Part-II

Compliance Status A. SPECIFIC CONDITIONS: S.N. Conditions

i) Capacity of the captive power requirement and D.G. Sets for the proposed plant shall not exceed 10 MW and 1x10.89 MW

ii) Other necessary statutory clearances from the concerned Departments including ‘No Objection Certificate’ from the H.P. State Environment Protection & Pollution Control Board (HPSEP & PCB) shall be obtained prior to commencement of construction and / or operation.

iii) Continuous on-line stack monitoring facilities to monitor gaseous emissions from all the stacks shall be provided. After expansion, limit of SPM shall be controlled within 50 mg/Nm3 by installing adequate air pollution control system viz. Electrostatic precipitators, bag house, bag filters and stacks of adequate height etc. Interlocking facility shall be provided in the pollution control equipment so that in the event of the pollution control equipment not working, the respective unit (s) is shut down automatically. Data on ambient air, fugitive and stack emissions shall be submitted to the Ministry’s Regional Office at Chandigarh, H.P. State Environment Protection & Pollution Control Board (HPSEP & PCB) and CPCB regularly.

iv) An action plan shall be prepared and submitted to the Ministry’s Regional Office at Chandigarh for the control of SO2 emissions from the captive power plant.

v) Ambient air quality monitoring (AAQM) stations shall be set up as per statutory requirement in consultation with the H.P. State Environment Protection & Pollution Control Board (HPSEP & PCB). Ambient air quality including ambient noise levels shall not exceed the standards stipulated under EPA or by the State authorities. Monitoring of ambient air quality and shall be carried out regularly in consultation with HPSEP & PCB and data submitted to the CPCB and HPSEP & PCB regularly. The instruments used for ambient air quality monitoring shall be calibrated time to time.

vi) The National Ambient Air Quality Emission Standards issued by the Ministry vide G.S.R. No. 826(E) dated 16th November, 2009 shall be followed.

vii) Gaseous emission levels including secondary fugitive emissions from all the sources shall be controlled within the latest permissible limits issued by the Ministry and regularly monitored. Guidelines/ Code of Practice issued by the CPCB shall be followed. New standards for the sponge iron plant issued by the Ministry vide G.S.R. 414(E) dated 30th May, 2008 shall be followed.

--5-- viii) The company shall install adequate dust collection and

extraction system to control fugitive dust emissions at various transfer points, raw mill handling (unloading, conveying, transporting, stacking), vehicular movement, bagging and packing areas etc. All the raw material stock piles shall be covered. A closed clinker stockpile system shall be provided. All conveyers shall be covered with GI sheets. Covered sheds for storage of raw materials and fully covered conveyers for transportation of materials shall be provided besides coal, cement, fly ash and clinker shall be stored in silos. Pneumatic system shall be used for fly ash handling. Water sprinkling arrangement shall be made in the raw material stock yard and cement bag loading areas.

ix) Efforts shall be made to reduce impact of the transport of the raw materials and end products on the surrounding environment including agricultural land. All the raw materials including fly ash hall be transported in the closed containers only and shall not be overloaded. Vehicular emissions shall be regularly monitored.

x) Asphalting/ concreting of roads and water spray all around the stockyard and loading/ unloading areas in the cement plant shall be carried out to control fugitive emissions. Regular water sprinkling shall be carried out in critical areas prone to air pollution and having high levels of SPM and RPM such as haul road, loading and unloading points, transfer points and other vulnerable areas. It shall be ensured that the ambient air quality parameters conform to the norms prescribed by the Central Pollution Control Board in this regard.

xi) Total water requirement for cement plant from bore wells shall not exceed 748 m3/ day as per ‘Permission’ accorded by the Central Ground Water Authority/ State Ground Water Board (CGWA/ SGWB) and efforts shall be made to further reduce water consumption by using air cooled condensers. All the treated wastewater shall be recycled and reused in the process and/ or for dust suppression and green belt development and other plant related activities etc. No process wastewater shall be discharged outside the factory premises and ‘zero’ discharge shall be adopted.

xii) Efforts shall be made to make use of rain water harvested. If needed, capacity of the reservoir shall be enhanced to meet the maximum water requirement. Only balance water requirement shall be met from other sources.

xiii) All the bag filter dust, raw meal dust, coal dust, clinker dust and cement dust from pollution control devices shall be recycled and reused in the process and used for cement manufacturing. Spent oil and batteries shall be sold to authorized recyclers/ reprocessors only. Sludge generated from sewage treatment plant (STP) shall be used as manure.

xiv) All the fly ash shall be utilized as per Fly Ash Notification, 1999 subsequently amended in 2003. Efforts shall be made to use fly ash maximum in making Pozzolona Portland Cement (PPC).

xvi) As proposed, green belt shall be developed in at least 8 ha.

