TOWN OF AJAX

EX10.3 TOWN OF AJAXTo construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Rossland Road from Brock Road to Westney Road, in the Town of Ajax, Duffins Creek Watershed, as located on property owned by the Town of Ajax and the Toronto and Region Conservation Authority. The purpose is to reconstruct and realign Rossland Road between Brock Road and Westney Road in the Town of Ajax. The warmwater fisheries timing window will apply to work at the East Duffins Creek and the Redside Dace timing window will apply to work at Urfe Creek, unless otherwise specified in writing by the Ministry of Natural Resources (MNR). Through review of the information provided, TRCA is of the opinion that the project and implementation as proposed will not cause serious harm to fish. 57

Jain Investments Limited. The purpose is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of an addition to the partially constructed place of worship; proposed community hall; the relocation of the sanitary servicing including septic system installation and connection; on-site paving works; and the westbound left-turn lane and eastbound right-turn lane for an existing place of worship associated with a municipal site plan application. 66

CITY OF PICKERING

EX10.8 REGIONAL MUNICIPALITY OF DURHAMTo construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and interfere with a wetland along the west shore of Frenchman's Bay between Sunrise Avenue and Beachpoint Promenade, in the City of Pickering, Frenchman's Bay Watershed, as located on the property owned by the Toronto and Region Conservation Authority. The purpose is to address basement flooding in the Westshore service area (community located on the west side of Frenchman's Bay) as a result of excessive stormwater inflow and infiltration into the sanitary sewer system in the City of Pickering. No in-water work will take place. Work within the wetland area adjacent to Frenchman's Bay between Sunrise Avenue and Beachpoint Promenade will take place in the winter when ground conditions are more favourable for construction. 68

CITY OF VAUGHAN

EX10.9 CITY OF VAUGHANTo construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Plan 65R-17806, PART 1, North side of Major Mackenzie Drive, between Highway 400 and Jane Street, in the City of Vaughan, Don River Watershed as located on the property owned by the City of Vaughan. The purpose is to conduct site grading and alter a watercourse, in order to facilitate the development of the Vaughan Healthcare Centre Precinct (VHCP) project, in the City of Vaughan. The proposed development includes the construction of new access roads, two stormwater ponds and their associated outfalls, proposed culverts under Major Mackenzie Drive and proposed roads along with site grading to service and develop the overall subject site. 70

EX10.10 SOBEYS CAPITAL INCORPORATEDTo construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot 9, Concession 9, 8265 Huntington Road, in the City of Vaughan, Humber River Watershed as located on the property owned by Sobeys Capital Incorporated. The purpose is to conduct site grading in order to facilitate the development of a single-storey expansion (Phase 2) to an existing industrial building for Sobeys Capital Incorporated, in Planning Block 57/58 West, in the City of Vaughan. 74

TOWN OF CALEDON

EX10.11 SOUTH FIELDS III COMMUNITY INC.To construct, reconstruct, erect or place a building or structure, site grade, temporarily or permanently place, dump or remove any material, originating on the site or elsewhere and alter a watercourse on Part Lot 20, Concession 2 EHS Plan 21T-11002, (Kennedy Road and Old School Road), in the Town of Caledon, Humber River Watershed as located on the property owned by South Fields III Community Inc.. The purpose is to construct a temporary stormwater management facility to facilitate grading and servicing works associated with the final phase of a new residential subdivision. 76

EX10.12 STANDARD DELEGATED PERMITS 78

Standard Permits are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. Standard permits are subject to the authorization of designated staff appointed as Enforcement Officers, as per Authority Res.#A199/13. Standard permits are non-complex permissions consistent with TRCA approved policies and procedures and issued for a time period of two years or less.

___________________________________________________________________________KEY ISSUEAcquisition of property required to facilitate erosion control works on the Lake Ontario Shoreline in the City of Toronto – Scarborough Community Council Area, under the "Greenlands Acquisition Project for 2011-2015", Waterfront Component.

RECOMMENDATION

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.334 hectares (0.825 acres ), more or less, of land improved with a 2-storey single family dwelling, being Lots 311-315, Plan 1566, City of Toronto, municipally know as 1 Midland Avenue, Scarborough, be purchased from Thomasene Tresa Tarasuk;

THAT the purchase price be $1.4 million dollars payable on the closing date;

THAT the owner be permitted to remain in possession of the dwelling for up to five years from the closing date subject to the owner paying market rent for the period of possession;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of thelands free from encumbrance, subject to existing service easements;

THAT Gardiner Roberts LLP, be instructed to complete the transaction and all reasonable expenses incurred incidental to the closing for land transfer tax, legal costs, and disbursements are to be paid;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining needed approvals and signing and execution of documents.

BACKGROUNDResolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for 2011-2015.

During the 1980’s there were numerous identified land slides, with a loss of tableland on the properties located at Fishleigh Drive in proximity to the intersection of Midland Avenue and Fishleigh Drive.

Shoreline stabilization measures were subsequently designed by Keith Phillpott Consulting Limited on behalf of TRCA to address the erosion by eliminating wave action from Lake Ontario. The objective of the design was to halt the erosion of the toe of the bluff, and allow the upper slope to naturally recede to a stabile angle of repose. A review of the original project file indicates that the shoreline stabilization works were terminated prior to completion of the project at the easterly limits, below 81 Fishleigh Drive, as a result of objections from the public regarding the loss of a significant feature along the Scarborough Bluffs known as the ‘needles’ below 1 Midland Avenue that would occur over time as the Bluffs flattened out and stabilized with vegetation. It was believed that at the time there was sufficient shoreline protection works in place to successfully protect the residences along Fishleigh Drive over the long-term, while 1 Midland Avenue would eventually require acquisition without shoreline protection in place. Shortly after commencing construction of the shoreline stabilization works, TRCA purchased the residential property at 85 Fishleigh Drive. The house was demolished shortly after in 1993.

As a result of unexpected, progressive erosion at 81-83 Fishleigh Drive despite the constructed shoreline works, TRCA retained Terraprobe Limited in 2012 to review the existing site conditions and update the Long Term Stable Slope Crest (LTSSC) position for these properties and 1 Midland Avenue, to determine the maximum recession point of the Bluffs relative to the existing dwellings and other essential structures. The results of the study confirmed that the dwellings at 81 and 83 Fishleigh Drive would be at risk over the long-term if no additional stabilization works were implemented at the site. The study also confirmed that as expected, the dwelling at 1 Midland Avenue would also be at risk without any shoreline protection in place.

Resolution #A225/13 approved at Authority Meeting #11/13, held on January 31, 2014, provided an update on management of erosion and slope instability hazards resulting from the severe weather event on July 8, 2013 and other backlogged priority sites. The report recommended proceeding with 10 erosion related restoration projects in the City of Toronto. One of these projects was the acquisition of 1 Midland Avenue in 2014 and the extension of shoreline protection below 83 and 85 Fishleigh Drive in 2015.

Negotiations have been conducted with Randall R. Friedland, the seller’s solicitor.

Attached is a plan showing the location of the subject lands.

RATIONALEThe acquisition of the subject property falls within the scope of the works set out in Authority Resolution #A225/13.

