Prohibition of Administering Prescription Drugs TAKE notice that on 26 April 2012, I, Stephen Christley, Executive Director. Public Health and Clinical Systems, Department of Health and Ageing, having formed the opinion that Dr Jason Michael Johnson has administered prescription drugs in an irresponsible manner, exercised the authority delegated to me by the Minister for Mental Health and Substance Abuse under Section 62A of the Controlled Substances Act 1984, and made the following order under Section 57 (1) (c) of the Act:

Dr Jason Michael Johnson Date of birth 4 October 1974, is prohibited from supplying, prescribing, administering, using or having possession of the following substances or class of substances; • a drug of dependence as declared by Regulation 7 of the

Controlled Substances (Poisons) Regulations 2011, pursuant to Section 12 (3) of the Controlled Substances Act 1984, namely any poison listed in Schedule 8 of the Standard for the Uniform Scheduling of Medicines and Poisons as published and amended by the Secretary to the Department of Health and Ageing under the Commonwealth’s Therapeutic Goods Act 1989;

• prescription drugs that contain codeine or dextropropoxyphene; and

• benzodiazepines. This order does not apply to any of the above substances, drugs or class of drugs lawfully supplied or prescribed for the treatment of Dr Jason Michael Johnson by a registered health practitioner or by a veterinary surgeon for administration to an animal in Dr Johnson’s care. Preamble It is necessary to amend the Karoonda East Murray (DC) Development Plan dated 2 June 2005 and as amended by the Statewide Wind Farms Development Plan Amendment on Interim Operation as of 19 October 2011.

SCHEDULE 2 From 1830 hours on 17 May 2012 to 0600 hours on 19 May 2012.

SCHEDULE 3 1. The co-ordinates in Schedule 1 are defined as degrees, decimal minutes and based on the WGS 1984 datum. 2. No fishing activity may be undertaken during the daylight hours from 0600 hours to 1830 hours on any day during the period specified in Schedule 2. 3. The licence holder or registered master may only undertake fishing activity according to the balance of fishing nights endorsed on the registrations and entitlement extract of their licence. 4. Fishing activity may only be undertaken using T90-mesh cod ends and grids, in accordance with the licence condition 8221. 5. At least one hour prior to sunset on each night that fishing will occur, the licence holder or registered master must call PIRSA Fishwatch on 1800 065 522 and report the following information: (a) licence number; (b) name of licence holder; (c) registered boat; (d) name of person lodging the report; (e) date on which fishing will commence; (f) nearest land location of departure; and (g) research survey block number from which fishing will

RULES OF COURT District Court (Criminal and Miscellaneous)

Rules 1992 (Amendment No. 12) By virtue and in pursuance of Section 51 of the District Court Act 1991 and all other enabling powers, we, Terence Anthony Worthington, Chief Judge, and Dean Ernest Clayton and Kevin Gordon Nicholson, Judges of the District Court of South Australia, do hereby make the following Rules of Court: 1. These Rules may be cited as the ‘District Court (Criminal and Miscellaneous) Rules 1992 (Amendment No 12)’. 2. The District Court (Criminal and Miscellaneous) Rules 1992 are amended as set out below. 3. This amendment will commence on 1 July 2012 or upon its gazettal, whichever is the later. 4. Rule IV—3 is amended by: (i) deleting the words ‘A person’ at the commencement of subrule IV-3.05 and

inserting in their place ‘Subject to Rule 3.06, a person’; (ii) inserting after the word ‘trial’ and before the comma in the second line of

subrule IV-3.05 the words ‘or sentence’; (iii) deleting the text of sub-paragraph (a) in subrule IV-3.05 and inserting in its

place: ‘for the trial or sentence, as the case may be, and directions hearings relating

to the trial or sentence’; (iv) inserting immediately after subrule IV-3.05 a new subrule IV-3.06 as follows: ‘IV—3.06 Subject to section 59IQ of the Evidence Act 1929 and to any

contrary direction by the Court persons in custody will appear before the District Court for the following hearings by audio visual link:

3.06.1 directions hearings; 3.06.2 bail applications ; 3.06.3 pre-trial conferences conducted under Rule 7; 3.06.4 such other applications as the Court may order.’ (vi) inserting new subrules IV-3.07 and IV-3.08 as follows: ‘IV—3.07 A party may object to the use of an audio visual link for a hearing

to which Rule 3.06 refers by: (a) an oral submission made at the time of arraignment or on any other

occasion on which the person in custody is present in Court; or (b) at least three business days before the hearing, filing a notice of objection

using Form 24. A notice of objection may be determined at the discretion of the Court by a Judge at a hearing in Court at which the person in custody is present, or in chambers without the Judge hearing from any party, or at a hearing using an audio visual link (whether that be a hearing to which Rule 3.06 refers, or otherwise).

