5 COMMUNITY SERVICE

5.1 IN UNIVERSITY CONTEXT

Prosecutor in disciplinary hearings of the Potchefstroom- and Vaaldriehoek campuses of the NWU as of 1994 until 2005. This includes investigations and advice to the rector and registrar of the PUK and Vaaldriehoek campuses in accordance with the die establishment of disciplinary hearings.

Investigation of alleged initiation practices at the Potchefstroom Collage of Agriculture and the drafting of a report on the findings on 9 March 2002.

Give legal opinions to ITB NWU in accordance to the validity of a contract. 2002.

Give legal opinion to the Student council of the NWU in accordance to the validity of traffic fines on the Potchefstroom campus. 2002.

Member of the Civil Society Working Group, a sub-committee of Arterial Network tasked to work woth the 2005 UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions. I

was part of the three member task team that compiled a report "South African Civil Society Report on the implementation of the UNESCO 2005 Convention on the Protection and Promotion of the Diversity of Cultural Expressions", which was submitted to the Cultural Sector of UNESCO during April 2012.

Since 2010, I have been giving lectures on an annual basis to the Family and Marriage Society of South Africa (FAMSA), Potchefstroom on the theme "Cultural Diversity and Family Laws in South Africa". Lectures in 2012 were on 3 August 2012 and 1 November 2012. From 2013 Mr JL Matthee is giving the same lecture to FAMSA based on the material that I developed.

* 1997-2000. Coordinator LLM – program between the University of the North and the NWU.

* 2001. Present a guest lecture on the Law Succession. Vrije University, Netherlands.

* 1998 - 2001. Representative of the Dean in exchange programs with Universities of Leyden, Vrije University, University of Amsterdam (Netherlands) en Catholic University of Leuven (Belgium). Acts as host for visiting academics of these universities and visited these universities in 2000 to re-establish these programs. Also responsible for the organisation student-exchange programs between 4 Universities and the Faculty of Law. Organisation involves the selection of students, bursary applications, visa applications, residence, travel arrangements etc.

* 1/10-1/12/2004. Study assistance to Sophie van Dijk (Stud no 1219227), Rijks University van Groningen, Netherlands.

* 13-15 January 2004 participated in a consultation to discuss "Affirmation and Appreciation of the Religious and Belief Dimensions Underlying African Wisdom and Values and Their Transmission in Schools" with the International Association for Religious Freedom (IARF) in co-operation with the Peace Education Standing Commission (PESC) of the World Conference on Religion and Peace/International (WCRP). Project for Inter-Religious Consultations for Creating Educational Strategies to Maintain and Promote Conditions for Supporting Freedom of Religion or Belief. Presentation: Introducing Religious Concepts and Beliefs in the Teaching of Law.

* 7-11 January 2008. Present a lecture entitled "Human Rights and Legal Pluralism in South Africa" at the Tilburg/Potchefstroom Summer school at the NWU, Potchefstroom.

* 5/3/2009. Attend an Expert Meeting at the MPI Heidelberg with experts from Namibia.

* 23-25/2/2011. International & Human Rights Guest Seminar on Legal Pluralism: The Case of South Africa and Lessons for Other Countries, Tilburg, the Netherlands.

* Project: " Legal Transplants and Parliaments: A Possible Dialogue Amongst Legislators?" Received an invitation from T Groppi and I Spigno (Italy) to co-author a country report on Namibia within this project.

* CONREASON Project: MPI Heidelberg, Germany. The project seeks to develop a new approach to the comparative study of constitutional reasoning. Its aim is to produce a systematic and comprehensive picture of constitutional reasoning "in action". While the Project is also innovative in using quantitative techniques to analyse judicial opinion writing, its main part consists of the preparation and collection of expert-produced country reports.

* Editor of PER since 2012 (Co-editor from 2003-2011.) I was instrumental in PER obtaining accreditation status in 2003.