The findings of the most recent geotechnical review of the LTSSC position, completed in 2012 by Terraprobe Inc. on behalf of TRCA, identified that the LTSSC is 21 metres from the existing crest of slope, and would run through the house at #1 Midland Avenue. Further, the projection of the LTSSC position is based on the assumption that the toe of the bluffs through this area is static, and not subject to further erosion.

Currently this sector of the waterfront from the end of Fishleigh Drive to Brimley Road does not feature shoreline protection, and is subject to erosion caused by ongoing wave action. The preliminary proposed course of action is to slightly extend the shoreline protection below #81 and #83 Fishleigh Drive to install a buttress along a portion of the slope to provide long-term protection for these homes, and to acquire the property at 1 Midland Avenue to leave the remaining section of bluffs in the study area, previously referenced as “the needles”, in a natural state.

The purchase of the subject lands when combined with both the TRCA-owned lands at 85 Fishleigh Drive and the City of Toronto-owned Midland road allowance lands, have the potential to be a good local park with views of the Lake Ontario.

Both, the market value and the market rent of the subject property were based on an appraisal prepared by D. Bottero & Associates Limited.

TAXES AND MAINTENANCEThe taxes and required maintenance of the subject property will be covered by the market rent during the rental period. When the rental is terminated, the dwelling will be demolished and the property will be turned over to the City of Toronto under the terms of the existing management agreement.

FINANCIAL DETAILSFunds for the costs related to this purchase are available from enhanced capital funding for critical erosion sites from the City of Toronto within account 175-01.

RECOMMENDATION

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.253 hectares (0.625 acres), more or less, of vacant land, being Part of Lot 7, Registered Plan 83, and designated as Parts 2 and 3 on draft Reference Plan prepared by David B. Searles Surveying Ltd. referenced as Drawing File 92-1-13.DWG, City of Toronto be purchased from Petro J. Developments Limited;

THAT the said conveyance include a reservation for Petro J. Developments Limited of a non-exclusive, temporary construction access easement for the construction and access and excavation of the development including underground parking over Part 3 on said draft Reference Plan which expires upon the earlier of: (a) the date of completion of all works relating to the development of 42 Parklawn Road; or (b) 21 years less one day from the date of transfer of the conveyance;

THAT the purchase price be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easements and temporary construction easement;

BACKGROUNDResolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for 2011-2015.

As a condition of site plan application, Petro J. Developments Limited is to transfer the valleylands to TRCA for the nominal consideration of $2.00.

A portion of the subject valleylands includes a reserved non-exclusive, temporary construction access easement which expires upon the earlier of: (a) the date of completion of all works relating to the development of the subject lands; and (b) 21 years less one day from the date of transfer of the conveyance.

As a condition of approval, Petro J. Developments Limited is to provide funds to TRCA in the amount of $11,695 for trail construction. TRCA Watershed Management and Restoration Services staff will work with City of Toronto staff to complete the trail construction on the subject valley lands.

Negotiations have been conducted with Nadia Jacyk, President of Petro J. Developments Limited.

Attached is a plan showing the location of the subject lands.

RATIONALEThe subject property falls within the scope of TRCA’s approved Greenlands Acquisition Project for 2011-2015. Through review of the site plan application for a proposed mixed use development for the subject property, TRCA staff established the limits of the open space lands (i.e. Parts 2 and 3 on draft Reference Plan prepared by David B. Searles Surveying Ltd. referenced as Drawing File 92-1-13.DWG.).

TAXES AND MAINTENANCEIt is proposed that the lands be turned over to the City of Toronto under the terms of the existing management agreement.

FINANCIAL DETAILSFunds for the costs related to this purchase are available in the TRCA land acquisition capital account.

RECOMMENDATION

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.132 hectares (0.326 acres), more or less, of vacant land being Part of Lot 20, Concession 1 EHS and designated as Block 118 and Block 119 on a Draft Plan of Survey prepared by J. H. Gelbloom Surveying Limited, Ontario Land Surveyors, under their Project: 11-008 dated April 21, 2014, in the Town of Caledon, Regional Municipality of Peel, located to the west of Kennedy Road, and north of Mayfield Road, be purchased from Moscorp VII Development Inc.;

THAT the purchase price be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easements;

THAT the firm of Gardiner Roberts LLP, Barristers & Solicitors, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs, and disbursements are to be paid;

AND FURTHER THAT authorized TRCA officials be directed to take the necessary action to finalize the transaction including obtaining needed approvals and signing and execution of documents.

BACKGROUNDResolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for 2011-2015.

Negotiations have been conducted with Peter Maleganovski of Monarch Corporation, acting as agent on behalf of the owner.

RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Etobicoke Creek watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015.

Through the review of subdivisions 21T-10001C and 21T-10002C for proposed residential development of this site, TRCA staff established the limits of the open space lands (i.e. Block 118 and Block 119 on the draft plan of survey) which are comprised of an environmental buffer and a portion of the valley corridor of Etobicoke Creek at this location.

TAXES AND MAINTENANCEBased on TRCA's preliminary review of the criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Tax Incentive Programs, it would appear that all the subject property may be eligible for an exemption upon restoration of the area. Taxes for 2014 are estimated to be approximately $200.00.

RECOMMENDATION

THAT Toronto and Region Conservation Authority (TRCA) staff be authorized to utilize $50,000 of funding received from the Ontario Power Authority (OPA) to hire BRE (Building Research Establishment) UK to continue providing advisory services related to partnership development, fundraising and technical expertise to further develop the demonstration buildings at Innovation Park;

THAT the BRE Canada Innovation Park Business Plan, dated March 10, 2014 be received;

THAT staff be directed to seek funding to complete the design and implementation of servicing, including watermain, wastewater and telecommunication services, to service both Innovation Park and the Kortright Visitor Centre, and to seek funding for refurbishment of the existing Greenworks Building as the Innovation Park Visitor’s Centre; THAT staff be directed to seek in-kind donations (products and services) from suppliers, manufacturers, consultants, etc. to facilitate construction and implementation of the Innovation Park;

The Living City Campus at KortrightThrough the planning process at that time the vision for The Living City Campus was established as:

"to inspire, support and monitor change toward sustainable living, leading the way toward sustainable development and the use of sustainable technologies through practice, education and market transformation.

This vision (was) to be realized by enhancing the existing facility to make it:a link to cutting-edge thinking, technologies and initiatives;

practical demonstrations on how to integrate 'green' community building projects into daily

lives;a place of local, national and worldwide significance; and

a destination to visit, to learn and enjoy time and again.”

Since the adoption of the plan, staff has worked with many partners to bring into fruition the essence of many elements of the plan. Some of these green elements include Canada’s first photovoltaic testing site, Ontario’s first LEED (Leadership in Energy and Environmental Design) platinum commercial building (Restoration Services Centre), the LEED gold Earth Rangers Centre, a complete energy retrofit of the Kortright Visitor Centre, and construction of the Archetype houses, two LEED platinum demonstration houses. The Archetype houses were constructed as a partnership between TRCA and the Building Industry and Land Development Association (BILD) and 125 of its members. Since the houses opened on Earth Day 2009 the homes have attracted over 20,000 visitors including builders, policy makers, students, homeowners and international professionals.

