    1. RELEVANT PREVIOUS DECISIONS

    1.1 Cabinet Resources Committee 14 December 2011 (Decision 14) -RESOLVED 1. The fees and charges (charging schedule) for the Environment,Planning and Regeneration Directorate as detailed in Appendix A andC of the report were approved for public consultation2. The Interim Director of Environment, Planning and Regeneration isauthorised in consultation with the relevant Cabinet Members to makechanges to the Charging Schedule as detailed in Appendix A and C of

    the report subject to consultation findings and the Equality ImpactAssessments as required to progress through approval and adoptionby the Committee to take effect from 1 February 2012 or at the latest 1

    April 2012.3. That the Interim Director of Environment, Planning and Regenerationand the Cabinet Member for Environment give particular considerationto the configuration of parking charges.

    2. CORPORATE PRIORITIES AND POLICY CONSIDERATIONS

    2.1 The consideration of appropriate charges and payment mechanismsfor parking on street and in the Councils charged for car parks isconsistent with contributing to the One Barnet Plan and Corporate Planpriorities Better Services with Less Money through being an efficientCouncil with services designed to meet the changing needs of

    residents, and A Successful London Suburb by enhancing Barnetsreputation as a good place to work and live.

    3. RISK MANAGEMENT ISSUES

    3.1 Varying fees and charges always poses an element of risk around theproportionate level of variation when compared to motorists ability topay and/or the test of reasonableness. Every effort has been made tomanage the lowering of charges to an appropriate level; however,some element of reputational risk will remain.

    3.2 The implementation and enforcement of parking controls andappropriate tariff structures helps ensure the effective use of theboroughs road network and encourages the free flow of traffic.

    4. EQUALITIES AND DIVERSITY ISSUES

    4.1 Section 149 of the Equality Act 2010 requires a decision-maker to havedue regard to achieving a number of equality goals: (i) to eliminatediscrimination, harassment, victimisation and any other conduct that isprohibited by the Act; (ii) to advance equality of opportunity betweenthose with protected characteristics and those without; and (iii) to fostergood relations between persons with a relevant protected characteristicand those without. The relevant protected characteristics are age,disability, gender reassignment, pregnancy and maternity, race,

    religion or belief, sex and sexual orientation.

    4.2 The proposed reduction in parking charges is not considered todisadvantage any section of the community by relieving the financialburden associated with paying for parking at a higher rate and willmake parking in the borough more affordable and therefore moreavailable to all. The introduction of additional payment methods will

    also benefit those who may otherwise be impacted by existingtransaction methods.

    5. USE OF RESOURCES IMPLICATIONS (Finance, Procurement,Performance & Value for Money, Staffing, IT, Property,Sustainability)

    5.1 The variation of parking changes and payment methods requires

    amendments to the Councils existing Traffic Management Orders. .Estimated total costs reflect the necessary statutory processes,including those already undertaken and allowing for advertising,printing and all officer time and are estimated at approximately 3,000.

    5.2 The costs involved in making the parking vouchers more widelyavailable include increased voucher printing costs of 4,000 per 50,000vouchers and the reduction in sales income due to the 5% discount.

    However this additional cost and reduced income will be neutralised asthe alternative Pay by Phone service also incurs a cost per transaction

    which equates to an average of 5% of the parking charge. Appendix Didentifies the comparison assuming the same volumes of eachtransaction type.

    expected to impact on the income, however if this assumption does notmaterialise there is a risk that the car park income could reduce

    accordingly. Close monitoring will be necessary and this could lead tofurther amendments being necessary at a later date.

    5.6 The cost to install the credit card machines in car parks is expected tocost up to 67,500 assuming that one is installed in each of thecouncils car parks. The cost of annual maintenance will not be knownuntil quotations have been received but it is not expected to exceed10,000 annually. This will be funded from the Special Parking Accountreserve.

    6. LEGAL ISSUES

    .6.1 The Traffic Management Act 2004 places an obligation on authoritiesto ensure the expeditious movement of traffic on their road network.

    Authorities are required to make arrangements as they consider

    appropriate for planning and carrying out the action to be taken inperforming the duty.

    6.2 The Council as Highway Authority has the necessary legal powers byvirtue of Section 46A of the Road Traffic Regulation Act 1984 (RTRA)to vary charges published under Section 46. In doing so it must followthe procedure set down in Part V of the Local Authorities Traffic Orders(Procedure) (England and Wales) Regulations 1996 to amend the

    existing Traffic Management Orders.

