The new Local Control Funding Formula (LCFF) is a historical change in the way the state allocates funding for school districts. The LCFF is designed to close the achievement gap by providing additional funds to support improved student outcomes and accountability. We are no longer implementing the state's plan for eligible students; we must develop a plan locally that achieves improved results. The LCFF accountability system requires that districts develop a three-year Local Control and Accountability Plan (LCAP) and annually update it.

ISSUE

The LCAP must identify goals based on state priorities for all students, numerically significant subgroups, students with disabilities and eligible students. Additionally, the statute requires engagement with a variety of stakeholders in the development of the plan. Modesto City Schools has held 16 workshops for staff and community members asking for input to develop the LCAP draft. Prior to the approval of the plan, the district must review the draft in a public hearing in order to receive additional feedback from interested stakeholders.

PROPOSAL

Modesto City Schools staff has completed the requirements necessary to compose a draft LCAP to present in a public hearing. Input will be received and agreed-upon revisions will be made prior to Board approval at the June 22,2015, Board meeting.

The LCAP draft can be accessed at www.mcs4kids.com. Copies of the LCAP draft are also available in the Superintendent's office.

RECOMMENDATION

It is recommended that the Board of Education conduct a public hearing to review the draft of the Local Control and Accountability Plan.

ISSUE

Regulations regarding the Local Control Funding Formula (LCFF) and Local Control Accountability Plan (LCAP) state that the budget and LCAP public hearings be held on the same day. It further states that the LCAP adoption cannot be on the same day as the LCAP public hearing.

Funds are used to replace computers and printers throughout the District that are not directly in a classroom or computer lab. These dollars could be budgeted annually in the Senior Director, Information Technology Services budget.

These dollars were designed to backfill the State's textbook funding shortfall for adoption cycles. Despite the elimination of revenue limit and equalization aid funding, this increase is still in place.

o Common Core Textbook Adoption - With the one-time funding being exhausted at the end of fiscal year 2014115, the need to find additional funding to support the implementation of Common Core State Standards (CeSS) was necessary. A flat amount was established in an attempt to offset the requirements.

• Artificial Turf Replacement o Downey High School's synthetic turf athletic field was completed in fall 2007.

Manufacturers estimate that synthetic turf will require replacement every ten (10) years. An assigned line has been established in order for funding to be available when the replacement is necessary.

SUBJECT: Approval of Authorization to Award Bid No. 15-4601 Football Helmets and Impact Sensor Monitoring Equipment to Riddell All American Sports

BACKGROUND

Last year, Dominic Barandica, a student at Gregori High School, presented a research project to his English class on football concussions and football helmets. His project lead to . a collaborative partnership between Modesto City Schools and Doctors Medical Center for the 2014 football season. Gregori High School football piloted the concussion prevention program with 36 helmets this past season. Student safety is a primary concern and new

. integrated nioiritoring and alerting tools designed specifically for the proactive protection of football players is now available. The helmets are designed to disperse energy, reducing the risk of trauma. New integrated technology is used to monitor and record significant head impacts sustained during a football game or practice. Medical professionals on the sideliD.es use handheld devices that are designed to alert team staff of high-risk single and multiple head impacts, and enable improved identification and management of concussions. . .' . Modesto City Schools and Doctors Medical Center plan to expand this program to all high school.sites for the 2015 season; Each highschool will be provided 54 helmets with the. concussion sensors. Eighteen sensor equipped helmets will be provided for each Frosh, JV, and Varsity teams at each of the seven comprehensive high schools.

ISSUE

The purchase of these helmets and sensor equipment exceeds the current bid threshold of $86,000. The District sought formal bids for football helmets and impact sensor monitoring equipment as required by Public Contract Code and Education Code. Board authorization is now needed to award the bid.

PROPOSAL

Formal bids were solicited and two responses were received. Bid No. 15-4601 was opened on May 15, 2015 at 3:00 p.m. The bid award is for one year, with the option to renew for up to two additional one-year periods. Bid results are as follows:

The 2015-16 school year calendar has not been agreed upon between the District and employee associations. Until time a calendar has been finalized, it is necessary to establish calendars on a monthly basis.

