19 Procedure for Bid Submission

1. The bidder shall submit his response through Bid submission to the tender on eProcurement platform at

www.eprocurement.telangana.gov.in by following the procedure given below. 2. The bidder would be required to register on the e-procurement

market place https://tender.telangana.gov.in and submit their bids online. Offline bids shall not be entertained by the Tender Inviting Authority for the tenders published in e-procurement platform.

3.The bidders shall submit their eligibility and qualification details, Technical bid, Financial bid etc., in the online standard formats displayed in eProcurement web site. The bidders shall upload the

scanned copies of all the relevant certificates, documents etc., in support of their eligibility criteria/technical bids and other certificate/documents in the eProcurement web site. The bidder

shall sign on the statements, documents, certificates, and signed documents only to be uploaded by him, owning responsibility for

their correctness/authenticity. The bidder shall attach all the required documents for the specific tender after uploading the same during the bid submission as per the tender notice and bid

document.

4.The system would only authenticate the Encryption certificate

uploaded into the Eprocurement system at the time of User Registration or updated through User profile. The bidder has to ensure that the uploaded certificate in the eprocurement system is

used for the Bid submission and no other certificate though valid

will be recognized by the eprocurement system.

3. Submission of Hard copies:i) All the bidders shall invariably upload the scanned copies, Proof of online Payment (Remittance)

of EMD in eProcurement system and this will be the primary requirement to consider the bid responsive. The authorised agents

should upload the certificate of authorisation issued by the Milk

powder manufacturing Co-op Dairies.

ii) The Telangana Foods shall carry out the technical evaluation based on the uploaded certificates/documents, Proof of online Payment (Remittance) towards EMD in the eProcurement system

and open the price bids of the responsive bidders.

iii) The successful bidder shall invariably furnish the original Proof

of online Payment (Remittance) towards EMD, Certificates/Documents of the uploaded scan copies to the Tender Inviting Authority before entering into agreement, either

personally or through courier or post and the receipt of the same within the stipulated date shall be the responsibility of the successful bidder. The Telangana Foods will not take any

responsibility for any delay in receipt/non-receipt of original Proof of online Payment (Remittance) towards EMD, Certificates/ Documents from the successful bidder before the stipulated time.

On receipt of documents, the Telangana Foods shall ensure the genuinity of the Proof of online Payment (Remittance) towards

EMD and all other certificates/documents uploaded by the bidder in eProcurement system. In support of the qualification criteria

before concluding the agreement.

4. Deactivation of Bidders :

As per the GO. Ms. No. 174 -I&CAD dated: 1-9-2008, Deactivation of Bidders, if any bidder fails to submit the original hard copies of uploaded certificates/documents,

Proof of online Payment (Remittance) towards EMD within stipulated time or if any variation is noticed between the uploaded documents and the hardcopies submitted by the

bidder, the successful bidder will be suspended from participating in the tenders on eProcurement platform for a period of 3 years. The eProcurement system would

deactivate the user ID of such defaulting bidder based on the trigger/recommendation by the Tender Inviting Authority in the system. Besides this, the department shall

invoke all processes of law including criminal prosecution of such defaulting bidder as an act of extreme deterrence to

avoid delays in the tender process for execution of the development schemes taken up by the government. Other

conditions as per tender document are applicable.

5. Payment of EMD: It is mandatory for all participant bidders to electronically pay EMD Online by utilizing the Payment

Gateway Service on E-Procurement platform". The Electronic Payment Gateway accepts all Master and Visa Credit Cards

issued by any bank and Direct Debit facility/Net Banking/NEFT payment modes through ICICI Bank and/or Axis Bank Payment Gateways to facilitate the transaction. This is in compliance as

per G.O.Ms.No. 14 Dated: 18-09-2017. A GST of 18.00% + Bank charges on the transaction amount payable to TSTS shall be

applicable. In addition to this, Bidders can also pay the EMD through Download of PDF format of RTGS Challan for respective Payment gateway and pay the EMD through their Parent Bank

account. Once the EMD is received by the EProcurement application, Bidders can automatically continue with their Bid

Submission online.

IMPORTANT NOTE REGARDING EMD PAYMENT:

1. Bidders are encouraged to use only Net banking facility for payment of EMDs as far as possible for faster refunds in

case of unsuccessful Bids for the Tender.

