16. SPECIAL POLICE SERVICE CHARGES Special Police Services (SPS) are police services provided over and above core policing at the request of a person or organisation and in some cases there are powers in law for the police to recover the costs of this additional policing. There must be an agreement between the event organiser and the police for the need for special police services and a risk assessment will need to be undertaken in order to determine the level of police resources required for each event (refer to Staffordshire Police Operations and Events Planning Policy for further guidance on this). 16.1 Categories of Special Police Services For charging purposes there are 3 main categories of Special Police Services: 1. Commercial Events intended to generate private profit. 2. Non-commercial events, i.e. a) charitable, b) community events, or c) not for profit. 3. Statutory events reflecting constitutional rights or processes.

Brief guidance for each of the main categories is provided below, and the chart in Appendix 1 gives some examples of events that could apply to each category. The level of charge does not simply depend on the category but on individual circumstances – including the ability to charge in law. 16.1.1. Commercial Events intended to generate private profit Events where there is a financial gain or profit to the organiser without specific community benefit, usually but not exclusively through members of the public having to pay an entrance fee to gain access to the event. As guidance, commercial activity will be characterised by the securing of a site(s) and usually requiring payment for entry to the event. This can be private land or land that becomes controlled for the purposes of and benefit to the event. It is normally further identified by the existence of a promoter or equivalent. Where an event is categorised as Commercial, the organiser should be charged the full economic cost of the special police services provided. Any decision to depart from the general principle of charging full economic cost to a commercial event should only be made on exceptional grounds and with the specific approval of a Force Executive Officer on the basis of a full report of all the relevant issues. Previous instances of non-recovery of charges should not prevent charges from being levied in future. Low level policing (within normal core policing) of Commercial events can be charged for. 16.1.2. Non-Commercial Events, i.e. a) charitable events, b) community events, c) not for profit events

16.1.2 a) Charitable Events Events where although there is a financial gain, the surplus is for charitable distribution. These maybe local charities but in some circumstances reflect a wider charitable status.

Some charitable events may have a local dimension which makes them akin to community events, however, tests to determine this should include a clear “registered charity” status and that the event is meeting the aims of its charitable mission as set out in its registration requirement. Where an event is categorised as Charitable this provides the basis for abating the special police service charges (see Appendix 2). However, it should be noted that the mere designation of an event being charitable does not itself negate the charging of legitimate operating costs including special police services.

16. SPECIAL POLICE SERVICE CHARGES continued

16.1.2 b) Community Events Events not for personal or corporate gain but for community or local interest purposes or to raise funds for local community institutions. Community events need to be considered in the context of community policing in the broadest sense as the need for fostering and maintaining good relations between the police and local communities is increasingly recognised as important for achieving policing objectives. The policing of community events, and any charges levied, may help or hinder the achievement of these broader policing objectives and therefore where an event is categorised as a Community Event this provides the basis for abating the special police service charges (see Appendix 2). 16.1.2 c) Not for Profit Community Events Events where although a minimal fee for participation is charged it is generated only to cover organisational costs and not to raise a profit. Those organising events do so on a voluntary basis for the benefit of participants and spectators. Some non-commercial events do not fit into the community or charitable definitions outlined above, but are organised on a voluntary basis and generate revenue only to cover organisational costs, such as amateur cycling or running events. Where an event is categorised as a Not for Profit Community Event this provides the basis for abating the special police service charges (see Appendix 2).

Where an event is categorised as Non-Commercial (either: a) charitable events, b) community events, c) not for profit events) it provides the basis for abating the special police service charges. However, not recovering the full cost of associated policing represents a subsidy from public funds and so a reasonable contribution towards the cost of policing is both desirable and feasible. As part of core policing a certain level of policing will normally be provided within, and for, communities. Where a Non-Commercial event is assessed as requiring low level policing within normal core policing levels (however deployed) such deployments shall be treated as part of the visibility and local re-assurance components of local policing and as such will not be charged for. The Assessment Criteria Matrix in Appendix 2 must be applied to each individual event to determine the specific charging methodology for that event. 16.1.3. Statutory events reflecting constitutional rights or processes Events where there is no financial gain to the organiser and which reflect constitutional rights, or a cause of royal, national or defined public interest. Policing of statutory events is part of core activity and no charges should be made.

