Bill brings 40 years of practical construction experi-ence to bear on the challenges of local governance in pursuit of healthy, safe, and sustainable communities. Bill holds numer-ous professional certifications, and has served as President of the County Building Officials Association of California.
Thomas Ahrens has been Chief Building Official for the City of San Rafael for over 8 years, and has also served as San Rafael Fire Marshal. He began his construction-related career on the other side of the counter, beginning as a carpen-ter before obtaining his GC license.
Fred Lustenberger has been Chief Building Official for the Town of Tiburon since 2010, and also works as a Certified Access Specialist. He has worked as a Building Official for the city of San Carlos, as well as Mariposa County and Sonoma County. He was a general contractor for 9 years.

While it’s not pulling a rabbit out of a hat like the stage magician, we will show a contractor the way to change a ‘member’ into a LLC ‘manager’. SWIFT justice comes to ‘posers’ who harm real contractors with acts no one will applaud and, unfortunately, we can’t help a contractor make ‘ornamental metal’ stand-in for a ‘structure’…
Q: Your firm assisted us in getting set up with our “B”, “C-23” (Ornamental Metal), and “C-17” (Glazing) licenses. We would now like to add the “C-51” (Structural Steel) to the license. Our company is very diverse and sometimes gets into areas that could be considered “structural” and we of course don’t want any problems. Would this require an examination if we use the same Responsible Managing Officer (RMO) that holds our current licenses?
A: Thank you for contacting us again. While the CSLB will sometimes consider waiving a trade exam for an individual who has held a classification that is very closely related to the classification being applied for, in my opinion the “C-51” is not very closely related to the classifications currently on your license. I don’t believe the CSLB will grant a waiver of the trade exam in this case.
Q: We recently obtained a contractor’s license for our Limited Liability Company (LLC). We noticed on the license that the CSLB has our personnel listed as “members” instead
of “managers”. I’m not sure if this was our mistake when we applied or the CSLB’s mistake, but regardless, we need to get that corrected. How do we do that?
A: This change can be made by completing an Application to Report Change of Title for Current Personnel of a Limited Liability Company with the Board. There is no fee for filing this change.
As indicated in a recent CSLB press release, “one of the goals of (our) undercover sting operations is to convince those caught for illegal contracting that they’re far better off getting their license and working as a legitimate contractor.” Unfortunately, for some individuals that message just doesn’t seem to sink in.Of the 13 persons cited April 24 on illegal contracting charges at stings in Chino and Lake Elsinore, three were repeat offenders, including one who had a $5,000 warrant hanging over his head for failing to appear in court on a previous contracting violation.
As has often been covered in this column, the CSLB’s Statewide Investigative Fraud Team (SWIFT) regularly conducts these sting operations in order to put a dent in the underground economy. In this most recent action, CSLB investigators requested bids for painting, fencing, concrete, and tile work at two locations, with the highest estimate coming in at $9,350 for a fence project. The
suspect with the $5,000 warrant, is a very familiar figure to CSLB investigators. He’s an unlicensed painter from Riverside who has three prior misdemeanor charges related to illegal contracting, and has been cited twice by CSLB on administrative violations.
The Contractors Board tries to bring unlicensed contractors over to the legal side and will even give those caught in these stings an application to apply for a license. However, according to CSLB Registrar Steve Sands, “we won’t tolerate these chronic offenders who think they can sidestep the law and endanger the public.”Twelve of the 13 suspects, including the previous offenders, received misdemeanor citations for contracting without a license. According to B&P Code 7028, conviction penalties for contracting without a license include up to six months in jail and/or up to $5,000 in fines -- plus penalties escalate with successive violations.

