2020 global marine fuel limit sulfur implementation plan

In order to effectively implement the International Maritime Organization's global sulfur

limit regulations for marine fuels from January 1, 2020 (hereinafter referred to as the

Global Sulfur Limits Regulations), the relevant laws and regulations such as the

Regulations on the Prevention and Control of Marine Pollution by Ships in the Law of the

People's Republic of China on Prevention and Control of Air Pollution. This regulation is

formulated by the regulations and the requirements of the International Convention for

the Prevention of Pollution from Ships and the Implementation Plan for the

Implementation of the Air Pollutant Emission Control Area of Ships (Ji Hai Fa [2018] No.

168).

First, the overall requirements

Implementing the Party Central Committee and the State Council on accelerating the

construction of ecological civilization, laying a solid foundation for pollution

prevention and control, and winning the blue-sky defense war, fulfilling the

obligations of China's international conventions, fully considering the actual

development of China's shipping industry, and adhering to environmental standards

without reducing international and domestic standards. Coordinated advancement to

ensure the effective implementation of the global sulfur limit in China, reduce the

emission of marine air pollutants, promote the development of green shipping, and

serve the country's major strategy.

Second, the specific requirements

(1) Requirements for the use, loading of fuel and alternative measures for ships.

1. From January 1, 2020, international vessels entering the waters under the

jurisdiction of the People's Republic of China shall use fuel oil with a sulfur

content not exceeding 0.50% m/m (hereinafter referred to as compliant fuel).

“Fuel” in this plan refers to the oil for combustion that is delivered to the ship

for ship propulsion or operation, including distillate fuel and residual fuel.

2. Since January 1, 2020, international navigation vessels have entered our

domestic river vessels.

In the air pollutant emission control area, fuel oil with a sulfur content not exceeding

0.10% m/m shall be used; since January 1, 2022, if the international navigation vessel

enters the Hainan waters of China's ship air pollutant emission control area, sulfur shall

be used. Fuel with a content not exceeding 0.10% m/m.

3. Since March 1, 2020, international navigation vessels entering the waters under the

jurisdiction of the People's Republic of China shall not be loaded with self-use fuel with

a sulfur content exceeding 0.50% m/m (hereinafter referred to as non-compliant fuel).

4. Where the alternative measures adopted by international navigation vessels meet

the equivalent requirements described in Article 4 of Annex VI of the International

Convention for the Prevention of Pollution by Ships, the requirements of paragraphs 1,

2, and 3 of this paragraph may be waived. The above-mentioned "alternative

measures" refer to measures used by the ship to use any device, equipment or

alternative fuel to achieve the same or better air pollution reduction effect. From

January 1, 2020, ships are not allowed to discharge the open-type exhaust gas

cleaning system washing water in the ship's air pollutant emission control zone of

China.

(2) Requirements for the use and loading of fuel information for ships.

5. From January 1, 2020, if a Chinese nationality international voyage vessel is unable to

obtain compliance fuel and the vessel is used or loaded with non-compliant fuel, the

next port shall be a foreign port and shall report to the maritime authority of the port

of registry immediately and down. The competent authority of Hong Kong submits the

"Report on Compliance Fuel Not Available" (Annex); if the next port is a port of China, it

shall submit a "Report on Compliance Fuel Not Available" to the maritime

administration of the port. A copy of the Compliance Fuel Not Available Report shall be

retained on board for 36 months for inspection. 6. From January 1, 2020, foreign ships sailing on international voyages will not be able

to obtain compliance

If the oil causes the ship to use or load non-compliant fuel, and the next port is a port

of China, it shall submit a “Report on Compliance Fuel Not Available” to the maritime

administration of the port before arriving at the waters under the jurisdiction of China.

7. From January 1, 2020, if the quality of the added fuel found by a Chinese-in-class

international voyage does not comply with the requirements of Article 14 or Article 18

of the Annex VI of the International Convention for the Prevention of Pollution from

Ships, it shall immediately report to the Maritime Administration of the Port of Registry.

Non-compliant fuel information, including fuel refueling ports, fuel supply units, and

fuel test reports.

8. The Maritime Safety Administration of the People's Republic of China regularly

submits to the International Maritime Organization the confirmed ship “Report on

Compliance Fuel Not Available” and the information on non-compliant fuel installed on

ships of Chinese nationality.

(3) Ships carrying non-compliant fuel disposal requirements.

9. From March 1, 2020, if an international voyage ship illegally loads non-compliant fuel

in the waters under its jurisdiction, it shall follow the International Maritime

Organization's Guide to Port State Supervision on Emergency Measures for Non-

Compliant Fuels (MEPC.1/Circ.). 881), measures to unload non-compliant fuel may be

taken, or the non-compliant fuel may be retained on board the ship and provided with

a non-compliant fuel commitment not in the waters under our jurisdiction, with the

consent of the maritime administration in the port.

