CSLB Proposes Legislation for 2015

The Contractors State License Board’s Legislative

Committee will be meeting next Friday, February

20th, to discuss whether the board should pursue

having the following bills introduced this year. If

the committee approves these proposed measures,

the recommendation will be placed on the full

Contractors License Board’s agenda at their March

meeting. Since this final approval will be after

the deadline for new bill introductions (which is

Friday, February 27th), the bills will be introduced

either as spot bills (place holders) or be introduced

by a legislative policy committee (typically either

the Senate or Assembly Business and Professions

Committee) since committees do not have

1). Enforcement of Licensing Provisions

Relevant Provisions: Business and Professions

Code section 7011.4

Summary: This proposal will expand the authority

of Enforcement Representatives

(ERs) to issue a written notice to appear (NTA) for

failure to secure workers’

compensation insurance.

Staff Comments: An NTA is a court order

mandating an individual’s presence at a hearing,

on a specified date, to answer to wrongdoings of

misdemeanor crimes. Under existing law, ERs with

the Contractors State License Board (CSLB) have

the authority to issue a written NTA.

This proposal would expand the jurisdiction of the

Enforcement division to include

ensuring payment of compensation that may

become due to an injured employee. The

proposed language does not reference a specific

section of the law, but is similar to that

in Labor Code (LC) section 3700.5, regarding

workers’ compensation (WC) insurance

requirements.

According to the Enforcement division, under

existing law, staff cannot add an LC section 3700.5

violation for failure to carry workers’ compensation

to the NTA; therefore, staff must include this

violation in a supplemental report along with the

NTA. The ability to include the Section 3700.5

violation on the NTA could streamline the district

attorney (DA) referral process. CSLB estimates

that 20 percent of the NTAs issued for unlicensed

practice will include the Section 3700.5 violation

(misdemeanor charges filed with the DA for

unlicensed activity and no WC policy).

The Department of Industrial Relations’ Division

of Labor Standards Enforcement (DSLE) issues

citations for failure to carry workers’ compensation

insurance, however, it does not file the LC section

3700.5 violations with the DA; DSLE takes

administrative action, whereas CSLB files criminal

charges with the DA. The Department of Insurance

also takes action against employers for WC

violations, but only against those that have WC

policies (premium fraud issues), whereas DSLE and

CSLB take action for not having a WC policy.

DSLE has sole authority to cite for wage violations.

ERs currently list these violations in their written

reports, and DA’s determine what charges are filed.

This proposal does not significantly change existing

practice, as WC violations can be noted in the

written reports.

Unlicensed contractors are likely violating other

wage and tax laws, but this proposal

provides specific authority for ERs to cite for WC

violations only.

2). Authority to Issue Citations – Collection of Additional Information

Relevant Provisions: Business and Professions

Code section 7028.6

Summary: This proposal would allow the

Contractors State License Board (CSLB) to collect a

Social Security number (SSN) from an individual

contracting without a license.

This authority would pertain primarily to

individuals identified during an undercover

sting operation.

Staff Comments: This new authority would

improve CSLB’s ability to collect fines from

unlicensed individuals. CSLB participates in the

Franchise Tax Board’s Intercept Collection

Program to assist in the collection of fines from

licensees. This program intercepts refunds

(including unclaimed state property and lottery

winnings) when individuals have delinquent debts to

government agencies.

When the Legislative Committee reviewed this

proposal, the language specified collection of a

Social Security number. The Committee heard

public comment recommending that a taxpayer

identification number be included. The proposal no

reflects this suggestion.

According to the Enforcement division, historically,

enforcement staff requested SSNs from unlicensed

individuals, but could not refer cases to the

Franchise Tax Board for collection because the

Attorney General’s office does not believe that

CSLB is authorized to collect this information.

Enforcement also notes that the authority to collect

SSNs will assist CSLB in regard to targets identified

in sweeps, since they receive an administrative

citation rather than a notice to appear in court.

To seek recovery of a debt through the Intercept

Collection Program, CSLB must submit

a SSN, and with the authority to collect that

information from unlicensed individuals

CSLB could more likely collect unpaid fines

through fuller participation in the program.

One of the requirements to participate in the

Intercept Collection Program involves at least a 30-

day notification to an individual with an unpaid debt

to allow that person time to dispute or settle the debt.

This proposal could improve the collection rate

for citations against unlicensed contractors and,

potentially, act as a greater deterrent to engaging in

unlicensed activity.

