LHA Delays Action on Rental Rule

The LHA postponed action on a proposed rental rule at both the August and September meetings. They cited lack of perti-nent information from LHA counsel.

At the August meeting a number of homeowners objected to the proposed rules. Comments included concern they infringe on property rights; two homeowners questioned both the legal and ethical rights of LHA to impose or enforce any type of rental rules on single-family homeowners.

Kraig Koach, a Sarasota attorney and Landings homeowner suggested such an action could open the LHA to lawsuits.

Homeowner and Eagle publisher , Irwin Starr, had requested, in absentia by e-mail, the Board include The Eagle August edi-torial in the record. It had not been included in the minutes, so he was permitted to read the editorial at the September meeting.

tion violates constitutional “equal protection” guarantees by cre-ating “two classes of unit owners.” This amendment appears to be in response to the 2002 ruling of the Florida Supreme Court Woodside Village Condominium Association v. Jahren, in which the Court broadly upheld the power of Association members to amend a Declaration of Condominium to impose severe unit rental restrictions This new law would not appear to affect any rental restriction approved and recorded prior to October 1, 2004. Liability for Association Information to Purchasers and Lienholders — Condominium Associations and their authorized agents are excused from liability for providing in good faith any information about the condominium or the Association in re-sponse to a written request from a prospective purchaser or lien holder, so long as the information which is provided includes a written statement substantially as follows: “The responses herein are made in good faith and to the best of my ability as to their accuracy.” Defibrifiator Devices — The law providing conditional immu-nity from civil liability for persons who acquire an automated external defibrillator device for use on heart attack victims is amended to specifically apply the law to condominium, coopera-tive, homeowner, time share and mobile home Associations. The conditions involve maintenance and testing of the device, appro-priate training of the person who uses the device on the victim and notification of local emergency medical service authorities of the placement of the device. The new law also prohibits any in-surer from requiring that such an Association purchase medical malpractice liability coverage as a condition of other insurance coverage and prohibits such insurers from excluding damages

EDITOR’S NOTE: The 2004 Florida Legislature passed multiple changes in the laws regulating operation of both Homeowner’s Associations (The LHA and LMA) and Condo-minium Associations (remaining associations in the Landings except the LRC). There are far too many to detail them all here but the following summarizes those The Eagle feels are most relevant to Landins.

One section of the statutes governs Homeowners including the LMA. A separate section governs Con-dominiums Associations. In the summary below they are separated by condo and homeowners rules and by effective date. This is not a summary of all changes nor of the entire law governing these associations. Specific questions should be directed to your own counsel. Daniel J. Lobeck of Lobeck, Hanson & Wells, P.A. has graciously allowed The Ea-gle to reprint his summary of the changes.

Affecting Condo Associations Effective October 1, 2004:

Rental Restrictions: In this significant change the Condomin-ium Act is amended to add the following to provisions concern-ing amendment of the Declaration of Condominium: Any amendment restricting the unit owners’ rights relating to the rental of units applies only to unit owners who consent to the amendment and unit owners who purchase their units after the effective date of the amendment.

Reserve Waiver — The Condominium Act is amended to clar-ify that votes to waive, reduce or transfer reserve funds may be cast only by the unit owners subject to assessment for the re-serves in question. Previously, this law only specifically referred to “multi-condominium Associations.” Question and Answer Sheet — The requirement that condo-minium unit owners provide a certain question and answer sheet to resale purchasers, which had been repealed, has been restored to the Condominium Act. Since that repeal, Associations had still been required to prepare and maintain the question and answer sheet to provide to any owner or purchaser upon request, even though owners were not required to provide it to purchasers. Affecting Home Owners Associations (Effective October 1, 2004) Owner’s Right to Add Board Agenda Items — The Board of Directors must include on the agenda of a Board meeting any item of business requested by petition of at least 20% of the total membership voting interests. The meeting must be held within 60 days of receipt of the petition, upon not less than 14 days’ written notice of the meeting to all members. At such a meeting (but not at Board meetings generally), each member may speak for up to 3 minutes. The Board is required to “address” the item added to the agenda by petition but is not obligated to take further action. The amendment does not state whether it is sufficient for one or more members of the Board merely to discuss the item or whether the making and disposition of a motion is also required in order to sufficiently “address” it.

(Continued from page 2) Security Signs — The following protection for security signs is added: Any parcel owner may display a sign of reasonable size pro-vided by a contractor for security services within 10 feet of any entrance to a home.

Notices of Certain Board Meetings — Fourteen days notice must be provided to owners of any Board meeting to consider a special assessment (not just a “non-emergency” special assess-ment, as in the Condominium Act) or parcel use (“Rules that regulate the use of parcels in the community”. The notice must be mailed, delivered or “electronically transmitted” to the mem-bers as well as posted conspicuously on the property. Alterna-tively, it may be broadcast on closed-circuit cable television not less than 14 days before the meeting. Oddly, although the notice for a meeting considering a change in a parcel use rule must state that subject will be considered at the meeting, no comparable requirement is explicitly provided for the content of notice of a Board meeting to consider a special assessment. Amendments for Home Owners Associations and LMA, (Effective June 23, 2004) Fine Collection — As in the Condominium Act, the Associa-tion may not file a lien to collect an enforcement fine. Also, it is added that the prevailing party in any action to recover a fine is entitled to recover reasonable attorney’s fees and costs (although that is probably already implicit in the existing law). Mandatory Mediation — In a major revision, mediation before the Division of Florida Land Sales, Condominiums and Mobile Homes is required prior to filing litigation in most HOA disputes. The disputes subject to mandatory mediation are those concern-ing use of or change to a parcel or common property; meetings of

How many believers does it take to say an idea has “momentum?”