2. Bidders are advised not to use RTGS Challan downloads at the penultimate hour of Bid submission closing as any delay

by their banker would not enable Bid submission on the platform. Please allow a minimum of 60 minutes for enabling Continuation of Bid Submission from the time the

Pool Account receives credit of the EMD from the Bidders Bank for both NEFT and RTGS Transfers. For RTGS

Transfers, the Pool Account can get immediate credit whereas NEFT transfers would follow RBI Payment Cycle

time.

3. Bidders are advised to pay EMD Online at least T-1 or T-2 days before Bid submission closing date (T= Bid submission

closing date) to avoid last minute delays and denials of successful Bid submission and to take care of any delays in

Banking procedures.

4. Un-Successful Bidder EMD Refund process: The bid is declared unsuccessful, under the following circumstances.

Bid submitted by the bidder is not the lowest bid. Upon Finalization of the L1 Bid. Technical Disqualification of the Bid in case of 2 cover system. EMD paid but bid not

submitted EMD refund will be initiated by the Tender Inviting Authority directly and through Online only and through the same payment channels as EMD received by

the Department. (RTGS / NEFT /Credit Card /Debit Card refund), within 30 days from the date of publishing the

Decision / Result. However, Vupadhi /GoTS will not be held responsible for the delays occurring due to banking

channels/procedures/processes of the respective vendor.

6. EMD REFUND: The EMD of unsuccessful bidders shall be refunded through online duly utilising the “Refund EMD” available

on eprocurement platform.

IMPORTANT NOTE REGARDING EMD REFUNDS: Bidders are requested to use discretion in their choice of payment channel for remittance of EMD. Time taken for

Refunds under Ideal conditions:

1. Net Banking / NEFT / RTGS Challan: One (1) Banking Business Day from time of initiation of refund by Tender

Inviting Authority subject to RTGS/NEFT timings of RBI.

2. Credit card/ Debit card: 7-10 working days from time of initiation of refund by the Tender Inviting Authority.

However, this may be longer in case of certain bank cards. In case of delays, bidders are requested to

contact the Card issuing Bank for faster resolution.

7. Payment of Transaction Fee: It is mandatory for all the participant bidders from 1st January 2006 to electronically pay a

Non-refundable Transaction fee to M/s. TSTS , the service provider through "Payment Gateway Service on E-Procurement platform". The Electronic Payment Gateway accepts all Master and Visa Credit

Cards issued by any bank and Direct Debit facility/Net Banking of ICICI Bank, Axis Bank to facilitate the transaction. This is in compliance as per G.O.Ms. 13 dated 07.05.2006. A GST of 18.00%

+ Bank charges on the transaction amount payable to TSTS shall

be applicable.

8. Corpus Fund: As per GO MS No.14 User departments shall collect 0.04% of ECV (estimated contract value) with a cap of Rs.

10,000 (Rupees ten thousand only) for all works with ECV upto Rs.50 Crores, and Rs. 25,000/- (Rupees twenty-five thousand only) for works with ECV above Rs.50 Crores, from successful bidders on

eProcurement platform before entering into agreement / issue of purchase orders, towards eprocurement fund in favour of Managing Director, TSTS . There shall not be any charge towards

eProcurement fund in case of works, goods and services with ECV

less than and upto Rs. 10 lakhs.

9. Tender Document: The bidder is requested to download the tender document from eprocurement portal and website of Telangana Foods https..//tfoods.telangana.gov.in free of Cost and

read all the terms and conditions mentioned in the tender Document and seek clarification if any from the Tender Inviting Authority. Any offline bid submission clause in the tender document

could be neglected. The bidder has to keep track of any changes by viewing the Addendum/Corrigenda issued by the Tender Inviting Authority on time-to- time basis in the E-Procurement platform.

The Department calling for tenders shall not be responsible for any

claims/problems arising out of this.

10. Process Fee: Rs.10,000.00 Demand Draft in favour of Telangana Foods shall be submitted along with bid

11. Bid Submission Acknowledgement: The bidder shall complete all the processes and steps required for Bid submission. The system will generate an acknowledgement with a unique bid

submission number after completing all the prescribed steps and processes by the bidder. Users may also note that the bids for

which an acknowledgement is not generated by the e-procurement system are treated as invalid or not saved in the system. Such invalid bids are not made available to the Tender Inviting Authority

for processing the bids. The Government of TS are not responsible for incomplete bid submission by users.

