It has been an extremely busy and productive Spring. The NASCLA 2015 Mid Year Meeting in Huntsville was a valuable working meeting and also a good time. If you did not attend, you definitely missed a treat and great meeting. It was nice to have Dale Atkinson, Executive Director of Federation of Associations of Regulatory Boards (FARB) back with us for this meeting; it’s always great to have Dale discuss Board Member and Officer roles and responsibilities. It was also perfect timing to discuss the monumental SCOTUS decision from the North Carolina Board of Dental Examiners vs. the Federal Trade Commission. I know we are all dealing with the implications of this decision and there will be more to discuss in the future.

I was privileged to attend our first Subject Matter Expert Job/Occupational Analysis workshop for the new NASCLA Electrical Examinations held in Salt Lake City, Utah in March. This particular meeting was for the Master Electricians/Electrical Contractor Examination and there is another one scheduled in June in Dallas, Texas for the Journeyman Electrician Examination. This was a constructive meeting and attended by some great representatives in the Electrical Industry. Doug Traylor, NASCLA Accredited Examination Program Committee Chair, and Kara Schmitt, NASCLA Psychometrician, are doing an excellent job with this project and I truly do look forward to launching these three new examinations. I am very pleased with the expansion of our member services, which will ensure NASCLA’s viability and future in representing the construction industry.

We continue to plan and work on our NASCLA 2015 Annual Conference to be held in San Diego, California this year. I hope you all can attend this year’s conference and look forward to a fantastic meeting. It’s a wonderful location surrounded by lots of fun activities for you and your guests.

As always, I would like to thank our wonderful staff and hardworking committee members that help make everything possible. As discovered at the NASCLA 2015 Mid Year Meeting, we have almost completely finalized our current NASCLA Strategic Plan that was supposed to carry us through 2016. So thank you for all of your hard work and dedication to this organization. Together, we will continue to grow NASCLA for the betterment of the safety, health, and welfare of the citizens we protect and for the construction industry that we support. Florida Construction Industry Licensing

BoardThe Florida Construction Industry Licensing Board (CILB) was originally created by the Florida Legislature in 1963 for the regulation of Florida contractors. At its inception, the CILB regulated only general, building and residential contracting. Today, the CILB licenses contractors in more than 18 categories, including air-conditioning, pool, roofing, plumbing, mechanical and underground utility. The Board’s mission is to license efficiently and regulate fairly for the protection of Florida’s citizens. The Florida Construction Industry Licensing Board is divided into 2 divisions and comprised of 18 members. Membership on the board includes: 4 general contractors, 3 building or residential contractors (at least 1 must be a building contractor and 1 must be a residential contractor), 1 roofing contractor, 1 sheet metal contractor, 1 air-conditioning contractor, 1 mechanical contractor, 1 pool contractor, 1 plumbing contractor, and 1 underground utility and excavation contractor, 2 building officials, and 2 consumer members. Each member is appointed by the Governor, confirmed by the Florida Senate and may serve for 2, 4-year terms. The Board meets 3 days each month (except December) and is responsible for reviewing licensure applications, disciplining licensed contractors, developing administrative rules and issuing binding legal opinions to individuals substantially affected by the Board’s professional practice act. The CILB is also responsible for administration and management of the Florida Homeowners’ Construction Recovery Fund. The Recovery Fund was created in 1993 in the wake of Hurricane Andrew as a fund of last resort to compensate consumers who contracted for construction, repair or improvement of their Florida residence and who suffered monetary damages due to the financial misconduct, abandonment or fraudulent statement of a licensed contractor. The CILB is housed within Florida’s Department of Business and Professional

Regulation(DBPR), which employs the Board’s administrative staff and is tasked with providing the Board’s day to day services, including application processing, license issuance, investigative services and call center services. DBPR, through its “Apply Now!” and “Customer Success” initiatives, has focused its efforts into streamlining its licensing process to remove unnecessary barriers to Florida contractors and businesses while maintaining reasonable enforcement efforts to protect the health, safety and welfare of Florida citizens. DBPR also provides direct enforcement of contractor licensing laws through its Division of Regulation’s Unlicensed Activity Enforcement program. During FY 2013/2014, the Department conducted 34 undercover sting operations with local law enforcement and 489 licensing sweeps in areas throughout Florida. In addition, the Department conducted over 600 public outreaches to educate Florida’s consumers on the dangers of using unlicensed contractors. As of July 1, 2014, the Construction Industry Licensing Board and the Department of Business and Professional Regulation provide licensing to more than 85,000 contractors. The CILB and DBPR remain dedicated to ensuring the integrity of Florida’s contracting industry to benefit Florida’s contractors as and uphold the safety of Florida’s citizens.

NASCLA 2015 MID YEAR MEETING OVERVIEW

The NASCLA 2015 Mid Year Meeting was held on March 11 – 13, 2015 at the Westin Huntsville Hotel in Huntsville, Alabama. The meeting was a great success thanks to the hard work and dedication of NASCLA’s Executive Committee, Board of Directors, Committee Members and Staff!