Currently the Campus is one of North America’s largest demonstration, education and research facilities for renewable energy and green buildings. The addition of the Sustainable Technologies Evaluation Program (STEP) to the campus has helped generate numerous research projects with industry and academic institutions including Ryerson University, York University, University of Waterloo, University of Guelph, McMaster University, George Brown College and Seneca College. STEP has also developed several professional training and certification programs for erosion and sediment control professionals and photovoltaic installers which have prompted requests from national and international organizations for TRCA staff to sit on numerous safety, research and standards committees, raising TRCA’s profile around the world.

Partnership with Building Research EstablishmentTo build on this success and grow the international market for Canadian green products and services, TRCA staff sought Authority direction in 2012 to develop a business arrangement with BRE in the UK, for the establishment of an Innovation Park at The Living City Campus at the Kortright Centre for Conservation which was received through Resolution #A132/12 which states, in part:

THAT Toronto and Region Conservation Authority (TRCA) enter into a Memorandum of Understanding (MOU) with the Building Research Establishment (BRE) to collaborate on research, education and training initiatives;...

...AND FURTHER THAT TRCA be authorized to spend up to $50,000.00 to fund the development of a business plan for a Canadian Innovation Park to be located at The Living City Campus at Kortright, subject to funding being available.

BRE developed the “Innovation Park” concept to assist British builders in achieving new building code standards. Similar to TRCA’s existing Archetype houses but on a much larger scale, these Parks have driven Britain’s building industry toward net zero carbon home production by 2016. TRCA aims to collaborate with its municipal and corporate partners to expand its existing demonstrations, research and education programs at The Living City Campus to become Canada’s BRE Innovation Park. TRCA hopes that the Innovation Park will position Ontario as a North American and global leader in providing innovative solutions for sustainable construction.

Municipal Planning ContextIn 2012 TRCA staff began discussing with City of Vaughan staff development of Innovation Park at The Living City Campus. The property is subject to an extensive planning regime, and to ensure consistency with the variety of planning instruments, and to ensure the integrity of the natural heritage features on the property, TRCA staff met with City staff in December 2012 to develop a common understanding of how it all fits together from a planning perspective. TRCA presented a Planning Brief to City Planning and Building staff outlining policy and zoning matters and plans showing proposed structures and sensitive features.

The review included: the Provincial Greenbelt Plan (permits conservation authority activities that are within approved plans and strategies); Vaughan Official Plan 2010 which is consistent with the Region of York Official Plan (Section 9.2.2.15 provides for sustainable building demonstration); and Zoning By-law 1-88 (OS2 permits conservation projects). The site plans showed the natural features and required buffers ensuring that the proposed building and structures are outside of these areas. This review confirmed that the proposed building demonstration park meets the relevant planning instruments and the prescribed tests and that no Planning Act approvals are required to develop it. Since that meeting, during detailed design, the location of the demonstration park was adjusted slightly north, however it remains outside of all the required features and buffers.

RATIONALEPlanning ProcessIn November 2012 a stakeholder workshop attended by 65 industry and academic stakeholders was held to gain insight into stakeholder needs and to identify potential collaboration opportunities for the Innovation Park. Feedback and outcomes from a series of breakout sessions, held during the workshop, were then used in the development of the Business Plan. The Business Plan was developed to assist with identifying key objectives for the Park, determining key design themes and performance benchmarks for the demonstration buildings, identifying features and outcomes of the Park, and outlining stakeholder involvement. The first draft of the business plan was posted on The Living City Campus website in October 2013, and an update was completed and posted in March 2014. The business plan developed by BRE outlines the primary aim of the Innovation Park as providing a platform for the construction industry to demonstrate innovative solutions to achieve low carbon buildings and sustainable development and to provide government and industry with data on capital costs, skills gaps and carbon savings. The secondary objective is to trial industry’s ability to meet future policy targets in building code prior to legislation being implemented.

Some key objectives for the Park include:

Market visualization – demonstrate a rolling five year vision of the Canadian sustainable

construction market for stakeholders by leveraging the next generation of innovative sustainable building products and services from Canadian businesses in the Innovation Park.

Economic development – support efforts to deliver enhanced economic development

outcomes (new business start-ups, job growth, inward and outward investment and increased exports).

Legislative driver - provide the public sector with a model to test and verify future

regulations and policy.

Knowledge hub - act as a resource for sustainable construction by providing accurate

and impartial advice on construction practice, innovative technologies, and strategies for reduced carbon emissions, sustainable water use and energy cost savings.

Training hub – work with industry to develop training programs to meet the needs of

sustainable construction industry and incorporate new and innovative products within the supply chain.

Collaborative research – support existing academic research; provide signposting and

direction for new research linked to Innovation Park objectives; drive the development of new patents, businesses, research platforms; and enhance knowledge transfer through research collaboration among leading institutions.

Product development process – support businesses in launching new investments by

providing a physical platform to develop, test, demonstrate and showcase new products and services.

Private investment – create new products and businesses that receive investment from

private investors to support start-up and expansion activities.

Consumer demand – drive increased Canadian consumer demand for sustainable

building products and services by creating a high-quality consumer experience that showcases the future of the built environment.

Location of BRE Innovation Park at The Living City CampusThe Park will be located adjacent to the existing Archetype houses (Attachment 2). Seven new demonstration buildings will be constructed on approximately 332 sq/m lots. Each will follow key design themes to suit Canadian market requirements. Lots will be developed by a Build Partner who will select a theme (or a combination of themes) from those outlined in the ‘Performance Standards and Development Briefs ’ document. Performance metrics and validation requirements for the design themes were developed based on the outcomes of a design charrette held in July 2013, in partnership with TRCA, BRE and York University’s Faculty of Environmental Studies (https://www.thelivingcitycampus.com/sites/default/files/Design%20Brief%20master.pdf). Technical performance targets will be further developed for each theme through consultation and design charrettes. The performance targets are set at levels intended to push industry towards achieving more sustainable and energy efficient buildings while developing them in a framework to ensure cost competitiveness and robust verification. Building design and construction will be assessed and benchmarked against these performance targets to verify performance claims and aid in market acceptance.

Build Partners may be a single organization or a consortium of organizations. Build Partners will be required to sign a collaborative agreement, committing them to technical performance verification requirements, research objectives and plan, monitoring requirements and post-occupancy evaluation, collaboration on innovation and within the supply chain, access for demonstration purposes, branding and marketing requirements, and other requirements as necessary. Build Partners will be supplied a serviced lot, and will be responsible for funding the design, construction, operation, and maintenance of a demonstration building on their lot (Attachment 2).

The Value of the BRE Innovation Park The Innovation Park will provide facilities to field test and demonstrate innovation and excellence in the built environment, showcasing Canadian developers, manufacturers, utility companies, designers and contractors as leaders in the development of sustainable buildings and community demonstration. It will provide a springboard for Canadian companies to demonstrate how they can deliver sustainable buildings not only to the Canadian market, but also to international markets. The Innovation Park will also offer a number of programs and services including: tours, networking events and conference programs, educational seminars and professional development for building industry professionals, research facilitation with new and existing academic partners, product placement, competition management, industry cluster resource and information dissemination; product testing, certification and labelling, brokering, product commercialization and collaboration fostering.