AB 2355 (Levine) – Local Requirements for RAP/RAS on Roads – I am pleased to inform you that MBA’s
sponsored bill, AB 2355 (Levine), was heard this
week in the Assembly Transportation Committee
and passed out 13-0. It will next be heard in the
Assembly Appropriations Committee where it
should have no problems being approved.
If signed by the governor (as I expect) it will
encourage local governments to adopt Cal Trans’
forthcoming specification to use at least 40%
reclaimed asphalt pavement in their hot asphalt
roadway mix. Also included in this proposed
standard will be a mixture of up to 30% by
weight of the use of recycled asphalt shingles.
All local governments will be required to adopt
Cal Trans’ standards by January of 2017 or
conduct a public hearing to explain why.
AB 1522 (GONZALEZ) EMPLOYMENT: PAID SICK DAYS - StoppedI have reported in the past about the importance
of our joining together with our fellow employer
associations by forming coalitions to stop BAD
bills. I cannot emphasize enough how successful
coalitions have been to our legislative efforts in
stopping bad bills and helping the good ones.
A perfect case in point is AB 1522 (Gonzalez).
This bill was stopped DEAD in its tracks this
week before being heard in the Assembly
Appropriations Committee. Assemblywoman
Gonzalez realized that our coalition had ‘done its
homework’ and that the bill would never get out
of committee. Instead, she waived presentation,
meaning this should be the end of the line for this
measure this year.
AB 1522 would have mandated that all
employers, except those with collective
bargaining agreements, provide any employee
who has worked in California for seven days
with paid sick leave, at an accrual rate of one
hour for every thirty hours worked. After the
90th day of employment, employees would be
allowed to utilize their paid sick leave to care
for themselves or a family member. Pursuant to
AB 1522, any unused sick leave accrued in the
preceding year could be carried over to the next
year, which is a significant change in existing
law. While many employers voluntarily offer
sick leave for full-time employees, expanding
this to a mandate on all employees to temporary,
seasonal, and part-time employees would have
created a huge burden on employers. Thankfully,
the committee members agreed with us and
informed the member that her bill would not
get out of committee. One down and countless
others to go!
AB 1705 (Williams) – Defines Substantially Complex Public Works Projects Moves onIn 2011, we co-sponsored SB 293 (Padilla) which
provided for 5% retentions on all public works
projects unless the agency specified in the bid
that the project was “substantially complex.” If
they did, they could keep the retentions at 10% on
the project. School districts and other agencies
immediately began calling each project they
were doing ‘substantially complex.” Obviously
they were ‘gaming’ the system which meant
that another bill had to be introduced this year to
correct the loophole.
AB 1705 will define “substantially complex.” If
signed into law, the measure will require public
entities to explain the reasons why a project is

maintenance projects and routine work
commonly performed by licensed contractors,
such as upgrading parking lot lights or installing
bleachers or chain link fencing, from being
included in the exception.
AB 1734 (Sawyer-Jones) – Increases Small Business and DVBE ParticipationThis measure passed out of committee the other
day. It requires each state agency to establish
and achieve a goal of 25% small business (SB)
participation and an annual phased-in goal of 5%
disabled veteran business enterprises (DVBE)
participation in state contracting.
AB 2471 (Frazier) – Requires Agencies to Issue Change Orders This measure was approved in committee this
week. This bill requires public entities, when
additional work is needed, to issue change orders
promptly, and in no event later than 60 days
after the extra work is performed. If the public
entity fails to issue a change order within this
timeframe, the original contractor may bill for
this work that has already been performed, and
the public entity shall be liable for that work.
Prejudgment interest, which is interest from
the time the amount was due until the case was
resolved, would accrue at the rate of 10% per
year if the public entity fails to promptly issue
a change order or pay in compliance with this
bill. Additionally, an original contractor may
enforce requirements of this bill through a writ of
mandate, which is a court order to a government
entity.
Bills Set for Week of May 5thPolicy committees are winding down next week.
All House of origin bills must be out of their
policy committee before next Friday or die.
AB 1569 (Rodriguez) – Tax Credit For ApprenticesThis bill, for taxable years beginning on or after
January 1, 2016, and before January 1, 2020,
would allow a credit against the taxes imposed
under those tax laws in an amount equal to
$2,000 for each registered apprentice trained by
the taxpayer in the taxable year. This bill would
require the Division of Apprenticeship Standards
to establish a procedure for taxpayers, in the form
and manner jointly prescribed by the Division
and the Franchise Tax Board, to apply and
receive a certificate for purposes of the credit.
Update on DIR Annual Filing Fee for Public Works ContractorsThe fight goes on between the Department
of Industrial Relations and the contractor
community over the annual $300 filing fee to
perform public work. Among other things, there
is a huge concern that a contractor who has subs
who have not paid the fee prior to submitting a
bid will be disqualified. The argument we are
making is that the fee should not be required until
the contractor has been awarded the contract.
These and other concerns continue. I will keep
you posted.
Cal/OSHA Issues First High Heat Advisory of 2014 as Temperatures Rise Across the StateCal/OSHA is advising all employers to protect
their outdoor workers from the risks associated
with heat illness. Beginning mid-week,
temperatures are expected to be 15 to 25 degrees
above normal in both northern and southern
California.
“With the first significant heat wave of the
year expected this week and into the weekend,
we want to make sure employers know their
responsibilities and what is needed for outdoor
workers to avoid heat illness,” said Christine
Baker, director of the Department of Industrial
Relations (DIR). The Division of Occupational
Safety and Health, commonly known as Cal/
OSHA, is a division of DIR.
“Early in the season, especially as the
temperatures spike, all workers, regardless
of fitness, should be given the opportunity to
acclimatize to handle heat stress and prevent
serious injuries from heat illness,” said acting
Cal/OSHA Chief Juliann Sum.
California’s heat regulation requires all
employers with outdoor workers to take basic
steps to protect outdoor workers:
• Train all employees and supervisors about
heat illness prevention.
• Provide plenty of cool, fresh water and
encourage employees to drink water
frequently.
• Provide a shaded area for workers to take a
cool down recovery break.
• Prepare an emergency heat illness
prevention plan for the worksite, with
training for supervisors and workers on
the steps to take if a worker shows signs or
symptoms of heat illness.
• It is recommended that employers take
steps to help their workers acclimatize, or
get used to working outdoors in the heat.

