Development Application: Letter of Justification for Lot 89 (#35b) Bass Road, Bull Creek

Please note that we are seeking council approval for the above-mentioned development based on the following points

under the Design Principles of the Residential Design Codes (RDC):

5.1.3 Lot Boundary Setback (Setback to Lot Boundaries):

The proposed building is set back 1.029m & 1.162m from the lot boundary (in lieu of 1.5m as per Table 2a & 2b).

• The design aims to reduce impacts of building bulk on the adjoining properties. The façade is articulated and therefore the impact of building bulk is minimised.

• The proposed design provides adequate direct sun and ventilation to the building and open spaces on the site and adjoining property. The outdoor living area of our proposed site is orientated North. This Northern aspect, as well as ample north facing windows will ensure adequate direct sun and vent is delivered to the home.

• The design minimises the extent of overlooking and resultant loss of privacy on the adjoining property. There are minimal windows along the wall adjoining Lot 88. These windows are also setback 1.5m from the boundary

5.1.4 Open Space:

The open space proposed is 46.6% (in lieu of 50%).

• The proposed design reflects the existing and desired streetscape character or as outlined under the local planning framework. The design provides an aesthetically pleasing front façade and is articulated to promote interest. This will contribute positively to the streetscape character.

• The development proposal provides access to natural sunlight for the dwelling. The outdoor living area of our proposed site is orientated North. This northern aspect, as well as ample large north facing windows will ensure adequate direct sunlight is delivered to the home.

• The design aims to reduce building bulk on the site, consistent with the expectations of the applicable density code and/or as outlined in the local planning framework. We believe the 3.4% variation of to the open space to not be excessive and consistent with the expectations of the applicable density code. While the site cover component of the R-Codes has been exceeded, the outdoor living area has exceeded the minimum requirements.

• The development design provides opportunities for residents to use space external to the dwelling for outdoor pursuits and access within/around the site. The outdoor living area greatly exceeds the minimum requirements of the R-Codes. There are ample opportunities for the residents to use the space externally within the site. There is also a secondary outdoor space on the Southern boundary directly accessible from a living space.

• The design provides space for external fixtures and essential facilities. All external fixtures and essential facilities are compliant with 5.4.4 External fixtures, utilities, and facilities. There is ample room for all these without being visually obtrusive when viewed from the street.

5.2.2 Garage width:

The proposed design has a garage width of 59.5% (in lieu of 50%).

• The proposed design provides a porch projecting in front of the garage which reduces its visual width to 53% of the frontage. The garage is also setback 1.2m from the front of the home. This helps provide articulation to the streetscape and reduces the overall impact of the garage width.

• Due to the curve of the road and oversized verge, we believe that the overall width of the garage does not impact the existing streetscape and maintains a visual connectivity between the dwelling and the streetscape.

Based on the above and in conclusion we would appreciate if the shire could assess the above application on its

merits and finalise the approval.
