NATIONAL ASSOCIATION OF S TATE C ONTRACTORS LICENSING A GENCIES newsletter Volume 11, Issue 2 October 2015 It is with great honor that I serve as NASCLA President for Fiscal Year 2015/2016 and I am looking forward to another productive and exciting year for the association. We had an extremely successful Annual Conference in San Diego, California that included memorable speakers and events. Evaluations from the conference showed that people really enjoyed the presentations this year. Additionally, attendance was at an all-time high with nearly 120 people! I would like to extend a special thank you to all of our sponsors who, through their generous donations, helped to make this conference a great success. In the twelve (12) years of being a NASCLA Board of Director, I have had the pleasure of serving on several committees that help work towards the common goal of protecting the health, welfare and safety of the general public. More projects and events are in store for the year as our devoted committee members continue their efforts to improve the regulation of the contracting industry. In 2016, NASCLA will be expanding our membership benefits to include webinars that will be informative and beneficial along with continuing to add valuable information to the NASCLA Toolkit for Contractor Regulators. If you haven’t had the opportunity to visit the NASCLA Members Only website and review the Toolkit, I encourage you to do so. Additionally, NASCLA will be launching three (3) new NASCLA Accredited Electrical Examinations for Electrical Contractors, Journeyman Electricians and Residential Electrical Contractors that will be accepted in multiple jurisdictions in lieu of a trade examination. e NASCLA Accredited Examination Program Committee has worked extremely hard this past year and I look forward to what lies ahead for this program. NASCLA 2015 ANNUAL CONFERENCENASCLA members and supporters gathered in San Diego, California on August 31 – September 3, 2015 for NASCLA’s 53rd Annual Conference held at the Omni San Diego Hotel. Th e agenda included NASCLA Board of Directors and Committee Meetings, ten (10) Educational General Sessions led by some of the most prominent industry professionals and several networking events. Th e NASCLA Program Committee and Staff really out did themselves this year providing attendees with a truly wonderful conference experience.

NASCLA committee meetings began Monday morning, August 31st, and continued on Wednesday aft ernoon, September 2nd. During the various meetings the members worked hard to accomplish NASCLA committee goals and projects. NASCLA would like to recognize all of the committee members for their ongoing dedication, hard work and support throughout the year. You can fi nd the newly appointed committee members of FY 2015/2016 on page 6.

Th e conference offi cially began on Monday evening, August 31st, when new State Member attendees were invited to meet the NASCLA Board of Directors during a private reception. Th e opening reception followed on the Palm Terrace located outside near the pool of the Omni San Diego Hotel where attendees had the opportunity to mingle and network. During the opening reception the NASCLA 2015 Conference Sponsors were acknowledged. Th e 2015 sponsors included: PSI Services, LLC, Th e Home Depot, iContractor.net, American Residential Services, LLC, Sears Home Improvement Products, Prov, Inc., Big Picture Soft ware, GL Solutions, Cal-State Contractors License Service, International Code

Council (ICC), Access Laserpress, Zachry Industrial, Inc., Associated Builders & Contractors (ABC), Accela, Inc. and Pearson Learning Solutions.

On Tuesday, September 1st, Keith Warren, NASCLA President and Executive Director of the Alabama Electrical Contractors Board, welcomed everyone to NASCLA’s 53rd Annual Conference. Before General Sessions began, Keith Warren introduced Robert Marks, Chief Concierge of the Omni San Diego Hotel, who provided attendees with an overview of exciting activities and background information of the San Diego area.

Dale Atkinson, Attorney with Atkinson & Atkinson and Executive Director of the Federation of Associations of Regulatory Boards (FARB) kicked off the fi rst general session on Building Public Trust: A Look at Licensure Eligibility and Good Moral Character that addressed the legislative qualifi cations for licensure in the construction industry and identifi ed the legal issues related to granting and denying applications. Paul Greenwood, San Diego District Attorney, Head of Elder Abuse Prosecution Unit, gave his third presentation for NASCLA on Pursuing the Predators: How To Get A Felony Conviction Instead Of A Citation Against Th ose Who Target Elderly Victims of Contractor Fraud. Th e presentation focused on three (3) main objectives; discussed how contractor fraud and elder abuse overlap,

NASCLA 2015 ANNUAL CONFERENCEhow to deal with misconceptions that hinder elder abuse victim investigations and demonstrated how to build a criminal felony case against a fraudulent contractor. Th e aft ernoon sessions included a second presentation from Dale Atkinson providing a State of the Union: A Look at the Retaining Walls of Regulation tailored to Executive Directors and Board Members. Th is session addressed recent developments in the regulatory community related to case law, legislative enactments and media coverage from a multi-professional perspective. Paul Rozario, Director of Investigations for the Nevada State Contractors Board moderated a Roundtable Session on Renewable Energy.