The development of the Innovation Park provides opportunities for both ‘push’ and ‘pull’ innovation through construction sector focused facilitation. Providing a phased development to meet future standards gives a structured route to develop products and services that can be shown and implemented years before legislation comes into force. This allows a ‘push’ to the sector toward improved performance, energy efficiency and carbon savings, while proving that the legislation is achievable. ‘Pull’ innovation is facilitated by setting performance standards in advance of current requirements and providing a mechanism to enable construction in a ’real’ setting, with verification and testing in use. The design, delivery and operational model of the Innovation Park will encourage the businesses to collaborate with each other and network globally with BRE’s International Innovation Park network.

The development and operation of the Innovation Park will be on a collaborative basis, leveraging existing significant expertise and organizational capacity within the Greater Toronto Area and Ontario. The Innovation Park will also look to partner with national organizations, investors and laboratories. Levels of engagement envisioned include partnerships agreements (Memorandum's of Understanding), sponsorship agreements, research agreements and service contracts. Anticipated funding sources for the park include direct funding for program development, research funding, grant funding and facilitation fees for product integration. In-kind support will also be necessary and may include design support, free materials, research and development support, construction labour and construction labour through training initiatives. Sponsorship opportunities at multiple levels for cash and in-kind donations are also available for interested parties. In-kind donations (products and services) from suppliers, manufacturers, consultants, etc. are being sought on an on-going basis.

Implementation of BRE Innovation ParkThe Innovation Park will be implemented in four phases:

Predevelopment – finalization of program design, resource development, executed

agreements, secure funding, site planning, infrastructure design, engineering and approvals.Infrastructure – completion of the site improvements, landscaping, the Innovation Park’s

visitors’ centre, resource and business development.Construction – construction completion of the first phase of eight demonstration

buildings.

Operations – deployment of all programs and services, and continued resource and

business development.

In January, TRCA received a $500,000 contribution from OPA, making them a founding partner for the Park. The contribution is intended to act as a catalyst for the development of the Park and to leverage additional funding. Current funding priorities are focused in the design and construction of the Park’s infrastructure. Funding for the refurbishment of the Greenworks Building for the Park’s visitor’s centre will be sought once infrastructure funding is secured. In-kind donations of products and services will be sought on an ongoing basis. To date, there are seven interested Build Partners and letters of commitment are pending. Funding is currently being sought for the design and implementation of servicing, including the watermain, wastewater, stormwater and telecommunication services. Industry and municipal partners have committed over $500,000 in cash and in-kind services towards the Park’s infrastructure. The Innovation Park has also received $40,000 from INTACT insurance for stormwater design around the Park access road. Grant applications to the Federation of Canadian Municipalities (FCM) Green Municipal Fund for stormwater design and construction and FedDev Ontario are in development. An application was also submitted to the Holcim Awards for Sustainable Construction (cash prize of $100,000). In-kind service donations for energy modelling, design charettes, green building consultants and workshops have also been received.

Engagement and ConsultationTo-date, over 450 industry members and academics have been spoken to regarding the project. Letters of support have been received from organizations such as BILD, the Cement Association of Canada, Canada Green Building Council (CaGBC), Ontario Centres of Excellence, Sustainable Buildings Canada and CMHC, etc. In November 2013, meetings were held with Minister of Energy Bob Chiarelli and Minister Julian Fantino, MP of Vaughan. Both expressed interest and support for the project. We have also had successful meetings with PowerStream, Enbridge, Union Gas, Rogers Communications and Bell Mobility regarding input for the design of the infrastructure and potential sponsorship opportunities. A meeting is scheduled with ventureLAB, Vaughan’s regional innovation centre, to discuss their involvement in the Park.

Memorandums of Understanding have also been sent to 10 academic institutions, and fully executed agreements are in place with Ryerson University, University of Waterloo and Mohawk College. A Project Research Committee will be formed once fully executed agreements have been received by all contacted academic institutions. The committee will be comprised of senior or appointed representatives of academic institutions or research organizations who signed up to the collaborative research Memorandum of Understanding (MOU). The committee will play a key role in identifying research priorities for the park, establishing the research strategy for the Park and providing input to the Project Team.

ConclusionBRE has worked in partnership with TRCA over the past two years, investing $50,000 in this project. BRE was instrumental in the development of the business plan, performance standards and design briefs, and sponsorship prospectus. They also played a key role in securing the OPA funding. BRE has allocated significant time and resources to the establishment of the BRE Innovation Park in Canada. The BRE Innovation Park at The Living City Campus is unique in that it is fully planned on lands not owned by BRE nor is BRE leading the project. The BRE Innovation Park will utilize the skills and expertise of TRCA staff on site. Going forward, TRCA staff will provide leadership for the establishment and operation of the Park, with BRE acting as an advisor based on a fee for service. TRCA would like to hire BRE UK as a project consultant, providing advisory services related to partnership development, fundraising and technical expertise to continue moving the project forward. Staff is recommending that funds from the Ontario Power Authority be utilized to pay BRE.

Finalize and submit funding applications to FCM and New Building Canada Fund.

Attachment 12 Executive Summary

This document investigates the potential to develop a BRE Innovation Park at The Living City Campus at Kortright. It provides the technical parameters, the business case and project budget to implement the Innovation Park. In order to meet the desired objectives of the Innovation Park, the project requires substantial investment through Public and Private sector support through in-kind, grant or direct investment. This document is intended to provide the purpose and objectives of the Innovation Park to industry and potential partners, stimulate industry interaction with the project development team and ensure the technical standards implemented meet the needs of the Canadian Industry.

Project Development Team

The Toronto and Region Conservation Authority (TRCA) is one of the largest environmental organizations in Canada with over 600 employees and managing over 40,000 hectares of property and nine watersheds in the Greater Toronto Region (GTA). Its Living City Vision challenges the organization and its partners to make the GTA into one of the most sustainable, liveable city regions in the world. A key TRCA strategy to move the vision forward was the development of an innovative demonstration, research, and education centre called “The Living City Campus” located at the Kortright Centre for Conservation which is Canada’s largest environmental education centre.

To help accelerate the development of The Living City Campus, the TRCA has partnered with the Building Research Establishment (BRE) - one of the world’s largest building research, certification, and training organizations. To assist builders in Britain achieve new building code standards, BRE developed a concept called “Innovation Park.” Similar to TRCA’s existing Archetype Houses but on a much larger scale, these Innovation Parks have driven Britain’s building industry to towards net zero sustainable homes production by 2016. With the first Innovation Park established in 2003, four others are currently being designed or constructed around the world including, Scotland, Brazil, Portland Oregon, and China. Working with BRE, TRCA aims to collaborate with its municipal and corporate partners in the building industry to expand its existing demonstrations, research and education programs at The Living City Campus to become Canada’s BRE Innovation Park.

The Concept

The BRE Innovation Park at The Living City Campus’ mission statement is to accelerate the commercialization and adoption of green building products and services into the Canadian mainstream and to provide a platform for international recognition and acceptance.

The primary aim of the Innovation Park model is to provide a platform for the construction industry to demonstrate innovative solutions to achieve low carbon buildings and sustainable neighbourhood development and to provide government and industry with data on capital costs, skills gaps and carbon savings. The secondary objective is to trial industry’s ability to meet future policy targets in building code prior to legislation being implemented.

The Innovation Park is intended to drive the development of new and innovative construction products, processes and technologies. Experience within the International network of Innovation Parks shows how setting robust performance standards help drive industry to invest in new and advanced products that lead the market in meeting sustainability and energy objectives.