(33%) area in and around the cement plant as per the CPCB guidelines to mitigate the effects of air emissions in consultation with local DFO.

xvii) A Risk and Disaster Management Plan alongwith the mitigation measures shall be prepared and a copy submitted to the Ministry’s Regional Office at Chandigarh, HPPCB and CPCB within 3 months of issue of environment clearance letter.

xviii) All the recommendations made in the Charter on Corporate Responsibility for Environment Protection (CREP) for the Cement plants shall be implemented.

xix) All the commitments made to the public during the Public Hearing/ Public Consultation meeting held on 7th Sept, 2009 shall be satisfactorily implemented and a separate budget for implementing the same shall be allocated and information submitted the Ministry’s Regional Office at Chandigarh.

xx) At least 5% of the total cost of the project shall be earmarked towards the corporate social responsibility and item-wise details alongwith time bound action plan shall be prepared and submitted to the Ministry’s Regional Office at Chandigarh. Implementation of such program shall be ensured accordingly in a time hound manner.

xxi) The company shall provide housing for construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care, crèche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

B. General Conditions : i) The project authority must adhere to the stipulations made by

H.P. State Environment Protection & Pollution Control Board (HPSEP & PCB) and State Government.

ii) No further expansion or modification of the plant shall be carried out within prior approval of this Ministry.

iii) Industrial wastewater shall be properly collected, treated so as to conform to the standards prescribed under GSR 422(E) dated 19th May, 1993 and 31st December, 1993 or as amended from time to time. The treated wastewater shall be utilized for plantation purpose.

iv) The overall noise levels in and around the plant area shall be kept well within the standards (85 dBA) by providing noise control measures including acoustic hoods, silencers, enclosures etc. on all sources of noise generation. The ambient noise levels shall conform to the standards prescribed under Environment (Protection) Act, 1986 Rules, 1989 viz. 75 dBA (day time) and 70 dBA (night time). Compliance to all the standards for DG sets for noise shall be ensured and acoustic enclosures around DG sets shall be provided.

v) Proper house keeping and adequate occupational health programmes must be taken up. All the persons working in the sensitive areas shall wear protective covers. Occupational Health Surveillance Programme shall be done on a regular basis and records maintained. The programme must include lung function and sputum analysis tests once in six months.

vii) The project proponent shall also comply with all the environmental protection measures and safeguards recommended in the Rapid and Comprehensive EIA/EMP.

viii) A separate environmental management cell with full fledged laboratory facilities to carry out various management and monitoring functions shall be set up under the control of Senior Executive.

ix) As proposed, Rs. 25 crore earmarked towards capital cost and recurring cost/ annum for environmental pollution control measures shall be used exclusively to implement the conditions stipulated by the Ministry of Environment and Forests as well as the State Government. A time bound action plan along with the implementation schedule for all the conditions stipulated herein shall be submitted to the Ministry, HPSEP & PCB and CPCB. The funds so provided shall not be diverted for any other purposes.

x) A copy of clearance letter shall be sent by the proponent to concerned Panchayat, Zila Parishad/ Municipal Corporation, Urban Local Body and the local NGO, if any, from whom suggestions/ representations, if any, were received while processing the proposal. The clearance letter shall also be put on the web site of the company by the proponent.

xi) The project proponent shall upload the status of compliance of the stipulated environment clearance conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of the MoEF, the respective Zonal Office of CPCB and the HPSEP & PCB. The criteria pollutant levels namely; SPM, RSPM, SO2, NOX (ambient levels as well as stack emissions) or critical sectoral parameters, indicated for the projects shall be monitored and displayed at a convenient location near the main gate of the company in the public domain.