As a regular attendee of both the LMA and LHA board meetings we are hearing con-cerns “The Landings is looking shabby, long in the tooth,” and similar comments concerning the conditions and appearance of our community.

Comments run the gamut: road is uneven; some drive-ways don’t drain properly; some driveways are in terrible shape, some need pressure washing; there are dirty roofs; private home mailboxes are of a dated color and style; cars and SUVs parked in drives instead of garages; streets are congested with parked cars; trees around FPL streetlamps aren’t trimmed; houses painted an “undesirable” color - with board approval; landscaping and grass not “up to stan-dards.”

You get the idea. Many concerns come with

requests for new rules or stronger enforcement.

We don’t envy the boards’ job of separating issues of personal taste and property owners’ rights from designated responsibilities as defined by rules and covenants.

We too want The Landings to be attractive and retain property values; but we worry a small number of voices among our 702 property own-ers, could bring rules or in-crease enforcement rather than dealing with individual problems on an individual ba-sis.

At a recent meeting one long time homeowner commented he didn’t what to see the “Gestapo tactics” of one board some years ago. We agree.

Current boards have shown care and wisdom. Property owners can relieve some of the pressure by tending to their own maintenance.

Let’s work to protect The Landings from contentious board/owner conflicts we’ve read about.

in the current Eagle. A stop sign on Landings Boulevard at Kestral Parkway North makes no sense at all. First, the location can't be consid-ered a 4-way corner; North and South Kestral Parkway being offset by at least 75 feet; and there is no east-bound stop sign. Further-more, the intersection, as constructed, asks for a natu-ral slow-down by west-bound traffic. The break in the middle islands of Land-ings Boulevard combined with the beautifully land-scaped island at the end of Kestral Parkway North, asks for a driver's pause. It's an ill conceived traffic barrier, if that's what it's meant to be. To encounter it shortly after entering our upscale community leaves a bad impression, putting it mildly.

I also agree wholeheart-edly with Jack Jost's input on the North Gate area.

While I'm at it, the recent paint job of the two paved surfaces at the two en-trances looks horrible. The curb-sides there are all splashed up wth the red spray. Not exactly the work of a reputable painter and a first-impression eyesore to the more discerning ob-server.

Editor, Thanks for laying out a ra-tional approach to home-owners' rental policies. My opinion, (coming from someone who has no plans to rent his home now or anytime in the future) is that your (The Eagle’s editorial) plan makes sense and should be adopted just as you describe it.

Editor, The last (August) issue of the Eagle is loaded with Landings issues and discus-sions of them by Landins. I applaud your success in motivating people to partici-pate in our community’s decisions. As one of those motivated people I address a couple of those issues. You criticized the rules proposed by the Homeown-ers Association to limit the leasing of homes by their members. I agree they are pretty tough and some eas-ing would make sense. But they would not be a viola-tion of the rights of those homeowners who want to rent their homes. This is not an ordinary residential neighborhood. When we bought our homes we bound ourselves to an elaborate set of documents regulating the manner in which we use and maintain our properties. And we granted power to the elected board of our association to supplement the restrictions in the documents by adopt-ing rules and regulations. In return for the rights we sur-rendered we received the right to enjoy the benefits of those restrictions, namely that the same rules and regulations would be im-posed on our neighbors. The board’s responsibil-ity is to adopt whatever rules it believes, after con-sidering any comments re-

ceived from the members, will maintain and preserve the character and quality of this regulated community. There are many differences in the law regulating condominiums. They don’t apply to home-owners associations. Beth Gourley hopes that the Eagle can persuade drivers going west on Landings Boulevard to obey the stop sign at Kestral Parkway. I hope that the Eagle can per-suade the management asso-ciation board to remove the stop sign. Some drivers will drive through when they feel that a stop sign doesn’t belong where it is. That applies to this one. It makes sense to have signs on both Kestral Parkway North and South at Landings Boulevard, but not on Landings Boulevard. That is the community through-way. Bob Greenfield Landings Blvd. (ED: The State Legislature is gradually making the rules more similar and is obviously tightening control over both condo and homeowner asso-ciation strengthening owner’s rights. he was Sarasota's first city manager in 1946). I remem-ber some of his rules in run-ning a city. One that always comes to mind is that no flow of traffic should be stopped if no harm is involved. That is certainly the case on entering the main gate. The stop signs entering north and south onto Landings Blvd. are proper, and adequate, but the flow should be unobstructed on Landings Blvd.