3). Notification by Licensees of Changes in Recorded Information

Relevant Provisions: Business and Professions

(B&P) Code sections 136 and 7083

Summary: B&P Code section 136 is a general

provision that applies to all Department of

Consumer Affairs boards. It requires each licensee

to notify the board of an address change within

30 days, unless the board, by regulation, specifies

a shorter time. B&P Code section 7083, in the

Contractors’ State License Law (CSLL), requires a

licensee to notify the Registrar of an address change

within 90 days.

Staff Comments: As these two sections establish

different time periods for reporting, one of the

provisions should be amended to eliminate any

potential confusion. Staff recommends amending

the section within the CSLL, rather than the

provision that applies to all DCA boards.

Suggested amendment: B&P Code section 7083.

Notwithstanding any other provision of law, All

licensees shall notify the registrar, on a form

prescribed by the registrar, in writing within 90 days

of any change to information recorded under this

chapter. This notification requirement shall include,

but not be limited to, changes in business address,

personnel, business name, qualifying individual

bond exemption pursuant to Section 7071.9, or

exemption to qualify multiple licenses

pursuant to Section 7068.1.

Failure of the licensee to notify the registrar of any

change to information within 90 days shall cause

the change to be effective the date the written

notification is received at the board’s headquarters

office.

Failure to notify the registrar of the changes within

the 90 days is grounds for disciplinary action.

4). Effect of Disciplinary Action by the Division of Labor Standards

Relevant Provisions: Business and Professions

(B&P) Code section 7103.5

Summary: This proposal would add a new B&P

section to specifically authorize the Contractors

State License Board (CSLB) to take disciplinary

action against a licensee based on a final

disciplinary action taken by the Division of Labor

Standards Enforcement (DLSE).

Staff Comments:

Existing B&P Code section 7103 contains similar

language to that which is proposed,

which allows CSLB to take disciplinary action

against a license based on disciplinary

action taken in another state. Added in 1994 (AB

3302, Speier, Chapter 1135), this

legislation stemmed from two 1993 sunset review

hearings of CSLB.

The analysis of that bill stated: Through some of

the cases presented to this committee in the CSLB

hearings, it was learned that many consumers had

recurring problems with contractors whose out

of state licenses were suspended or revoked. The

author believes that when a contractor commits a

violation in another state that results in disciplinary

action against that out of state license, the contractor

should not be permitted to move to this state and

begin “ripping off” Californians. This bill allows

the CSLB to take action against a license

based on the disciplinary actions taken in another

state.

This proposal seeks to expand that authority to

include actions taken by DLSE. This would affect

contractors involved in public works projects who

face disciplinary action from DLSE for a violation

of prevailing wage requirements.

According to the CSLB Enforcement division,

DLSE receives thousands of complaints from

unpaid workers each year, many of whom were

employed by licensees. Construction contractors are

required to pay workers on public works projects the

prevailing wage, and failure to do so can result

in the issuance of a Civil Wage and Penalty

Assessments (CWPA). The majority of CWPAs

are resolved when the licensee pays monies owed

to workers, and no further action is warranted.

Unfortunately, some licensees do not pay workers

what they are owed or mitigate potential discipline

by filing for bankruptcy. This legislation addresses

those licensees who fail to comply with the CWPAs

when they discharge their debt through bankruptcy.

When a licensee does not pay monies owed to

workers, DLSE confirms the CWPA as a judgment

in civil court. CSLB routinely suspends licenses

for outstanding liabilities and can link to the public

disclosure on DLSE’s website. But under current

law, to impose discipline, CSLB must establish a

deliberate disregard and violation of a labor law.

DLSE action does not meet this requirement. CSLB

is seeking legislation that authorizes discipline

against licensees that commit egregious public

works payroll violations and do not take steps to

mitigate the violation.

If chaptered, the legislation will allow CSLB to

discipline licensees under the same evidence

requirements that apply when another state takes

an action against a contractor – B&P Code section

7103. For example, it will allow CSLB to take an

administrative action based on DLSE’s discipline.

This proposed language is permissive, rather than

mandatory, so it will not impose a significant

workload. Staff estimates an additional 10 to 20

Summary: Existing law establishes fees for

applications, examinations, and related activities.

This proposal would establish a fee to process

officer/personnel changes, raise the fee

for additional classifications and replacing the

qualifier, and establish a fee for

processing priority applications.