ISSUE

As the District and the employee associations continue to negotiate the 2015-16 school year calendar, a tentative monthly calendar for July 2015 and August 2015 need to be established for staff, students and the community.

PROPOSAL

In order to provide essential services to students and the District, it is proposed that the Board adopt the attached temporary calendars for the months of J~ly and August 2015 (excluding holidays, vacation credit, non-responsibility days and weekends). A separate calendar hiis beeri created for the Child Development Program ... The first day of student attendance will be Monday, August 10, 2015. The District will continue to negotiate the 2015-Hi work year calendar with the employee associations .. Important dates for July and August have been identified for planning purposes. . . . .

BACKGROUND

Since 1989, the Board of Education has received evaluations of the Associate Superintendents' performances. These evaluations are the basis for determining whether to extend the expiration dates of the Associate Superintendents' contracts. The Board received this year's evaluations for the Associate Superintendent, Human Resources and .the Associate Superintendent, Educational Services, in Closed Session on May 11, 2015.

ISSUE

The Associate Superintendents' contracts are valid for a period of two years. The current contract for the Associate Superintendent, Human Resources and the Associate Superintendent, Educational Services, are due to expire June 30, 2016. Therefore, it is necessary to approve new contracts effective July 1, 2015 through June 30, 2017 .

. PROPOSAL

The requested extension for the Associate Superintendent, Educational Services will be updated to reflect a new two~yearcontractperiod from July 1,2015 through June 30, 2017 and adjustment to longevity compensation. The Associate Superintendent, Human Resources position is being recommended to be replaced with a Deputy Superintendent, Chief Human Resources Official poSition. The contracted period will be from July 1, 2015 through June 30, 2017. The Deputy Superintendent position will require a base salary plus other adjustments for compensation provided to other District managers.

Attached is a copy of the new contracts.

FISCAL IMPACT

The total increase in on-going cost is approximately $13,384.

CONTRACT OF EMPLOYMENT FOR DEPUTY SUPERINTENDENT, CHIEF HUMAN RESOURCES OFFICIAL

This Agreement is entered into by and between the Governing Board of the Modesto City

Elementary School District and Modesto City High School District, hereinafter referred to as "the

Governing Board" or "Modesto City Schools," and Craig D. Rydquist, hereinafter referred to as

"Deputy Superintendent."

RECITALS

The parties hereto do mutually agree as follows:

I. TERMS OF CONTRACT EMPLOYMENT

Pursuant to Section 35031 of California Education Code, the existing employment

agreement between the parties hereto is hereby cancelled and terminated effective June 30, 2015

and the Governing Board hereby employs Craig D. Rydquist as the Deputy Superintendent, Chief

Human Resources Official, of Modesto City Elementary School District and Modesto City High

School District for the period commencing July 1, 2015 through June 30,2017, subject to the.

terms and conditions stated herein .. Deputy Superintendent accepts such employment and agrees

to perform all of the duties of said office during the term of this Agreement.

.. II. .. DUTIES AND RESPONSIBILITIES .

Deputy Superintendent shall perform all duties and exercise all powers as prescribed by .

all applicable laws, rules, and regulations of the State of California and the Governing Board.

The powers and duties of Deputy Superintendent shall be executed in accordance with the

applicable policies and regulations adopted by the Governing Board.

III. EV ALUA TION

Deputy Superintendent shall be evaluated in writing annually before June 30th of each

evaluation year in accordance with Governing Board policies and regulations. This evaluation

shall be reasonably related to the job description of Deputy Superintendent, Chief Human

Resources Official, and the goals and objectives of the school districts.

IV. SALARY

Deputy Superintendent's minimum annual salary during the term of this Agreement shall

be $160,876 plus longevity increments and other stipends provided other managers in the

District, for a total of $170,858. Payments are to be made in equal monthly installments on the

last day of each month. The Go.verning Board hereby fixes the salary of Deputy Superintendent

as set forth and orders the payment made in the manner indicated. For the 2016-17 fiscal year,

Deputy Superintendent's salary shall, contingent upon an evaluation indicating satisfactory

performance, be adjusted by an amount determined appropriate by the Governing Board. Such

adjustment shall occur after completion of the preceding school year's evaluation of the

performance of Deputy Superintendent and after consideration of the recommendation of the

Superintendent. Should any annual increase exceed the California Consumer Price Index for

Urban Wage Earners and Clerical Workers as calculated by the Department of Industrial

.. Relations, the increase in excess of this amount may not take effect· without a vote by the

Governing Board in public session at a regularly scheduled meeting of the Governing Board.

