Do they come recommended and what are their reviews like?As with most services, a firm recommendation from a family member or friend can beone of the most useful things to consider when choosing an estate agent and perhapsshould be considered the most important. A good recommendation should be a goodindication of the professionalism and performance of an estate agent and in a serviceindustry this is most important.

There are now a number of online review web sites for estate agents where the publiccan review and rate their own experience with estate agents. It would be a good ideafor anyone choosing an estate agent to check the performance of any company they areconsidering using on these web sites first. Sites such as allagents.co.uk, google reviewsand referenceline.com are well established sites that can be used.

Has the agent been successful in selling similar properties to yours?There is no point instructing an estate agent that mainly sells small terraced houses if youhave a large detached house, it’s worth looking for an estate agent that has a good trackrecord of selling similar properties to yours. Are they currently advertising similarproperties like yours? Have a look on their website or websites like rightmove.co.uk andzoopla.co.uk to see what they are selling. If they are selling similar properties the agentshould have applicants already registered looking for property like yours.

Do they advertise on the two biggest propertywebsites?This may not seem like an obvious question to ask, butwith nearly 90 per cent of buyers starting theirproperty search online, your property can’t afford tobe missing. Check that the agent appears on both ofthe two biggest property portals rightmove.co.uk andzoopla.co.uk and not just one as this could result inmuch less exposure for your property.

Do they present properties to a high quality?Check the details of the properties they are currently selling. Are the pictures of a highstand? Are their properties presented as attractively as possible? Are the descriptionsaccurate and most importantly how do properties present on their own web site? Youshould have confidence that the agent you choose will present your property in the bestpossible light.

ContractsAsk to see the contract in advance before signing it and before choosing your estate agent.It is important that you know what the length of the contract is and if there is a cancelationnotice period in case you wish to change estate agents because your current one isunderperforming. You may want to insist on a flexible arrangement, whereby you canreview the relationship from month by month. The total fee should also be clearly shownon the contract and clarification should be made that the fee is on a no sale no fee basis.

Liz Leitch (Lettings Manager of Drewery PropertyConsultants) gives an update on important legalchanges and market news:

The Immigration Act 2014 currently obliges agents andlandlords in the West Midlands to carry out document checksand keep records to identify if a potential tenant has the rightto reside in the UK. The old Tory-led coalition governmentintroduced the measures into one pilot region last December,promising a roll out across the UK in 2015. Speculation is now mounting that the roll out willbe as early as this summer.

The rules for the pilot in the West Midlands obliges agents and landlords to check the statusof would-be tenants for all new tenancy agreements. In most cases this involves checking thetenant’s passport or biometric residents permit and appropriate records will need to be keptfor up to 12 months after the tenancy ends.

The new rules also apply to individuals who take in lodgers and tenants who sub-letproperties. Failure to abide by the regulations will result in fines up to £3,000.

Drewery are keeping a close eye on the development of the Act and have systems in placeready for when it is rolled out.

SMOKE AND CARBON MONOXIDE ALARMS TO BE LEGAL REQUIREMENT IN RENTAL PROPERTIES.

Landlords in the UK will be required by law to install working smoke and carbon monoxidealarms in their properties from October 2015, it has been announced.

The proposed changes to the law would require landlords to install smoke alarms on everyfloor of their property, and test them at the start of every tenancy. Landlords would also needto install carbon monoxide alarms in high risk rooms such as those where a solid fuel heatingsystem is installed.

Those who fail to install smoke and carbon monoxide alarms would face sanctions and couldface up to a £5,000 civil penalty. This would bring private rented properties into line withexisting building regulations that already require newly built homes to have hard wired smokealarms installed.

New regulations will be laid in Parliament to require landlords to install smoke and carbonmonoxide alarms in their properties, and are expected to come into force, subject toParliamentary approval, on 10 October 2015.