The Innovation Park enables industry as a whole to interact in the provision of low carbon goods and services by providing a technically challenging, but safe commercial environment to test and showcase new products and construction techniques while also offering support through sector specific-training and outreach programs.

Conclusion

Through this business planning exercise, there is no technical reason why the BRE Innovation Park cannot be sited at The Living City Campus and interaction with potential building and funding partners indicates that industry will support the Innovation Park when sited there.To take the project forward, substantial work is required to develop and implement a funding strategy, secure letters of support from key organizations, engage public and private sector bodies, negotiate sponsorship opportunities and in-kind support, and secure necessary funds required to proceed with the infrastructure and construction phases.

A letter has been received from Dr. Asim Izzat and Mrs. Zahera Izzat who wish to purchase a 5 1/2 foot strip of TRCA-owned property located at the rear of 58 Park Drive in the City of Vaughan. A copy of the letter from Dr. and Mrs. Izzat is included as Attachment 1.

The subject TRCA-owned lands are situated within the Regulated Area and Regional Storm flood plain of the Humber River valley corridor at this location.

In accordance with TRCA policy, TRCA Property staff will circulate this request for disposal to TRCA technical staff, City of Vaughan and Regional Municipality of York for review and comment. Staff will report to the Executive Committee on the comments received and make a recommendation to either retain the property or declare it surplus. The proponent is advised of the results of the review at the time a report is prepared for the Executive Committee. The proponent has the opportunity to make a request to delegate at the Executive Committee at the time the matter is being considered.

RECOMMENDATION

THAT Toronto and Region Conservation Authority (TRCA) execute the 2014 work plan agreement with the Greater Toronto Chapter of the Canada Green Building Council (CaGBC) to December 31, 2014;

THAT TRCA continue to work with the Greater Toronto Chapter to deliver the initiatives in accordance with the signed Memorandum of Understanding with the Canada Green Building Council;

AND FURTHER THAT authorized TRCA officials be directed to take the action necessary to implement the agreement.

BACKGROUNDAs a founding partner of the CaGBC, TRCA has worked closely with the CaGBC on several initiatives since the Council was first established in 2003. The Council's mission is to "lead and accelerate the transformation to high-performing, healthy green buildings, homes and communities throughout Canada." TRCA has provided ongoing support in their work towards this mission, which is well-aligned with TRCA's vision for The Living City.

The Authority first formalized this relationship by approving the establishment of a Memorandum of Understanding between TRCA and CaGBC. By entering into the MOU, TRCA agreed to work in partnership with the CaGBC on various initiatives focused on increasing the uptake of green building practices and promoting sustainable community development in the GTA. At Authority Meeting #3/10, held on April 30, 2010, Resolution #A54/10 was approved as follows:

The purpose of the MOU was to formalize the working relationship between the two organizations and to establish priorities. Among the many roles and responsibilities outlined in the MOU, was the condition for TRCA to support and advocate for local funding opportunities and to work closely with the Greater Toronto Chapter (GTC). Following Resolution #A54/10, TRCA and GTC have developed and executed annual work plan agreements which identify key activities and initiatives to be completed in each calendar year.

RATIONALEAttachment 1 provides an overview of the various work plan components, the associated 2013 deliverables and the projected 2014 work plan. Execution of these activities are carried out, in part, with the annual grant funding provided by TRCA.

FINANCIAL DETAILSTRCA will provide financial support to the Greater Toronto Chapter of the CaGBC in the form of a $50,000 grant. These funds are available in account 415-89, provided by the City of Toronto and Region of Peel.

RECOMMENDATION

THAT the contract to provide analytical laboratory services for the surface water quality monitoring program as part of Toronto and Region Conservation Authority's (TRCA) Regional Watershed Monitoring Program (RWMP) be awarded to York-Durham Regional Environmental Laboratory (YDREL) from May to December 2014 at a total cost not to exceed $68,000.00 plus HST;

THAT authorized TRCA officials be directed to take the necessary action to implement the contract, including obtaining any necessary approvals and the signing and execution of documents;

AND FURTHER THAT staff be directed to proceed with their biennial inter-laboratory comparative assessment in autumn 2014 and to specifically re-assess the capabilities of the City of Toronto (Toronto) Dee Avenue laboratory.

BACKGROUNDAs part of the Regional Watershed Monitoring Program, TRCA collects monthly surface water quality samples at 46 sites throughout its jurisdiction. This is an extensive monitoring network; unique among most conservation authorities which usually rely solely on the data from the Provincial Water Quality Monitoring Network (PWQMN) through the Ontario Ministry of the Environment (OMOE). The RWMP supplements the 13 PWQMN stations with 33 additional stations throughout the jurisdiction. In addition, the RWMP collects winter samples (November through March) at all sites including the PWQMN sites and E. coli bacteria at all sites year-round. The additional sites and winter samples help to refine the data seasonally and on a subwatershed scale. The surface water quality data is used to help understand the impacts of agricultural and urban areas on stream water quality and Lake Ontario.

Historically, the analysis of these samples has been undertaken at several laboratories including the OMOE, Toronto (Dee Avenue) and various private laboratories. Using several laboratories has been a challenge over the years due to data compatibility. This issue has been identified as significant to the integrity of the RWMP, which was established to track and report on changes (often small) to the various water quality parameters assessed over time. The ability to achieve this requires that any changes observed in the data over time be attributable to only actual changes in water quality and not due to changes in technique or instrumentation used in the sample analysis process.

In an effort to improve the quality and consistency of the surface water quality data received and to allow a more consistent and robust interpretation of the results obtained, staff agreed and recommended that a laboratory comparison should be undertaken on a biennial basis (i.e. every other year). This inter-laboratory comparative study has been undertaken to determine which laboratory had results that most closely matched the processes and results available from the OMOE. The inter-laboratory comparison has been conducted in 2008, 2010 and 2012 and in each instance, the York-Durham Regional Environmental Laboratory provided the results most similar to the OMOE.

At Executive Committee Meeting #11/09, held on January 15, 2010, it was brought to the Executive Committee’s attention that TRCA was no longer using Toronto laboratory services for the analysis of surface water samples collected through the RWMP. At that time staff explained that the level of precision for analysis of certain water quality parameters required by TRCA was beyond the capability of Toronto’s Dee Avenue laboratory. The additional precision of data is needed by TRCA in order to fully understand subtle changes in water quality within the range of conditions found in the TRCA jurisdiction, including those parameters found in relatively low concentrations. It was also identified that staff at the Toronto lab was proposing some upgrades to their instrumentation, and that they would be in a better position in the future to meet TRCA's needs. In this regard it was requested by several members of the board that TRCA continue to liaise with the Toronto lab to determine if this partnership could be re-established in the future.

The 2012 inter-laboratory comparison study showed that Toronto’s Dee Avenue laboratory showed a marked improvement over previous comparisons. Toronto purchased an ICP-MS instrument in 2011 which has improved the capabilities of the laboratory. For many parameters, Toronto’s Dee Avenue laboratory had results similar to the OMOE but there continues to be a some issues with specific metals. Toronto staff is continuing with the calibration of their instrumentation and have been developing a new Business Plan for the Toronto Water Laboratory. Staff has continued to discuss opportunities to revisit the former partnership with Toronto Water and will initiate their biennial inter-lab comparison in the autumn of 2014 using only the YDREL, OMOE and Toronto laboratories. The intention of this comparison is to determine if the Toronto laboratory results are in-line with OMOE.