. V.. HEALTH, WELFARE AND LEAVE. BENEFITS

The Deputy Superintendent shall receive all health and welfare benefits, including twelve

.. (12)· days of sick leave, provided to certificated·administrators/inanagement employees of the··

District.

VI. TRANSPORTATION AND EXPENSE ALLOWANCE

Deputy Superintendent shall not receive an in-county mileage/expense allowance because

it is included in his salary.

VII. WORK YEAR

Deputy Superintendent shall be responsible for 222 days of full regular services to the

districts during each annual period covered by this Agreement. Deputy Superintendent will

receive holidays defined in Section 37220 of the Education Code. Non-responsibility days must

be taken within twelve (12) months of the year earned, except by special agreement between

Superintendent and Deputy Superintendent.

VIII. PROFESSIONAL DUES

Modesto City Schools shall pay dues for Deputy Superintendent for membership in the

Association of California School Administrators (ACSA) for the term of this Agreement.

Modesto City Schools shall also pay for membership dues and reasonable and necessary

participation expenses for membership and participation in such other professional or service

organizations as the Superintendent determines are in the interest of Modesto City Schools, not

to exceed $1,200 per year.

IX. NOTICE

The Governing Board may elect not to renew this Agreement for any reason and shall

provide Deputy Superintendent with written notice of this fact no later than forty-five (45) days

prior to the expiration of this Agreement. Deputy Superintendent shall inform the Governing

Board of this notice requirement, in writing, no later than March 1st of the final year of this

Agreement. Deputy Superintendent agrees that failure to provide the Governing Board with such

written notice shall conclusively constitute a material breach of this Agreement .

. Notwithstanding any contrary term contained in this Agreement, the :Governing Board may, upon

majority vote, immediately terminate this Agreement based on D~puty. Superintendent's failure

to provide the written notification and Deputy Superintendent shall not be entitled to any further

payirient or benefits under this Agreement.

·x. TERMINATION BY BOARD

Deputy Superintendent may be terminated by the Board at any time for, but not limited to,

breach of this Agreement, any ground enumerated in the Education Code, the Deputy

Superintendent's unsatisfactory performance, the Deputy Superintendent's failure to perform

responsibilities, or for other conduct which is seriously prejudicial to the District. The Board

shall not terminate this Agreement pursuant to this paragraph until a written statement of the

charges has first been served upon the Deputy Superintendent. The Deputy Superintendent shall

then be entitled to a conference with the Governing Board in closed session, at which time the

Deputy Superintendent shall be given a reasonable opportunity to address the Governing Board's

concerns. The conference shall not be conducted as an administrative evidentiary hearing and

there shall be no use of witnesses. Deputy Superintendent shall have the right to be represented

by counsel of his choice and expense. The Deputy Superintendent shall have a reasonable

opportunity to fully respond to all matters raised in the statement of charges, and shall have the

opportunity to introduce documentary evidence. If the Governing Board, after considering all

evidence presented, decides to terminate this Agreement, it shall provide Deputy Superintendent

with a written decision." The decision of the Governing Board shall be final. Deputy

Superintendent's conference with the Governing Board shall be Deputy Superintendent's

exclusive right to any conference or hearing otherwise required by law. Deputy Superintendent

knowingly waives any other rights that may be applicable to his termination.

XI. SETTLEMENT AGREEMENT

. Regardless of the term of this employment Agreement, if this Agreement is. terminated

pursuant to. or in a manner resulting in a settlement agreement between the parties, the maximum

cash settlement that Deputy Superintendent may receive shall be an amount equal to the monthly

salary multiplied by the number of months. left on the unexpired term of this Agreement.

However, if the unexpired term exceeds eighteen (18) months, the maximum cash settlement

shall not exceed the monthly salary multiplied by eighte~n (18).

If a settlement agreement provides to Deputy Superintendent any consideration other than

the cash benefits described above, the cash value of such consideration shall be computed and

deducted from the cash settlement prior to any payment the:reof.

