EXECUTIVE SUMMARY

The second six months of the Annual Work Plan 2 (1st November 2014 to 30th April 2015), which this reporting period covers, have been highly demanding for the ARISE team and counterparts. Excellent progress has been made both in term of activities initiated and results achieved.

Sectoral Bodies, ASEAN Member States (AMS) and ASEAN Secretariat have regularly been informed of the progress of ARISE and most recently, all have received presentations on the latest progress in conjunction with the planning for AWP3.

Thirty-two activities for 24 sub-projects were designed for implementation during the second Annual Work Programme (AWP 2) of ARISE, across all three Components. By the end of the AWP 2, 20 Activities were completed with 6 still ongoing. One sub-project has been cancelled as its activities have been taken on-board by another development partner after consultation with ARISE.

ARISE has organised and held 14 workshops during the reporting period. Of these workshops, 2 had a specific CLMV focus. The total number of participants for all events was 616, of which 108 were from CLMV. To date a total of 1541 participants have been supported since project inception.

The internal monitoring system on effectiveness shows an average rating of 5.7 out of possible maximum of 7 for all events held by ARISE, showing consistently good results.

Visibility levels for ARISE have increased significantly over the period of AWP 2 with 26 news stories reported on ASEAN News and 23 contributions made to the EU’s Internal Newsletter. Over 3,000 ARISE leaflets have been distributed by the Project, and visits to the Website are on the increase after a slow start. In addition over 850 leaflets that were produced specifically for the ASEAN Customs Transit System have been distributed to date.

Coordination with other donor agencies continues to be highly effective, with ARISE working with the World Bank and USAID on the creation of National Trade Repositories in Myanmar and the Philippines. In the Food Sector, good cooperation with DG SANTE has contributed to the establishment of the ASEAN Risk Assessment Centre in Malaysia, and discussions have been launched with FAO to ensure complimentary activities in the area of the ASEAN Food Safety Regulatory Framework. DG TAXUD will share its knowledge and experience in the context of the ongoing development of ASEAN Customs Transit System (ACTS) software. Collaboration with the Asian Development Bank (ADB), under their new Trade and Transport Facilitation project, continues on the preparation of the Cambodia, Lao PDR, Myanmar and Viet Nam (CLMV) for the rollout phase of the ACTS.

Results

Shown below is a summary of the results achieved under this reporting period. The results are shown at the component level, with further detail being provided in Section 3, where each of the planned sub-projects and associated activities are reviewed in terms of status and results.

COMPONENT 1: Overall ASEAN Economic Integration Process Management Strengthened

As part of the EU/ASEAN Dialogue on Connectivity, ARISE co-sponsored with Economic Research Institute for ASEAN and East Asia (ERIA), a high level Public Private Partnership (PPP) Networking Forum in the Philippines bringing together PPP practitioners from AMS for the first time. EU/ASEAN policy dialogue on connectivity was enhanced and formalised.

Training was provided to Cambodia and Malaysia on ASEAN Trade Repository/National Trade Repository (ATR/NTR) architecture and structures, Non-Tariff Measures (NTM) identification, classification and notification procedures, including for purposes of compiling the NTM database. The IT design of the ATR interface was completed and tested with a number of simulations conducted with the active participation of all AMSs, which largely endorsed the mechanism.

Initial work was conducted to revamp the SOLVIT-like online facility for the ASEAN Consultations on Trade and Investment (ACT), as requested by ASEAN. The tools aims at facilitating cross border trade dispute settlement. ASEAN Secretariat intends to formally launch it at the ASEAN Summit of November 2015 together with the ATR.

Contributions were made on selected Priority integration sectors for the ASEAN

Integration Report and a Concept Paper on the Enhanced Compliance Monitoring Tool prepared for ASEAN Integration Monitoring Office (AIMO). Revised Draft Taxonomy of Sector Indicators was also prepared in collaboration with AIMO

Second annual project monitoring report was produced and submitted with 5th Progress report. This includes reviewed and refined intermediate outcomes at the sub-project Level. Baselines prepared for selected aspects of Component 2.

Ongoing liaison with other dialogues partners on their monitoring of integration in particular with Ad hoc support to ASEAN Secretariat’s Strategic Planning and Coordination Division (SPCD) in their development of a project management system for ASEC.