A side note: I refer you to the case "Windom vs City of Sarasota" in the '90s. That related to the consequences of speed bumps and how they should not be allowed as a traffic abatement device. The case was decided in my fa-vor, with the order to the city to remove all speed bumps and not to add new ones. The city appealed the case. The appellate court in Lakeland ruled in favor of the city, saying "Windom had no standing in the case". What that meant was that I did not have to traverse streets with speed bumps to reach my destination. The judges never commented on why the bumps were more of a hazard than a help in controlling traffic. My hope is that some day a person will file another suit where that person has no alternate street to use in reaching a destination. If any-one is interested, we could sit down over a cup of coffee (maybe a pot) and give our views on speed bumps. Ask any engineer if he/she was

taught in college that streets or roads were not to be built with a smooth surface, but were to have intermittent elevations. Any traffic engi-neer will agree with that, but also will say he has to do "what the boss says", and that is usually the direc-tion of elected commission-ers who respond to persua-sion of special interest groups, not engineers.

I hope other readers will join in offering comments regarding Mr. Drybrough's Commentary, and also the letter from Jack Jost in that issue.

Editor, In deference to the ad in

the recent Eagle by Rick Koenig, I agree Landings homes are undervalued on the real estate market, but only by those who do not live in and appreciate the Landings.

We are a best kept secret. And I can't really say that I want that to change. I en-joy the privacy and security we experience. As a home-owner here, we are lucky, and doubly lucky if we are not selling, because if we are undervalued, we also pay less in taxes.

That said, as a REAL-TOR, I feel the comparative market pricing finds its way to even things out. We may be low now, but it doesn't take but a few sales

to change that. Those who are doing listings in the Landings know how desir-able we are, and how fast we sell. Perhaps in discussions with the seller, they should not be so anxious to list so inexpensively. Perhaps all involved can make more of the sale. A little more ag-gressive pricing, and home-work by the listing agent, and we won't be underval-ued anymore.

As REALTORS, we also have to get the bank's ap-praisers educated, so they agree the values should be higher, or we won't be able to sell at an elevated price.

Hopefully, in the long run, that won't change the char-acter of our neighborhood; but if it does, it will enhance it.

Editor It's nice to see the plaza

revamped. Its new colors are both elegant and invit-ing. However, there is one missing - and from my per-spective a major one - the large sign on U.S. 41 that represents the plaza itself and its shops has not been repainted. It's the same dirty grey that the rest of the plaza was before. What a shame! Whoever is in charge ought to know that the more attractive represen-tation the plaza gets, the more potential customers will visit. The shops will

thrive, maybe full occupancy could be achieved, which is good for shopkeepers and Landings plaza management alike. I went in the manage-ment office several times since April, and made them aware of it, to no avail. I hope The Landings Eagle can make it happen.

Additionally, Sunday Au-gust 15 the Herald Tribune's story titled :"Revenge of the lawn:

Those manicured yards take a toxic toll" by Joan Lowy caught my attention.

It made me aware of the toxicity of fertilizers and pes-ticides. Bird poisonings in residential areas is called by wildlife biologists "lawn care syndrome".

Xeriscaping is a viable al-ternative. For those of you who have a well, let me quote further that "nitrates and phos-phates from lawn and garden fertilizers pollute the water table, leading to algal blooms that choke the oxygen form ponds and lakes."

A Critical Eye - A Guest Commentary

By Fritz Drybrough When I first suggested this article to our editor for construc-

tive observations about our community it was with the idea that “we” would be able to bring our individual ideas and suggestions as to how our standards as a “first class” residential subdivision are maintained and/or improved upon. I am appreciative that many of you have taken the time to respond to this idea. My background as a developer included a sensitivity for detail because it’s the “little things” that often make the differ-ence between something good and something outstanding. Sort of like the piece of chocolate on the pillow.

I would appreciate expanding our vision to the things that surround our neighborhood. As an example, why hasn’t the pothole in the middle of the South driveway of the shopping center been repaired? And while we’re at it, it’s been several months ago that I pointed out the confusion caused by the strip-ing not being repainted on the same roadway? The manage-ment of the Landings Shopping Center has evidenced their good intentions by the repainting of all the facades and trim. The palms have been recently pruned, but the rear lighting is still obstructed by overgrowth in some areas – Yes, I drive be-hind the center as a shortcut and it could stand some tidying up too.

There has been a sort of widening of Phillippi Shores Drive – I assume for the eventual access to the new Phillippi Shores Landings – but it certainly wasn’t to the same standards that LMA was held to by the County when we improved the South access to the Landings – hmmm. I wonder why? No curbs or lighting are the obvious differences. The offer of landscaping the area by the developer is certainly going to help and maybe he hasn’t finished everything yet. I am writing this between hurricane Frances and Ivan and want to acknowledge the fine job being done by our LMA board and LRC staff in handling this situation. I would have doubted that ‘white caps’ would have appeared on Starling Lake, but there they were! We have surely been most fortunate to have escaped the wrath inflicted on our neighbors to the East and South of us. Many thanks to all for your efforts.

future. However, Board member Stan Lampert did say the board would not act without input of homeowners.