10. If an international navigation vessel unloads non-compliant fuel oil, it shall

comply with the relevant provisions of the Regulations of the People's Republic

of China on the Prevention and Control of Marine Environmental Prevention and

Control of Ships and Related Working Activities.

The provisions for oil supply and supply operations shall be reported to the maritime

management agency of the operation site, and safety and pollution prevention

measures shall be implemented.

(4) The oil supply unit shall record the case.

11. Before November 30, 2019, the ship bonded fuel supply unit (hereinafter referred

to as the oil supply unit) shall submit information such as the supply capacity and

contact information of the supply of compliant fuel in China's ports to the Maritime

Safety Administration of the People's Republic of China. The Bureau shall uniformly

report to the International Maritime Organization; if the supply capacity and other

information of the oil supply unit changes, the information shall be updated in a timely

manner.

12. The oil supply unit shall submit the filing materials to the maritime administration

institution in accordance with the requirements of the ship oil supply and acceptance

operation unit in the Regulations on the Prevention and Control of Marine

Environmental Protection of Ships and Related Working Activities of the People's

Republic of China and the Guidelines for Maritime Administration Services; The unit

that is engaged in the bonded fuel supply of ships in the river shall report to the

maritime administration.

(5) Supervision and management.

13. The maritime administrative agencies at all levels shall conduct on-site inspections

of ships on international voyages and oil supply units in accordance with the on-site

supervision and management guidelines formulated by the SIPO; for ships that violate

the regulations, the maritime administration shall comply with the “Air Pollution of the

People’s Republic of China”. The relevant laws and regulations such as the Prevention

and Control Law and the requirements of this program shall be dealt with; if the fuel

supplied by the oil supply unit exceeds the standard, the relevant competent

authorities may be notified and the regulatory information shall be disclosed to the

public on a regular basis.

14. The maritime administrative agencies at all levels may adopt the method of

sampling and testing of marine fuel.

Supervised and inspected and in accordance with the International Maritime

Organization's Notice of Advance Implementation of the Fuel Sample

Verification Procedure in MARPOL Annex VI (MEPC.1/Circ.882) and subsequent

15. The maritime administrative agencies at all levels shall examine the completeness

and authenticity of the “Report on Compliance Fuel Not Available” submitted by the

ship. If the review considers that the compliance is met, the maritime administration

shall not penalize the ship and follow this plan. If it is considered that the examination

is inconsistent, the maritime administration shall handle it in accordance with the

requirements of this plan.

(1) Raise awareness and conscientiously implement it. All shipping units should fully

understand the current grim situation of air pollution control at home and abroad,

prepare in advance for the implementation of the global sulfur limit, implement the

requirements of this program, implement the main responsibility of the enterprise, and

ensure the implementation of the new regulations. All oil supply units must actively

obtain fuel resources to ensure the supply of low-sulfur marine fuel in China's ports.

(2) Strengthen supervision and pay attention to services. The Maritime Safety

Administration of the People's Republic of China will establish a national unified ship

fuel reporting information system before the implementation of the global sulfur limit.

The maritime administrative agencies at all levels shall strengthen the supervision and

inspection of ships and oil supply units that arrive in Hong Kong. In implementing this

plan, we must fully consider the safety issues and avoid undue delays to the ships; we

must implement the 13 departments such as the Ministry of Transport. Guidance on

Strengthening the Supply and Support of Low-Sulphur Fuel for Marines, and

Establishing an Inter-Departmental Information Notification Mechanism,

(3) Strengthen publicity and strengthen guidance. All units should make full use of the

traditional media and new media to publicize the purpose and specific requirements of

the implementation of the global sulfur limit, and increase the exchange of experience

Note:

1. This document is the Chinese translation of Appendix 1 of the 2019 MARPOL Annex VI

Guidelines for the Uniform Implementation of the 0.50% m/m Sulfur Content Limit. In case of

dispute, the English version shall prevail.

2. According to Article 18.2.4 of MARPOL Annex VI, the “Report on Compliance Fuel Not

Available” (hereinafter referred to as “this report”) shall be sent to the competent authority of

the flag State and the port of destination authority. Once the ship/operator determines that it is

unable to obtain compliant fuel, it must send this report as far as possible before leaving the

port/terminal where the compliant fuel is not available. A copy of this report should be kept on

board for 36 months for inspection purposes.