xii) The project proponent shall also submit six monthly reports on the status of the compliance of the stipulated environmental conditions including results of monitoring data (both in hard copies as well as by e-mail) to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB. The Regional Office of this Ministry/ CPCB/ HPSEP & PCB shall monitor the stipulated conditions.

xiii) The environmental statement for each financial year ending 31st March in Form-V as is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company alongwith the status of compliance of environmental conditions and shall also be sent to the respective Regional Offices of the MoEF by e-mail.

xiv) The Project Proponent shall inform the public that the project has been accorded environmental clearance by the Ministry and copies of the clearance letter are available with the HPSEP & PCB and may also be seen at Website of the Ministry of Environment & Forests at http:/envfor.nic.in. This shall be advertised within seven days from the date of issue of the clearance letter, at least in two local newspapers.

xvi) The Regional Office of this Ministry at Chandigarh/ Central Pollution Control Board/ HPSEP & PCB shall monitor the stipulated conditions. A six monthly compliance report and the monitored data alongwith statistical interpretation shall be submitted to them regularly.

xviii) The Project Proponent shall inform the public that the project has been accorded environmental clearance by the Ministry and copies of the clearance letter are available with the HPSEP & PCB/ Committee and may also be seen at Website of the Ministry of Environment & Forests at http:/envfor.nic.in. This shall be advertised within seven days from the date of issue of the clearance letter at least in two local newspapers that are widely circulated in the region of which one shall be in the vernacular language of the locality concerned and a copy of the same shall be forwarded to the Regional Office.

7. The Ministry or any competent authority may stipulate any further condition(s) on receiving reports from the project authorities. The above conditions shall be monitored by the Regional Office of the Ministry located at Chandigarh.

PART-III Detailed Monitoring Report

The project is for the Cement Grinding Unit(2.00 MTPA) and Integrated Multi-fuel based Captive Thermal Power Plant (10 MW) and 1 DG set for 10.89 MW capacity at village-Pandiyana (Tikri), near Bagheri, Post-Khillan,Tehsil-Nalagarh, Distt. Solan (H.P). Total land required for the project is 24.51 ha. No National Park and Wildlife Sanctuary are located within 10 km radius of the plant site. No eco-sensitive areas are located within 15 km periphery of the plant. Total cost of the project is Rs. 450 crores. The project authority was having old Cement grinding unit (1.75 MTPA capacity) commissioned before 27.02.2010 and the Unit has been upgraded to the capacity to 2.00 MTPA. It is further clarified by the PA that total capacity of the Unit is limited to 2.00 MTPA only and no additional capacity will be created. About Rs.250.00 crores have been incurred on civil construction work of the project and Rs. 14.00 crores have been incurred on implementation of Environment Management Plans. Rs. 380.00 lacs have been spent on EMP as recurring expenditure in 2011-2012. The project site was earlier visited by the undersigned along with two officers from HPSPCB namely Shri Brij Bhushan Sharma, Ex. Engineer and Shri Ravinder Sharma, AEE, RO, HPSPCB, Baddi on 21.05.2010. It was learnt that the team of officers from HPSPCB had visited the Unit on 17.05.2010 and some observations were conveyed. The observations conveyed by HPSPCB, the action taken report by PA and the comments from this office on the basis of present visit are mentioned below:- S.NO. Observations conveyed by

The comments of this office.

1. Although two additional DG sets installed recently have been removed but foundation of these DG sets still exist there.

Two no. of additional DG sets which were kept along side four DG sets have been removed and shifted outside the plant premises.

The foundations of these additional DG sets have been removed.

2. Coal was found stored in open. As informed at site, the same is the material of Bagga Plant. Remove it immediately as the same is adding dust pollution in the area.

Coal has been dumped temporarily and is being shifted to JHCP, Bagga. However, to control dust pollution, water is being sprinkled continuously.

The coal has been shifted to JHCP, Bagga in time bound manner.

3. Kachha roads and places within the premises and Katcha ground of truck parking is also contributing towards air/dust pollution in the area.

All roads and truck parking areas within premises of the plant have already been concreted.

Most of the roads and parking areas have been made pucca.

4. Ambient air monitoring stations are not being operated properly and regularly. Run these stations on alternate days and change the filter papers after every 8 hours.

Ambient Air Quality monitoring stations are functioning properly and the data is being generated as advised.

The data is being submitted to this office on regular basis.