The provisions of this. section on "settlement agreement" shall remain effective in this

Agreement only so long as the provisions contained in Government Code sections 53260-53264

(as enacted in Chapter 962, Stats. of 1992) remain in the law with requirements substantially

similar to those described above. Any subsequent amendments to Government Code sections

53260-53264 shall be deemed to be and are hereby incorporated into this Agreement by this

reference.

In accordance with Government Code section 53243 et seq., any cash settlement related

to Deputy Superintendent's termination paid by the District, any District payments received by

Deputy Superintendent for paid leave with salary pending an investigation, or District funds

provided for Deputy Superintendent's legal criminal defense shall be fully reimbursed to the

District if Deputy Superintendent is convicted of a crime involving an abuse of his office or

position.

XII. APPLICABLE LA W

This Agreement is subject to all applicable laws, policies, rules, and regulations of the

State of California and Modesto City Schools.

The Board of Education approves the Schedule for Board of Education Meetings. On May 19, 2014, the Board approved meeting dates through June 22,2015. Typically, the District brings forward a schedule of Board meetings for the entire school year. BACKGROUND

Modesto City Schools currently has Board Policy 6115, Ceremonies and Observances (Special Days and Events) in place. This policy designates annual holidays/observances when schools will be closed and commemorative ceremonies.

On May 11, 2015, Board Policy (BP) 6115 was submitted to the Board of Education at a first reading with a proposal to change the BP to an Administrative Regulation (AR), to align with CSBA's sample as well as Education Code.

ISSUE

The Board of Education approved the proposed Administrative Regulation, provided the Board Policy also remain with amended language. The Board Policy has been revised and is atta.ched for the Board's review and approval.

In addition, Administrative Regulation 6115 also incorporates patriotic exercises and the procedures for displaying the United States flag. With the revisedBPandnew AR,Board Policy and Administrative Regulation 6115.1, Pledge of Allegiance to the Flag, are no longer

. needed and are proposed for deletion.

RECOMMENDATION

Day of the Teacher

Annually observe the second Wednesday in May to recognize teachers for the demanding and complex role they play in the lives of the children they serve. It arose out oflegislation co-sponsored byCTA and the Association of Mexican American Educators. California has patterned its celebration after the traditional "EI Dia del Maestro" festivities observed in Mexico and other Latin American countries.

Patriotic Exercises

. Each school shall conduct patriotic exercises daily. These patriotic exercises shall consist of the reciting of the Pledge· of Allegiance and may also include instruction that promotes understanding of the concepts of "pledge," "allegiance," "republic," and "indivisible" and understanding of the

.. importance of the pledge as an expression of patriotism, love of country,· and

. pride in the United States. (Education Code 5~720, 52730)

The flag of the United States and the flag of California shall be displayed during business hours at the entrance or on the grounds of every district school and on or near the district office. ISSUE

Annual renewals for computer software licenses and maintenance support services are required for the District to use these applications each year.

PROPOSAL

District staff recommends approval to purchase annual computer software licenses and maintenance support services for 2015-2016 with the following contracted vendors: Pearson Education, Inc., and Schoology, Inc.

BACKGROUND

Modesto City Schools has contracted with Apex Learning since 2013-2014 for online content delivery provider services. The District continues to use Apex Learning because it provides rigorous online content that is aligned to California State Standards, and many of their courses meet the UC a-g student requirements for freshman admission. Apex Learning's software also addresses the needs of the trailing learner through interactive audio visual components which help step the learner through activities and exercises entirely within the courseware. These features exceed the requirements of AB 347.

Apex Learning provides engaging, standards-based online curriculum for use in credit recovery and remediation programs, which includes skills-based instruction and critical

.thiriking strategies necessary for success on the CAHSEE. Apex Learning'scOursework satisfies the State statute requirements for district services to be provided to students, as well as meeting college admissions standards .

Apex Learning's current contract for services expires on June 30, 2015; the 2015-2016 agreement will exceed the $10,000 threshold and a services agreement is required.

1. Full access to the Apex Learning Comprehensive Course Catalog for 2,500 students on a subscription basis. Under this agreement, these subscriptions may be re-used once a student completes or withdraws from a course within a 12 month period.