IV—3.08 It may be necessary for counsel during the course of a hearing by audio visual link to take instructions on a matter which could not reasonably have been anticipated. In that event counsel will be provided with access to a private telephone which will link directly to the audio visual link facility at the custodial institution in which the person in custody is held.’

5. Rule IV—6.06(c) is amended by inserting immediately after the word ‘attend’ and before the semi-colon the words ‘but that attendance may be by audio visual link under Rule 3.06’.

6. Rule IV—7.06 is amended by adding immediately before the words ‘by the person committed for trial’, ‘subject to Rule 3.06,’. 7. A new Form 24 is added to the Schedule to the Rules as follows:

COMMENTARY TO THE STATEMENT OF THE AMOUNTS CREDITED TO AND ISSUED FROM THE CONSOLIDATED ACCOUNT FOR THE QUARTERS ENDED

30 DECEMBER 2011 AND 30 DECEMBER 2010

Receipts Taxation Higher payroll tax receipts for the December quarter 2011 compared with the same period a year ago reflects growth in taxable payrolls. Land tax receipts in the six months to December 2011 and for the December quarter 2011 are lower than the same periods a year ago, largely due to the timing of land tax receipts from the SA Housing Trust which were received in January 2012. Stamp duty receipts were lower in the December quarter 2011 compared to the same period a year ago, mainly due to softer property market conditions impacting on conveyance duty revenue. Royalties Higher royalty receipts for the December quarter 2011 compared with the same period in 2010 mainly relate to higher royalties from Olympic Dam due to the return to full production, and increased mineral prices. Fees and Charges The decrease in fees and charges for the first six months of 2011-12 financial year compared with the same period in 2010 mainly reflects decreased land regulatory service fees received due to the softer property market conditions. Commonwealth—General Purpose Grants Growth in general purpose grants between the first six months of 2011-12 and the corresponding period for 2010-11 is not indicative of underlying Goods and Services Tax (GST) revenue growth. This is because monthly grants are paid according to a payment schedule prepared by the Commonwealth Government at the commencement of a financial year rather than in accordance with the actual emerging monthly GST collections. In its 2011-12 Mid-Year Economic and Fiscal Outlook, the Commonwealth Government estimated the GST pool would grow by 3.5% in 2011-12. Commonwealth—Specific Purpose Grants Specific Purpose Grants for the December quarter 2011 were higher than the same period for the previous year mainly due to the annual indexation of grant payments. Commonwealth—National Partnership Payments Prior to 2011-12, National Partnership payments to the Consolidated Account were received at the end of the financial year. National Partnership Payments received in 2011-12 reflect their timing based on the nature of the National Partnership Payments and the achievement of particular milestones. Payments Payments were made pursuant to the Appropriation Act 2011 and also in accordance with other Acts for which specific appropriation has been authorised. The timing of these payments is generally established at the beginning of each financial year and may change in comparison to previous years depending on individual operating requirements at that time. Note Caution should be exercised in interpreting the quarterly statement of Consolidated Account transactions. Unlike the State Budget, which comprises transactions on an accrual basis, the information reflected in the quarterly statements is limited to cash transactions. Also, the Consolidated Account does not capture all the transactions undertaken by the general government sector (in particular, it does not record receipts to and payments from special deposit accounts). Finally, the timing of receipts and payments could be volatile within a particular year. As a result, apparently large movements between years may only be due to changes in the timing of receipts and payments and therefore may not have consequences for the underlying budget position.

Schedule 1—Fees

1—Short title These regulations may be cited as the Business Names Registration (Transitional Arrangements) Regulations 2012.

2—Commencement These regulations will come into operation on 28 May 2012.

3—Interpretation In these regulations—

Act means the Business Names Registration (Transitional Arrangements) Act 2012;

Minister means the Minister to whom the administration of the repealed Act was committed immediately prior to its repeal;

repealed Act means the Business Names Act 1996.

4—Transition provision—fees (1) The fees fixed by Schedule 1 are payable to the Commission in connection with the

operation of section 7 of the Act.

(2) The Commission may waive, reduce or refund a fee (or part of a fee) payable under these regulations if satisfied that it is appropriate to do so in a particular case.

5—Transitional provision—directions under section 8(4) of repealed Act to have effect

For the purposes of the resolution of outstanding matters under section 7 of the Act, a direction of the Minister given for the purposes of section 8(4) of the repealed Act will be taken to continue to have effect as if the repealed Act had not been repealed, and a reference in a direction to section 8(4) of the repealed Act will be taken to be a reference to section 7 of the Act.