Staff Comments: CSLB’s Licensing division has

identified new workload related to processing

applications for personnel changes, as well as

the increased number of applications to add a

classification and to replace a qualifier. In addition,

while a process exists for applicants to request

expedited application processing, there is no

charge to do so. The division completed a review

of workload and staff time dedicated to this work,

which was used to determine the appropriate fees

for each of these activities.

PROBLEM/SUMMARY:

A home improvement salesperson (HIS) is an

individual, employed by a home improvement

contractor licensed by the Contractors State

License Board (CSLB), who is registered to solicit,

sell, negotiate, or execute contracts for home

improvements on behalf of the contractor. Existing

law requires that an HIS apply for, and be separately

registered for each distinct contractor for which he

or she works.

This proposal would eliminate the requirement

that an HIS separately register to work for each

contractor and, instead, allow a properly registered

HIS to utilize his or her individual registration

with one or more licensed contractors. With this

change, the licensed contractor would be required

to notify CSLB about the pending employment of

any registered HIS, including the submission of the

HIS registration number, prior to the HIS beginning

work. Currently, CSLB has approximately 11,170

active HIS registrants, nearly 5,500 expired

registrants, and almost 85,000 invalid registrants.

PROPOSED LANGUAGE:

Amend Business and Professions (B&P) Code

section 7152 as follows: (a) “Home improvement

salesperson” is a person, employed by a home

improvement contractor licensed under this

chapter, who is registered under this chapter to

solicit, sell, negotiate, or execute contracts for home

improvements, for the sale, installation or furnishing

of home improvement goods or services, or of

swimming pools, spas, or hot tubs.

(b) The following shall not be required to be

registered as home improvement

salespersons:

(1) An officer of record of a corporation licensed

pursuant to this chapter,; or a manager, member,

or officer of record of a limited liability company

licensed pursuant to this chapter.

(2) A general partner listed on the license record of a

partnership licensed pursuant to this chapter.

(3) A qualifying person, as defined in Section 7025.

(4) A salesperson whose sales are all made

pursuant to negotiations between the parties if the

negotiations are initiated by the prospective buyer at

or with a general merchandise retail establishment

that operates from a fixed location where goods or

services are offered for sale.

(5) A person who contacts the prospective buyer for

the exclusive purpose of scheduling appointments

for a registered home improvement salesperson.

(6) A bona fide service repairperson who is in the

employ of a licensed contractor and whose repair

or service call is limited to the service, repair, or

emergency repair initially requested by the buyer of

the service.

(c) The exemption to registration provided under

paragraphs (1), (2), and (3) of

subdivision (b) shall apply only to those individuals

who, at the time of the sales

transaction, are listed as personnel of record for the

licensee responsible for soliciting,

negotiating, or contracting for a service or

improvement that is subject to regulation

under this article.

Statewide “Wage Theft is a Crime” Campaign Opens the Doors to California Labor Commissioner’s Office California Labor Commissioner Julie A. Su recently

hosted members of the press to discuss partnerships

with worker advocacy and industry groups and to

highlight recent achievements in fighting wage theft.

The event was held in the Los Angeles wage claim

office as part of the “Wage Theft is a Crime”

public awareness campaign, launched last year by

the Department of Industrial Relations (DIR) and

its Labor Commissioner’s Office. Bilingual staff

members were present at today’s event to provide

information on how workers can report wage theft

to the Labor Commissioner’s Office.

“Our department’s mission is to protect California’s

workers with comprehensive labor laws and

enforcement focused on businesses that intentionally

skirt the law,” said DIR Director Christine Baker.

“A critical part of that mission is the outreach and

education to the public we serve.”

“We’ve taken significant steps to increase access

to the Labor Commissioner’s Office and the

resources available to fight wage theft,” said Labor

Commissioner Julie A. Su. “This award-winning

campaign is one of the ways that we continue

to remove barriers and push back on the unfair

practices of the underground economy.”

The “Wage Theft is a Crime” campaign, which

won the 2014 HPRA National ¡BRAVO! Award for

Public Education Campaign of the Year, is grounded

in multilingual outreach to workers, employers

and over 800 community based organizations.

Educational materials distributed at local events as

well as through mailings, digital and print media

emphasize prevention of wage theft in low-wage

industries and encourage victims to report labor law

violations.

Since its debut in May 2014 with the website

WageTheftIsACrime.com (in Spanish

RoboDeSueldoEsUnCrimen.com), the campaign

has prioritized communication in the languages

spoken in California’s immigrant communities. The

campaign includes multilingual print and outdoor

advertising as well as radio commercials on ethnic

stations in English, Spanish, Chinese, Vietnamese,

Hmong and Tagalog.