3. If the ship is unable to obtain fuel in accordance with the provisions of Article 14.1 or 14.4 of

MARPOL Annex VI, this report should be submitted for certification.

4. Before completing this report, the ship/operator should pay attention to the following matters:

4.1 This report does not represent an exemption. According to Article 18.2 of MARPOL

Annex VI, it is the responsibility of the port of destination party to review the information

provided through its competent authority and take appropriate action.

4.2 In the event of inadequate and/or repeated applications, Parties may request additional

documentation and evidence proving that fuel is not available. Ships/operators may also be

subject to more detailed inspection or review during their stay in Hong Kong.

4.3 The ship/operator shall consider the logistics conditions and related policies of the

terminal and port when planning to install fuel, including but not limited to the replacement

of berths or anchors in ports or terminals for the purpose of obtaining compliant fuel.

4.4 The ship/operator should be prepared as reasonably as possible, including but not

limited to the different types of lubricants required for fuels of different viscosities and

sulphur content, as well as heating and other treatment equipment, so that the ship can use

compliant fuel.

2020 年全球船用燃油限硫令实施方案

为有效实施国际海事组织 2020 年 1 月 1 日起全球船用燃油

限硫规定(以下简称全球限硫令),根据《中华人民共和国大气

污染防治法》《防治船舶污染海洋环境管理条例》等有关法律法

规和我国缔结的《国际防止船舶造成污染公约》以及《船舶大气

污染物排放控制区实施方案》(交海发〔2018〕168 号)的要

求,制定本实施方案。

一、总体要求

贯彻落实党中央、国务院关于加快推进生态文明建设、打好

污染防治攻坚战和打赢蓝天保卫战的部署,履行我国缔结的国际

公约义务,充分考虑我国航运发展实际,坚持环保标准不降低、

国际国内协同推进,保障全球限硫令在我国有效实施,减少船舶

大气污染物排放,促进绿色航运发展,服务国家重大战略。

二、具体要求

(一)船舶使用、装载燃油和替代措施要求。

1.自 2020 年 1 月 1 日起,国际航行船舶进入中华人民共和

国管辖水域应当使用硫含量不超过 0.50% m/m 的燃油(以下简

称合规燃油)。本方案中的“燃油”,系指为了船舶推进或操作

而交付船上的用于燃烧的油类,包括馏分型燃油和残渣型燃油。

2.自 2020 年 1 月 1 日起,国际航行船舶进入我国内河船舶

大气污染物排放控制区的,应当使用硫含量不超过 0.10%

m/m 的燃油;自 2022 年 1 月 1 日起,国际航行船舶进入我国船

舶大气污染物排放控制区海南水域的,应当使用硫含量不超过

0.10% m/m 的燃油。

3.自 2020 年 3 月 1 日起,国际航行船舶进入中华人民共和

国管辖水域,不得装载硫含量超过 0.50% m/m 的自用燃油(以

下简称不合规燃油)。

4.国际航行船舶采用的替代措施满足《国际防止船舶造成污

染公约》附则 VI 第 4 条所述等效要求的,可以免除本款第 1、

2、3 项的要求。上述“替代措施”系指船舶使用任何装置、设备

或者替代燃料,使船舶取得与规定相同或者更好的大气污染减排

效果的措施。自 2020 年 1 月 1 日起,船舶不得在我国船舶大气

污染物排放控制区内排放开式废气清洗系统洗涤水。

(二)船舶使用和装载燃油信息报送要求。

5.2020 年 1 月 1 日起,中国籍国际航行船舶无法获取合规燃