5. Results of on-line stack monitoring

and Ambient Air monitoring are neither being sent to this State Board/Office nor being displayed at your own web site.

Results of stack monitoring and Ambient air monitoring have already been furnished by E mail.

The data is being submitted to this office on regular basis.

6. Environment Management Cell is required to be established in the plant.

Environment Management Cell has been established.

The PA has been asked to submit the full constitution of EMC along with activities during last six months on regular basis.

7. Rainwater harvesting system is still incomplete.

Action is in hand. Main Rainwater harvesting pits have already been constructed.

Rainwater harvesting system has been completed.

8. Sullage and other kitchen waste water is not being treated.

This has been complied as the incinerator and compost pits are already functional.

This should be complied regularly in consultation with HPSPCB.

9. Dust emission was observed at Clinker unloading section and Clinker Silo Section.

Action has been taken to minimize the dust emission in the clinker unloading section and clinker silo.

The PA has been asked to submit detailed action taken report.

Still the production is limited to old capacity of 1.75 MTPA and production to the capacity of 2.00 MTPA has not been achieved. The PA has applied for ‘Consent to Establish’ under Air & Water Acts for enhanced capacity to the tune of 2.00 MTPA but the same is yet to be obtained. The production figures and consumption of different raw material during 2011-2012 submitted by the project authority is given below:- Cement production: 17,00,737 MT Clinker consumption: 11,40,111 MT Fly ash consumption: 4,93,076 MT Gypsum consumption: 67,550 MT The condition wise latest compliance of different conditions is given below:- (A). Specific Conditions: Condition No. (i): Capacity of the captive power requirement and D.G. Sets for the proposed plant shall not exceed 10 MW and 1x10.89 MW. As mentioned in previous report also, three DG sets of the capacity of 10.89 MW each imported from abroad required casting of the foundations and roof protection from weather before their arrival at site. Accordingly, the foundation was constructed by the project authorities before the arrival of the equipment. But the MoEF, New Delhi has accorded the permission for one DG set of 10.89 MW only for upgraded Cement Grinding Unit.

--11-- It was observed at site that the PA has made only one DG set (10.89 MW) ready for operation. It was also observed that other two DG sets have not been made ready for operation and the PA has ensured that other DG sets will not be made operational until the permission from MoEF is given/amended.

Condition No. (ii): Other necessary statutory clearances from the concerned Departments including ‘No Objection Certificate’ from the H.P. State Environment Protection & Pollution Control Board (HPSEP & PCB) shall be obtained prior to commencement of construction and / or operation. It is informed by PA that the HSPCB has issued Consent to Establish and Consent to Operate for operation of new 10.89 capacity DG set. The PA has been asked to submit the copies of the same to this office for our record. Condition No. (iii): Continuous on-line stack monitoring facilities to monitor gaseous emissions from all the stacks shall be provided. After expansion, limit of SPM shall be controlled within 50 mg/Nm3 by installing adequate air pollution control system viz. Electrostatic precipitators, bag house, bag filters and stacks of adequate height etc. Interlocking facility shall be provided in the pollution control equipment so that in the event of the pollution control equipment not working, the respective unit (s) is shut down automatically. Data on ambient air, fugitive and stack emissions shall be submitted to the Ministry’s Regional Office at Chandigarh, H.P. State Environment Protection & Pollution Control Board (HPSEP & PCB) and CPCB regularly. It is observed that continuous on-line stack monitoring facilities (Opacity Meter) to monitor gaseous emissions from all the stacks have been provided. Stack monitoring data till June, 2012 has been submitted by PA to this office. The results are within the permissible limits. The PA has assured that the limit of SPM shall be controlled within 50 mg/Nm3 for which adequate air pollution control system viz. Electrostatic precipitators, bag house, bag filters and stacks of adequate height etc. have been established. The PA has also assured that the data on ambient air quality, fugitive emission and stack emissions shall be submitted to the Ministry’s Regional Office at Chandigarh, H.P. State Environment Protection & Pollution Control Board (HPSEP & PCB) and CPCB regularly. The height of existing stacks is given below:-

Condition No. (iv): An action plan shall be prepared and submitted to the Ministry’s Regional Office at Chandigarh for the control of SO2 emissions from the captive power plant. The Ministry has approved a captive Thermal Power Plant of 10 MW capacity only. It is gathered during the site visit that buildings were constructed for 30 MW Thermal