2. Apex Learning will host and support the delivery of its online content.

3. Apex Learning will provide two (2) days of on-site professional development which includes teacher mentoring and coaching.

4. Apex Learning will provide technical and customer support related to their services.

5. Apex Learning will provide a customer service representative to assist teachers and staff with the administrative functions of their system.

Purchases are required for various supplies, commodities or services during the course of each year.

ISSUE:

Existing contracts are in place for purchases of certain supplies, commodities or services for the next fiscal year. Authorization is needed to extend the purchases from these contractors for the 2015-16 fiscal year.

PROPOSAL:

Cooperative bids and initial contract awards have already been obtained for various commodities with the vendors listed on the attached .. These contracts are cooperative, or "piggy-backable," to achieve greater cost savings and allow for multiple public agency use. When these contracts were originally awarded and approved, terms allowed for contract extension for-additional one-year periods: Prices may be renegotiated at the time of contract

FISCAL IMPACT:

Approximate annual expenditures are as noted on the attached with an estimated total of $11,850,000 for the 2015-16 school year. On January 20,2015, the Board approved the District Security Team Proposal. The proposal included hiring School Security Officers, "each utilizing a squad car to patrol the school perimeter, surrounding areas, school parks, bus loading zones, junior highs, and to respond to other student safety issues before and after school."

ISSUE

The cost to purchase eight (8) squad cars exceeds the current bid threshold of $86,000. Competitive bids must be sought or identified to meet formal bid requirements.

PROPOSAL

On April 2, 2013; the City of Sacramento awarded Bid #B13131311025to Downtown Ford for the purchase of police vehicles. The contract term was for three (3) years. The City of Sacramento's bid contains cooperative purchase language thai allows for other agencies to utilize it as required by provision 20118 of the Public Contract Code. It is staffs determ:ination that we would derive inorebenefit by utilizing this cooperative bid contract than to seek separate bids;

FISCAL IMPACT .

The total cost of $265,390.36 willcome from the General Fund.

BACKGROUND

Districts are required to provide all services to students with special needs to allow access to education, including transportation. Transportation services are required under the various California Codes and legislative bodies including but not limited to the Education Code, the State Board of Education, the Vehicle Code, Federal Regulations and the California Administrative Code.

The District currently is partnered with Stanislaus County Special Education Local Plan Area (SELPA) on a transportation contract to provide home-to-school transportation for our Special Education students. This agreement will expire on June 30, 2015. Staffhas determined that it would be in the best interest of the District to contract directly with a transportation company to provide this service.

PROPOSAL

. Specifications were developed and formal proposals were sent to three potential providers,· . and advertised as required by law. In response to RFP No. 15-4600, the District received only one response, from Storer Transportation Service, Inc. Staff has evaluated the proposal response, and determined that Storer Transportation can adequately perform the services as specified in the RFP. The RFP specified a 5-year contract term. The contract will begin on July 1, 2015, and end June 30, 2020.

FISCAL IMPACT

The estimated annual cost for Home-to-School Special Education Transportation is $3.5 million and is budgeted in Special Education.

BACKGROUND

The District's Passport to Literature Lists, Grades 7 through 12, contain literature approved as (1) core works which all students are required to read and study in their language arts classes, (2) extended literature selections from which teachers select works appropriate for particular course studies, and (3) recreational literature selections recommended for independent reading for grades 7-8.

ISSUE

English department chairs meet annually with the English-LanguageArts Coordinators to review and revise the core works and extended literature lists based on recommendations from language arts teachers. This year the committee made changes to the extended works for Grades 7-8 and Grades 9-12 which will require an annotation and notification of parents' rights to request an alternate assignment.

1. In 1994, Modesto City Schools contracted to bring specially-trained, non-aggressive, contraband detection canines onto the District's 7-12 campuses. The program was eliminated in 2009 due to budget cuts and reinstated in 2013 ..

2. The intent of this effort is to provide a cost-effective deterrent to minimize the presence of controlled and illicit substances found on campus.

3. During unannounced inspections, trained canines sniff out controlled substances (illicit drugs, alcoholic beverages, and black gunpowder-based items).

ISSUE . .

PROPOSAL

.1. It is the District's responsibility to provide a safe and drug-free environment in order for students to gain maximum benefit from the educational program.

