Kindly recall our conversation during the CABE meeting held on 25.10.2016regarding the limited capacity of the Higher Educational Institutions in Delhi to caterthe huge demand for undergraduate seats from students of Delhi.

Every year, over 2.5 lakh students pass out from Government and private

schools in Delhi after giving the class XII examination. However, out of these nearly1.8 lakh students do not get admission in UG courses in Delhi. This is because thetotal intake capacity of UG level courses in Delhi University is only around 57,000 (ofthese only about 29,000 are from Delhi) and other State Universities in Delhi accountfor about 33,000 seats. (Details in Annexure-I)

The basic reason of this problem is section 5 sub-section (2) of the DelhiUniversity Act, 1922 which limits opening of new affiliating Universities within Delhi'sboundaries. It would be significant to mention that Delhi University Act was passedin 1922 by British Government, when the education was within the reach of limitedcitizens. Since then Delhi has grown as one of the most populated cities of thecountry. Its requirements have changed a lot. It would also be significant to mentionhere that one time exemption in the provisions of the said Act was given to GuruGobind Singh Indraprastha University. GGSIPU has already crossed the saturationlimits and it is mandated to affiliate technical and management institutes only.

Considering the current demands of diversified and newly developed courses ofgraduation and post-graduation level, it has become important to amend the Section

5 Sub-Section (2) of the Delhi University Act, 1922, so that the State Universities thatare presently existing or may be set up in future, can increase their own capacity andalso affiliate educational institutions. The draft proposed amendment is attached asAnnexure-II. This will help in requisite capacity expansion for higher education andallow more dynamic Universities and Colleges in Delhi. Request your urgent help inthis matter.

Background

The National Capital Territory of Delhi has two major Universities, which affiliate

colleges for students pursuing under-graduate degree courses in Delhi, as under-

1.Delhi University2.Guru Gobind Singh Indraprastha University

As per data collected by the Directorate of Higher Education from time to time,the approximate total intake capacity of University of Delhi for under-graduate leveldegree courses is 57,000. Against these seats approximately 03 lakh students applied

every year from Delhi and outside of Delhi. Approximately 2 lakh students passed outthe 12th Class Examination from Schools situated in Delhi. Keeping in the view of the

aforementioned facts there is huge demand of undergraduate seats in different courses

in Delhi.

Further, there are 12 Colleges affiliated with Delhi University are 100% funded by

Delhi Government and 16 Colleges affiliated with Delhi University are 5% funded byDelhi Government. These colleges are being funded through the revenue collected fromthe tax payers of Delhi, whereas, only approximately 55% students, who have passed

class 12th from Delhi Schools are admitted to these colleges and majority of them takeadmissions in colleges located in outskirt/rural areas of Delhi. In the main campus ofDelhi University the ratio of students passed from Delhi Schools is less than 25%

approximately.

Further it is submitted that the state Universities i.e. AUD, GGSIPU, DTU, NSIT,

IIITD and IGDTUW have 85% seats reserved for students who have passed out class12lh from Delhi, whereas Delhi University gives 85% reservation of seats for DelhiStudents for the MBBS/BDS Courses only. Besides this, College of Art, Neta Ji

Subhash Institute of Technology (NSIT) and Delhi institute of Paramedical Science andResearch (DIPSAR) which are under administrative control of Directorate of Trainingand Technical Education and are 100% Funded by Govt. of NCT of Delhi, have 85%reservation of seats for the students who have passed class 12'" from Delhi and 15%

quota for the students outside Delhi.

Justification for the proposal of the Delhi Govt. for amendment of Sub-Section (2)

of Section 5 of Delhi University Act, 1922 for addition of an "Enabler Clause" to

allow the Government of Delhi to open more affiliating Universities.

Since, admission to Delhi University colleges is based on the cut off marks

obtained by students in Class 12tn and also because there is no reservation for thestudents who pass out class 12th from Delhi in University of Delhi, therefore, very few

I students who have passed class 12lh from Delhi (Government as well as Privateschools) are able to get admissions in the University of Delhi. The reason for this is that

all the schools in Delhi are affiliated to CBSE Board whereas the students from otherStates qualify class 12lh from different State Boards and there is no normalization of

marks obtained in class 12th across different State Boards.

GGSIPU which was allowed to be opened as an affiliating University after anamendment in the Section 5 (2) of DU Act. 1992, is the only affiliating State University

operational in NCT of Delhi till date.