COMPONENT 2: Progress in Achieving the Free Flow of Goods Within ASEAN

CUSTOMS AND TRANSPORT

To support the implementation of Protocol 3 of the ASEAN Framework Agreement on the Facilitation of Goods in Transit (AFAFGIT), namely ‘Type and Quantity of Road Vehicles’ a standard cross-border vehicle windscreen sticker to complement the cross-border permit has been developed, and is under review by the Transport Facilitation Working Group.

In preparation for the Implementation of Protocol 4 of AFAFGIT – Technical Requirements

of Vehicles, ARISE has made recommendations on the nature of the documents to be carried on cross-border goods vehicles this includes vehicle inspection certificates, registration certificate, Insurance certificate, transport accompanying document, Commercial document( packing list), carriers license, and cross border permit.

The latest version of the Cross Border Transport for Passengers agreement has been simplified following proposals made by the ARISE expert and prepared for final review by ASEAN Member States. Signature by ASEAN Member States of the final agreement is expected to take place later in 2015 at the ASEAN Transport Ministers Meeting.

In support for the implementation of Protocol 5 (ASEAN Scheme of Compulsory Motor Vehicle Insurance), an ARISE expert is in the process of assessing the current situation and making recommendations for the way forward. The objective is to develop a suitable method for ASEAN Member States to purchase 3rd party vehicle insurance in the country of departure.

In preparation for the implementation of Protocol 7 and its technical annex’s, very good progress has been made on the ACTS system development. The electronic ACTS transit declaration and its related electronic messages at departure, transit and destination, the Transit Accompanying Document (TAD), the Guarantee management, the Authorised Transit Trader handling, and the Enquiry procedures have all been defined and agreed by AMS.

The ACTS Project Management Environment has been established with the following deliverables accepted; Inception Report Project Quality Plan (PQP), Overall Work Plan (OWP). Three initiation meetings have been held with Pilot Countries and the ACTS Implementation Team, and two ACTS Analysis Workshops.

Under the Strategic Plan for Customs Development (SPCD) on Mutual Assistance, a risk management workshop was held for ASEAN Member States. Arising from this workshop a proposal was made by ARISE to the ASEAN Customs Enforcement and Compliance Working Group (CECWG) for ARISE to support the development of standard mutual assistance arrangements.

To support the development of Authorised Economic Operators (AEO) programmes in ASEAN, ARISE ran a workshop in conjunction with the World Customs Organisation. This was followed by a second workshop for the training of AEO trainers for the Customs Authorities of ASEAN Member States.

Risk management: Proposals for further support from ARISE have been made to the ASEAN Customs Enforcement and Compliance Working Group (CECWG) and a formal response is awaited.

Standards and Quality

To supplement the new endorsed ‘Guidelines for the Development of Mutual Recognition Arrangements’, ARISE has compiled 2 explanatory annexes covering terms/definitions and scope. Furthermore an update has been prepared on the “Framework Agreement on Mutual Recognition Arrangements”. Approval will be sought at the next WG 1 (horizontal working group under of ASEAN Coordinating Committee on Standards and Quality) meeting in June 2015.

For Market Surveillance, the decision of ASEAN Coordinating Committee on Standards and Quality (ACCSQ), was that market surveillance should be dealt with within sectoral groups, this will require ARISE to refocus its activities.

The new ‘Guidelines on Accreditation and Conformity Assessment’ have been endorsed by the WG2 and subsequently the ACCSQ.

The proposal to develop the “ASEAN Guidelines for Laboratory Networks” has been endorsed by the ACCSQ. The guidelines were prepared and have been reviewed by WG 2, with the decision to proceed including consultation with other working groups to finalise these.

The guidelines for harmonisation of standards in ASEAN have been further disseminated to the ASEAN Product Working Groups; Rubber Based Product Working Group Prepared Food Product Working group, ASEAN Cosmetics Committee

For the food sector, the 3rd draft of the ASEAN Food Safety Policy circulated to the respective working groups in trade agriculture and health for final review. In preparation of the ASEAN Food Safety Regulatory Framework, the mapping of AMS food safety systems was initiated. Furthermore support was provided to the deliberation for the finalisation of the Mutual Recognition Arrangement for prepared foodstuffs.

A workshop to support the development ASEAN Common Food Control Requirements (ACFCR) on Labelling and Hazard Analysis & Critical Control Points (HACCP) auditing was held . This resulted in drafts being prepared which are now under consideration.

Support was provided for the development of operating procedures for the ASEAN Risk Assessment Centre. These finalised procedures will enable the commencement of operations by ASEAN Risk Assessment Centre (ARAC) during 2015.