The Labor Commissioner’s office, also known

as the Division of Labor Standards Enforcement,

is a division of DIR. Among its wide-ranging

enforcement responsibilities, staff inspect

workplaces for wage and hour violations, adjudicate

wage claims, enforce prevailing wage rates and

apprenticeship standards in public works projects,

investigate retaliation complaints, issue licenses and

registrations for businesses and educate the public

on labor laws.

Roundtable President Releases Statement Regarding Study on “Green Jobs” Impact to the California Economy

We’ve all heard about the governor’s ‘push’ for

‘green’ jobs. So, what kind of impact has ‘green’

jobs had on California’s economy. Following is a

statement just released by the California Business

Roundtable on the subject that is very interesting.

California Business Roundtable, president, Rob

Lapsley released the following statement following

the release of a study by the Center for Jobs and

the Economy on the impact of Green Jobs on the

California Economy.

Given the upcoming proposals on the next

generation climate policies, it is critically important

to start understanding exactly what the green

economy means to California’s long term jobs

future. According to a recent review from the

Center for Jobs and the Economy, multiple studies

indicate that 2% of all California jobs are classified

as green jobs. “There is evidence that California

has gained temporary jobs around construction

and installation of solar facilities and consulting

work for government and private employers, but it

appears that the green sector has not yet developed

substantial permanent, middle income jobs for a

long term employment base,” said Rob Lapsley,

President, California Business Roundtable.

“We need to put their numbers into perspective and

understand the unique role they will play and how

we can develop state policies that recognize their

importance while growing the other 98% of our

current jobs in other sectors.” said Lapsley.

For example, the only hard green jobs data from the

state was a California Employment Development

Department (EDD) survey from May 2009 to

January 2010 which found that “the results also

showed no discernable difference in the likelihood

that a green or non-green firm would experience

a net job gain.” The state should have the latest

and most transparent green jobs data to help the

Governor and policymakers in their decision-

making.

While some green industry sectors are growing,

many studies rely on reclassification of traditional

jobs such as those in garbage, public transit, utilities,

and government regulatory positions as “green”

in order to arrive at their numbers. This issue is

critically important because major environmental

and energy policy decisions will be based on these

classifications and incomplete numbers. The Center

noted that some reports on green jobs build their

numbers by including indirect jobs, including

supporting services such as “consulting, finance,

tax, and legal services.”

The analysis also found that nuclear, hydro, and

natural gas power jobs are treated as green jobs,

including in the most recent higher estimates,

although those facilities are not designated as such

under the AB 32 program. “If we expect to have an

accurate accounting that will guide policy-making,

then we need to start with a reasoned and practical

definition of a green job to be used by government

and private entities,” said Lapsley.

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

The name’s the thing in causing our first

contractor to call. A bi-coastal contractor needs

‘expedited’ advice on how to move from current

corporate license classes to his LLC, without

affecting work in progress. We also share a lesson

in Arizona licensing…

Q: We currently have a contractor’s license for our

corporation that operates out of Northern California

we’ll call it ABC Roofing Inc. We opened an

operation in Southern California and our accountant

formed a separate corporation for payroll purposes,

we’ll call this one XYZ Roofing Inc. Can we just

add XYZ Roofing Inc. as a dba to ABC Roofing

Inc.’s license?

A: No, since these are two separate entities, each

must have their own license number. A corporate

license number is issued exclusively to a specific

corporation registration number.

Q: We have a California corporation and also a

Delaware Limited Liability Company (LLC), both

that have licenses. Our corporate license has an

RME (Responsible Managing Employee) with

eight different classifications. We want to operate

under just the LLC license and cancel the corporate

license. How do we go about moving our RME from

the corporation to the LLC? We need to keep all

classifications active at all times.

A: The CSLB only allows you to add classifications

to your license one at a time, so you would first need

to decide the order in which you’d like to add them

to the LLC license and then submit the applications

one by one.

Because RME’s can only be on one license at a time

(except in some rare instances), once you add the first

classification to the LLC license, your Qualifier will

need to Disassociate from the corporation’s license.

I assume you will not be replacing the RME since

you intend on cancelling the corporate license, so

once he Disassociates you have 90 days to complete

the process of adding classifications to the LLC in

order to keep them all active at all times.