On Wednesday, March 11th, committee meetings began with the NASCLA Fiscal Policy and Procedures Committee and Executive Committee Meeting. The committee members reviewed and discussed the interim business and financial statements of the association. Additional committee meetings were held in the afternoon which included the NASCLA Publications Committee, NASCLA Program Committee, NASCLA Resources Committee, NASCLA Model Legislation Committee and the NASCLA Accredited Examination Program Committee. During the NASCLA Publications Committee Meeting,

members discussed the opportunities for the NASCLA Online Training Program on the NASCLA Contractors Guide to Business Law and Project Management, Basic Edition, as well as future publications updates, new state releases and other projects. NASCLA Program Committee discussed the upcoming NASCLA 2015 Annual Conference and items pertaining to sponsorship, speakers and formulating the agenda. The NASCLA Resources Committee members reviewed the revamped NASCLA Toolkit for Contractor Regulators website. The following new programs were added: Understanding the Board’s Role in a Legislative Environment, Business Assistance Program, Public Relations and Social Media. The NASCLA Model Legislation Committee discussed their upcoming physical committee meeting scheduled for April 16 – 17, 2015 where they will work on projects given to them by the NASCLA Board of

Directors. The NASCLA Accredited Examination Committee discussed the three (3) new examinations being created: the NASCLA Accredited Examination for Electrical Contractors, the NASCLA Accredited Examination for Journeyman Electricians, and the NASCLA Accredited Examination for Residential Electrical Contractors and the Job/Occupational Analysis Workshops that are underway.

On Thursday, March 12th the NASCLA Board of Directors and other NASCLA members participated in a leadership session facilitated by Dale Atkinson, Executive Director of Federation of Associations of Regulatory Boards (FARB). Attendees focused on the NASCLA Strategic Plan, Bylaws, Governance, Membership and Resources. NASCLA current efforts and future ventures were established by the NASCLA Board of Directors. Dale Atkinson also reviewed and discussed the North Carolina State Board of Dental Examiners v. Federal Trade Commission which could impact regulatory boards. Thursday afternoon, attendees enjoyed an educational tour of the Marshall Space Flight Center and U.S. Space and Rocket Center that showcased rockets, achievements, and artifacts of the U.S. space program.

On Friday, March 13th, the meeting concluded with the NASCLA Board of Directors Meeting which comprised of the NASCLA Committee Chair Reports and Voting Action Items. Thanks again for everyone who was able to attend and contribute to this successful meeting.

FY 2014/2015 Committee ProjectsNASCLA Marketing Committee Plan – Target States that are Interested in Administering/Accepting the NASCLA Accredited Examination Program for Commercial General Building Contractors.

Committee UpdateOne of the main NASCLA Marketing Committee responsibilities is to target states that are interested in the NASCLA Accredited Examination Program Committee. The committee will also begin working on a marketing plan for the NASCLA Education Program, NASCLA Toolkit for Contractor Regulators, NASCLA Investigator Training Program and additional association resources.

Committee UpdateThe committee will be focusing their outreach to West Coast States along with non-member and inactive state members inviting them to the NASCLA 2015 Annual Conference. A physical meeting was held between the Texas Department of Licensing and Regulation and the NASCLA Executive Committee on December 4, 2014. The goal was to gain more participation from their agency. Future face-to-face meetings will be conducted with Darren Mickler, Executive Director of the Georgia Licensing Boards as well as Melissa McBride visiting Montana and George Whalen visiting Massachusetts. In January 2015, the North Carolina Landscape Contractors’ Licensing Board and the National Construction Authority in Kenya became NASCLA State Members.

Committee UpdateThe committee held a physical meeting during the NASCLA 2015 Mid Year Meeting on March 11, 2015. They discussed the opportunities for the NASCLA Online Training Program on the NASCLA Contractors Guide to Business Law and Project Managment, Basic Edition and the upcoming publication updates and new state releases and projects. Pearson Learning Solutions, the new NASCLA Publishing Company, has completed the first publication update since partnering with NASCLA. The NASCLA Contractors Guide to Business, Law and Project Management, Arizona 6th Edition was completed and released on January 20, 2015.

CONSTRUCTION MANAGEMENT/PROGRAM MANAGEMENT LICENSURE

Prior to March 20, 2015, the Louisiana State Licensing Board for Contractors (LSLBC) offered a number of different classifications of construction management licensure that have been determined to be unnecessary and confusing. Effective March 20, 2015, the Board adopted a new Construction Management/Program Management rule to allow a licensed general contractor with a major classification to bid or perform any project specified for services within their classification of licensure. In recent years the trends of project design and engineering specified for Construction Management/Program Management created unnecessary and costly steps for licensed general contractors to add those terms to their license in order to bid and compete for that work. This rule can be found in its entirety in the Louisiana Administrative Code, Title 46, Part XXIX, and reads:

“Any person, company or entity who undertakes, attempts to, or submits a price or bid or offer to perform work in construction management or program management whose scope of authority and responsibility includes supervision, oversight, direction, or in any manner assuming charge of the construction services provided to an owner by a contractor or contractors in excess of $50,000 must possess a license from this board in the major classification of building construction or heavy construction or highway, street, and bridge construction or municipal and public works construction. Any licensed contractor with any of these major classifications shall be able to bid and perform any such project specified for construction and/or program management within the scope of the classification(s) they hold. If a program manager whose scope of authority and responsibilities does not include any of the above stated tasks, and who does not subcontract actual construction work, that program manager does not need a contractor’s license.”
