region shall have independent finances.

The Hong Kong Special Administrative Region shall use its financial revenues exclusively for its own purposes, and they shall not be handed over to the Central People’s Government.

The Central People’s Government shall not levy taxes in the Hong Kong Special Administrative Region.