* Invitation to attend the discussion by Dr Frank-Walter Steinmeier (German Federal Minister for Foreign Affairs) at SAIIA (WITS, Johannesburg) on 20 November 2014. The title of the discussion was “Participation, Rules and Responsibility – Three Pillars for International Cooperation to Strengthen Peace, Security and Welfare in Africa and the World”.

* I remain involved in the practical side of the law. On 11 April 2012 I received a request from Margaret Meyer (a colleague working at the Master’s Training: Justice College of the Department of Justice and Constitutional Development) to give my views on the “minutes of family meetings” they developed for family meetings to be held between the beneficiaries in the case of customary marriages.

* 1994-1996. "The Administrative and Legal Position of Traditional Authorities in South Africa and their Contribution to the Implementation of the Reconstruction and Development Programme". Research project between the NWU, University of the North, University of the Northwest, University of Natal (Pietermaritzburg), University of Zululand en Leyden University (Netherlands). Member of Traditional Authorities Research Group. This project had a variety of accomplishments in the form of reports, publications and addresses.

* 2000-** Focus area of the Faculty of Law NWU: "Project on Modern Day Impact of Religious Family Law Systems in South Africa: Hinduism, Judaism and Islam." Project leader. Other members of the project are NMI Goolam (Unisa), W du Plessis (NWU), JGH Badat (Durban-Westville), R Gokul (ML Sultan Technikon), W Goldstein (Talmudiese Akademie, Jhb), NM Bernhard

(Rabbi), MF Heyns (NWU) en N Moosa (Wes Kaap). One of the accomplishments of the project was a book with the title: "Introduction to Legal Pluralism in South Africa: Religious Legal Systems". The book was published in 2002 by Butterworths.It is translated into Afrikaans and the Afrikaans version was published at the end of 2002.Other accomplishments was addresses and publications. The project continues in 2004 and a number of addresses, publications and post-graduate research are expected in the future.

* 2001-**. Focus area of the Faculty of Theology: Project II on Women and Church and Society (Reformed Theology and the Development of the South African Society Member of the research team. The project is unde the supervision of Prof. FJ van Rensburg of the Faculty of Theology. Various research partners are part of the project. Accomplishments of this project are workshops, addresses and a publication in the journal In die Skriflig van 2004.

* 2001-**. Focus area of the Faculty of Law NWU: Project on Equality in South Africa. Member of the research team. The project is under the supervision of Prof J Swanepoel of the Faculty of Law. The accomplishment that is planned to be reached is a book on "Equality in South Africa." Two chapters are written by C Rautenbach and is already delivered.

* 2002-2003. Konrad Adenauer Stiftung Research Project on Politics, Soci-Economic issues and Culture in Constitutional Adjudication. Member of the research team under the supervision of Prof. L Jansen van Rensburg. Various persons of the NWU, Unisa, UNIWEST and Stellenbosch are part of the project. One of the accomplishments of the project is a training workshop.

* 2003-2007. Konrad Adenauer Stiftung Research Project on Politics, Socio-Economic issues and Culture in Constitutional Adjudication. Project leader from 2003. Accomplishments include drafting of a manual, maintenance of a database and the organising of workshops, colloquia and seminars.

* 2003. Member of the research team of the North West legislator - Participation in the project. This project included the assessing of al the laws in the Northwest province in the light of the provisions in the Constitution. A complete report was handed to the legislator in March 2003.

* 2003. Responsible for the drafting of a disciplinary code for the College of Agriculture of Potchefstroom that has been in use since January 2003. The co-operation between the College of Agriculture and the Faculty of Law was awoken by a preliminary short course by Rautenbach C that organised it and was partly presented by. Other co-workers in the course was Me Roos, Me Van der Walt en Prof Robinson.

* 2005. Nova Southeastern University International Citator and Research Project. Co-operation in the drafting of a Foreign Citation Manual. See http://www.nsulaw.nova.edu /citator/index.cfm.