As per the preamble of the GGSIPU, it is an affiliating and teaching University to

that focuses on professional education :

"An Acf to establish and incorporate an affiliating and teaching University at Delhito facilitate and promote studies, research and extension work in emerging areas of

higher education with focus on professional education, for example engineering,technology, management studies, medicine, pharmacy, nursing, education, law etc. andalso to achieve excellence in these and connected fields and other matters connected

therewith or incidental thereto."

On an average, 2.5 Lakh students pass class 12th every year from the schools inDelhi. As can be observed from the data mentioned above there is a huge mismatch

between the number of students who pass out class 12th from Delhi schools and the

number of students who are able to get admissions to under-graduate degree courses

in various colleges in Delhi.

In addition to the above mentioned universities, there are a number of Central

Universities like JNU and Jamia Millia Islamiya but they majorly run Post-Graduatecourses and Research Studies. As a result of this the students who pass out class 12th

' from Delhi schools have to per force take admissions in the colleges outside Delhi.

Although, the GGSIPU has affiliated approximately 120 Self Financing institutes,but the total capacity of all the courses in these institutes is only around 30,000. Also as

mentioned earlier the focus is mainly on professional education.

Other State Universities like Ambedkar University Delhi and the other Technical

Universities running technical courses like DTU, IIITD, DPSRU & IGDTUW also have

limited intake capacity.

The Delhi University Act 1992 prohibits educational institutions within the limitsof NCT of Delhi to get affiliated to any other university except Guru Gobind Singh

Indraprastha University.

As can be seen from the aforementioned clause, as on date no new affiliatingUniversity can be set-up in Delhi. In order to enhance avenues of Higher Education for

the students of Delhi and to ensure availability of sufficient seats for students pursuing

! under-graduate level degree courses, the Govt. of NCT of Delhi has proposed anamendment in the Sub-Section 2 of Section 5 of Delhi University Act, 1922. Theproposal was initially mooted by Sh. Manish Sisodia, Hon'ble Dy. Chief Minister/MoHE,

Delhi who had then written a letter to the Hon'ble Minister of MHRD, Govt. of India vide

D.O. letter No. DyCM/2016/7158 dated 13-12-2016 (copy placed at page 13/C).

Subsequently, the Legistlative Assembly of the National Capital Territory of Delhi

in its sitting held on 29-06-2017 unanimously adopted the following two Government

resolution moved by Shri Manish Sisodia, Hon'ble Minister of Higher Education :-

Resolution No. I

"Taking note of the fact that there are over two lakh students who pass out fromschools in Delhi, who are struggling to get admission in Institutions of Higher Education;Also noting the fact that twenty eight colleges affiliated to the University of Delhi arefunded partially or fully the Government of NCT of Delhi from the resources contributed

by the tax payers of Delhi;Hereby resolves that 85% of the total seats in the Institutions and colleges of

Higher Education affiliated to the University of Delhi that are funded by the Government

of NCT of Delhi, be reserved for students belonging to Delhi"

Resolution No. 2

"Taking note of facts that there are over 2 lakh students who pass out fromschools in Delhi, many of whom are struggling to get admission in Higher Education

institutions;Taking further note of the facts that as per the following provisions of the

University Act. 1922 no other University in Delhi is legally authorized to grant affiliation

to any college.

ISub-Section (2) of Section 5-

"Notwithstanding anything in any other law for the time being in force, no educationalinstitutions within the afore-mentioned limits shall be associated in any way with or beadmitted to any privileges of any such other University incorporated by law in India, andany such privileges granted by any such other University to any educational institution

within those limits prior to the commencement of this Act shall be deemed to be

withdrawn on the commencement of this Act:

Provided that the Central Government may by order in writing, direct that the provisionsof this sub- section shall not apply in the case of any institution specified in the order;

Provided further that provisions of the sub-section shall not apply in the case ifany educational institution affiliated to the Indraprastha Vishwavidyalaya incorporated

under the Indraprastha Vishwavidyalaya Act. 1998."

With the Govt. of NCT of Delhi in favour of increasing the number of institutionsby way of opening a University that would also be authorized to affiliate college which

would end the shortage of Higher Education institutions in Delhi:

Hereby resolves to recommend to the Central Government to amend the DelhiUniversity Act (1992) and add another proviso in Sub- section (2) of Section 5 which

would state:"Provided further that provisions of this sub-section shall not apply in the case of

any educational institution affiliated to the State Universities in Delhi, which presently

exist or may be set- up in future."