--12-- Power Plant but the TPP has never been installed. The equipments and machinery procured for the TPP is being shifted to the other TPP in other State. The Project authorities have requested that they should be allowed to retain the buildings and to allow them for other uses. However, the Hon’ble High Court has ordered to dismantle the buildings. The Ministry may kindly allow the PA to keep the buildings for other uses. Condition No. (v): Ambient air quality monitoring (AAQM) stations shall be set up as per statutory requirement in consultation with the H.P. State Environment Protection & Pollution Control Board (HPSEP & PCB). Ambient air quality including ambient noise levels shall not exceed the standards stipulated under EPA or by the State authorities. Monitoring of ambient air quality and shall be carried out regularly in consultation with HPSEP & PCB and data submitted to the CPCB and HPSEP & PCB regularly. The instruments used for ambient air quality monitoring shall be calibrated time to time. It is observed that 3 Ambient air quality monitoring (AAQM) stations have been set up as per statutory requirement in consultation with the H.P. State Environment Protection & Pollution Control Board (HPSEP & PCB). The Ambient air quality including ambient noise levels are being monitored by PA regularly and the results are submitted to RO, MOEF, Chandigarh, HPSPCB and CPCB. PA has also assured that the instruments used for ambient air quality monitoring shall be calibrated time to time. The results in respect of ambient noise levels and Ambient Air Quality till June, 2012 carried out by the PA itself are submitted and placed in the file. All the results are within the limits. The Ambient Air Quality has been monitored by International Testing Center, Panchkula which is an approved lab in June, 2012.The results are placed in the file. The results are within the limits of the HPSPCB. Condition No. (vi): The National Ambient Air Quality Emission Standards issued by the Ministry vide G.S.R. No. 826(E) dated 16th November, 2009 shall be followed. The PA has already started compliance of National Ambient Air Quality Emission Standards in respect of upgraded cement grinding unit and the PA has further assured to comply this condition satisfactorily in due course of time. However, the compliance of this condition will be monitored by this office from time to time. Condition No. (vii): Gaseous emission levels including secondary fugitive emissions from all the sources shall be controlled within the latest permissible limits issued by the Ministry and regularly monitored. Guidelines/ Code of Practice issued by the CPCB shall be followed. New standards for the sponge iron plant issued by the Ministry vide G.S.R. 414(E) dated 30th May, 2008 shall be followed. The PA has assured to comply this condition satisfactorily. However, the compliance of this condition will be monitored by this office from time to time.

--13-- Condition No. (viii): The company shall install adequate dust collection and extraction system to control fugitive dust emissions at various transfer points, raw mill handling (unloading, conveying, transporting, stacking), vehicular movement, bagging and packing areas etc. All the raw material stock piles shall be covered. A closed clinker stockpile system shall be provided. All conveyers shall be covered with GI sheets. Covered sheds for storage of raw materials and fully covered conveyers for transportation of materials shall be provided besides coal, cement, fly ash and clinker shall be stored in silos. Pneumatic system shall be used for fly ash handling. Water sprinkling arrangement shall be made in the raw material stock yard and cement bag loading areas.

Condition No. (ix): Efforts shall be made to reduce impact of the transport of the raw materials and end products on the surrounding environment including agricultural land. All the raw materials including fly ash hall be transported in the closed containers only and shall not be overloaded. Vehicular emissions shall be regularly monitored. It is observed that the trucks having raw material including fly ash is transported in the closed containers only. The compliance of this condition will be monitored by this office from time to time. Condition No. (x): Asphalting/ concreting of roads and water spray all around the stockyard and loading/ unloading areas in the cement plant shall be carried out to control fugitive emissions. Regular water sprinkling shall be carried out in critical areas prone to air pollution and having high levels of SPM and RPM such as haul road, loading and unloading points, transfer points and other vulnerable areas. It shall be ensured that the ambient air quality parameters conform to the norms prescribed by the Central Pollution Control Board in this regard.