Further to the impact assessment of the ASEAN Cosmetics Harmonised Regulatory Scheme (ACHRS), approval for the review and update of the ASEAN Cosmetics Directive was given by ACCSQ. In addition the publication of the summary report of the impact assessment of the ACHRS was initiated.

The evaluation of the Electrical and Electronic Equipment (EEE) Mutual Recognition

Arrangement (MRA) was initiated and the preliminary findings will be presented to the Joint Steering Committee EEE in June 2015

Through a workshop for the Pharmaceutical Product Working Group, the scope, objectives, and contents of a Mutual Recognition Arrangement for Bio-equivalence (BE) Study Reports have been defined. This has resulted in the preparation of a draft MRA.

In support of the CLMV for implementing ASEAN Harmonised Electrical Electronic Equipment Regulatory Regime (AHEEERR) recommendations have been made to Cambodia on draft regulations and the regulations have been approved by the government and submitted to the JSC EEE for acceptance. A workshop for stakeholders’ regulatory authorities and other stakeholders in Myanmar on the March 10-11, 2015 leading to the drafting of a road map for further actions

Preparatory work on the methodology to conduct of the study for Consumer awareness has been completed and a workshop planned for AMS representatives.

COMPONENT 3: Strengthened Capacity of the ASEAN Secretariat to Support AEC

Implementation and Integration

As of the end of April 2015, out of the 10 ARISE-funded positions, 9 have been recruited,

with only the position of Chief Internal Auditor unfilled. The newly-created position of

ACTS Project Manager has already greatly facilitated the advancement of the ACTS,

particularly enhancing the intra-ASEAN Secretariat coordination between Customs and

Transport. Good ongoing relations have been maintained between the ARISE team and

the Grant Project manager.

A more detailed breakdown is provided Section 1, where the resources used are reported at the Sub-Project level, while in Section 2 on the “Overview of Resources” the use of resources is reported at the activity level and aggregated to the total use against the AWP2 budget.

Resource management efficiency for events continues to be assessed with data showing an average cost of 180€/day/participant for the reporting period against a rolling average 210€/day/participant.

Monitoring

The Technical Assistance Team has established a comprehensive internal monitoring system for the project. The monitoring system broadly comprises of three types of monitoring:

Ongoing monitoring of the quality of workshops and study tours, through standard

participant evaluation forms;

Six monthly monitoring on the progress of the planned activities; and

Annual monitoring of the results at the Activity level and the contribution to the

realisation of the intermediate outcome at the Sub-Project level.

Effective workshops

One of the key methods by which ARISE builds capacity and enhances knowledge amongst its key stakeholders is by coordinating and delivering workshops and study tours. To date, there have been 12 such events during the second half of AWP2. The overall participants’ assessments of these events are presented in the table above. Not covered by the assessment was the PPP forum held in Manila in December.

As a general conclusion, a consistently high standard has been maintained across a broad range of topics, stakeholders and AMSs. The technical and organisational arrangements have both been rated highly, giving an overall assessment in the upper ranges of participant satisfaction.

A satisfactory rating would have been on the 3.5 mark and we have achieved an average overall rating of 5.7. Every event has performed above average with some expected variation depending on topic and participants.

Going forward, the ARISE team will continue to review both technical and organisational aspects of such activities, and take any corrective actions that may have been highlighted by participants to enhance the outcomes.

Efficient activities

ARISE is also constantly striving to undertake cost-effective activities that demonstrate our focus on efficient utilisation of resources. Over the entire Project period to date (1st January 2013 to 30th April 2015) there have been 44 events that have been supported financially by the Programme. These include workshops, study tours and promotional events. The average cost per participant per day for the reporting period was €180, while the cumulative average cost per participant per day has reduced to €210.

It is worth noting that costs per head have been consistently decreasing over this period by applying a conservative activity management style. For instance, the Project will run, where possible, national events in AMS’s capitals, thereby lowering travel and per diem costs, as well as hosting a number of events in Jakarta where the Project can leverage on its in-house project administration efficiencies. It is noted that events that require travel by participants to European destinations significantly increase the unit costs.

Activity momentum is on-track

Thirty-two Activities for 24 sub-projects were designed for implementation during the second Annual Work Programme of ARISE, across all three Components. By the end of the AWP, 26 Activities were either completed or still ongoing. One Sub-Project has been cancelled as its activities have been taken on-board by another development partner after consultation with ARISE.

ii) Intermediate Outcomes

The overarching approach adopted by the Project is to seek results. It is also the first of the EU-supported ASEAN Economic Integration projects to have M&E as an integral part of the project architecture, with a designated Key Expert for this area. This has influenced both the approach and mode of engagement of the Project team, with a focus on achieving significant change and positive outcomes through their delivery of outputs.