2. Kontraband Interdiction Detection Services, Inc., will provide 54 full-day visits from August 1, 2015, to June 30,2016, at a cost of $332 per visit, per team. The District will be invoiced monthly, not to exceed an annual cost of $17,928.

3. Campus common areas, lockers, automobiles, vacant classrooms, and grounds shall be subject to inspection at Modesto City Schools' discretion. Kontraband Interdiction Detection Services, Inc., policy and procedures prohibits the use of detection canines to "sniff' individuals under any and all circumstances.

SUBJECT: Approval of Services Agreement between Modesto City Schools and the Modesto Police Department for the 2015-16 School Year

BACKGROUND

June 1, 2015

The Modesto Police Department provides direct law enforcement services to school administrators in order to maintain safe and secure campuses during sporting and other special events. The presence of police officers is preventative in nature and increases the safety of students, faculty, and the public. High school principals have specifically·· requested the presence of police officers to provide security for home football and powderpuff games. The Board has also requested the. presence of a police officer at Board meetings.

ISSUE

Campuses must be safe and orderly. Two Modesto Police Department officers will provide direct law enforcement services and assist with security, supervision, and crowd control at Modesto City .Schools' football/powderpuff games held at Downey High School, Johansen High School, and Modesto Junior College Football Stadiums. The Stanislaus County Sheriffs Department will provide security at footballJpowderpuffgames held at Gregori High School·under a separate contract. . .. .

The presence of a police officer at Modesto City Schools Board meetings will increase security for·Board members, staff, and the public who attend these public meetings.

PROPOSAL .

Modesto Police Department will provide two (2) Police Officers at home football/powderpuff games (Downey High, Johansen High, and Modesto Junior College Football Stadiums) and one (1) Police Officer at Modesto City Schools' Board Meetings.

FISCAL IMPACT

The contracted amount with Modesto Police Department will not exceed $27,000. This amount includes $22,000 for football/powderpuff games to be funded from Risk Management Property and Liability Insurance and $5,000 for Board meetings funded from the General Fund.

SUBJECT: Approval of the Agreement with ASPIRAnet Behavioral Health to Provide Risk Assessment Procedures for Modesto City Schools' K-12 Students for the 2015-2016 School Year

BACKGROUND

In 1999, Modesto City Schools formed a partnership with Stanislaus County Behavioral Health and Recovery Services and since 2008 with ASPIRAnet Behavioral Health to develop and implement Risk Assessment Procedures. Risk Assessors are Marriage and Family Therapists (MFT) or Clinical Social Workers (LCSW)·specially trained to evaluate students who threaten to do physical harm to themselves or others, develop a written or verbal "hit list" of students they want to harm or kill, develop a written or verbal plan to commit harm to themselves or others, or cause concern for the potential risk of violence.

ISSUE

In order to continue to provide risk evaluation services, the ASPIRAnet Behavioral Health contract must be renewed for the 2015-16 school year.

PROPOSAL

Students need to be safe from self harm or harm from others to ensure safe and orderly campuses .. Risk Evaluators evaluate students who pose a threat to harm themselves, other students;or staff. When a student who poses a threat to himself or others is identified, the site administrator contacts District office staff who screens the student for referral to specially-trained ASPIRAnet Behavioral Health Risk Evaluators.

Risk Evaluators interview the student to determine whether they are in immediate danger of harming themselves or others. If the student is in immediate danger, the site administrator contacts the Modesto Police Department, parent/guardian, or 911 to transport the student to Doctors Medical Center - Emergency Room. Students who are not in immediate danger are referred to appropriate support services in the county or at the school.

FISCAL IMPACT

The California Interscholastic Federation (CIF) is the ruling body for high school competitive athletics. All Modesto City Schools' high schools are member schools in the CIF and compete athletically in the Modesto Metropolitan Conference. Each local school district must designate school representatives to the athletic league in which it participates to maintain all voting privileges.

ISSUE

Article 2, Section 25, of the California Interscholastic Federation Constitution requires that each local school district Board of Education ratify to the appropriate CIF section office the appointment of individuals who will be school representatives tothe athletic league for the following year.

