    Continuing on the Unlicensed Contractor Discussion of Last Week

    Continuing our discussion from last week, the Contractors State License Boards (CSLB) staff proposed creating, as an action to encourage unlicensed contractors to obtain a license even though they did not have the necessary structural experience to become a B General Contrac-tor, a new C-1 Classification - Non-Structural Remodel/Repair Contractor: 832.01 which would be defined as: A non-structural remodeling and repair contractor remodels and repairs existing structures of three (3) stories or less, built for support, shelter and enclosure of persons, ani-mals, chattels or movable property of any kind; provided that no load bearing portion of the existing structure is altered, added or moved; this includes footings, founda-tions, and weight bearing members. This classification excludes C-16 Fire Protection and C-57 Well Drilling altera-tions and repairs.

    Unfortunately, the contractor and labor members on the CSLB immediately felt their turf threatened and kicked the can down the road on addressing the matter. Dur-ing last weeks Licensing and Enforcement Committee meeting staff suggested, as an alternative to the new C-1 classification, raising the floor for requiring a contractors license from the current $500 (which is labor and materi-als combined) to an undisclosed higher amount.

    So, what to do? The underground economy is rampant (that crunching sound is the underground economy eat-ing your lunch!); regulations continue to be piled on for legitimate contractors who grow more frustrated by the day; and, consumers who are the CSLBs highest priority, are getting burned more and more. Simply, a new ap-proach has to be found. Things to consider: If the CSLB adopted a new C-1 license, the applicant would still be required to prove that he/she had at least 4 years of documented experience and would have to take both

    the trade and law portions of the exam. They also would be required to carry a $15,000 contractor license bond, workers comp if they have workers, etc.

    There also could be additional requirements placed on them, such as a higher bond amount, mandatory liabil-ity insurance and possibly a host of other things. Also remember, for structural work (which these licensees could not perform), this work would be subbed-out to a properly licensed B General Contractor. While many of you might express doubt on whether these people would indeed sub this work out, just remember that currently most do not have ANY licenses, bonding, liability insur-ance, workers comp, etc., so bringing them into the licensing tent would provide consumers with a lot more recourse than they have now! This certainly would be a major achievement/solution rather than just raising the floor on licensing (from the current $500 to ??).

    Since over 90% of the contractor problems that the CSLB deals with are in residential, maybe there should only be residential licensing? For commercial/industrial and pub-lic works instead put the onus on the bonding companies to qualify these contractors. This solution would certain-ly allow for more staff emphasis on their largest problem - the residential sector! Other than these thoughts, what else can be done? We welcome your input and ideas.     A MAJOR JUMP FOR RETAIL SALES Friday, the Department of Commerce reported a 1.3% April gain in U.S. retail purchases. The core retail sales advance was also impressive at 0.9%. Minus car and truck buying, retail sales were still up 0.8% last month.1

    IMPROVEMENT IN CONSUMER SENTIMENT The University of Michigans much-watched household sentiment index rebounded 6.8 points to 95.8 in its initial May reading. Surveys of Consumers chief economist Richard Curtin cited frequent income gains, an improved jobs outlook, and the expectation of lower inflation and interest rates as reasons for the sudden rise.2 WHOLESALE INFLATION PICKS UP The April Producer Price Index displayed a moderate rise, in contrast to preceding months. Wholesale inflation rose 0.2% last month, 0.3% with food and energy costs subtracted.1 A DOWN WEEK ON WALL STREET Despite some notably positive economic indicators, stocks pulled back for the week as first-quarter earnings from major retailers disappointed. The Dow fell hardest, losing 1.16% across five days; the NASDAQ slipped 0.39% for the week; the S&P 500, 0.51%. The three major indices settled on Friday as follows: DJIA, 17,535.32; NASDAQ, 4,717.68; S&P, 2,046.61. Oil was at $46.29 on the NYMEX as the stock market closed Friday; gold was at $1,275.20 on the COMEX.3,4 THIS WEEK: Monday, Agilent Technologies reports quarterly results. Wall Street assesses earnings from Home Depot, Red Robin, and TJX Companies on Tuesday, along with the April Consumer Price Index and reports on April industrial output, housing starts and building permits. Wednesday offers minutes from the Federal Reserves April policy meeting along with earnings from American Eagle Outfitters, Booz Allen Hamilton, Cisco, L Brands, Lowes, Staples, Take-Two Interactive, Target, Hormel Foods, Urban Outfitters, and Williams-Sonoma. On Thursday, investors will watch for a new initial claims report and earnings releases from Advance Auto Parts, Applied Materials, Autodesk, Bon-Ton, Dick's Sporting Goods, Dollar Tree, Gap, Perry Ellis, Ross Stores, Shoe Carnival, Stein Mart, Toro, and Walmart. April existing home sales numbers arrive Friday, plus earnings news fromCampbell Soup, Deere & Co., and Foot Locker.

    Forklift vehicles are not like automobiles; theyre about twice as heavy, due to the counterbalance weight needed to carry large loads. Because forklifts are so heavy, when a pedestrian worker gets injured by a forklift vehicle, the injury is often very serious and sometimes fatal. To avoid becom-ing a victim of a forklift accident, be constantly aware of the forklift activities around you both in your immediate work area and in other areas of the workplace you may need to go.

    Forklifts dont maneuver like automobiles. Forklifts can turn in a very small radius. Theyre rear-wheel driven, so their rear end swings out wider than an automobiles pathway. So, always give a forklift PLENTY of room to maneuver. Dont stand near a forklift when it begins to move. Their extra weight means a forklift cant stop as fast as an auto. Dont try to squeeze by an operating forklift; their unex-pected movements can crush you between the vehicle and a stationary object.

    Forklifts have limited visibility. The forks and lifting mecha-nism block the line of sight for the driver. If theres a load on the lift, visibility is even more limited. So, its up to YOU, the pedestrian, to watch for and avoid forklifts. Dont rely on the forklift driver to see you. If you MUST move around near an active forklift, maintain eye contact with the driver at all times. And, always provide enough space for the forklift to move safely out of your way.

    Never stand near or under loaded forklift tines/forks. Forklifts can drop their load or knock over a stack of materials, causing a possible caught/crush injury. Always wait until a forklift is idle and the parking brake is ON, before entering an active forklift working zone. Evaluate work areas around you to ensure that forklift activities cant impact you. For example, a forklift in one aisle can push a product off a shelf from that side of the aisle into the adjacent aisle you may be in and crush you.

    Listen carefully and look both ways before you step out from an aisle, around a corner, or across a pathway. Avoid cross-ing in front of a moving forklift and dont try to beat one to a crossing. Install mirrors in blind entry areas to help pedestrians and forklift drivers keep track of each other. Paint wide, safe pathways on work area floors to separate pedestrians from forklift travels zones. Adequate lighting can also ensure that drivers and pedestrians see each other.

    Finally, stay alert and work at a safe pace; distracted or hur-rying workers and quick paced forklift driving can lead to an accident or injury. Get periodic training on forklift safety to remember safe work practices and the consequences if you dont follow them. If there are forklifts present where you work, think about your surroundings and how you can keep yourself safe from a forklift injury.