Each additional classification application will take

several weeks to process, and with 8 classifications

to add one at a time, it may be difficult to complete

the process in 90 days. The CSLB has an expedite

committee that will review your reason for wanting

your application(s) processed on a more immediate

basis. The expedite requests are evaluated on a case-

by-case basis, but it may be worth attempting in your

case. If you need assistance with this process please

Q: You’ve helped us in the past with our California

license. My company is licensed in California with

the following classifications: General Building (“B”),

Electrical (“C-10”), HVAC (“C-20”), Plumbing

(“C-36”), and “C-43” (Sheet Metal). We need to

obtain a license in Arizona but I understand that

each classification requires a separate application

and has a separate license number. Without being

familiar with the laws in Arizona, if we were just to

obtain a residential General Building license, can we

use that to perform electrical jobs, plumbing jobs,

etc? Or do we need the specialty licenses as we do in

California?

A: While the laws do vary a bit from California,

with a “B” (General Residential Contractor) license

in Arizona you are not permitted to perform work

related to electrical, plumbing, air conditioning

systems, boilers, swimming pools, spas and waters

well. All work relating to these trades requires either

the specialty license, or it must be subcontracted to

an appropriately licensed contractor.

Hand Tools

The potential for injury from commonly used hand tools is always present.

Often these tools become so much a part of the job that we take them for granted. Certainly a broken tool can prove to be a hazard, but so can using the wrong tool for the job or failing to recognize the other hazards that can develop while using common hand tools.

Hand tools by definition are not powered by a secondary source. They rely on the force, strength and skill of the user to function properly. In order to do that safely, they need to be in good working order.

Did you know that each employer is responsible for the safe condition of tools and equipment used by employees, including tools and equipment which may be furnished by the employee?

Many potential injuries are associated with using simple hand tools:

• Strain, sprains and overexertion • Cumulative trauma injuries • Foreign objects in the eyes • Hand or body injuries • “Struck-with” or “struck-by” injuries • Lacerations and punctures

Many hand tools are used on virtually any job. Here are a few common types:

• Wood working tools such as chisels • Pounding tools such as hammers • Digging tools such as shovels • Cutting tools such as pruning loppers • Mechanical tools such as adjustable jaw wrenches • Various types of hand saws, rakes and pliers

Hand Tools

Before use:

Regardless of the type of tool, all hand tools should be inspected before they are used. Even employee-owned tools used on a job site should be inspected before use. Damaged, bent or defective equipment should not be used.

• Handles should be inspected for cracks: − They should not be painted, lacquered or covered

up with tape or material that prevents adequate inspection.

− Jaws should be in good shape, not loose, worn or stripped.

• Blades should be sharp and in good condition.

• Striking surfaces should be solid and free of worn edges or mushrooming that could create a flying debris hazard.

• Certain equipment requires ANSI or other certifications; non-approved tools should not be used in place of the approved equipment.

During use:

• Follow the instructions. Hand tools are designed to be used under particular manufacture-specified conditions and only used for the intended purpose. − Never use “cheater bars,” extension handles, power equipment, or other non-

approved alterations. − Make sure you are not going beyond what the manufacturer intended by

making variations on either the equipment or its use.

• Many accidents and injuries occur when the wrong tool is selected for a specific task. Common occurrences include: − Using screwdrivers as chisels or as pry-bars. − Using wrenches as hammers. − Using loppers instead of a pruning saw on larger branches.

Personal protective equipment (PPE):

• Proper use of any hand tool includes considering the personal protective equipment (PPE) needed while using the tool.

• In many cases safety glasses or gloves should be used.

• With exposed blade cutting equipment, chaps or other cut-resistant material should be considered.

• One of the best examples of eliminating the hazard is the new style of razor knife that eliminates the possibility of people cutting themselves.

Hand Tools

There are other potential hazards that can impact the type of PPE to be used:

• The type of PPE required may be altered by the presence of: − Electricity − Spring energy − Compressed air − Chemicals − Fluids − Heat or cold

• A person working during a warm summer day may need different types of PPE than a person working on a cold winter day, even though they are using the same tools and performing the same tasks.

• In some cases the PPE may require that a different tool be selected or that considerations be made for other pertinent hazards depending on the conditions that are encountered.

Ergonomics must be considered:

• The conditions or tasks to be performed may require the worker to hold the tool in an awkward position: − This may create a hazard in and of itself, or it may make the worker more

susceptible to other hazards such as falls or potential damage to knees or other body parts.

• Another common problem with the use of hand tools can be repetitive motion issues that can produce cumulative trauma disorders. − One of the more common occurrences of this condition is when framers and

roofers repeatedly swing a hammer in the course of a day.