* 2008-**. Interest Group on Use of Foreign Precedents by Constitutional Judges. Member of the Interest Group on the Use of Foreign Precedents by Constitutional Judges headed by Professors Tania Groppi (University of Siena) and Marie-Claire Ponthoreau (University of Bordeaux). The project originated during the World Congress of the International Association of Constitutional Law, which was held in Athens in June 2007. The overarching aim of the research project is to survey the use of foreign precedents (foreign cases) by judges presiding in constitutional cases in a number of countries. Currently the Interest Groups comprises of 38 members from several African, American, Asian, European, Latin American and Oceania countries, including South Africa. In the cadre of this project I have developed an empirical databases accessible at http://www4-win2.p.nwu.ac.za/dbtw-wpd/textbases/ccj.htm. The research results have culminated into a presentation at the VIIIth World Congress of the International Association of Constitutional Law: Constitution and Principles, 6-10 December 2011 in Mexico.

* 2010-**. Great Limpopo Transfrontier Conservation Area (GLTFCA) Policy Research Group. To do interdisciplinary research on the issues involved in the GLTFCA. In the cadre of this project I have presented a paper at the 11th AHEAD (Animal & Human Health for the Environment and Development)-GLTFCA Working Group Meeting, SA, 2-4 March 2011. Animal & Human Health for the Environment and Development (AHEAD) was launched at the 2003 IUCN World Parks Congress in Durban, South Africa. In September 2003, an AHEAD-Great Limpopo TFCA (GLTFCA) Working Group was established by assembled African expertise to consider how to address the wide range of complex health issues confronting the region and threatening biodiversity conservation as a land use of choice. This Working Group, which involved stakeholders from Mozambique, South Africa, and Zimbabwe, has continued to meet regularly over the past 7 years to facilitate a locally-driven

process to address disease-related and other threats to biodiversity conservation and development success in the GLTFCA.

* 2011-**. Participated in a conference organised by the Human Rights Education in Diverse Religious and Cultural Contexts (HREID, Faculty of Educational Sciences North West University (under the leadership of Prof C Roux). The International Conference on Human Rights Education in Diversity: Challenges and Proposals 18-20 April 2011. Delivered a response to one of the keynote addresses by NMI Goolam. The presentation is to be published in a peer review textbook in the future. The applicant is currently discussing future research possibilities on cultural diversity.

* 2011-**. Participated in a project entitled "Governance and limited Statehood" organised by the Social Science Research Center Berlin (WZB), Berlin which resulted in a chapter contribution entitled "South Africa: Legal Recognition of Traditional Courts – Loose Ties between Two Judicial Systems" to be published in Justice between Tradition, Religion and the State: Decision‐making on Pluralist Normative Ground. Edited by Matthias Kötter / Tilmann J. Röder/Gunnar Folke Schuppert / Rüdiger Wolfrum (Palgrave MacMillan (United Kingdom) Forthcoming in 2015).

* 2012-**. A member of the Arterial Network sub-committee entitled Civil Society Working Group on the Cultural Diversity Convention. At a Conference on the Cultural Diversity Convention, hosted jointly with the Department of Arts & Culture on 20-21 October 2011; the SACCD and Arterial Network agreed to merge as one organised civil society network of organisation to continue to mobilise for the effective implementation of the Convention by government and civil society. To drive this mandate in a focused manner a sub-committee referred to as the Civil Society Working Group on the 2005 Convention was established. Members of the Working Groups were democratically elected at this Conference. As a member of the task group of the Working Group, we completed a country report which was submitted to UNESCO in April 2012 entitled "South African Civil Society Report on the implementation of the UNESCO 2005 Convention on the Protection and Promotion of the Diversity of Cultural Expressions".

* 2012-2015: I received an invitation to participate in the international Comparative Constitutional Reasoning Project (CONREASON) housed by the Max Planck Institute in Heidelberg and headed by Andras Jakab (Schumpeter fellow) – see http://www.conreasonproject.com/. I invited a colleague, Prof Lourens du Plessis, to co-participate in the project. We attended two workshops (Germany and Hungary) and published a contribution in the 2013 German Law Journal. Currently the country reports are being finalised and will be published in 2015.