Sir,

1. We ____________________________ hereby offer our tender in accordance with the

conditions of the contract for transportation of food products of Telangana Foods from

Telangana Foods,IDA,Nacharam to the 35,700 Anganwadi centres in various Districts.The

details are given in Annexure I) for a period of 12 months w.e.f. 01.04.2020 to 31.03.2021. The

rates shall be quoted transportation charges per Metric ton for an average rate of

Balamrutham and Snack Food district wise inclusive of unloading charges at Anganwadi Centre

level. The details are given in Annexure-I in the website.

2. We enclose herewith a Bank Demand Draft for the sum of Rs.5,00,000/-( Rupees FIVE

Lakhs Only) NO.____ Dt. ___ as Earnest Money Deposit which is to be returned to us

if this offer is not accepted .

3. I/we enclose herewith a Bank Draft for the sum of Rs.10,000/- (Rupees Ten Thousand Only) bearing No. __________ and date_________towards the non-refundable cost of Process Fee in favour of “Telangana Foods”.

4. We furnish the following details for your consideration

i.We ensure minimum 10 own vehicles (10MTS to 26MTs capacities) with covers in the

name of transporter(s) with registration numbers (Xerox copy of the R.C. Books shall be

enclosed)

ii.We ensure that the we will deploy required number of closed vehicles with sufficient good

Tarpaulins to withstand all weather conditions.

iii. We ensure that sufficient no. of drivers shall be engaged with driving license and other

certificates required for vehicles and driving.

iv. We ensure that we will deploy required No.of small vehicles to reach the AWCs located in

the interior places.

v. We ensure that godown facilities shall be arrangedat District Head quarters and at any

convenient places for onward transportation of Food to AWCs with all required facilities for

smooth unloading and loading of food including road connectivity.

vi.We have agency with other transporters to supply the trucks on their transport, in order

to supply trucks without interruption on demand.

vii. We have branches/Liaison in the mofusil to deploy 5-6 vehicles having 3 good tarpaulins

(not plastic tarpaulins) per day of required capacity.

viii. We can deploy vehicles if load is given even for one destination in the case of part

loads. ix. We can supply closed trucks on specific requisition (Usually during rainy season).

x. We ensure that the finished food will be transported to the Anganwadi Centers from

Telangana Foods, within one week from the date of receipt of food from M/s.Telangana

Foods.

xi. We ensure that we maintain sufficient manpower for handling the logistics.

xii. we ensure that unloading of finished food is our responsibility.

xiii. The finished food received from M/s.Telangana Foods shall be distributed to

Anganwadi

Centre on first come first basis. xiv.We ensure that the reconciliation at Godowns shall be done for every 3 months for non

delivery/short delivery supplies. xv.We agree to pay 2% penalty on cost of short delivered Finished Food for non supplied

quantity of Food.

xvi. We ensure that insurance is made to the value of food while transit of goods from Telangana Foods to AWCs.

xvii. we ensure to deploy A digitally alpha numeric literated driver cum operator, who is going to operate the App (Smart Mobile application) and is able to take the bio metric authentication from the concerned anganwadi teacher against the indent and also able to

rectify the minor data entries through smart mobile. And we also have compatible smart Mobiles with 1.3 Ghz Processor speed, 32GB RAM, latest Android software with above 7.0 and antivirus to down load the mobile applications as instructed by the Managing Director,

Telangana Foods.

xviii. We shall have no claim from Telangana Foods, if the Anganwadi centres added or

deleted by Telangana Foods within the purview of the Districts

xix. We shall have no claim towards diversion charges for consignment from center to center within the purview of the District. Further we shall have no claim and objection to deliver

the part loads at centers in respective District as per the directions of the Telangana Foods.

xx. As per the rules of Central Excise Departments, we shall furnish serially numbered

consignment note to avoid objections and complications.

xxi. We shall not withdraw before the finalization of the tender or increase/decrease the rate

or seek for change in the rate after finalization or any time after allotment of contract or during

execution of the contract and if we do so,we agree that we shall be disqualified for ever for

submitting tender to Telangana Foods &we shall have to forfeit the EMD and Security Deposit.

xxii.We agree that the rate quoted shall be firm and that no price escalation will be allowed

during the period of contract.

xxiii.We ensure that we have the experience of minimum two years in transporting bulk

quantity.Experience and other financial particulars are furnished.