The Green Book was a subject at both meetings. There were objections LHA board members were not listed separately and objections no addresses for homeowners were included. The board agreed to look into the board listing issue and explained “no addresses” is the LMA policy in publishing the book. They agreed to supply the homeowner who raised the issue a listing of homeowners and addresses.

Other items discussed over the two meetings include: ●Large numbers of cars in driveways, sometimes overflow ing into the streets. ●People with multiple car garages who still leave one or more cars parked in the drive, including large SUVs. The board explained there is no basis for legal action unless they are commercial vehicles or trucks. ●The board voted to have counsel develop a cease and desist order against the owner of several Landings properties pre-venting any work on the properties until appropriate plans are submitted to and clearances obtained from the LHA. ●A homeowner raised the issue of a new fence constructed between his property and his neighbor which appeared to be a dog run and was built without LHA approval. The neighbor is an LHA Board member. Apologies were made for the slip-up, but the fence did meet necessary standards and was ap-proved, If dog noises did become an issue that is a separate problem and would be handled as a nuisance issue, should it occur.

(LHA from page 1) Kestral Park Way Pump Station Done After months of work the Kestral Park Way South sewer pump station is complete. We should see less of the “honey trucks” and other repair vehicles with the new pump in place.

The site was also remodeled to accommodate standardized repair vehicles that can own back right up to the pump even when it is necessary to use a small crane to pull it from the ground.

Should there be a break in operations emer-gency notifica-tion is radioed to sewer authori-ties. The red signal light will activate.

The Landings Survives Charley, Frances and Ivan Relatively Unscathed Landings property owners are counting

their blessings after three close calls. Charley headed right for Sarasota and the

Tampa Bay, but took a last minute swing inland before its forecasted time, sparing us but bringing devastation to those not far south.

Frances came close behind actually bring far more damage than Charley, but still minimal to The Landings. All the photos on this page are from Frances.

Even with broad and lengthy power out-ages in the area, The Landings had only occasional, brief interruptions. Both the underground utilities system and the recent reinstallation of main feeder lines probably contributed to our good fortune.

A hurricane weary population saw initial tracking for Ivan and many packed up and headed north. Despite the intensity and tracking suggesting a direct hit, few Land-ings’ residences boarded-up.

But high pressures on Ivan sent him to the northern Gulf coast, leaving only showers and light winds for Sarasota and The Land-ings.

It's human nature to take life (and people) for granted when

all is running along at normal speed. Then something out of the ordinary occurs – Hurricane Charley is a good example – which causes us to sit up and take notice.

Let's hear it for Kevin Richards, Landings Racquet Club manager and his staff, who did all that was necessary to ensure our club didn't blow away! Never mind that fickle Charley decided to change directions at the last minute. No one could have known that in advance. It was more than likely the storm would have plowed right through The Landings, damaging homes, downing trees and causing all kinds of havoc at the Racquet Club.

Kevin saw to it the outdoor tables and chairs were dismantled and safely stored in the clubhouse, that the courts were cleared of all moveable objects and the nets removed, that the pool deck lounges and chairs were lowered into the pool itself, pre-cluding Charley from using them as flying missiles, which could have caused untold damage.

Thank you, Kevin, for preserving that which we've become so accustomed to having and just take for granted. And here's another quiet hero: fellow Landin Norbert Bieser, who single-handedly hefted all the pool deck lounges and chairs out of the pool and back onto the deck! What muscles, what stamina, what a great neighbor.

Maybe there are some other heroes out there. Want to share them with us?

owners who have not paid annual dues. ● Striping of the resurfaced Landings Blvd. is to take place.

A determination was made subsequent to this meeting to use a plastic based striping rather than paint for longevity. There was some discussion of what some feel are “confusing” mark-ings between Landings Plaza entries and the Trail. It was sug-gested any changes ion those markings are a matter for Sara-sota County. ● Pothole repair estimates are being prepared.

A damaged drain grate near Landings Circle will cost about $650 to replace, though it may be possible to switch it with another in a less critical area. There was a discussion of the problems with multiple cars overflowing into the streets for parking at several residences. Lack of action on cleaning up the dead landscaping on Starling

Drive was mentioned. That had been cleaned up by mid-August and was awaiting completion of the landscaping plan. The total project was budgeted in the mid-thousands.

The September meeting of the LMA could take no official actions due to lack of a quorum. The board members present provided an informational meeting and took several comments from property owners.

The President reported: ● The entry sign work was underway ● There seems to be some lack of agreement among home-

owners regarding sharing costs for drainage renovations on

(“LHA from page 1) Landings Lane. Until there is agreement from homeowners the monies approved by both LMA and LHA will not be spent. ● The “deep-agricultural” well utilized by the LMA to irri-

gate public areas is aging badly. It is not likely approval for a similar well can be obtained under current Florida water poli-cies. Therefore it may be necessary to budget the drilling of several shallow wells, the type used by homeowners for irriga-tion, over the next few years. ● A car was ticketed for parking on a Landings street over-

night. The owner indicated he would be coming to the LMA meeting to object, but didn’t show!