• Many great new tool designs have been developed to reduce this type of injury in the workplace: − Hammers with more ergonomically designed handles are now available. − The amount of force required to properly use some of these new, more

ergonomically designed tools is also considerably less.

Hazard Assessments:

• Employers need to perform hazard assessments in their workplaces to characterize the nature and types of hazards that are present.

• They are simple and do not have to be cumbersome.

• Consider the types of tools that will be used, the conditions that will be experienced and the type of personal protective equipment that may be needed.

• Hazard assessments should be in writing and specific for the job or task to be performed.

La posibilidad de una lesión proveniente de herramientas manuales que se usan comúnmente siempre está presente.

¡Las consideraciones de seguridad siempre son críticas! Frecuentemente estas herramientas se vuelven tan familiares al trabajo que realizamos que las subestimamos. Ciertamente una herramienta rota es una amenaza, pero también el utilizar la herramienta incorrecta para el trabajo o el no reconocer las otras amenazas que pueden estar presentes mientras utilizamos las herramientas manuales comunes.

Las herramientas manuales por definición no reciben energía de una fuente secundaria. Dependen del impulso, la fuerza y la habilidad del usuario para funcionar adecuadamente. Para hacerlo de la forma más segura, necesitan estar en buenas condiciones de trabajo.

¿Sabía que cada empleador es responsable por la condición de seguridad de las herramientas y equipos utilizados por los empleados, incluyendo herramientas y equipos que pueden haber sido proporcionados por los empleados?

Muchas lesiones potenciales están relacionadas con el uso de estas simples herramientas manuales:

• Tensión, torcedura, esfuerzo excesivo. • Lesiones por traumas acumulativos • Objetos extraños en los ojos • Lesiones en manos o cuerpo • Lesiones al golpearse o ser golpeado por una herramienta • Laceraciones y perforaciones

Antes de usarlas:

Sin importar de qué tipo de herramienta se trate, todas las herramientas manuales deben ser revisadas antes de su uso. Incluso las herramientas que son propiedad de los empleados y que se usan en el sitio de trabajo deben revisarse antes de su uso. El equipo dañado, doblado o defectuoso no debe ser utilizado.

• Las asas deben de revisarse para detectar grietas: − No deben estar pintadas, barnizadas o cubiertas con

cita o material que impida una inspección adecuada. − Las mandíbulas deben estar en buen estado – no

sueltas, desgastadas o dañadas.

• Las navajas deben estar afiladas y en buen estado:

• Las superficies al descubierto deben ser sólidas y no tener bordes gastados o enmohecidos que pudieran generar una amenaza de residuos voladores.

• Ciertos equipos requieren de una certificación ANSI o de otro tipo; herramientas no aprobadas no deben ser usadas como reemplazo de equipo aprobado.

Durante su uso:

• Especificaciones del fabricante: − Las herramientas manuales están diseñadas para ser utilizadas bajo condiciones

particulares especificadas por el fabricante y únicamente deben ser usadas para el propósito que fueron fabricadas.

− En consecuencia, “barras de extensión,” manijas extensibles”, equipo de electricidad u otras alteraciones no aprobadas no deben ser utilizadas.

• Amenazas adicionales se generan cuando se realizan variaciones ya sea en el equipo o en el uso que van más allá del propósito del fabricante. − Muchos accidentes y lesiones ocurren cuando se elije la herramienta equivocada

Existen otras amenazas potenciales que pueden influir en el tipo de EPP que debe utilizarse:

• La presencia de electricidad, energía de resorte, aire comprimido, químicos, fluidos, calor o frío pueden modificar la necesidad y el tipo de EPP que se requiere.

• Una persona que está trabajando durante un caluroso día de verano puede necesitar un tipo diferente de EPP que otra persona que está trabajando en un frío día de invierno, aun cuando estén utilizando el mismo tipo de herramientas y haciendo las mismas tareas.

• En algunos casos, el EPP puede requerir que se elija una herramienta diferente o que se tengan que consideras posibles amenazas dependiendo de las condiciones que prevalezcan.

Se debe tener en cuenta la ergonomía:

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.

ReadyMarin.org is Marin County’s website for information on emergency preparedness, whether you are just learning or an experienced emergency volunteer. Our mission is to provide guidance, training and resources to keep you and your family safe during an emergency, whether it requires you to evacuate or shelter in place. Get Ready is a county-sponsored 2-hour training, facilitated by our local Fire Departments and community volunteers, that will provide you with an overview of how to prepare your family and home.

Community Emergency Response Team (CERT)

For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.