5. We shall strictly observe and follow the terms and conditions as stated here-

under

A. We shall deposit the required and fixed amount (7.5% of the cost of Finished Food & Transportation ) in cash or an unconditional irrevocable Bank Guarantee from a Local Branch of

Nationalized Bank towards Security Deposit for each District load which shall be refundable without interest at the end or termination of the contract after deduction of all the amounts

due to the factory.we further agree and authorize the factory to forfeit and retain the entire Security Deposit amount with it if we violate any of the terms and conditions as stated in the tender notice, tender application form and also the agreement that may be executed on

acceptance of our tender.

B. We shall keep vehicles clean and shall not give rise to contamination of the food products

contained in the consignments. The trucks not accepted by the Quality Control of Telangana Foods shall be returned unloaded and for the resultant dislocation in the schedule of dispatches, I/We shall be solely held responsible to make good the loss incurred in case the

Organization engages any other outside vehicle to cope up with the Organization’s schedule of dispatches.If we fail to deploy the vehicles, Telangana Foods shall have the right to invoke clause 3 c of the agreement.The condition will be strictly adhered to & any loss caused to

Telangana Foods be borne by us.

C. I/We shall deploy the vehicles indented in the previous day for the next day (in time) as per the indent placed over phone/written schedule/demand. In exceptional case, it shall be allowed by Telangana Foods for 1 day delay in deployment of vehicles. If I fail to deploy the vehicles

on 2nd day, Telangana Foods shall have the right to recover 3% on the transport charges of the particular centre for 2nd day, 10 % for 3rd day and on 4th day, Telangana Foods is at liberty to engage trucks from outside to cope-up with the Organization’s schedule of dispatches and the

extra expenditure incurred shall be recoverable from me/us. Time and date of delivery shall be essence of Contract.

D. If we fail to discharge our duties in terms of the contract, the factory shall have right to appoint other contractors and use all its resources to complete the work within the stipulated

time and all charges and expenses occasioned by such default on the part of us,shall be recoverable from us or from EMD/SD.

E. We accept the condition that we shall deploy vehicles for part/full loads and shall not put any other load/loads in the truck/trucks other than Telangana Foods materials. We shall accept to seal the part load lorries at the time of loading at Telangana Foods and

we also accept to get the proper acknowledgement of receipt on the way bill the load received with seal only. We shall take biometric receipt for food delivered to AWC.

6. we shall prefer our claims for the transport bill every month. Bills will be submitted before

the 20th day of next month. The acknowledgments of online generated indents (through app)

of consignments booked by the factory to the consignees shall be sent along with the monthly

bills. Along with consignment, factory way bill, in duplicate will be issued as a token of the

delivery of the material. properly filled online generated biometric and manual delivery

acknowledgments from Anganwadi Centres shall be obtained and produced by us.The duplicate

copy of the way bill will be retained at the consignee and the original way bill along with the

freight claims has to be submitted to Telangana Foods within 20th day of the next month . In

case of improper biometric and manual acknowledgments in the freight claims, such

acknowledgments can be sent by Telangana Foods for its rectification to us and the

expenditure incurred by us towards TA & DA shall not be paid. We agree to the condition that

Telangana Foods reserves the right to disallow the claim if acknowledgment is improper.

i.The bills submitted shall include the ESI,EPF and GST remittances.ESI and EPF particulars

shall be submitted along with bills which includes No.of employees(Drivers,cleaners,hamalis

and others) names,attendance and wage sheets.

ii.The Telangana Foods need not make any payment of interest on outstanding bills. The transport bills should be preferred within 20th day of the next month.