Anna Gervait, of Flicker Field Circle raised several issues: ● The recently repainted sign at the Landing Plaza did not

complete the job leaving it looking shabby, reflecting, she felt, on The Landings. It was explained the LMA has little control of the Plaza though the Plaza does share in some maintenance costs on the roads. But an informal request would be pursued. ● The lamp post installation on the “under lit” Flicker Field

Circle seems to be taking forever. It was explained this is in the hands of FPL who must make the installation. ● People seem to be allowed to pass the Main Gate after

10PM more easily than they should. The Board assured Ms. Gervait they would talk to Richard Mayo on this matter and make certain there is proper enforcement. ● She urged addresses be included in the Green Book.

Board members said they are not included because people have requested the information be kept private. Bob Fernander expressed concern over the inaccuracies in the

newest Green Book and material not updated. (Please see “LMA” next page)

We had a ton of calls about the hurricanes and evacuation. To clear the air: if and when this area is under a mandatory evacuation order, the Sheriff’s office will drive through the community and announce it over loud speaker. You will also hear about it on the radio and see it on the news. Many of you called the gate asking if you had to leave and some seemed rather perturbed when told that

we didn’t know. Until the Sheriff comes in and tells us, we know just as much as you do -- in fact you probably know more! We don’t have cable TV and our antenna doesn’t get any stations. The only radio we have is little bitty clock radio. Here’s our best advice: if a hurricane is

headed our way and you would rather not be here, then by all means leave and go somewhere safe! Don’t wait for the police or security to tell you to leave; by that time the hurricane is within two days of striking and the roads leading to safety (places not affected by the storm) are jammed with traffic.

We have received complaints about residents who walk their dogs and don’t clean up after them. Please refrain from leaving dog feces all over the property. Bring a paper/plastic bag with you when you walk your dog and dispose of the bag properly.

LMA has instructed the security team to leave written notices on vehicles that are parked on the street overnight. If you leave your car on the street all night and awake to a “ticket” on your windshield this means you are in violation of LMA rules regarding cars left on the street over-night. The security team only writes the tickets and the copies are given to LMA. LMA is responsible for levying fines, letters, etc; security is not in charge of that.

We are still getting reports about resi-dents, guests and service people running stops signs, blocking the right of way, and speeding. This needs to stop... LMA will not hesitate to send out letters and levy fines. Service peo-ple need to heed the rules as well; we don’t want to have to call the companies they represent and complain..

LRC Adds Clinics, Sets Schedules

The Landings Racquet Club will host After School Junior Tennis a program for pre-teens and post-teens. The schedule includes sessions for 13 years and over and for 12 years and under. The prices per four-week sessions are: one hour per week ($72); one hour twice a week ($128); one hour three times per week ($180); 90 minutes per week ($84); 90 minutes twice per week ($152); and 90 minutes three times a week ($216). Racquet Club Library Expands Adds Reserve Book List

by Ralph Ricapito The Library at the Landings Racquet Club has expanded once again to accommodate the more than a thousand books now in the Li-brary. The room is broken down into three categories : 1) Hardback Fiction, alphabeti-cally by authors; 2) Paperback Fiction, alpha-betically by author and 3) Non-Fiction ar-ranged by topics. We’ve also started a reserved book section of approximately one hundred books, recent best sellers or favorite books of members they prefer not to donate to the Library but are anxious to share them with other members. How the reserve book list works is quite

simple. A list is attached to the basket for the returned books. If you see a book you might like to read just put your name, phone number and the title of the book on a slip of paper and hand it in to the Pro Shop. You will get a call telling you to pickup the book at the Pro Shop or let you know where you are on the list. Such books like Joanne Meyer’s new book Fortune Cookie, The Da Vinci Code, and Alexander Hamilton are on the list.

The Library has become a popular addition to the Club thanks to members who have contributed such good books, visit the room so frequently and return the books so promptly that we can all utilize and be proud of this wonderful asset.

Drugs: Getting the Best Price A First Person Report

Editor’s Note: Drug prices have continued to increase, despite popular and govern-mental pressure to control them. The advent of the “Medicare Drug Card” seems to have added as much confusion as it has price relief. This account of purchasing blood pressure medicine, by a Landin wish-ing to remain anonymous, provides important tips on getting the best price.

If you’re not lucky enough to still have one of those retire-ment plans or insurance policies providing drugs you’d better become a “smart buyer!.”

My doctor recently prescribed blood pressure medicine trying to get my 140’s over 70’s to the newly recommended levels of less than 120 over 80!

The initial prescription was for Lotrel 10/20. My first discov-ery was the drug is not available in Canada, therefore no Cana-dian purchase to reduce cost. I did discover an internet drug store offering the drug for $225.00 plus $3.24 postage/handing for 100 doses, substantially less than any local supplier. Con-tacting my doctor was necessary to alter the prescription to the quantity providing the best price.

By the time for the renewal of the prescription, the price from my internet supplier had increased and a local source now had the best price.

Saving was simply the result of careful shopping, checking internet sources and obtaining a change in the prescription.

A more significant, long term saving came when the doctor

added a generic diuretic to the blood pressure fight. The prescription called for HTZC (Hydrochloriazidine) 12.5g. Shopping around locally I found a 100 day supply would cost

anywhere from $25 to $40. A call to the same people supply-ing my earlier prescription, at the lowest prices I had found, got a quote of $39.95 (plus postage/handing) for a 100 dose supply.