With the continued move to Common Core State Standards coupled with revised funding formulas and increased accountability, Modesto City Schools is facing a wealth of curricular and fiscal changes all requiring the need for prompt adaption to those changes. The collection of data is ongoing and prevalent throughout Educational Services programs; however, the interpretation of the data for the purpose of deducing program efficacy and appropriate use of public funding is essential.

ISSUE

. A consistent process for the evaluation of programs within Modesto City Schools is essential to establishing long-term gains, analyzing cost effectiveness, and ultimately resulting in meaningful changes to instruction.

PROPOSAL

Hanover Research is a global information· services fum providing knowledge support to assess data-derived iriformation. Modesto City Schools will continue to contract with Hanover Research to provide evaluation/assessment of current programs. The contract

. includes the authority of Modesto City Schools to request research on any program/topic it sees relevant to educational programs/processes. Areas of research for our District have inch,lded to date Read .180, AVID, national benchmarking, best practices, and analysis of currently existing survey data. The contract will run for thirty, three (33) months, commencing on September 30,2015 and concluding on June 30,2018 with annual invoicing each year (September 30, 2015, June 30, 2016, and June 30, 2017).

FISCAL IMPACT

K-6 schools participated in the Traveling Teacher and Tours Programs through the Great Valley MuseumlModesto Junior College during the 2014-15 school year. The programs presented to students included, but were not limited to, Atoms and Molecules, Flower Dissection, Animal Adventures, Rainforest, Science or Magic, Oceans, Squid Dissection, Rocks N Minerals, Owl Pellets, and Dinosaurs.

ISSUE

All services to anyone vendor exceeding $10,000 must be approved by the Board of Education.

FISCAL IMPACT

The consultant services for the Traveling Teacher and Tours Program through the Great Valley Museum will total $18,000, exceeding the $10,000 threshold. These services were not included in previously approved services with Modesto Junior College totaling $33,000. Thefunding sources have been identified as After School Education and Safety Grant, Associated Student Body, and Local Control Funding Formula (LCAP 2.l.c and LCAP 3.2.c).

RECOMMENDATION

SUBJECT: Ratification of Amendment of Services Agreement Contract with Scholastic, Inc., 2014-2015

BACKGROUND

Modesto City Schools continues its transition to Common Core Standards through professional development that incorporates collaboration, coaching, and strategic instructional practices.

ISSUE

The District will provide professional development to support teachers in the instructional shift to Common Core. Scholastic, Inc., will provide our District with professional development programs and services during 2014-2015 school year in the form of implementation trainings and online staff surveys and data reporting.

On August 18, 2014, the Board approved a services agreement with Scholastic rnc., in the amount not to exceed $89,696.00. The amount will need to be increased by $2,299.00 to include the cost of additional program implementation training. These costs will be incurred for the 2014~2015 school year.

FISCAL IMPACT .. . . .. .

The contracted amount for Scholastic, Inc., will not exceed $91,995.00.· The increase of $2,299.00 for. the program implementation training will be funded by Title II.

RECOMMENDATION

BACKGROUND

K-6 schools contracted with California State University, Stanislaus to train and support students in grades 4,5, and 6 in improving their math performance during the 2014-2015 school year. These contracted services included tutoring, math camp, and professional development for teachers.

ISSUE

All services to anyone vendor exceeding $10,000 must be approved by the Board of Education.

FISCAL IMPACT

·Additional services provided to Franklin Elementary School for improving·math performance will total $7,500. These services were not included in previously approved services with California State University, Stanislaus totaling $3,000. The combined services exceed the $10,000 threshold. The funding sources have been identified as Title I arid Economic Impact Aid .

BACKGROUND

Modesto City Schools contracted with Stanislaus County Office of Education staff for a variety of professional development and services during the 2014-15 school year. Included but not limited to, teaching academic language, STEM lessons, integration of math and science lesson studies, monitoring the implementation of Robertson Road's School Improvement Grant (SIG), training and consultation to family child care providers, math-related professional development, and summer school curriculum.

ISSUE

Additional services provided by Stanislaus County Office of Education will exceed the contracted maximum compensation for this vendor.