油导致船舶使用或者装载不合规燃油的,下一港为国外港口的,

应当立即向船籍港海事管理机构报告,并向下一港主管机关提交

《合规燃油不可获得报告》(附件);下一港为我国港口的,应

当向该港口的海事管理机构提交《合规燃油不可获得报告》。

《合规燃油不可获得报告》副本应当在船保留 36 个月以备检

查。

6.2020 年 1 月 1 日起,外国籍国际航行船舶无法获取合规燃

油导致船舶使用或装载不合规燃油,下一港为我国港口的,

应当在到达我国管辖水域前向该港口的海事管理机构提交《合规

燃油不可获得报告》。

7.2020 年 1 月 1 日起,中国籍国际航行船舶发现加装燃油的

品质不符合《国际防止船舶造成污染公约》附则 VI 第 14 条或第

18 条要求的,应当立即向船籍港海事管理机构报告不合规燃油信

息,包括燃油加装港口、燃油供给单位和燃油检测报告等相关信

息。

8.中华人民共和国海事局定期向国际海事组织报送经确认的

船舶《合规燃油不可获得报告》和中国籍国际航行船舶加装的不

合规燃油信息。

(三)船舶装载不合规燃油处置要求。

9.2020 年 3 月 1 日起,国际航行船舶在我国管辖水域违规装

载不合规燃油的,应按照国际海事组织《关于解决不合规燃油紧

急措施的港口国监督指南》(MEPC.1/Circ.881),可采取卸载

不合规燃油的措施,或者经所在港的海事管理机构同意,将不合

规燃油留存船上并提供不在我国管辖水域使用不合规燃油承诺

书。

10.国际航行船舶卸载不合规燃油的,应当按照《中华人民共

和国船舶及其有关作业活动污染海洋环境防治管理规定》《中华

人民共和国防治船舶污染内河水域环境管理规定》中有关船舶

油料供受作业的规定,向作业地海事管理机构报告,并落实

安全与防污染措施。

(四)供油单位备案。

11.2019 年 11 月 30 日前,船舶保税燃油供给单位(以下简

称供油单位)应当将在我国港口供应合规燃油的供应能力和联系

方式等信息报送至中华人民共和国海事局,由中华人民共和国海

事局统一报国际海事组织;供油单位的供应能力和其他信息有变

化的,应当及时更新信息。

12.供油单位应当按照《中华人民共和国船舶及其有关作业活

动污染海洋环境防治管理规定》和《海事政务服务指南》中的船

舶油料供受作业单位备案要求,向海事管理机构提交备案材料;

拟在内河从事船舶保税燃油供给单位应向海事管理机构报告。

(五)监督管理。

13.各级海事管理机构应当按照我局制定的现场监督管理指南

对国际航行船舶和供油单位的供油船开展现场检查;对于违反规

定的船舶,海事管理机构应当按照《中华人民共和国大气污染防

治法》等有关法律法规和本方案的要求予以处理;对于供油单位

所供应的燃油超标的,可通报有关主管部门并定期向社会公开监

管信息。

14.各级海事管理机构可采取船用燃油取样化验的方式开展

监督检查,并按照国际海事组织《提前实施 MARPOL 附则

VI 中燃油样品验证程序的通知》(MEPC.1/Circ.882)及随后生

15.各级海事管理机构对船舶提交的《合规燃油不可获得报

告》的完整性和真实性可视情进行审查,经审查认为符合的,海

经审查认为不符的,海事管理机构应当按照本方案要求予以处

理。

三、保障措施

(一)提高认识,认真落实。各航运单位要充分认识当前国

内外船舶大气污染防治的严峻形势,提前做好全球限硫令实施前

的准备工作,认真执行本方案的各项要求,落实企业主体责任,

国港口低硫船用燃油供应能力。

(二)加强监管,注重服务。中华人民共和国海事局将在全

球限硫令实施前建立全国统一的船舶燃油报告信息系统。各级海

事管理机构要加强对到港国际航行船舶以及供油单位的监督检

查,在实施本方案时要充分考虑安全问题,避免对船舶造成不当

延误;要落实《交通运输部等十三个部门关于加强船用低硫燃油

供应保障和联合监管的指导意见》,建立部门间信息通报机制,

合规燃油不可获得报告

(样本)

注意:

1.该文件为《2019年 MARPOL附则 VI 0.50% m/m硫含量限值的

统一实施导则》附录 1的中译本,若遇争议,以英文版为准。

2.根据 MARPOL附则 VI第 18.2.4条的规定,《合规燃油不可获得

报告》(以下简称“本报告”)应发送给船旗国主管机关和目的港

当局。船方/经营人一旦确定无法获得合规燃油,须尽可能在离开

无法获得合规燃油的港口/码头之前发送本报告。本报告的副本应

在船保留 36个月以备检查之需。

3.如果船舶无法获得符合 MARPOL附则 VI中第 14.1或 14.4规定

的燃油,则应提交本报告用以证明。

4.在填写本报告之前,船方/经营人应当注意以下事项:

4.1 本报告不代表免除。根据 MARPOL附则 VI第 18.2条规定,目

的港相关方有责任通过其主管当局审查提供的资料,并采取适当

行动。

4.2 如果出现不充分和/或重复申请,缔约方可要求提供更多证明

燃油不可获得的文件和证据。船方/经营人在港期间也可能受到更

详细地检查或审查。

4.3 船方/经营人在计划加装燃油时,应考虑码头、港口的物流条

件及相关政策,包括但不限于为了获得合规燃油在港口或码头内

更换泊位或者锚位。

4.4 船方/经营人应尽可能合理地准备,包括但不限于规定内不同

粘度和不同硫含量的燃油所需的不同类型润滑油,以及加热和其

他处理设备,以便船舶能够使用合规燃油。