--14-- It is observed that all roads and truck parking areas within the premises of the Plant have already been concreted. It is further assured by the PA that remaining kuchha areas will also be concreted in due course of time. Condition No. (xi): Total water requirement for cement plant from bore wells shall not exceed 748 m3/ day as per ‘Permission’ accorded by the Central Ground Water Authority/ State Ground Water Board (CGWA/ SGWB) and efforts shall be made to further reduce water consumption by using air cooled condensers. All the treated wastewater shall be recycled and reused in the process and/ or for dust suppression and green belt development and other plant related activities etc. No process wastewater shall be discharged outside the factory premises and ‘zero’ discharge shall be adopted. The PA is complying this condition by adopting ‘0’ discharge of the effluent from the factory. However, the compliance of this condition will be monitored by this office from time to time. Condition No. (xii): Efforts shall be made to make use of rain water harvested. If needed, capacity of the reservoir shall be enhanced to meet the maximum water requirement. Only balance water requirement shall be met from other sources. Few of the rainwater harvesting measures have been completed. The compliance of this condition will be monitored by this office from time to time. Condition No. (xiii): All the bag filter dust, raw meal dust, coal dust, clinker dust and cement dust from pollution control devices shall be recycled and reused in the process and used for cement manufacturing. Spent oil and batteries shall be sold to authorized recyclers/ reprocessors only. Sludge generated from sewage treatment plant (STP) shall be used as manure. The PA has assured to comply this condition satisfactorily. In total 9.87 used oil was generated during the year 2011-2012 as hazardous waste which has been disposed off as per HW(M,H & T) Rules, 2008. Condition No. (xiv): All the fly ash shall be utilized as per Fly Ash Notification, 1999 subsequently amended in 2003. Efforts shall be made to use fly ash maximum in making Pozzolona Portland Cement (PPC). The fly ash is being used in the cement by the PA. In total 4,93,076 MT of fly ash has been consumed/utilized by the Plant during the year 2011-2012. Condition No. (xv): Efforts shall be made to use low grade lime, more fly ash and solid waste in the cement manufacturing. It is clarified here that the Unit comprises of Cement Grinding Unit and does not have clinker production plant. Hence, the limestone is not required for operations. However, it is informed by PA that the efforts are being done to get more fly ash from different sources.

--15-- Condition No. (xvi): As proposed, green belt shall be developed in at least 8 ha. (33%) area in and around the cement plant as per the CPCB guidelines to mitigate the effects of air emissions in consultation with local DFO. The PA had been raising green belt since the year 2008. The PA has been asked to complete the development of green belt as early as possible. Condition No. (xvii): A Risk and Disaster Management Plan alongwith the mitigation measures shall be prepared and a copy submitted to the Ministry’s Regional Office at Chandigarh, HPPCB and CPCB within 3 months of issue of environment clearance letter. It is confirmed that a Risk and Disaster Management Plan alongwith mitigation measures was prepared as a part of EIA report and submitted to Ministry of Environment & Forests for seeking environmental clearance. Condition No. (xviii): All the recommendations made in the Charter on Corporate Responsibility for Environment Protection (CREP) for the Cement plants shall be implemented. The PA has complied the recommendations of the CREP for Cement Grinding Units. The report is submitted and kept in the file. Condition No. (xix): All the commitments made to the public during the Public Hearing/ Public Consultation meeting held on 7th Sept, 2009 shall be satisfactorily implemented and a separate budget for implementing the same shall be allocated and information submitted the Ministry’s Regional Office at Chandigarh. It is confirmed that most of the commitments made during the Public Hearing meeting have been duly complied and the action is being taken to comply rest of the measures. The details of commitments, the expenditure involved and the compliance status was enclosed with earlier report.