Surprised at the seemingly high price, I acted on a hunch ask-ing how much for a 25g. dose?

To my shock the reply was: “We can give you those, etched for cutting in two, for $8.95 plus postage and handing.” Check-ing a local supplier I found the 25mg dosage in 100 unit quanti-ties for $5.87. . .no postage! Shopping plus contacting the doctor to change the prescrip-

tions dosage , and pill splitting resulted in purchasing the drug for $.029 per dose vs. as much as $.40 per dose. Annual sav-ings, by shopping, as much as $135. Yes, I do have to cut the pill in half.

Here is my list of suggestions for checking out your prescrip-tion costs: ●Check all available sources for costs including internet and Canada. ●Ask about price differences for various dosage levels and pill quantities. ●Be prepared to ask you doctor to alter the quantity of pills you can obtain at once and the dosage level, if the doctor is willing to let you divide the pill. (Generally the best, prac-tical price break comes at 100 pills.) ●When renewal time comes don’t automatically assume where you got the best deal last time is where you will get the best deal this time. Re-shop!

The moral: even with drug cards, hard as they are to compre-hend and compare, be independent and shop for your drugs while communicating with your doctor on dosage and quantity options. It can save you large amounts of money!

Travlin’ With Landins - Why Malta? by Dee Ricapito

That’s the question everyone asks about our vacation. Ralph is interested in ancient history - even took courses at Sarasota Tech. His professor said Malta had ancient sites dating 1000 years before the pyramids of Egypt.

We found there are five sites preserved within the Islands of Malta and Gozo because they are deemed World Treasures by UNESCO. Some have been standing for over 5000 years, making them over l000 years older than Stonehenge. It was a real adventure investigating the carvings and bones of the pre-historic relics found at these temples.

Three historical periods of Malta were of interest to us: (l) The Ancient Period with its Temples and altars found at Hagar Qim, a colossal stone sculpture at Tarxien Temples depicting a Mother Goddess, the underground Hypogeum that we were lucky to tour since they only allow ten visitors every two hours, and on Gozo the absolute oldest freestanding stones at Ggantija Temples. Still a mystery how they were built. (I really feel infinitesimal in time after my visit there). (2) The Crusade Pe-riod of Valletta where The Knights of St. John resisted the

Great Seige of Malta (in 1565). We s a w t h e Grand Mas-ters Palace a n d t h e knights in shining ar-mor. I sat in

the same chair where the Pope and the Queen of Eng-land sat in when they visited the Palace. And, (3) The World War II Period, where they played a memorable role and resisted the attack of the Axis powers when Malta got the reputation of being the thorn in Rommel's

side. Many Americans will not be able to tell you the location of

Malta which is 60 miles south of Sicily, and the smallest nation in the European Union. Even though Malta is a highly visited tourist area where English is the official language, less that l% of tourists are American. Yet, it's a movie making mecca where TROY was filmed , "The Gladiators" and "Popeye" with Robin Williams.

Another highlight was mingling with the Maltese people, riding the buses from village to village, and walking and talking to so many friendly people who seemed to love Americans. We enjoyed a night of festival and fireworks. We looked into peo-ples homes and were amazed with the clean high standard of living they en-joyed in their beautiful small homes with marble floors and wooden an-tiques.

I saved the BEST FOR LAST: The main highlight of the whole trip was ROMAN! Upon return we stopped in New Jersey to visit our newest addition to the family, our first grandson Roman

Robbie Salum’s Tennis Tips

My next three columns deal with the three basic doubles formations, Both-Up Formation - Both-Back Formation, the Up-and-Back Formation and Side-by-Side Formations, . Each corre-sponds to a strategy.

Both-Up Formation In the first two formations: Both-Up Formation or Both-Back Formation partners are positioned at about equal depth. If one stays half way back or up

at the net, the team is really in a mini Up-and-Back Formation — either at the net or baseline. which opens an angular channel be-tween them.

The third Doubles formation is the Up-and-Back Formation called the Shift Position of the Up-and-Back Formation. There are variations: Australian Doubles, “I” Formation and when one team switches during a point.

The Both-Up Formation is the most offensive way of “attacking doubles”. Positioning gives your team the best chances to force or generate angle shots. Your team keeps the number of unforced errors low, pressure more the opponents and you both may hit more winners.

The Both-Up Formation's vulnerability is the exposure and unprotected formation. How often you use the Both-Up Forma-tion depends on how good your team's net game is and how good your opponents are. Usually some teams that are impatient want to play and win "right" away. In another instance opponents that

recognize your move constantly play lobs as defensive maneu-ver (Both-Back) to force your team to chase lobs.

The formation is used in two ways: Randomly and consis-tently.

Both-Up play strategies are two very different games. That is, some doubles teams fight to get into the Both-Up

Formation on every point, and some move into it only on occa-sion.

Here are the requirements you need for each: • To succeed Attacking Consistently in Doubles, both you

and your partner must have penetrating volleys and dependable overheads; at least one of you should be able to get and smash lobs.