SPECIAL POLICE SERVICE CHARGES continued 16.3 Special Police Service Charges The policing of all events should first be costed on a full economic cost basis using the Special Police Service charges below. The full economic cost will form the basis of the amount the event organiser is charged, and where the charge is to be abated or there is a nil charge, it will highlight the impact of that abatement in terms of potential income foregone. * A short notice rest day requirement to work is paid at time and a half as the officer would not actually be paid for their rest day, had they been allowed to take it off. The net effect of requiring an officer to work a short notice rest day is that the force pays one and a half times the flat rate. Therefore this Premium charge is applied in addition to the Special Service Charge. ** If an officer is scheduled to work on a public holiday but takes the holiday entitlement then they are still paid a normal monthly salary. Where an officer is required to work a public holiday then they are paid at x hours at double time. This is in addition to the normal monthly salary they would receive. Appendix 2 Assessment Criteria Matrix

To arrive at the charging methodology to be applied to an event an Assessment Criteria Matrix has been developed to assess events against a range of criteria. A score is applied to each assessment criteria on a sliding scale and the total score will determine the charging methodology that is applied to that event. This Assessment Criteria Matrix must be completed for each event prior to it being policed in order to determine the charging methodology to be applied and to ensure force wide consistency of charges. Previous instances of non-recovery of charges should not prevent charges from being levied in future.

25. Disclosure Charging Guidelines

The following Disclosure Charging Guidelines provide further information and advice in relation to types of information we may provide and when appropriate to do so. Business areas within Staffordshire Police who provide information include: Central Disclosure Unit - based within Protective Services at Police Headquarters who deal with requests in relation to (a) child care proceedings and (b) domestic incidents, dealing primarily with the Courts and Solicitors. Central Archives (Disclosure) Unit - based at Leek Police Station who deal with (a) Criminal Injuries Compensation Authority, (b) requests in accordance with the Memorandum of Understanding between ACPO and the Association of British Insurers and (c) requests from Solicitors relating to matters other than child care proceedings and domestic incidents and including information required in relation to civil proceedings. Traffic Process Unit – based within Justice Services at Police Headquarters who deal with requests in relation to Road Traffic Collisions. Force Solicitors Office - based within Professional Standards at Police Headquarters who deal with (a) regulatory matters which involves providing large volumes of information to the General Medical Council and other regulatory bodies and (b) any matters relating to action against the force. Information Assurance Team – based within Professional Standards at Police Headquarters who deal with requests for information under (a) the Data Protection Act 1998 - information about the data subject only) and (b) Freedom of Information Act 2000 - information about policy, procedures and decision making. (Refer to Section 16 – other charges). It is expected that charges will not be applied for the disclosure of information where:-

1. Disclosure is required by a regulatory body/authority due to immediate risk to children or vulnerable adults. This includes (a) local arrangements in place between Staffordshire Police, Staffordshire County Council and Stoke on Trent City Council in relation to the Police/Family Disclosure Protocol and (b) ACPO agreement with CAFCASS in relation to private law cases.

Note: In cases where repeat/duplicate requests are received consideration should be given to applying appropriate charges.

2. Disclosure has been agreed as part of information sharing arrangements for partnership working

associated with the requirements of the Crime and Disorder Act 1998 (Staffordshire and Stoke on Trent Community Safety Partnerships Information Sharing Protocol refers) and other information sharing agreements.

or 3. In exceptional cases, where a request is from a litigant in person, consideration may be given to

a discretionary waiver of the charges based upon their financial situation. This decision will be made by Staffordshire Police based on recommendation from the Solicitor and/or Courts and will only cover certain items.

Note: Cost rules for family proceedings stipulate that civil procedures apply where parties in litigation require documents from a 3rd party who isn’t party to litigation but that the 3rd party (Police Force) is entitled to apply a reasonable feed for compliance with the order.

Notifiable Occupation Scheme Under the Notifiable Occupation Scheme, forces have an obligation to disclose certain information. Initial disclosure is without charge and sufficient detail will be provided in the first instance to allow the regulatory or governing body concerned to conduct an adequate risk assessment in terms of the risk that may be posed to children, vulnerable adults, national security and probity and administration of justice. On occasions, the regulatory or governing body will request further supporting information to aid their own internal investigations as to whether the individual is still fit to practise in their profession. Dealing with such requests requires information to be retrieved and decisions made about what information should be disclosed. The majority of these requests will take no more than 2 hours to complete. Any requests that take longer than 2 hours will incur further costs at an hourly rate of £25.00 per hour. When applying charges for Court Orders it is important that the recipient (in the majority of cases this will be the acting solicitor) for the data should pay for the disclosure and NOT the Courts. No charges will apply in relation to any disclosure to Court ‘For Judges Eyes only’. Information Sharing Agreements are available from the Policy Database via the Force intranet. Payment Where charges apply payment should be made prior to disclosure. Cheques should be made payable to ‘Staffordshire Police Authority’.

Copies of Photographs Images should only be of the offender or victim and should not be disclosed if the image identifies any third party (*see note below), unless judged to be in the public interest. Indecent photographs of children should only be provided in relation to Court Orders and disclosed for ‘Judges Eyes Only’. Copies of Statements All third party details or identifying material to be redacted unless consent of the individual has been obtained or named as a party within a Court Order. Consent of witnesses must always be obtained unless judged to be in the public interest then the individual should be notified of the disclosure and given the opportunity to oppose disclosure. Interview with Police Officer (per Officer) Requests for an Officer interview associated with this process should be directed, in the first instance, to Central Archives who will liaise with the appropriate personnel.