--16-- Condition No. (xx): At least 5% of the total cost of the project shall be earmarked towards the corporate social responsibility and item-wise details alongwith time bound action plan shall be prepared and submitted to the Ministry’s Regional Office at Chandigarh. Implementation of such program shall be ensured accordingly in a time hound manner. The funds to the tune of Rs.202.86 lacs have been earmarked for complying the Corporate Social responsibility. A statement indicating the works done, location of the works, status of the works and the expenditure involved was enclosed with earlier report. The PA has been asked to submit the compliance report from time to time. Condition No. (xxi): The company shall provide housing for construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care, crèche etc. The housing may be in the form of temporary structures to be removed after the completion of the project. The condition is being complied satisfactorily. B. General Conditions : Condition No. (i): The project authority must adhere to the stipulations made by H.P. State Environment Protection & Pollution Control Board (HPSEP & PCB) and State Government. The “Consent to Operate” under Air & Water Acts have been obtained by the PA which was valid upto 31.03.2012. The PA has applied to update the Consent to Operate for further period of 1 year. Condition No. (ii): No further expansion or modification of the plant shall be carried out within prior approval of this Ministry. The PA has assured to comply the condition satisfactorily. Condition No. (iii): Industrial wastewater shall be properly collected, treated so as to conform to the standards prescribed under GSR 422(E) dated 19th May, 1993 and 31st December, 1993 or as amended from time to time. The treated wastewater shall be utilized for plantation purpose. The PA has assured to comply the condition satisfactorily. Condition No. (iv): The overall noise levels in and around the plant area shall be kept well within the standards (85 dBA) by providing noise control measures including acoustic hoods, silencers, enclosures etc. on all sources of noise generation. The ambient noise levels shall conform to the standards prescribed under Environment (Protection) Act, 1986 Rules, 1989 viz. 75 dBA (day time) and 70 dBA (night time). Compliance to all the standards for DG sets for noise shall be ensured and acoustic enclosures around DG sets shall be provided.

--17-- It is confirmed that ambient noise levels are being monitored by PA during day and night time within the existing plant premises and well within the prescribed norms. It is further assured that proper acoustic enclosure have been provided for one DG set of 10.89 MW capacity. Condition No. (v): Proper house keeping and adequate occupational health programmes must be taken up. All the persons working in the sensitive areas shall wear protective covers. Occupational Health Surveillance Programme shall be done on a regular basis and records maintained. The programme must include lung function and sputum analysis tests once in six months. It is confirmed that a well equipped health center has been established within the plant premises to cater the health needs of the staff and workers. Besides this a Safety officer has been deputed to tackle the safety aspects such as safety helmets, shoes, hand gloves, glasses and earmuffs to the workers. There are 560 workers in the Unit. It is assured that lung function and sputum tests are done for the workers once in six months time. The medical reports in respect few workers for medical check up are submitted to this office. No worker has been found affected by any occupational disease so far. Condition No. (vi): The company shall undertake eco-development measures including community welfare measures in the project area. It is gathered that the community development activities have already been undertaken in villages surrounding the Plant area and so far approximately Rs. 2.00 crores have been incurred. It is further informed that the works for community welfare are being taken thereafter also. The details will be submitted by PA to this office from time to time. Condition No. (vii): The project proponent shall also comply with all the environmental protection measures and safeguards recommended in the Rapid and Comprehensive EIA/EMP. The PA has assured to comply this condition satisfactorily in due course of time. However, the compliance of this condition will be monitored by this office from time to time. Condition No. (viii): A separate environmental management cell with full fledged laboratory facilities to carry out various management and monitoring functions shall be set up under the control of Senior Executive. The PA has informed that Environment Management Cell with full fledged laboratory facilities to carry out various monitoring functions has been set up within the Cement Plant premises. The PA has been asked to submit the names of officers, their designation, duties assigned and the activities during last 6 months in respect of Environment Management Cell. PA has also been asked to submit the details of equipments and chemicals kept in the lab.