Sessions on Wednesday, September 2nd, included a presentation from Phil Ostrander, Political Consultant for Oklahoma Legislative Consulting Group, on State Politics for Agency Administrators – You Can Infl uence Your Own Destiny… “Custer’s Last Stand” or “I’m Glad I Looked into the Valley and Saw Who Was Coming.” David Fogt, Chief of Enforcement for the California Contractors State License Board, presented on Predatory Service and Repair Contractors – Identifying, Investigating and Convicting; during this session attendees learned strategies to identify predatory contractors, investigation techniques and steps to achieve successful criminal prosecutions. Jeff rey Reese and Brian Wienke from Accela, Inc. spoke on Connecting Government and Citizens through Mobile Technology discussing bringing critical government services directly to fi eld staff by providing real-time access to data through a map-based interface on a mobile device. Jennifer Lewis, Public Information Offi cer for the Nevada State Contractors Board, gave the last presentation of the day on Utilizing NASCLA’s Toolkit to Advance Your Board.

Th e NASCLA Board of Directors met for their fi nal board meeting in the aft ernoon on Wednesday, September 2nd. Following the meeting, attendees were invited to take a cruise on a Hornblower Yacht where they participated in a scavenger hunt on Coronado Island. Attendees loved the networking opportunity this provided along with enjoying the beautiful weather and scenery.

Th ursday, September 3rd, the fi nal day of the conference, welcomed back David Fogt who presented his second session on Multi-State Investigations and Opportunities for Sharing Best Practices. Attendees

learned strategies to identify licensure scams, how to coordinate multi-state investigations and achieve media coverage for enforcement success. Tadas Dabsys, Vice President of PSI Services, spoke on How to Cheat on Licensing Exams where attendees enjoyed hearing stories on previous cheating off enders. Doug Traylor, Director of Examinations and Assessment for the Louisiana State Licensing Board for Contractors, presented two (2) back-to-back sessions on State Agency Mobile Applications and On the Road Ahead: Moving Forward with NASCLA Exams. Th e conference sessions concluded with the NASCLA Report of States session where State Members shared an overview of their board with attendees. Th is conference was a favorite among participants who enjoyed the exceptional speakers and the fabulous location. “Over the past several decades, the share of U.S. workers holding an occupational license has grown sharply. When designed and implemented carefully, licensing can off er important health and safety protections to consumers, as well as benefi ts to workers. However, the current licensing regime in the United States also creates substantial costs, and oft en the requirements for obtaining a license are not in sync with the skills needed for the job. Th ere is evidence that licensing requirements raise the price of goods and services, restrict employment opportunities, and make it more diffi cult for workers to take their skills across State lines. Too oft en, policymakers do not carefully weigh these costs and benefi ts when making decisions about whether or how to regulate a profession through licensing. In some cases, alternative forms of occupational regulation, such as State certifi cation, may off er a better balance between consumer protections and fl exibility for workers.Th is report outlines the growth of licensing over the past several decades, its costs and benefi ts, and its impacts on workers and work arrangements. As South Carolina property owners begin the task of securing repairs aft er recent fl ooding across the state, the South Carolina Department of Labor, Licensing and Regulation is warning consumers to be on the lookout for scam artists.

“Consumers are anxious to get the work done quickly and get their lives back to normal aft er a storm,” said Janet Baumberger, Administrator of the South Carolina Residential Builders Commission. “But, they may neglect to take necessary precautions when hiring repair people.”

Th e biggest problem is homeowners paying too much in advance and hiring unlicensed contractors. Th e unlicensed practice of residential or commercial building in this state is a misdemeanor and upon conviction is punishable by a jail sentence and/or a monetary fi ne pursuant to S.C. Code Ann. § 40-59-200 and § 40-11-200 respectively.

“Honest contractors do not require large sums of money upfront,” she said. “Th e most common complaints we receive aft er severe storms are from overcharged property owners. A scam artist will take your money up front and not perform the service as promised.”