Basically to be successful your team may require the follow-ing skills…

• To succeed with random Both-Up play, both you and your partner must be able serve and volley, rush to the net with the return of serve, place volleys, and at least one of you should have a reliable overhead.

Occasionally your opponents on the defensive, hitting off the back foot hitting you floaters, which are soft, high returns easy to volley. Even if one of this back-foot shots is a lob that gets over you, it's bound to be a high-flying defensive one. So you or your partner will have time to run back for it.

Therefore, when the Both-Up Formation is occasioned, most doubles teams can play it. It gives you great gratuity points and angles.

Remember you play at the level where you are at, but you and your partner may improve on how to play Both-Up, be-cause sometimes you have no choice. Sometimes you're forced into the Both-Up Formation by a short shot or a drop shot.

11 years old. Only child at home. In a home where the par-ent’s bedroom is on one side of the house, and the other bed-rooms are on the other side of the house – way on the other side of the house.

11 years old. Not a lot of friends. All alone on the other side of the house.

Sure, we have 2 cats. But cats are not always good company. They are cats. Cats are aloof.

The 11 year old wants a dog. We are the parents. We discuss a dog. You have to let a dog in and out. A dog wags its tail. You have to walk a dog. The dog walks give you needed exer-cise. You have to feed and water a dog. The dog can’t wait to give you a kiss when you walk in the door. You have to bathe a dog. The dog gives you love and knows when you have had a long hard day. You can see it in their eyes. A dog is expensive to care for. A dog loves to fetch when you throw a toy, and to play tug of war with it. A dog can’t always wait for you to finish what you are doing so far from it’s home. The dog puts its head in your lap. You must rush home to the dog. You rush home because you love the dog.

OK we say. OK, you can have a dog. If the 11 year old had a tail, she would be wagging it! OK, BUT…the dog must fit certain parameters, certain criteria. The tail stops wagging.

OK, so here it is: No puppies, I have no time to train a dog, to stop it from teething, to teach it toilet habits (no puppies means NO PUPPIES!). The dog must be small, but not too small – 20 to 30 pounds (closer to 20 is better, because it will grow) (no, a boxer is too big). It must have short hair – not so much to groom or shed (a sheltie is pretty, but you have to comb its mane and back to get out knots and dirt). It must not be a breed that barks too much (love a beagle, hate the baying). Hopefully it will be a dog that likes to sleep during the day when we are gone to school and work, so it doesn’t get in too much mischief (like a Jack Rus-sell terrier). Has to be a female (male dogs have many problems – sort of like men, but that’s another story). She must like cats (we have 2, hey, no one said it was going to be easy). And it can’t be too expensive (a char pei is cute, but pretty pricey).

The pound may have just the dog. And so we started by calling the pound for its operating hours.

Then we visited and filled out prospective parent cards. And we looked at big dogs, and small dogs, and mean dogs, and sweet dogs. They all wanted to come home with us, but they weren’t the right dog. Too big, too little, too much hair, this one might bite, too lively, too young, too old. None just right.

And we visited, and visited, and visited, and visited, and vis-ited, and visited, and revisited. And we went to the County pound, and the Humane Society of Sarasota. And we went to

Wow......this year's hurricane season sure kept the LRC Staff on it's toes!! Moving out-door furniture inside, taking down or rolling-up windscreens on all 8 courts, putting all the pool furniture in the pool, etc.......and then "undoing" all those actions required a lot of time and a lot of effort. I am very proud of the LRC Staff (especially for all they did in preparation for hurricane Frances), as I was away on vacation. Sarasota, and the Landings Racquet Club has been VERY fortu-

nate......at least so far. We did lose one court light on Court #5. Two additional lights were slightly damaged. We also lost all the water coolers on the courts, even though we attempted to tie them down!! All in all, not too bad, especially when one considers those truly un-fortunate folks who had their homes demolished and even loved ones lost. I guess my message to all our members and everyone who reads this column is the following. Take the time NOW to make sure you have everything you need in case the next Hurricane decides to come through our area. If you have questions about your safety, go to a shelter or someplace where you will be safe. And finally, since none of us know when our day will come, let's all try to do a better job treating everyone with respect and kindness. In the great big scheme of things, I think most of us occasionally forget how important family, friends and neighbors are!

LRC President’s Report By Bob Fernander

August and September have been excit-

ing months dodging hurricanes. Hurricane Charley passed too close for comfort to our south followed by Frances that just missed us to the north. Ivan caused us much anxiety as we prepared the club once again for a big blow. We did sustain some damage to the courts and lost one light pole on court 5. We hope to have that re-placed shortly.

In spite of the storms and incessant rain we managed to make some progress. The fencing pro-ject on courts 5 - 8 should be completed before the end of September. Our great staff did much of the grunt work. They sanded the rust from each post, applied a coat of primer paint, a special rust inhibitor and a final coat of special green protection. Next summer we will replace the fencing on courts 1 - 4. With the replace-ment of the rusty fencing with vinyl fencing and a few

fence posts, we should not have to revisit the fencing issue for quite a few years. We are also addressing the strengthening of the rusting light poles, as they are obviously quite vulnerable to high winds. Replacement is very expensive so if we could rea-sonably add a few years of use to them we intend to do so.

