    To provide the Secretary of Transportation with the flexi-

    bility to transfer certain funds to prevent reduced oper-ations and staffing of the Federal Aviation Administra-

    tion, and for other purposes.

    Be it enacted by the Senate and House of Representa-1

    tives of the United States of America in Congress assembled,2

    SECTION 1. SHORT TITLE.3

    This Act may be cited as the Reducing Flight4

    Delays Act of 2013.5

    SEC. 2. AUTHORIZATION TO TRANSFER CERTAIN FUNDS TO1

    PREVENT REDUCED OPERATIONS AND2

    STAFFING OF THE FEDERAL AVIATION AD-3

    MINISTRATION.4

    (a) IN GENERAL.Notwithstanding division G of the5

    Consolidated and Further Continuing Appropriations Act,6

    2013 (Public Law 1136), any other provision of law, or7

    a sequestration order issued or to be issued by the Presi-8

    dent pursuant to section 251A(7)(A) of the Balanced9

    Budget and Emergency Deficit Control Act of 1985 (210

    U.S.C. 901a(7)(A)), the Secretary of Transportation may11

    transfer during fiscal year 2013 an amount equal to the12

    amount specified in subsection (c) to the appropriations13

    account providing for the operations of the Federal Avia-14

    tion Administration, for any activity or activities funded15

    by that account, from16

    (1) the amount made available for obligation in17

    that fiscal year as discretionary grants-in-aid for air-18

    ports pursuant to section 47117(f) of title 49,19

    United States Code; or20

    (2) any other program or account of the Fed-21

    eral Aviation Administration.22

    (b) AVAILABILITY AND OBLIGATION OF TRANS-23

    FERRED AMOUNTS.An amount transferred under sub-24

    section (a)(1) shall25

    (1) be available immediately for obligation and1

    expenditure as directly appropriated budget author-2

    ity; and3

    (2) be deemed as obligated for grants-in-aid for4

    airports under part B of subtitle VII of title 49,5

    United States Code, for purposes of complying with6

    the limitation on incurring obligations during that7

    fiscal year under the heading GRANTS-IN-AID FOR8

    AIRPORTS under title I of the Transportation,9

    Housing and Urban Development, and Related10

    Agencies Appropriations Act, 2012 (division C of11

    Public Law 11255; 125 Stat. 647), and made ap-12

    plicable to fiscal year 2013 by division F of the Con-13

    solidated and Further Continuing Appropriations14

    Act, 2013 (Public Law 1136).15

    (c) AMOUNT SPECIFIED.The amount specified in16

    this subsection is the amount, not to exceed $253,000,000,17

    that the Secretary of Transportation determines to be nec-18

    essary to prevent reduced operations and staffing of the19

    Federal Aviation Administration during fiscal year 201320

    to ensure a safe and efficient air transportation system.21