RATIONALEThe 2012 inter-laboratory comparison study identified strengths and weaknesses among the various laboratories assessed in terms of the equipment and analytical procedures, as well as the analytical detection limits available for certain water quality parameters. In terms of overall performance however, the laboratory which matched and/or exceeded the OMOE results was again the YDREL. The YDREL is owned and operated by the regions of York and Durham and is set-up to provide contracted lab analytical services in addition to providing services for regional programs and projects. YDREL provided a quotation of $186.00 per sample (plus HST) for 2014. This is the same unit cost offered last year. The YRDEL has successfully and effectively provided TRCA with these laboratory analytical services since 2010 and at comparable charges in the past three years. Therefore, staff recommends that the project be a preferred source contract with YDREL as per Sections 9.3.1(a) and 9.3.3 of TRCA's Purchasing Policy as follows;

9.3.1 The goods and services are only available from one source or one supplier by reason of:a. need for compatibility with goods and services previously acquired and there

are no reasonable alternatives, substitutes or accommodations;

9.3.3 The required goods and services are to be supplied by a vendor or supplier having specialized knowledge, skills, expertise or experience that cannot be reasonably provided by any other supplier.

Staff is of the opinion that the results achieved from the York-Durham Regional Environmental Laboratory through the most recent biennial comparative study (2012), the quality of the data received over the past four years, and the benefit received in maintaining consistency in the data obtained for TRCA's water quality monitoring matched or exceeded the Ministry of the Environment Laboratory.

FINANCIAL DETAILSFunding required to support this work, totalling $68,000.00 plus HST, has been identified in the 2014 Regional Watershed Monitoring Program account 124-15. These costs account for the expected monthly lab analysis plus a 10% contingency for additional sites/samples that may be needed for the RWMP or other projects. These funds are identified in TRCA's 2014 Capital Budget with funding from the regions of York, Durham, Peel and the City of Toronto.

BACKGROUNDThe City of Toronto is proposing to implement a multi-use pathway through a section of Hydro One's corridor, north of Finch Avenue from approximately Maxome Avenue to Bayview Avenue. The trail system is part of a more comprehensive plan to construct a new multi-use trail system that will create a formal link between Yonge Street and Victoria Park Avenue. The purpose of this project is to help make greenspaces more accessible within the City and encourage people to participate in healthy activities to make the City of Toronto a better place to live.

Creating an accessible greenspace is an important component of this project since the proposed multi-use trail system is expected to attract various types of cyclists and pedestrian traffic. The newly proposed asphalt pathway will be approximately 600 metres long by 3.5 metres wide. The asphalt paving of the multi-use trail will improve safety for pedestrian traffic and recreational activities.

Restoration Services staff reviewed the bid received from Appco Paving against its own cost estimate and has determined that the bid is of reasonable value and also meets the requirements and deliverables as outlined in the contract documents. Further assessment by TRCA staff of Appco Paving's experience and ability to undertake similar projects was conducted through reference checks which resulted in positive feedback that Appco Paving is capable of undertaking the scope of work.

Based on the bids received, staff recommend that Appco Paving be awarded Contract RSD14-04 for asphalt pathway paving, in the City of Toronto, for a total amount not to exceed $122,838.25 plus a contingency amount of $12,300.00 to be expended as authorized by TRCA staff, plus HST, it being the lowest bid that meets TRCA specifications.

THAT TRCA staff be authorized to approve additional expenditures to a maximum of $28,000.00 as a contingency allowance if deemed necessary;

THAT should staff be unable to negotiate a mutually acceptable tender agreement with the above-mentioned contractor, staff be authorized to enter into contract negotiations with other contractors, beginning with the next lowest bidder meeting TRCA specifications;

BACKGROUNDHeart Lake Conservation Area (HLCA) is one of the few large greenspaces in the City of Brampton. It is a destination, not only for Brampton residents, but also for those in the Greater Toronto Area because it offers a variety of opportunities for recreation, conservation education, and tourism. As part of the HLCA master plan it is the intention of Toronto and Region Conservation Authority (TRCA) to draw additional users to HLCA in order to expand and diversify the client base resulting in increased revenue. In order to maintain safe roadway access within HLCA the existing road infrastructure needs to be restored as many priority access points have deteriorated over time. Upgrades to road infrastructure will ensure all roads are meeting the required safety regulations throughout the park. The scope of the work for this project includes the restoration of an existing section of Green Acres Road, restoration of the main entrance driveway, construction of a new granular parking lot and construction of a new driveway for access to the new workshop/administrative building. The new driveway leading to the workshop/administrative building will tie into the existing main entrance laneway and will allow for fire access to the new workshop/administrative building. TRCA will require the services of a qualified contractor to carry asphalt paving works of existing road infrastructure within HLCA in order to maintain safe roadway access for park users and TRCA staff.

RECOMMENDATION

THAT the staff report dated May 8, 2014, regarding the results of negotiations with Mr. Brent McKee, owner of 163 Thistledown Boulevard, for an exchange of lands with TRCA be received.

BACKGROUNDMr. Brent McKee, expressed an interest in purchasing a fragment of TRCA owned property located adjacent to 163 Thistledown Boulevard in the City of Toronto.

In accordance with TRCA policy, property staff circulated a description of the lands requested for disposal to TRCA technical staff and City of Toronto staff for review and comment. Staff reported back to the Executive Committee at Meeting #1/13, held on March 1, 2013.

At the March 1, 2013, Executive Committee meeting staff was recommending that the subject parcel be retained by TRCA for conservation purposes. However, due to the fact that the rear portion of 163 Thistledown Boulevard is situated within the Regional Storm flood plain, staff was directed to pursue the opportunity for a land exchange.

Staff discussed the possibility of a land exchange with City of Toronto Parks, Forestry and Recreation staff, who manage these TRCA lands pursuant to the existing management agreement, and TRCA Planning and Development Division staff.

Both City of Toronto Parks, Forestry and Recreation staff and TRCA Planning and Development staff are receptive to a proposed land exchange as this would bring the flood susceptible portion of 163 Thistledown Boulevard into public ownership.

At Executive Committee Meeting #8/13, held on October 4, 2013, Resolution #B122/13 was approved as follows:

THAT staff be authorized to enter into negotiations with Mr. Brent McKee, owner of 163 Thistledown Boulevard, for an exchange of lands with TRCA;

AND FURTHER THAT a report be brought forward to the Executive Committee at a future date with the results of the negotiations.

Staff commenced negotiations, outlining the steps involved to complete an exchange of lands with Mr. McKee, including an estimate of costs, which would be the sole responsibility of Mr. McKee. The following steps were identified by staff:

a market value appraisal report by an accredited appraisal firm in order to establish the

value of the tableland versus the flood plain land to be exchanged;a deposited Reference Plan;

an Application for Consent to sever TRCA land, with the possibility of a further requirement

for an Official Plan and Zoning By-law Amendment; removal and relocation of the existing chain link fence.