The aforementioned Resolutions were also conveyed to the Vice-Chancellor,University of Delhi vide letter No.F.DHE-4(13)/Affl.Col.lnstt/State University/2016-

17/3897 dated 23-08-2017 and the same was also conveyed to the Hon'ble Minister,

MHRD by the Speaker, Delhi Legislative Assembly vide DO No.22(3)/Resolutions/2015/LAS-IV/Leg./2935 dated 06-07-2017 (copy placed at page 31-

32/C).In this regard the comments of GGSIP University has been sought on the

following points:-

a.How has GGSIP University been able to keep a check oncommercialization/profiteering by the private Self Financing Institutions of

education if the proposal at No. 1 above is accepted.b.How the quality of the education is being maintained by these private Self

Financing Institutions.

Justification

In order to address the concern raised by Delhi University, forwarded by MHRD

through mail dated 13.02.2018, placed opposite at page 62-65/C, following points are

submitted for consideration :-

1. The standard and quality of education is maintained by GGSIPU, which is the

only affiliating State University, through the following mechanVsm.

(i) The proposed scheme and syllabi is deliberated upon by the Board ofStudies of the School where representation is from the faculty of the

School and eminent scholars from outside the University are members.Once approved by the Board of Studies of the School, the scheme and

syllabiof studies for a specific programme of study is put-up to the Academic

Council of the University for its consideration. After approval of theAcademic Council of the University, the scheme and syllabi

is implemented.

(ii) One aspect of quality monitoring of the academic standards of the

University is the Annual Academic Audit of the affiliated institutionsconducted by the University every year after the completion of

the academic session. The academic audit takes in to consideration the

availability and the academic qualifications of the teachers in the

institutions; the availability of books and journals or the quality of theinstitution's library; the research output of the institution; the status of

annual admissions to the institution; the academic performance of the

students of the institution in the University Examinations; the academicperformance of the students passing from the institution; accreditation byNational Board of Accreditation (NBA) and / or National Assessment and

Accreditation Council (NAAC); institutional support to faculty for their

development in the form of study leave grant, research grant and / orconference participation facility; status of classrooms (teaching aid); job

placement of the students of the institution and feedback from thestudents, faculty and alumni of the Institution. The academic audit is

conducted by a team of experts from the University and outside.

(iii) The affiliation process of the University is based on the assessment of theinfrastructure, faculty, and the academic audit report for the institution. Theassessment of the suitability of an institution for affiliation to the Universityis performed by a committee of senior persons from academics and

administration (from outside as well as the University).

(iv) The University's examination question papers are set externally and

evaluation is done at central evaluation centre under the supervision of the

teachers of the University campus faculty.

2. In order to ensure that there is not commercialization of education by private self

financing institutions and to keep a check on the practice of profiteering, following

checks are observed :-

(i) Most of the colleges / institutions affiliated to the University are self-

financing institutions. The jurisdiction of the University extends to the

National Capital Region (NCR) including the National Capital Territory ofDelhi (NCTD). For the self-financing institutions located in NCTD, the

' Government of NCTD has established a State Fee Regulatory Committee(SFRC). The SFRC recommends the fee for the self-financing institutions

located in the NCTD. Based on the recommendations of the SFRC, on

similar lines, the University decides the fee structure for the self-financing

institutions located in NCR outside of NCTD.

By the above stated mechanism a stringent control over private self financinginstitutions is being maintained so that they do not indulge in any profiteering/

commercialization of Higher Education. Similar mechanism can be applied to prevent

commercialization of education and control the quality the education, if any new

affiliating university is allowed to be opened under Govt. of NCT of Delhi.

TheLegislative Assembly of National Capital Territory of Delhi having its sitting inDelhi on 29th June, 2017 has taken note of the fact that there are over two lakhs

students who pass out from schools in Delhi and are struggling to get admissionin institutions of Higher Education of Delhi. Also, noting the fact, that twenty eightcolleges affiliated to the University of Delhi are funded partially or fully by theGovernment of NCT of Delhi, from the resources contributed by the tax payers ofDelhi, has resolved that 85% of the total seats in the institutions and "Colleges ofHigher Education, affiliated to the University of Delhi, that are funded by theGovernment of NCT of Delhi, be reserved for students belonging to Delhi.

Therefore, it is requested that DU may kindly take necessary action toimplement the above mentioned resolution at the earliest. Directorate of HigherEducation, GNCTD may kindly be kei-aselbpthe action taken in the matter.
