Proposal:

The Owner is requesting permission to maintain a deck with the following variances:

Official Plan:

The subject lands are designated “Low Density Residential” by in-effect OPA #240 (Woodbridge Community Plan). The subject lands are also designated “Low Rise Residential” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan.

Comments:

On September 17, 2009, the Committee of Adjustment approved Minor Variance application A201/09 for the subject lands, to permit a deck with a minimum rear yard setback of 7.0m and a minimum interior side yard setback of 1.0m. According to the Owner, the deck was constructed incorrectly, as per the previous approval and, therefore, the subject application (A090/13) is required to maintain the deck as constructed. The Development Planning Department has no concerns with the minor changes to the previous approval (A201/09). Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Recommendation:

The Development Planning Department supports Minor Variance Application A090/13.

No. 65M-2871, municipally known as 29 Vaughan Mills Road) Proposal:

1. To permit a rear yard setback of 6.42 metres to the deck. 2. To permit an interior side yard setback of 0.63 metres to the deck.

Comments: A site inspection was conducted on April 4, 2013 at 29 Vaughan Mills Road. Note the concrete deck and stairs has been constructed. The location of the deck with a minimum interior side yard setback of 0.63 metres will not interfere with the lot grading or existing drainage pattern. The side yard setback of 0.63 metres from the side yard property lines and is adequate for drainage along the property line.

The Development/Transportation Engineering Department has no further comments or objection to application A090/13.