In this regard the Annual Monitoring Report was prepared and is available as an Annex to this progress report. It tracks progress across the Sub-Projects as well as higher-level macro-economic indicators of ASEAN economic integration. In addition baseline quantitative desk research was conducted on selected aspects of Component 2. The focus was on a) cross-border cargo and passenger movement across the three borders that will constitute the pilot ASEAN Customs Transit System and b) trade performance of the five sectors in which ARISE is offering support to ASEAN quality infrastructure, namely automotive, electrical and electronic, cosmetics, pharmaceutical and prepared food. The findings from the research are presented as an Annex to this progress report.

A further element of the project management and monitoring process has been the engagement with other dialogue partners supporting ASEAN. There are regular formal and informal awareness raising and coordination meetings with the key programmes, particularly those supported by GIZ, Australian Development Cooperation, World Bank, ADB, and USAID.

The Mid-Term Review of ARISE will commence in May 2015 and will be the occasion to reflect on the progress to date and take on board lessons learnt as the project moves into its third and final

annual work programme. The MTR should also be able to contribute to an assessment of the project’s intermediate outcomes. The M&E actions of the project will increasingly be focused on outcomes during its last phase.

Sub Component 0.2 Public Relations and Visibility

The ARISE technical assistance team has ensured that the Project, its stakeholders and activities received a high degree of visibility.

Visibility levels for ARISE have increased significantly over the period of AWP 2 with 26 news stories reported on ASEAN News and 23 contributions made to the EU’s Internal Newsletter. This forms Annex 1 of the report. Over 3,000 ARISE leaflets have been distributed by the Project, and visits to the Website are on the increase after a slow start.

In addition over 850 leaflets that were produced specifically for the ASEAN Customs Transit System have been distributed to date.

ARISE supported the development and publication of the ASEAN “Guidelines for the Development of Mutual Recognition Agreements” This falls under the auspices WG 1 of the ASEAN Consultative Committee on Standards and Quality (ACCSQ). As the guidelines are cross sectoral, ACCSQ has mandated ARISE to disseminate the publication to the different Working Groups. To date, over 350 copies have been distributed.

Sub Component 0.3 Resource Management

During the reporting period, a new activity was requested by ASEC, which was to assist in the streamlining of the ASEAN working groups for Agriculture Forestry and Fisheries. The new activity 1.1.1.3 is being carried out as part of the Post 2015 strategic plan for AMAF. The resources which have been allocated are: 70 Senior Short term expert days, 25 Junior short term expert days and € 18 510 of incidentals. Provide support for high level EU-ASEAN dialogue through exposure of high-level ASEAN policymakers to EU experiences, support the development of ASEAN policies and enhance the capacity of the members of high-level ASEAN committees to discharge their functions in support of the ASEAN integration process, while providing opportunities for increased dialogue, information exchanges, networking and co-operation between ASEAN and the EU.

Summary of Results

As part of the EU/ASEAN Dialogue on Connectivity, ARISE Co-sponsored with ERIA, a high level PPP Networking Forum in the Philippines bringing together PPP practitioners from AMS for the first time. EU/ASEAN policy dialogue on connectivity was enhanced and formalised.

Activity 1.1.1.3 ASEAN Agriculture and Forestry Sector Reorganising Support

Specific Purpose

High-level institutional support in relation to the reorganisation of the ASEAN Agriculture and Forestry Sector and to review the various relevant ASEAN organs, processes and institutions, in order to ensure ASEAN’s centrality within the evolving regional architecture. This is to be achieved by reviewing the relevant ASEAN Economic Community (AEC) subsidiary bodies and the number of their annual meetings in order to propose options for consolidating the various subsidiary bodies across the AEC pillar towards improving the efficiency of their meetings. The particular institutional focus of this activity is the ASEAN Agriculture and Forestry Sector (AMAF). The existing structure and mechanisms under AMAF need to be researched, reviewed, analysed and streamlined in order to support the next stages of ASEAN’s integration efforts beyond 2015.