Acclimatization is important for new
workers and for everyone during times of
high heat.
“Extra attention and training should focus
on work pace, water, shade, and rest breaks.
Workers should be encouraged to report any
symptoms promptly to avoid the progression of
mild heat illness to more serious heat exhaustion
and heat stroke. Focusing on preventive
measures is the best way to keeping the
workforce healthy and productive,” added acting
Chief Sum.
Special “High Heat” procedures are also
required when temperatures reach 95 degrees
and workers are at greater risk. At these times,
supervisors must take extra precautions:
• Observe workers for signs and symptoms of
heat illness.
• Remind workers to drink water frequently.
• Provide close supervision of workers in the
first 14 days of their employment (to ensure
acclimatization).
• Have effective communication systems
in place to be able to summon emergency
assistance if necessary.
Cal/OSHA will inspect worksites in outdoor
industries such as agriculture, construction,
landscaping, and others throughout the heat
season. Through partnerships with various
employer and worker organizations in different
industries, Cal/OSHA will also provide
consultation, outreach and training on heat
illness prevention.
Cal/OSHA takes a comprehensive approach to
preventing heat illness among outdoor workers.
Its award-winning heat illness prevention
campaign, the first of its kind in the nation,
includes enforcement of heat regulations as
well as outreach and training for California’s
employers and workers.

requirements and training materials can be
obtained at Cal/OSHA’s Heat Illness web page
or the Water. Rest. Shade. campaign site. A Heat
Illness Prevention e-tool is available on Cal/
OSHA’s website, and more information can be
found on DIR’s Facebook and Twitter pages.
Cal/OSHA’s Consultation Program provides
free and voluntary assistance to employers and
employee organizations to improve their health
and safety programs. For assistance from the
Cal/OSHA Consultation Program, employers
can call (800) 963-9424.
Employees with workplace safety questions or
complaints, including heat illness, can contact
the Cal/OSHA district office in their region to
file a confidential report. Recorded messages
in English and Spanish detailing resources for
California workers are also available toll free at
1-866-924-9757.

Good drivers are skillful, law-abiding and safety-conscious.
When drivers fail to focus on driving responsibilities, disregard laws and take chances, they put everyone at risk. In order to be a good driver, you must build your skills through training and practice, comply with the law and be safety-focused.
Train and practice:
• Some people do not react well to different driving conditions. In most cases, poor driving behaviors result from a lack of training and practice.
• If you are not skilled in a maneuver, find the right method and practice until you can execute it perfectly.
• Areas that may require extra practice include: − Backing up. − Negotiating turns at
intersections. − Handling skids.
Obey the laws: • A true professional is familiar with
all applicable laws and ordinances. • A responsible driver also knows all
of the company rules, regulations and policies that relate to driving for work.
• Knowing the rules is still not enough—the rules must be observed.
Be safety-focused:
• Be proactive and vigilant about your responsibilities and safety. • Promote a positive, safe driving culture. • Be willing to accept suggestions. • Adhere to rules and procedures, even when under pressure. • Be prepared to: − Confront others in a constructive manner when rules are not followed. − Inform and educate co-workers and individuals in the work groups by offering
proactive suggestions for improvement.
To be a professional in any field requires hard work, training and practice. With effort, you can become a skilled driver.

For the last nineteen years students all over Marin County have had the opportunity to learn hands-on skills of the construction trade. The class is eighteen weeks and is offered every Spring Semester on Wednesday evenings at Redwood High School, Larkspur. Our Assistant Instructors take groups of five students each and build a shed from the ground up. It is a memorable experience and the students and instructors look forward to every Wednesday. Students also have the opportunity to be hired for a six week Summer Internship with local contractors. They will be completely qualified to use power tools during the internship. Please support us by hiring a student for an internship. Students who interview are recommended by all Instructors to insure they are ready to work for you! You will not be disap-pointed.