FISCAL IMPACT

. The additional services provided by Stanislaus County Office of Education for Math workshops, Science Lesson Study Cycles at Franklin, and multiple inservice days with Frank Smith will total $12,950. These services were not included in the previously approved services with Stanislaus

SUBJECT: Approval of Student Teaching Agreement with California State University, Chico

BACKGROUND

Regular Meeting

The District has participated each year in agreements with colleges and universities to provide practice teaching experience to college students enrolled in education curricula.

ISSUE

The District is interested in entering into a student teaching agreement with California State University, Chico to provide practice teaching experience for their students enrolled in education curricula.

PROPOSAL

The District would like to enter into a student teaching agreement with California State University, Chico, effective June 2, 2015 through June 30, 2020. Copies of the agreement will be available for review in the Human Resources Office.

FISCAL IMPACT

There will be no cost to the District.

RECOMMENDATION

It is recommended that the Board of Education approve the student teaching agreement with California State University, Chico.

SUBJECT: Approval of Revised Job Description: June 1,2015 JC# 6002/1607 Yard Duty Supervisor

BACKGROUND

The Human Resources Department is responsible for proposing new job descriptions and maintaining up-to-date job descriptions through revisions, and placing employees appropriately on the respective salary schedules. The proposed job description was approved by the Superintendent's Cabinet and the California School Employees Association.

ISSUE

The Yard Duty Supervisor does not represent a new position. The job description is being revised to add an additional job code to differentiate between the two types of employees that will be hired into the Yard Duty Supervisor position. Specifically, a job code for classified Yard Duty Supervisors needed to be created as they will be paid on the end of month pay schedule and the hourly Yard Duty Supervisors will continue to be paid on a mid-month pay schedule.

PROPOSAL

The attached job description is proposed for the Board's consideration.

FISCAL IMPACT

The Yard Duty Supervisor will be paid at $11.00 per hour on the Classified Hourly Salary Schedule.

RECOMMENDATION

It is recommended that the Board of Education approve the revised job description: JC# 6002/1607 Yard Duty Supervisor.

JC# 6002 (Hourly) YARD DUTY SUPERVISOR

OVERALL RESPONSIBILITY

Under general supervision, supervise and monitor the behavior of students. Responsible for enforcement of the District's Student Conduct Code and individual school rules. Assist in the maintenance of an orderly and safe campus.

SPECIFIC RESPONSIBILITIES

1. Inform students of acceptable school behavior. E

2. Monitor student conduct in and around campus; enforce campus rules and regulations. E

3. Immediately report student injuries to the site administrator or his/her designee, and complete required accident forms. E

4. Intercede in potential problem situations between students; provide assistance to staff in discipline of students, and when necessary, write referrals. E

5. Patrol assigned duty area(s) during assigned hours providing general supervision of students outside of class and inform site principal or his/her designee of problems likely to disrupt the educational process. E

6. Ask students who are out of class during class time to give reason for their absence from class. Direct tardy students to go to appropriate school office. E

7. Escort students to the school administration in cases of serious or repeated violations. E

8. Recognize and report any signs of unusual activities. Intercept non-students who come on campus during school hours and direct them to either report to the office or leave campus. NotifY the site principal or his/her designee immediately if a non-student fails to comply. E

9. Assist in maintaining the safety of duty area(s). Monitor for proper identification and/or direct visitors to the office prior to going to a classroom or any other location on the school grounds. E

10. Report safety hazards and vandalism to administration. E

11. Assist students with various needs related to assigned duty area(s) (i.e., assisting students in cafeteria). E

12. Wear District-designated attire in a presentable manner during assigned work hours. E

Sufficient vision to read small print. Sufficient depth perception to file documents. Sufficient hearing to hear normal and telephone conversations. Ability to speak in an understandable voice and with sufficient volume to be heard at a normal

conversational distance, hand-held radio, and on the telephone. Sufficient dexterity to manipulate small objects, print or write legibly, operate telephone, use computer

keyboard, typewriter and other business machines. Sufficient lower body strength, stamina, and mobility to stand, kneel, walk, stoop, bend, and extend legs

for prolonged periods of time. Sufficient physical ability, strength, mobility, and stamina to climb stairs, and move, lift, push/pull, or

carry objects which may frequently exceed 20 pounds. Sufficient physical ability to sit or stand for prolonged periods of time.
