Having a Will is fairly commonplaceespecially as we see extended and morecomplex family units.

But what happens if the Will of adeceased loved one turns out to beincorrect? What if it contains a typo,incorrect information or you believe thatthe testator’s instructions have beenmisunderstood?

The first thing to establish is whether itis a matter that can be 'rectified.' If notthe gift or even the whole Will may beinvalid meaning that, if there is noprevious Will then the deceased's estatemay fall into intestacy where otherfamily members or even the Crowncould benefit.

For a Will to be rectified it must either,fail to carry out the testator's intentionsas a result of either a clerical error or thedrafter of the Will has failed tounderstand the testator's instructions.

If it is an error that can be amended andall parties affected by the Will agree thenit's simply a matter of applying to the

local probate registry to have the Willamended.

However, if any party affected by the Willdisagrees over the error then the matter has togo to the High Court, which can be a lengthyand costly procedure. In some cases, partiesinvolved may have to give evidence.

The good news is that the law around whatconstitutes as a 'clerical error' is widening,increasing the chances of a Will withstandingand the testator's wishes being carried out.

For example, the signing of the wrong Will(Marley -v- Rawlings, 2012) and the wrongtemplate being used in a Will (Brooke v Purton& Ors, 2014) were considered by the Court asclerical errors, allowing the Court to amendthe Will and carry out the testators' intentions.The case Brooke v Purton & Ors, where Irepresented the claimants, was reported in theLaw Reports for future cases to refer to;demonstrating how the Courts areencouraging a more flexible and commonsense approach to the rectification of Wills.

The desire for the Court to uphold thetestator's intentions behind the Will and avoidunjust and unintended outcomes is evidenthowever, it is still too early to say whether theCourt will assist in upholding invalid Wills inevery situation. Rather, it will continue toconsider each case on its merits.

The best solution, if you're affected by an errorin a Will, is to apply to the Probate Registry forrectification. If you need expert legal advicethen seek this swiftly as you have six monthsfrom the grant of probate to make anapplication. And, most importantly, if you'remaking a Will check it and triple check ityourself to ensure it is 100% correct.

He set himself the task ofperforming a good deedevery day for a year. So farhe has clocked up 100 andhis idea is catching on. Hebegan by paying for astranger’s takeaway mealand for his 100th good deedhe is planning to give awayhis Nintendo Wii gamesconsole. He has launched a

compe on to finding adeserving recipient.

His online good deed diarynow has hundreds offollowers as he records hislatest random act ofkindness.

He said: “We all need helpsome mes and giving a li leextra hand to those peoplewho need and deserve itmost is the aim of the diary.I started the good deed diarya er going through a lot as achild with my own heartsurgery and then having lostsomebody close to me lastyear through cancer.

The first entry was a video ofhim paying £16 for Kentuckyfriend chicken for thewoman in the car behind hisat a drive-through takeaway.

He says that he never hasany idea in advance whatthe good deed of he day willbe. “It’s amazing howthey’ve presentedthemselves to me.” he said.“Since star ng the diary I’verealised just how manyopportuni es there areevery day to help others.”

given clothes to beggars,sent flowers to friends andcaptured an escaped dog.

Mr Cameron, a shopmanager from Tuffle,Gloucestershire, said: ”Idon’t have a favourite gooddeed as they’ve all beenspecial, but I feel a massivesa sfac on when people tellme I’ve inspired them to dosomething good. I had oneemail from a man who saidhe’d given his coat to ahomeless man on his way towork as he saw himshivering in the rain… These li le things make abig difference to someone’sday and it’s really nice toknow it’s catching on.”
