CsLB Announces Zero-tolerance enforcement

Policy on uncertified electricians

The Contractors State License Board (CSLB) established a zero-tolerance enforcement policy in 2010 and now issues legal action against any C-10 Electrical contractor who willfully employs an uncertified electrician to perform work as an electrician. CSLB is legally required to open an investigation and initiate disciplinary action against the contractor (which may include license suspension or revocation) within 60 days of receipt of a referral or complaint from the Department of Industrial Relations’ Division of Apprenticeship Standards (DAS).

Labor Code Section 3099.2 stipulates that anyone who performs work as an electrician for C-10 Electrical contractors shall hold an electrical certification card issued by DAS; DAS is required by Labor Code Section 3099.2 to report violations to CSLB.

Electricians are defined as those who engage in the connection of electrical devices for C-10 contractors. It is CSLB’s position that electrical work must be performed by either a state-licensed or a certified electrician. An indentured apprentice or state-registered electrician trainee may also perform electrical work if supervised by a state-certified electrician. Trenching, concrete, framing, and other work that does not involve connecting electrical devices may be performed by noncertified workers.

Target Support Shows in Real NumbersLandowner letter prompts more

than 1,000 responses

San Rafael, CA -- More than 1,000 San Rafael residents have stepped up to lend support for a proposed Target store. Stephanie Plante, whose family business owns the former San Rafael landfill site where Target wants to locate, says she was frustrated that the many people who have spoken to her in favor of the store were not being heard. She sent a letter to San Rafael residents to confirm her belief that they want the store. She included a postcard for response, and was gratified—and over-whelmed—when stacks of cards of support began pouring in. “It’s been amazing,” said Plante. “Two days after the letter hit, I received five postcards. The next day, 75, then 400, and so on—we’re now at over 1,000 people. I’ve never experienced any-thing like this.” Plante has hired extra office help to process the cards that arrive daily. She said that supporters are proving what she has long asserted, that Target is desired by the community and that efforts to prevent it are the work of a small group of self-interest opponents. Time after time, the message is clear, she said. “We did independent research in December that showed that nearly 7 in 10 people in San Rafael support Target. Our neighbors in the Canal area have collected over 800 signatures of support. And now we outreach to the rest of the city and hear from another 1,000 to date who say yes to Target.” Plante says she hopes the combined efforts help the San Rafael City Council vote in support of the store at a public hearing scheduled for April 21. She said that the new jobs, sales tax revenue and shopping choices alone make the proposal a sound one, and the many ways residents who have stood up to say “yes” make the decision clear. “I am so grateful to all the people who have joined in this show of support,” said Plante. “I know people’s lives are busy and times are tough. The fact that so many people have taken the time to add their voices to the discussion is beyond gratifying. It’s going to take me a while to thank them all, but I will.”

Federal Lead-Paint Regulations now Being enforcedBY: Phil Vermeulen, Legislative AdvocateAs I’ve reported in the past, and want to remind you again, the United States Environmental Protection Agency (U.S. EPA) is

now enforcing the Renovation, Repair and Painting (RRP) Rule. The law requires “lead paint safety certification” for anyone

who does remodeling or demolition in homes, schools, and childcare facilities constructed before 1978. Failure to obtain the

proper certification can result in fines of up to $37,500 for each day and each location where violations occur.

EPA inspectors are responding to leads and conducting worksite and paperwork inspections throughout California and the

other states in EPA’s Region 9. EPA is also receiving tips from the public about possible violations through its online Tip

& Complaint form. When EPA receives a tip, inspectors evaluate whether any state or local laws are being broken. If they

are, city or county building officials or the Department of Industrial Relations’ Division of Occupational Safety and Health

(DOSH) immediately respond in order to quickly address any unsafe operations or conditions. Tips are then filed for future

inspections and contractors or construction firms are sent a warning

letter.

California law parallels several of the RRP requirements. While state and local officials cannot address federal violations,

they can issue citations for violating state requirements, and pass along information to EPA inspectors. The EPA’s interim

final enforcement document has more information about this enforcement regulation.

How To Comply

To comply with the regulation, contractors, or at least one individual employed by a licensed contractor’s firm, must be

enrolled in and complete approved training by December 31, 2010 (but I understand that many contractors are just now

seeking the training). Training costs vary by provider. Once training is complete, the contractor needs to apply for

certification, which costs $300 and is valid for five years. For more information about the program and its requirements you

can go to the EPA’s website at: http://www.epa.gov/lead/pubs/renovation.htm#requirements

If you are in need of this training, there is one reputable school that I can refer you to who has offices statewide. License

Instruction Schools has a toll free number to contact them: 800-346-7277

By the way, it is not necessary to submit EPA certification or proof of lead safety course completion to the CSLB; however,

the CSLB’s website provides a link to the U.S. EPA’s list of certified firms in their area so consumers can check a contractor

license and certification status in the same location.

Finally, the U.S. EPA is soliciting input from small business regarding exterior lead paint on public and commercial buildings.

The advice and recommendations will be considered as the agency develops regulations regarding the renovation, repair, and

painting of such buildings.

SAFETY TOPICTrenching & Shoring SafetyAn unsupported, improperly shored or sloped trench or excavation wall can collapse killing or injuring workers with little or no warning. However, most of these accidents can be anticipated and prevented with the proper training and education.

What conditions influence the kind and amount of shoring needed?

• Depth of trench – If a trench is five feet deep or more, it must be shored or sloped. If there’s a possibility of soil movement, even in shallower trenches, it must be shored. If there’s any doubt, shore or slope it!

• Soil Classification – The more liquid the soil, the more you need to protect against cave-ins. Try to prevent water from collecting in existing trenches.

• Changing weather conditions - Trenches safely sloped or shored in dry weather can become deathtraps when wet. Even hard- packed soil can become unstable after a rain.

• Heavy loads in the area – Understand that nearby structures such as buildings, curbs, trees, and utility poles put stress on trench shoring. Never operate or park heavy equipment next to a trench.

• Vibration – If digging a trench near a roadway or where other operations create vibration make sure the shoring/sloping design reflects those conditions. Make sure to acquire permits and call 811 (Underground Service Alert) to locate hidden obstructions like underground pipes or utilities that may affect the trench prior to any excavation. If any obstructions are located, remove or protect them from damage.

Precautions are needed when excavating near backfilled or disturbed soil, they may require additional sheeting and bracing, as will hard compact ground if there is filled ground nearby. Warning signs should be posted around trenches, provide adequate lighting for nighttime work. Also, when there is any doubt of the atmosphere in the trench, test and ventilate.

A “competent person” must make daily inspections of the trench and protective systems and anytime there is a change in the conditions that could weaken the trench (such as a rainstorm). A “competent person” as defined by Cal/OSHA is a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions that are unsanitary, hazardous, or dangerous to employees. The competent person has the authority to impose prompt corrective measures to eliminate these hazards.

In this case it would apply to someone who is familiar with Cal/OSHA provisions relating to trenches, excavations, and earthwork with its related protective systems and is knowledgeable in soil analysis. They must also be able to recognize and test for hazardous atmospheres and also have the authority to take prompt corrective action. Make sure workers can get in and out of the trench quickly. If hazardous conditions are detected, all work must be stopped and not resumed until the hazard(s) has been corrected. When the work is completed, all excavations must be backfilled.