Eg.Febraury bills shall be submitted before 20th of March.

ii.In case of improper bills, the bills will be rectified by us at the concerned center& submit within the stipulated 15 days from the date on which the original bills are returned.

iv.We further agree to transport the finished foods packed in various units i.e. 20 kgs and 4-5kgs (HDPE bags)

v. We further agree to quote transportation charges inclusive of unloading ,loading and unloading charges + 18%GST. vi.The District Distribution report shall be submitted to Telangana Foods duly authorized by the

District Welfare Officer of the Concern District. 7. I/We shall deliver the full truck or part load consignments within a period of 10 working days

from the date of receipt of the materials from the Telangana Foods.It is the responsibility of the

transporter to deliver the goods in time at the proper destination, and in no case, the

transporter can claim detention charges in delays in delivering the goods. In case of delays in

delivery beyond the above said period, a penalty of 2% per day of delay will be levied,

calculated on the cost of food and the same shall be recovered from the party.

8. We shall be bound by the liabilities and responsibilities as laid down in ‘The Carriers Act’. The small parcels as consignments of others shall not be loaded into any vehicles containing. Telangana Foods as to cause damage to the consignments of the factory either in the quality or

safety particularly keeping in view of the fact that the consignments of the factory contain food products meant for children, pregnant women and lactating mothers.

A. I/We agree to use 3 good tarpaulins to protect the consignment from Sun, Rain etc.,

Ropes shall be tied in such a way that the goods are not damaged or torn or subject to

undue stress.

B. I/We shall not carry any other goods along with the food products.

C. The transport contractor shall not sublet work either part or whole to any other

transport company or party.

D. I/We agree to transport food to AWC, in any District, if Government allots new AWCs during the progress of the contract on same rate, terms & conditions relating to the said

District.

9. We agree to follow the digital supply chain management applications entrusted by the M.D, Telangana Foods and to download the compatible mobile application to check the veracity of

biometric authentication against the goods delivered to each and every anganwadi centre as directed by the M.D., Telangana Foods.

10. We agree to procure the compatible smart mobiles and network SIM modules for successful implementation of biometric authentication as directed by the director and to upgrade the mobiles as instructed by the M.D., Telangana Foods.

11. i. We shall arrange/ensure safe storage (if absolutely necessary) conditions in the Godown vehicles so as to ensure that the safety and quality of the food products in the consignments

does not get impaired.

ii. The cost of damaged material and any other expenses incurred in this connection shall be recoverable firms. This is without prejudice to our other liabilities as a contractor for the safe and proper carriage of goods.

12. i. Any loss suffered by the factory due to non delivery or any short delivery of consignments and also loss due to damage to the consignment either in quality or quantity

shall be recoverable from our bills to be preferred from time to time as and when reports of short delivery, non delivery and damages are received by the factory.

ii.We shall be held responsible for all transit risks such as Fire, theft, Pilferage, Flood, Shortage etc.,

iii. No shortage in transportation are accepted. If there is any shortage or non delivery of the food products, we shall be held liable to pay to the factory not only the cost of food products and transportation charges but also in addition 100% of the value of the above as

penalty.

iv. Penalty @ 5% shall be imposed and deducted from us for particular freight charges,

whenever we request Telangana Foods in writing to issue duplicate way bill in advance. To get acknowledgement from Anganwadi Centres in extraordinary circumstances such genuine

request shall be reached to Telangana Foods within the period of 15 days from the date of unloading. Other wise the transporter claim shall be disallowed. The Duplicate D.C will be rectified by us at the concerned centre and submit within the stipulated 15 days from the

date of the issue of duplicate DC/Way bill by Telangana Foods.

v. If we do not submit any proof of delivery / properly acknowledged delivery challan and

online biometric authentication with in stipulated 15 days from the date of unloading of goods, we shall be given a further time of 15 days to submit properly acknowledged delivery challan either original or duplicate with a penalty of 5% on transportation charges.

vi. Similarly, if we fail to submit original/duplicate properly acknowledged delivery challan

and online biometric authentication even after 45 days from the date of delivery of material,

a penalty of 20% on transportation charges shall be imposed.

vii. And if failed to submit properly acknowledged delivery challan and online biometric authentication even after 45 days period from the date of material Telangana Foods shall

obtain acknowledgments from the consignee by deputing its personal and the cost of doing so shall be recovered from our EMD/SD, and if not delivered, double the cost of material shall be recovered from our bills/EMD/Security Deposits available with Telangana Foods.