Here is a subject we seldom address but frequently gripe about. Tennis was begun and developed as a genteel sport for ladies and gentlemen. Manners, etiquette, behavior, courtesies,

private homes. And to pet stores. And to the dog show. And even to a cat shelter.

But no dog that was just right. We live by Pet Smart. They sometimes bring dogs for adop-

tion. We visited Pet Smart. They had no dogs that were just right. But….they suggested the Suncoast Humane Society. All the

way in Englewood. We had lived here 5 years, but had never traveled 25 miles

down the road to Englewood. It was way over there. And we were here.

But…they thought there was a dog there – our dog. Short hair, female, about 25 pounds. We call. Sure enough. They might have our dog. Does it like cats? We don’t know, they say. Wait a minute, we will put her in with cats and see how she does. We wait a minute. Back she comes on the phone. The dog doesn’t seem to care about cats at all. We are coming, we say. Do not give our dog away. We are on our way. Please hold her

for us. Here we come. And we jump in our car. All 3 of us. To go get our dog.

And we travel down the 25 miles. At last, after 6 months of looking. Will we find our dog? My wife says yes.

I can’t argue with my wife. I never win. So I know we will find our dog.

(“Midge” from page 23) We hunt and finally find Englewood. And then we hunt and finally find the Suncoast Humane Society. Hey, pretty nice digs! We park. We go in. Pretty nice inside, too.

We are here for our dog. Our dog. Fill out the paperwork. Then, at long last, go inside the hallowed halls to find our dog.

Too big. Not our dog. Too small. Not our dog. Jumping up and down. Not our dog. Smallish dog, female, short hair, seemingly very friendly, looks smart, doesn’t bark at us.

This is the one we told you about, they say. This is your dog they say. We have been looking for a long time, we say. We have looked at a lot of dogs, we say. We must have time with her to know (although we already know). And we go in the little fitting room, and get fitted with the best dog, just the right size, female, smart, short hair, not overly lively, doesn’t care about cats, doesn’t seem to bark. Our dog. Our dog. Our dog. And the dog seems to know it, too!

On the way home, we cuddle and talk to Midge (her adoption agency name) and discuss names. We must have had a hun-dred or more names we bandied about.

But Midge was Midge then, and we knew that Midge was Midge now and forever.

Our Midge. Our dog at last! OK, so here it is: Not a puppy. Already trained for both the bathroom and

and appearance are equally as important as the rules of play and we each have expectations that attention is given to them all. I and other members have seen a relaxation of these traditions and would like to encourage our member’s awareness and the practice of them.

Here are a few frequently observed infractions. (1) While a game is in progress, don’t cross the court. You are there for exercise so walk around to your court. That is true of the Pro’s court while a lesson is in progress. (2) As an observer, don’t engage a player in a conversation and expect the other players to wait happily. While taking and paying for a lesson, one does not appreciate someone engaging the Pro in conversation. (3) Each player is equally entitled to a warm up before the match starts, so try to hit the ball to each other rather than trying to kill the ball or put it away. (4) Dress properly. That means wear tennis attire. Anyone that can afford to belong to the LRC surely should be able to afford proper tennis clothing and shoes. (5) Please heed your court reservation or cancel it far enough in advance for someone else to use it. (6) Play on the court as-signed. If you wish for some reason to change courts, please consult the staff in the office. (7) After office hours use com-mon sense about the use of the courts. Stay off if it is too wet. Don’t mess up a clean dressed court if you can play on one al-ready used. Question any stranger’s use of the courts. Thank you in advance for your cooperation.

☺� There are problems with mailboxes. Cars, delivery trucks and service workers park in front of them making it im-possible for the mail carrier to pull up to them and difficult for homeowners to get to them. ���� A reminder, it is illegal for anyone, including service

people to place anything indide mailboxes without appropriate postage and address. ���� Why can’t service workers park without blocking access

to roads at islands? They could pull in driveways if there weren’t so many trucks with oil leaks. ���� The stop sign on Landings Blvd. at Kestral Park Way is

worthless unless people respect it. Either enforce it or get rid of it! ☺☺ How lucky we've been through three hurricane en-

gagements. ☺ I think the Landings looks pretty good, but homes have

water in their drives after every rain. They should get their drainage ditches fixed.

It is unclear whether an assessment collection action will be deemed a “covenant enforcement dispute” subject to mandatory mediation Purchaser Disclosure Summary — Revisions have been made in the disclosure summary required to be provided by parcel sellers to purchasers. The principal change is adding the amount of current assessments. Also, the provision that in the absence of a disclosure statement a contract is voidable by the purchaser any time prior to closing is amended to limit that rescission right to three days after receipt of the disclosure statement or the closing, whichever occurs first. Of interest to all parties filing documents with the Clerk of the Circuit: Effective June 1, 2004, the fee to the Clerk of Circuit for re-cording documents in the public records has significantly in-creased in the amount of $4 per page. The new fee is $10 for the first page and $8.50 for each additional page.
