In this case I refer to my letter of June18th, 2004. You did not answer it until now. My party received another payment of € 700.00 from Mr. M__ on June 21st, 2004. So as of now Mr. M___ paid altogether € 1,700.00 of the cost he owes us. The regarding court sentence of County court Frankfurt of March 2nd, 2000 has been in force since the Superior Court Frankfurt issued a ruling on October 7th, 2003. Thus it has been in enforced since nine month. Mr. M___ refused to agree with the settlement proposals from my clients which would have solved all financial requests. Another proposal for payment of rates was also denied. Moreover Mr. M__ was obliged to supply us with information which he did in part only. Under these circumstances my party is no longer willing to be kept hanging. In the name of AAWS Inc. we urge Mr. M__, to pay our cost including interest as ordered by the court, deducted by the already paid amount as mentioned above, until July 20th, 2004 to one of the bank accounts listed below. - 2 - Should Mr. M__ fail to comply he must face law enforcement (Zwangsvollstreckungs-maßnahmen). Furthermore we urge Mr. M__to extend his information to us. We refer to our letter of May 4th, 2004 and to explanations in our letter of June 18th, 2004. The given information of May 7th , 2004 provides incomplete data regarding distribution of the unlawfully manufactured copies. Although Mr. M__ claims to have given away these books free of charge, he is nevertheless obliged to provide complete information. For example he omits name and address of the person who picked up the Hebrew books at Mr. M__’s home. Regarding the Swedish edition he did not provide a list of the receivers’ names in Sweden. Mr. M__ must face the fact that he is subject to law enforcement and fines should he continue to fail revealing such information and we will ask the court for prosecution according to German Civil Code § 888 ZPO. Eventually it has been lawfully ruled by the County court on March 2nd, 2000 that Mr. M__’s manufacturing and distribution of several listed editions he is obliged to pay Schadensersatz (punitive damages). We have been ordered to enforce this claim for damages in another lawsuit if necessary. Coming to the end of this letter we point out that this writing refers to the requests from AAWS Inc. against Mr. M__ only. With more requests from sides of Anonyme Alkoholiker Interessengemeinschaft (AAeV) will be dealt with in another separate letter coming soon.
