SB 465 (Hill) Amended that Would Require Contractors to Report Settlements

Several months ago we discussed SB 465 (Hill) which was introduced in reaction to the June 16, 2015 tragedy when the balcony at the Library Gardens Apartments in Berkeley, CA collapsed, killing six students and injuring seven others. What convinced the author to carry the bill was the fact that notably, over the past three years, the company paid out $26.5 million dollars in construction defect settlements. According to the author, there is no provision in current law to require notification to the CSLB that these settlements had taken place; thus the board couldn’t perform their due diligence to ascertain if the settlements were due to shoddy workmanship or worse.

To correct this oversight, the measure would have re-quired all contractors to report any settlement of $25,000 or more to the CSLB in order for the board to determine if problems with the contractor existed that warranted a citation, suspension or revocation of the license. Unfortu-nately, since construction is highly litigious, it would have created lots of extra work for contractors, overburdened the CSLB staff and ultimately, not worked for the afore-mentioned reasons.

Due to major opposition from the construction industry, which emanated during an informational hearing, the following amendments have been offered. While better, the bill still requires contractors to notify the CSLB on all settlements of an amount to be determined by the CSLB. Highlights of the amendments include:

1). Section 7021 is added to Business and Professions Code(a) By January 1, 2018, the board shall enter into an interagency agreement with the Division of Occupational Safety and Health to ensure that any citation, fine, or any other actions taken by the division against a licensed con-

tractor, along with any other information the division may possess regarding a licensed contractor, is timely reported to the board.(b) By January 1, 2018, the board shall enter into an in-teragency agreement with any other state or local agency the board deems to be in possession of any information relevant to its priority to protect the public described in Section 7000.6.

2). Section 7071.18 is added to the Business and Profes-sions Code:(a) Notwithstanding any other law, a licensee shall report to the registrar in writing the occurrence of any of the following within 90 days after the licensee obtains knowl-edge of the event:(1) The conviction of the licensee for any felony.(2) The conviction of the licensee for any other crime that is substantially related to the qualifications, functions, and duties of a licensed contractor.The bill passed yesterday 12-0 with 4 abstentions out of the Assembly policy committee and will be heard next in the Appropriations Committee.To read the amended bill go to: http://www.leginfo.ca.gov/pub/15-16/bill/sen/sb_0451-0500/sb_465_bill_20160608_amended_asm_v95.pdf

RETAIL SALES RISE ANOTHER HALF-PERCENT This healthy May increase follows the 1.3% gain recorded by the Department of Commerce for April, and offers more evidence that the economy has rebounded from a sluggish first quarter. Core retail sales (minus auto and gasoline purchases) were up 0.4% last month.1

INFLATION CONTINUES TO FIRM According to the Bureau of Labor Statistics, consumer prices rose 0.2% in May while producer prices advanced 0.4%. While a drop in food prices tempered the gain in the Consumer Price Index, the core CPI (which strips out energy and food costs) was up 2.2% in a year, exceeding the Federal Reserve’s annualized inflation target. The May wholesale inflation jump still left the Producer Price Index up just 0.8% year-over-year; plunging energy costs have held the PPI in check.1,2

CONSTRUCTION ACTIVITY MODERATES IN MAY Building permits and housing starts both increased 4.9% in April, but Census Bureau data reveals no such leaps last month. Groundbreaking declined 0.3% in May, while the issuance of permits increased by 0.7%.1

INVESTORS ANXIOUSLY AWAIT U.K. VOTE As expected, the Federal Reserve refrained from an interest rate move last week; Wall Street was more concerned about the potential of a Brexit. The S&P 500 fell 1.19% in five days to 2,071.22, and the other major indices fell with it. The Nasdaq gave back 1.92% on its way to a Friday close of 4,800.34, while the Dow slipped 1.07% on the week to 17,675.16. Gold is on a 3-week winning streak: it settled at $1,294.80 on the COMEX Friday, rising 1.5% in five days. WTI crude fell 2.2% for the week, closing Friday at $47.98 on the NYMEX.3

THIS WEEK: Nothing major is scheduled for Monday. Tuesday, Federal Reserve chair Janet Yellen begins two days of testimony in the Senate on monetary policy; earnings news emerges from Adobe Systems, CarMax, Carnival, FedEx, KB Home, La-Z-Boy, and Lennar. Wednesday, Wall Street looks at May existing home sales numbers and earnings from Barnes & Noble, Bed Bath & Beyond, Red Hat, and Winnebago. On Thursday, the United Kingdom holds its referendum on whether or not to stay in the European Union; investors will also consider May new home sales figures, the federal government’s latest initial jobless claims report, and quarterly results from Sonic. Friday offers the final June University of Michigan consumer sentiment index, a Census Bureau report on May hard goods orders and earnings from Finish Line.

Architectural landscaping involves more than just planting and soil; it can include carpentry, stone and concrete work, and the use of landscaping materials such as mulch and rock.

Be familiar with the jobsite that you will be working. A landscap-ing plan that includes materials and site layout can help you plan the proper order of material delivery and management, along with the necessary tools and equipment. Call the Underground Service Alert service at 811 to get the location of underground utilities marked to avoid disturbing them. Mark underground and overhead utilities and power lines on the plan to prevent acciden-tal contact.

Personal protective equipment (PPE) prevents injuries. Sturdy work boots protect your feet from cutting blades and crushing injuries from large equipment and heavy landscape materials. Gloves protect your hands from scrapes, cuts, and punctures. Impact-resistant safety glasses and/or face shields protect your eyes from flying debris and UV lenses can offer further protection from the sun. Earplugs and earmuffs prevent hearing loss from loud equipment.

Power equipment used to shape the landscape such as tren-chers, tillers, and bobcats can cause serious injury and death if not used properly. Read the instructions and get training on the equipment you use. Know where the moving, cutting, and

rotating parts are and keep clear of them. Inspect power equip-ment before each use to ensure guards and safety switches work properly. Never leave running power equipment unattended.

Maintain good housekeeping on the jobsite. Store materials prop-erly where they will not cause slip, trip and fall hazards or engulf workers. When you move heavy materials around the jobsite, use mechanical lifting devices or use a team to lift items. Secure loads so they don’t shift positions while you lift them. Keep items close to your body and lift with your legs, not your back.

Know basic first aid and keep a first aid kit on the jobsite to treat minor injuries. Have shade available and stay hydrated to avoid heat illness. Layers of clothing help you respond to changes in the temperature. Wear sunscreen, a hat, and long pants and shirts to protect your skin from sun exposures.