    6.3 The Councils charging powers are regulated by the general duty onAuthorities under Section 122 of the RTRA to have so far aspracticable having regard to the matters specified in subsection (2) tosecure the expeditious, convenient and safe movement of vehicularand other traffic and the provision of suitable and adequate parkingfacilities on and off the highway.

    7. CONSTITUTIONAL POWERS

    7.1 Council Constitution, Part 3, Responsibility for Functions, Section 3(Responsibility for Executive Functions) - section 3.2 details theresponsibilities of Cabinet Members and provides that the Leader of

    hours is introduced at a cost of 2.20. Research has identified thatmany other London boroughs provide similar vouchers with costs

    varying up to 5 each and therefore the proposed charge at 2.20would be considerably less than some other boroughs currentlycharge.

    8.3 Based on the number of all day visitor vouchers sold during the2011/12 financial year the total sales amounted to 265,305 of incometo the Special Parking Account. By introducing a half day visitorvoucher it will need to be recognised that should all residents opt toonly buy half day vouchers in the same quantity as in 2011/12 theimpact on total sales could amount to a reduction of 129,999. Thisfigure allows for the fact that last years total sales were based on acharge per voucher of 4.00 each, whereas the current charge is 4.16each.

    Reduced rate Parking Voucher

    8.4 One of the current methods of paying for car parking on street is via aparking voucher which is in the form of a scratch card. These arecurrently available to purchase in a limited number of shops, librariesand via the Barnet Contact Centre. Analysis of the volumes of vouchersales via local shops indicates two issues; Firstly that there are notenough local shops currently selling the vouchers and therefore theyare not widely available and secondly that it may not be widely knownthat vouchers are available to be purchased at designated shops.

    8.5 It is therefore proposed that more local shops be encouraged to sell theparking vouchers and in order to help facilitate this they will beprovided free of charge with advertising literature to place in their shop

    windows and will received a 5% discount on the current price of theParking Voucher.

    8.6 By providing more outlets selling the vouchers they will be much morereadily available and will provide a real alternative to those residents

    who choose not to use or struggle to use the Pay by Phone service.

    effects on the highway and possible impact on local traders.Accordingly these charges were reviewed in line with all of the

    Councils fees and charges for 2012/13 and increases in their ratesapproved. However, the increases were not implemented due toconcerns raised regarding their potentially negative impact.

    8.9 In designating paid parking places under the Road Traffic Regulation Act,it is important to recognise that the objective is to implement parkingpolicies. If patronage is low, this means that the Council is not achievingits aim of providing suitable parking facilities in a given area and alsomeans that predicted income from the use of the car parks will not berealised.

    8.10 The solution is to reconsider charges in order to better reflect the localprevailing highway and trading conditions recognising that a reduction inthe tariff could also be considered when circumstances dictate.

    8.11 Accordingly a small scale review has been carried out on the Councilscharged for car parks to ascertain typical usage thereby informing thedegree of underutilisation. The results of these surveys (Appendix A) ,and transaction activity details (Appendix B) are attached to this report. Itis not considered that wholesale changes are necessary in the firstinstance to the existing charges levied as in some locations the tariff isconsidered appropriate, being accepted by and serving the community

    well. However, in some areas it is considered there is merit in varying the

    tariff.

    8.12 The net effect on income is difficult to quantify empirically, as theoreticallyany reduction in fees charged might result in no tangible difference to thelevels of patronage and therefore income could reduce. However, thelikelihood is that a reduction will be seen to encourage a higher rate ofpatronage resulting in increased income overall.

    8.13 Taking this approach now demonstrates that the Council has responded

    to the concerns of the community and in due course affords the Councilbetter opportunity to serve the community generally, whether as part of aTown Centre review or as a result of the outcome of a number ofinitiatives instigated by the Cabinet Member for Environment that arecurrently under consideration.

    charges it is proposed to install one credit card payment machine ineach of the car parks.

    8.17 Initial enquires with the three main providers of such machines hasindicated that the cost per machine is likely to be around 4,500 if they

    were purchased outright, including the associated costs of installationand setting up. It is also possible to rent these machines although theinitial enquiries indicate that this may not be the most cost effectiveoption.

    8.18 It is intended to now seek competitive quotations from these threesuppliers with options to purchase, rent and/or a combination of the twoand following evaluation of the most cost effective option to instruct theinstallation of such machines.

    8.19 There will also be be a need to enter into an annual maintenanceagreement with the chosen supplier to ensure that the machines

    remain fully operational. It will also be necessary to makearrangements for sufficient resources to visit each machine to ensure apaper receipt is issued following each payment transaction.