After considering the steps and costs involved as outlined by staff, Mr. McKee declined to further pursue an exchange of lands.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The purpose of this application is to undertake works within TRCA's Regulated Area of the Don River Watershed to facilitate the construction of an approximate 4.27 metre x 8.53 metre (14.01 feet x 27.98 feet) gazebo (non-habitable accessory structure) located at the rear of an existing residential dwelling associated with a municipal building permit. A partially channelized tributary of the West Don River traverses the rear portion of the subject property and a large part of the property is within the Regional Storm Floodplain. The proposed gazebo is located within the Regional Storm Floodplain but outside of the hydraulic floodway.

The watercourse is located within an 8.0 metre easement which extends into the subject property from the rear lot line. The proposed works are located within the easement. Please note that the City of Vaughan's Public Works Department does not object to the placement of the gazebo within the easement for overland flows. The City's approval is conditional upon the property owner grading the area along the fence line to create a swale to direct any potential overland flows towards the watercourse at the rear of the property.

Control of Flooding:The proposed works are located within the Regional Storm Floodplain. However, TRCA Water Resources staff has confirmed that the proposal will not have a significant impacts to the storage and/or conveyance of flood waters.

Pollution:Appropriate erosion and sediment controls have been proposed with this application, and will be maintained throughout all phases of construction.

Dynamic Beaches:Not applicable.

Erosion:There are no geotechnical and/or slope stability concerns with this project.

The warmwater fisheries timing window will apply to work at the East Duffins Creek and the Redside Dace timing window will apply to work at Urfe Creek, unless otherwise specified in writing by the Ministry of Natural Resources (MNR). Through review of the information provided, TRCA is of the opinion that the project and implementation as proposed will not cause serious harm to fish.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:This proposal involves widening Rossland Road from 2 to 4 lanes including turning lanes, a sidewalk and multi-use trail. A new 400 mm and 1050 mm diameter watermain will be constructed and infiltration trenches are proposed on both sides of Urfe Creek and the East Duffins Creek prior to stormwater release from the road. At Urfe Creek, the existing 7 m span box culvert will be replaced with a new single span bridge with a waterway opening of 30 m. An existing tributary of Urfe Creek will need to be realigned further to the north to accommodate the road widening. In addition, a new headwall will be constructed and connected to this realigned section of creek which will direct storm runoff from the existing ditch into the creek.

In addition to the road widening, work will also involve a realignment of Rossland Road to eliminate the 100 m offset at the intersection of Rossland Road and Church Street. Rossland Road will be realigned to the south from just west of the East Duffins Creek so that it connects with the existing alignment of Rossland Road on the east side of Church Street. The double span bridge (26.4 m bottom width opening) along existing Rossland Road over East Duffins Creek will be removed and the creek restored to natural conditions. A new 3-span bridge (44.5 m bottom width opening) will be constructed along the realigned portion of Rossland Road and over the East Duffins Creek. A section of the existing Rossland Road west of Church Street will remain in place to allow for access to existing and future infrastructure (watermains, utilities) within the road. The section of road that will remain will be reduced in width and the edges planted.

Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction.

Dynamic Beaches:Not applicable

Erosion:No geotechnical/slope stability issues are anticipated for the proposal.

Conservation of Land:The warmwater fisheries timing window (July 1 to March 31) will apply to work at the East Duffins Creek and the Reside Dace timing window (July 1 to September 15) will apply to work at Urfe Creek, unless otherwise specified in writing by the Ministry of Natural Resources (MNR). The subject property is located within the Lake Wilcox Special Policy Area (SPA) and is entirely within the Regional Storm Floodplain. Under the SPA criteria, redevelopment on a small scale may be permitted within the floodplain provided adequate flood proofing measures can be incorporated into the design and construction of all proposed buildings. The proposed dwelling, including all openings associated with the proposed works, are above the minimum elevation of the Regional Storm event and will be adequately flood-proofed in accordance with SPA and TRCA criteria. The proposed dwelling has been designed to withstand water flows and velocities expected during the 350 Year Storm Event. Furthermore, TRCA Water Resources Staff reviewed this application and are satisfied that there will be no impact on the storage and conveyance of floodwaters as a result of the proposed construction. The proposed works are considered to be Phase II of a larger 25 ha community development for the Bram East community. The final development will consist of multiple sports fields, recreation and park areas, in addition to the works proposed in Phase I and II. Proposal:The purpose of this application is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of an addition to the partially constructed place of worship; proposed community hall; the relocation of the sanitary servicing including septic system installation and connection; on-site paving works for the parking area and walkways; and Mayfield Road improvements including the westbound left turn lane and eastbound right-turn lane for an existing temple complex associated with a municipal Site Plan Application (City File #SP10-011) at 7905 Mayfield Road, in the City of Brampton. The proposed works are considered to be Phase II of a two staged development on the subject lands. The Phase I works involved the construction of a temple complex and were approved by the TRCA Executive Committee on May 6, 2011 (TRCA Permit #C-110242). However, the works associated with the initial phase were not completed. The institutional land use has been approved through an Official Plan Amendment (OPA) (City File #C10E17.4) and subsequent Ontario Municipal Board (OMB) Order (Case #PL030972). TRCA's principle concerns, including the delineation of the valley corridor have been addressed through the OPA process.

The West Humber River Tributary abuts the west portion of the proposed development. Through the OPA process, TRCA delineated the top of bank associated with the valley corridor. The proposed development is appropriately setback 10 m from the top of bank, which forms the limit of the valley corridor.

As part of the Phase I works, an extensive enhancement planting plan was submitted in order to improve the ecological condition of the adjacent valleylands. Additional plantings are proposed as part of this application.

Control of Flooding:The proposed works are located outside of the Regional Floodplain. As such, no impacts to the storage and/or conveyance of floodwaters are anticipated.

The purpose is to address basement flooding in the Westshore service area (community located on the west side of Frenchman's Bay) as a result of excessive stormwater inflow and infiltration into the sanitary sewer system in the City of Pickering. No in-water work will take place. Work within the wetland area adjacent to Frenchman's Bay between Sunrise Avenue and Beachpoint Promenade will take place in the winter when ground conditions are more favourable for construction.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:This proposal involves replacing segments of sanitary sewer in order to reduce the risk of basement flooding in the West Shore service area. The primary source of flooding in this area is excessive storm water inflow and infiltration into the sanitary collection system. Where there are low points in the roadway, excess stormwater can enter the sanitary sewer system through manhole covers. Pooling water can also infiltrate the sanitary system through system deficiencies such as misaligned joints, roof leaders and foundation drains, where connected. In this area it appears that the sanitary sewer is lower than the storm sewer leading to the conclusion that foundation drains are connected to the sanitary system. The Environmental Assessment which was completed in 2011 identified source control solutions such as the Basement Flooding Loan Program, disconnection of roof leaders, sealing of sanitary sewer manhole covers where surface ponding occurs to prevent inflow, and re-grading Bruce Hanscombe Memorial Park to establish an overland relief route in the area of pond along Breezy Drive.

Improvements to private residences was determined to be one of the more costly options and would take the longest to implement. As a result, the preferred alternative (replacing segments of sanitary sewer) will manage excess flow and meet the Regional performance objectives. The preferred alternative allows for infrastructure renewal including new manholes, new service connections, less disruption to the neighbourhood and the replacement sewers are located in an area where basement flooding is most frequently experienced. New service laterals can also be inspected at the time of construction and, if needed, replaced or lined to reduce inflow.