Condition No. (ix): As proposed, Rs. 25 crore earmarked towards capital cost and recurring cost/ annum for environmental pollution control measures shall be used exclusively to implement the conditions stipulated by the Ministry of Environment and Forests as well as the State Government. A time bound action plan along with the implementation schedule for all the conditions stipulated herein shall be submitted to the Ministry, HPSEP & PCB and CPCB. The funds so provided shall not be diverted for any other purposes. The funds to the tune of Rs. 25 crores were earmarked for completing integrated project comprising of 2.00 MTPA Cement Grinding Unit, 30 MW captive Power Plant and 3 x 10.89 MW DG sets. As the environmental clearance has been accorded to establish only 10 MW CPP and one DG set of 10.89 MW only, the expenditure on EMP will also be reduced proportionately. The details of expenditure on implementation of EMP’s till March, 2011 and plan for next two years was given with earlier report. Recurring expenditure in 2011-2012 on implementation of EMP has incurred to the extent of Rs.380.20 lacs. Condition No. (x): A copy of clearance letter shall be sent by the proponent to concerned Panchayat, Zila Parishad/ Municipal Corporation, Urban Local Body and the local NGO, if any, from whom suggestions/ representations, if any, were received while processing the proposal. The clearance letter shall also be put on the web site of the company by the proponent. The PA has confirmed that this condition has been duly complied. Condition No. (xi): The project proponent shall upload the status of compliance of the stipulated environment clearance conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of the MoEF, the respective Zonal Office of CPCB and the HPSEP & PCB. The criteria pollutant levels namely; SPM, RSPM, SO2, NOX (ambient levels as well as stack emissions) or critical sectoral parameters, indicated for the projects shall be monitored and displayed at a convenient location near the main gate of the company in the public domain. The PA has assured to comply this condition satisfactorily in due course of time. However, the compliance of this condition will be monitored by this office from time to time. Condition No. (xii): The project proponent shall also submit six monthly reports on the status of the compliance of the stipulated environmental conditions including results of monitoring data (both in hard copies as well as by e-mail) to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB. The Regional Office of this Ministry/ CPCB/ HPSEP & PCB shall monitor the stipulated conditions. The PA has assured to comply this condition satisfactorily in due course of time. However, the compliance of this condition will be monitored by this office from time to time.

--19-- Condition No. (xiii): The environmental statement for each financial year ending 31st March in Form-V as is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company alongwith the status of compliance of environmental conditions and shall also be sent to the respective Regional Offices of the MoEF by e-mail. The PA has assured to comply this condition satisfactorily in due course of time. However, the compliance of this condition will be monitored by this office from time to time. Condition No. (xiv): The Project Proponent shall inform the public that the project has been accorded environmental clearance by the Ministry and copies of the clearance letter are available with the HPSEP & PCB and may also be seen at Website of the Ministry of Environment & Forests at http:/envfor.nic.in. This shall be advertised within seven days from the date of issue of the clearance letter, at least in two local newspapers. The PA has yet to forward the copies of the advertisement given in the newspapers. The PA has been asked to send the same immediately.

Condition No. (xv): Project authorities shall inform the Regional Office as well as the Ministry, the date of financial closure and final approval of the project by the concerned authorities and the date of commencing the land development work. It is informed that the date of financial closure will be 31st March of every year. Condition No. (xvi): The Regional Office of this Ministry at Chandigarh/ Central Pollution Control Board/ HPSEP & PCB shall monitor the stipulated conditions. A six monthly compliance report and the monitored data alongwith statistical interpretation shall be submitted to them regularly. The PA has assured to comply this condition satisfactorily in due course of time. However, the compliance of this condition will be monitored by this office from time to time. Condition No. (xvii): The Project Authorities shall inform the Regional Office as well as the Ministry, the date of financial closure and the final approval of the project by the concerned authorities and the date of commencing the land development work. It is informed that the date of financial closure will be 31st March of every year.

--20-- Condition No. (xviii): The Project Proponent shall inform the public that the project has been accorded environmental clearance by the Ministry and copies of the clearance letter are available with the HPSEP & PCB/ Committee and may also be seen at Website of the Ministry of Environment & Forests at http:/envfor.nic.in. This shall be advertised within seven days from the date of issue of the clearance letter at least in two local newspapers that are widely circulated in the region of which one shall be in the vernacular language of the locality concerned and a copy of the same shall be forwarded to the Regional Office. The PA has yet to forward the copies of the advertisement given in the newspapers. The PA has been asked to send the same to this office also immediately. Condition No. (7): The Ministry or any competent authority may stipulate any further condition(s) on receiving reports from the project authorities. The above conditions shall be monitored by the Regional Office of the Ministry located at Chandigarh. It is upto the Ministry of Environment & Forests to decide. However, there is no recommendation from this office to stipulate any new condition in the environment clearance letter. Condition No. (8): The Ministry may revoke or suspend the clearance if implementation of any of the conditions is not satisfactory. It is upto the Ministry of Environment & Forests to decide revocation or suspension of the env. clearance letter. However, there is no recommendation from this office to revoke or suspend the environment clearance letter.

Condition No. (9): Any other conditions or alteration in the above conditions shall have to be implemented by the project authorities in a time bound manner. The PA has assured to comply this condition satisfactorily if laid down by the MoEF, New Delhi in future. However, the compliance of this condition will be monitored by this office from time to time.