13. We accept the condition that the Managing Director reserves the right to reject any tender or a portion of it or all the tenders without assigning any reasons therefore and the

right to alter, add, delete or modify any of the tender/contract conditions stipulated herein without notice during the subsistence of the contract. The M.D is not bound to accept the lowest tender. Her/His decision with regard to acceptance of tender shall be final and

conclusive. 14. The factory shall have the option to extend the contract on the same terms and conditions

for a further period of three months after its expiry subject to Telangana Foods requirement.

15. Any disputes or difference what-so-ever arising between the parties out of or relating to the conclusion, meaning and operation or effect of this contract or the breach thereof shall be settled by Arbitration in accordance with the Rules of arbitration of the Indian Council of

Arbitration and the award made in pursuance thereof shall be binding on the Parties”.

16. The E.M.D shall be liable for forfeiture if we back out from the offer or seek any

modification in the accepted terms and conditions there of after submission of the tender 17. After submission of transportation bills (in full shape) along with delivery challan (in

original) shall be paid within 30 days. If tenderer backed out alternative arrangement shall be made through other transporters/suppliers and difference cost will be recovered from the party/transporter.

18. Provided that any demand for arbitration in respect of any claims of the contract under the contract shall be in writing and made within one week of the date of termination or completion

of the contract and where this provision is not complied with our claims shall be deemed to have been waived and/or absolutely time barred and that the factory shall be discharged and released of all liabilities under the contract.

19. RESPONSIBILITY OF CARRIER;

i.We are liable to pay all taxes imposed by Central/State Government pertaining to this

contract.

ii.We shall be responsible to abide by all terms in force from time to time and the factory

shall not be responsible for any act of omission on the part of the carrier and/or their

employees/their associates, for non-observance of any provision of the law.

iii. we agree to distribute finished food to all the Anganwadi centres without any

interruptions.

20.i. We assure that we shall abide by the terms & conditions of the tender and such agreement that may be signed on this tender being accepted and instructions issued by the

M.D., Telangana Foods from time to time.

ii. We note that we are invited to be present either in persons or through our authorized

representative at the time of opening of tender iii. We further agree to the condition that the Telangana Foods shall have the right to reject any or all the tenders without assigning any reason whatsoever and its decision in this

regard is final and bindings on us. 21. In case of any accident to the workers engaged by us during the execution of the contract

within the premises of the godown at district head quarter or during transit or at the receiving

end we shall be responsible for the same.

22. All disputes shall be subject to the jurisdiction of District Courts only.

23. Terms and Conditions of Tender enquiry

i) Tender consists of two parts 1) Technical Bid 2) Financial Bid or Price Bid.

ii) Technical bid consists of Tender Schedule (signed and seal affixed on each page), documentary evidence in support of firms registration, financial capability, past experience

and turn over etc., and shall be accompanied by documents as mentioned above under “Eligibility Criteria” apart from Demand Drafts towards cost of process fee.

iii) Price quoted by the bidder shall be a price (inclusive of all other costs like cost of bag,

transportation, handling charges,unloading,loading and unloading and toll gate charges etc.) + GST 18% as applicable. Un-loading charges shall however be borne by the Telangana Foods. If any taxes, duties, cess etc., are increased or decreased in future by the State or Central

Governments, the same shall be made applicable. Rate to be quoted shall be per kgs in Indian rupees and paisa. Price quoted shall be valid for a period of one month after the last date of opening of financial bids. In case of any discrepancy between the

prices quoted in words and figures, lower of the two will be adopted. iv) Only Technical Bids will be opened on-line on due date for the same.

v) Financial Bids / Price Bids of only those bidders who are qualified in technical

bids will be opened on-line on the due date for the same.

24. The online tenders should be submitted through eprocurement portal to the Managing Director, Telangana Foods, Nacharam, Hyderabad by 1.00 P.M on 11.03.2020 along with uploaded copy of demand draft for Rs 10,000/-towards process fee from a Nationalized

Bank (other than Urban Co-operative Bank, Grameena Banks & Foreign Banks) payable to Telangana Foods at Nacharam, Hyderabad.E.M.D shall be paid in the eprocurement porrtal .The technical bid will be opened in presence of the tenderers or their authorized

representatives who choose to be present at 3.00 P.M on the same day i.e. on 11.03.2020. Those tenders without E.M.D will be rejected. Tenders received after stipulated time will not be