The existing sanitary sewers generally along Vistula Drive, Essa Crescent, West Shore Boulevard, Vicki Drive, Greycoat Lane, Sanok Drive and Breezy Drive will be replaced with larger diameter sewers to improve the conveyance capacity of the local system in areas where basement flooding regularly occurs. However, only work between Sunrise Avenue and Beachpoint Promenade along the west side of Frenchman's Bay will fall within the TRCA regulated area. The existing 400 mm diameter sanitary sewer will be removed and replaced with a new 750 mm diameter sanitary sewer along the same alignment and will connect to an existing network of sewers at Beachpoint Promenade.

In addition, the future re-grading of Bruce Hanscombe Memorial Park, adjacent to Breezy Drive will establish an overland flow route and help minimize ponding on Breezy Drive between Essa Crescent and Oklahoma Drive. The work within Bruce Hanscombe Memorial Park will be reviewed and approved under a separate application and coordinated with the City of Pickering.

Control of Flooding:Works within this area are not anticipated to affect the conveyance or storage of flood waters.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The proposal is to conduct site grading and alter a watercourse in order to facilitate the servicing and development of the Vaughan Healthcare Centre Precinct (VHCP) project, in the City of Vaughan. The overall subject property is approximately 33.1 ha (81.8 ac) in size and is located west of Jane Street and north of Major Mackenzie Drive. The property is bounded by an existing residential development to the north, Highway 400 to the west, Jane Street to the east and the existing Canada's Wonderland theme park to the south.

A headwater tributary to the Don River originates from a stormwater management pond located in the residential subdivision to the north, which then traverses the site, crossing under Major Mackenzie Drive. The site is also located partially in the Regional Storm Flood Plain. The flood plain condition on the site is attributed to an undersized culvert under Major Mackenzie Drive which then spills onto the southern portion of the property.

Over the past year, TRCA staff have been attending Vaughan Healthcare Detailed Design Progress Committee meetings to assist with the development of this project. It is a very complicated site to develop and all agencies requiring input are in attendance. In order to facilitate and expedite the development, one TRCA permit is being issued that will facilitate the various stages of this important project as it advances/develops. This Committee will ensure the progress of this project and that all matters are addressed as various aspects are built and designed.

The proposed development will consist of the Mackenzie Vaughan Hospital, which is located on a 14.9 ha block on the eastern half of the property. Other buildings will be designed and constructed for a range of healthcare and related uses, which will be located west of the hospital block. These buildings include a long-term care facility, supportive community housing, a medical mall, research, education and training facilities, community health uses and medical office space. The proposed works that will form part of this permit are to primarily service and prepare the site for the development of the above-noted buildings and structures.

Servicing of the property will be conducted in two phases with multiple projects in each phase.

Phase 1:

Project a): Access Road/Loop Ramps: Construction of new access roads and loop ramps north of Major Mackenzie Drive, which will provide access onto the site and for Canada's Wonderland to the south. The construction of these roads will be necessary in order to allow Canada's Wonderland to remove current easements in their favour over the remainder of the hospital site.

Project b): Construction of additional culverts under Major Mackenzie Drive in order to convey runoff from the site and external drainage areas. The undersized condition of the existing culvert will also be addressed through this project through the increase in capacity to convey flows from the Don River tributary. Once this project is complete, the majority of the site will be removed from the Regional Storm Flood Plain as it will then be contained within the newly restored watercourse channel block (see Project (c)).

Project c): Grading and development of a greenway block. The existing watercourse will be restored and enhanced through the implementation of a natural channel design.

Project g): Two (2) sets of conspan culvert crossings are to be constructed under proposed roads. These culverts will convey flows from the Don River tributary through the site.

Control of Flooding:The construction of the access road/loop ramps will temporarily take place within the Regional Storm Flood Plain of the Don River. A contingency plan has been submitted and reviewed by TRCA technical staff to ensure the flood plain is not impacted during the construction period. The storage and/or conveyance of flood waters will not be impacted by the proposed works.

Once the culverts under Major Mackenzie Drive are completed, the majority of the site will be taken out of the flood plain through the restoration works within the greenway. The flood plain will then be exclusively contained within the proposed greenway/watercourse corridor.

Pollution:Erosion and sediment control measures including rock checks, swales, sediment ponds will be constructed on the site. In addition, silt fencing will be erected and maintained around the work site, to ensure that sediment does not migrate into the adjacent natural system.

Dynamic Beaches:Not applicable.

Erosion:Erosion will be minimized through the implementation for the aforementioned sediment and erosion control measures.

Conservation of Land:There are no geotechnical/slope stability issues associated with the proposed works. No other significant natural features will be removed as part of the proposed works.

PlantingsPlantings of native, non-invasive species will be carried out in accordance with TRCA Planting Guidelines. Plantings will take place in and around the stormwater management ponds, outfall areas, culvert crossings and greenway/watercourse corridor.

An appropriate buffer was applied from the stream corridor at that time. The proposed development respects the previously established limit of development.

Proposal:The subject lands are located on the east side of Kennedy Road, north of Mayfield Road in the Town of Caledon. The lands are part of the Mayfield West Phase 1 residential community, and the current plan is generally consistent with both the vision and the land use plan for this portion of the community. The Southfields III plan of subdivision is a draft approved, partially registered plan, for which the first two of three phases have been registered. The first two phases were serviced by existing, previously approved stormwater management ponds, and no additional TRCA permits were required to facilitate the construction of these phases. Phase three of this subdivision will be serviced by a new stormwater management pond, to be constructed adjacent to the Humber 'H3' Tributary, at the north end of the subject property. The subject permit application is to allow for the construction of a temporary stormwater management facility, to facilitate earthworks and servicing within this final phase of development. A permit application has also been submitted, and will be brought forward at a later date for the proposed permanent stormwater management facility, which is to be located in the same location as the proposed temporary pond. TRCA staff have reviewed the initial technical reports submitted in support of this temporary stormwater management facility, and have visited the subject property. Based upon this, and the letter of undertaking provided by the proponent to address all outstanding TRCA requirements prior to the issuance of the permit, TRCA staff are supportive of this permit moving forward for consideration at this time.

Control of Flooding:The proposed development is located outside of the Regional Storm Floodplain. As such, no impacts to the storage and/or conveyance of flood waters is anticipated.

Pollution:Appropriate erosion and sediment controls will be installed and maintained throughout all phases of construction.

Dynamic Beaches:Not applicable

Erosion:There are no geotechnical and/or slope stability concerns associated with this permit application. Potential erosion on the subject property, as well as any potential erosion associated with the stormwater discharge for this site will be avoided through adherence to TRCA's Erosion and Sediment Control Guidelines.

Conservation of Land:No significant vegetation will be removed as a result of construction. A restoration and enhancement planting plan will be submitted with a future permit application for permanent servicing on the subject property. There are no fisheries related concerns associated with this project.

PlantingsPlantings are not proposed with this temporary facility, however, plantings will be associated with the proposed permanent stormwater management facility - the permit application for which, will be brought forward to the Executive Committee in the near future.

The rocks and Filtrexx Soxx will be augmented with live shrubs. Works will take 1 day. Further work may be undertaken in the summer, under a separate contract and Ontario Regulation 166/06 permit, to further secure the road and enhance the function of the creek.