Project status

The main support so far provided has been devoted to researching and drafting a comprehensive mapping and stock-taking paper on the current AMAF organs and subsidiary bodies (a total of 44 Working Groups, Task Forces and other bodies) and researching and proposing a draft AMAF structure that is efficient and effective to support the implementation of the Vision, Objectives and Goals of the ASEAN Cooperation in Food, Agriculture and Forestry sectors towards 2025. In order to do so, a comparative exercise of relevant international organizations and organizations structures has been conducted. Several meetings with ASEC’s AINRD and with relevant donors (i.e., GIZ) were held. A presentation was made to the Special (ASOF) Technical Meeting on Developing New Strategic Plan of Action (SPA) Forestry for 2016-2025 held in Phnom Penh, Cambodia on 4-5 March 2015.

Summary of Results

Mapping of the current terms of reference (ToRs) functions and practices of the various Working Groups (WGs), Task Forces (TFs) and other institutional bodies (IBs) under AMAF;

Support to other sectorial initiatives related to the process of AMAF streamlining, such as GIZ’s technical assistance in the forestry and agricultural sectors;

EU/ASEAN policy dialogue enhanced and formalised; and

Relations enhanced by flexibly catering to a specific request of the ASEAN Secretariat for high-level institutional support.

Sub-Project 1.1.2 Support to the Implementation of ASEAN Trade in Goods Agreement (ATIGA) Intermediate Outcome:

ATIGA Implementation will be enhanced through the establishment of an ASEAN Trade Repository (ATR) and harmonization of National Trade Repositories (NTR).

Activity 1.1.2.3 Assisting in the development and operationalization of the ATR/NTRs, with particular focus on the notification and transparency of NTMs

Specific Purpose

Support the implementation of the ATIGA, with particular focus on enhanced transparency through the ATR/NTRs system and on the identification, classification and notification of Non-Tariff Measures (NTMs). The strengthening of the institutional arrangements and management of the regional economic integration process will occur through the creation and operationalization of the ATR and the NTRs. The identification, classification and notification of NTMs will assist businesses, traders and governments to deal with such measures, prevent or resolve trade barriers, and foster regional integration.

Project status

Continuing support was provided under the auspices of the ASEAN Coordinating Committee on the Implementation of the ATIGA (CCA). A second batch of Two-Day National Workshops on ATR/NTR/NTMs and Transparency/Notification Procedures under the ATIGA have been successfully held by ARISE in Cambodia and Malaysia, on 20-21 November and 25-26 November, respectively. The workshops aimed at providing technical expertise and support to assist AMSs in their process of NTR development and to provide a better understanding of the substantive structure and outlay that will inform the ATR’s IT interface and the requirements for both hardware and software development, as well as the transparency and notification procedures to be applied in relation to NTMs under the ATIGA. Particular focus was placed on the process of NTM identification and classification in line with the 2012 UNCTAD NTM Classification. The AMSs, which received support, showed strong commitment to comply with the transparency obligations under the ATIGA and very high numbers of participants (i.e., between 50 and 60) attended the workshops with representatives from all relevant ministries and agencies involved in the national Inter-Agency Coordination Committees on ATIGA transparency. Coordination was ensured with relevant donors (i.e., World Bank and USAid). Three more two-day national workshops on ATR/NTR/NTMs have been requested (by Brunei Darussalam, Indonesia and Vietnam) and will tentatively be held between June and July 2015. Request has been made for more intensive and dedicated workshops to be provided on the key issue of NTM identification and classification in light of the 2012 UNCTAD NTM Classification and ATIGA transparency obligations. Five-day intensive workshops will be offered starting in September 2015 and well into 2016 as the NTRs start being connected to the ATR. IT work was conducted to write the software for the ATR interface and simulations were provided to AMSs during a dedicated one-day workshop held in Bangkok, Thailand on 10 April 2015. The AMSs endorsed the new system, which will be formalized before CCA at the meeting of 20-22 May 2015 in Siem Reap, Cambodia. Initial work has also commenced to revamp the SOLVIT-like online facility for the ASEAN Consultations on Trade and Investment (ACT), as requested by ASEAN. The general features of the new online facility, which will be accessible through the ATR, will be presented at to the meeting of the SEOM with Dialogue Partner on 30 May 2015 in Manila, the Philippines.

Activity 1.1.2.3 Assisting in the development and operationalization of the ATR/NTRs, with particular focus on the notification and transparency of NTMs

Summary of results

Presentations were given at all CCA meetings and CCA formally endorsed the proposed ATR architecture and methodological approach to operationalizing the ATR/NTRs system of transparency;

Ad hoc training was provided to 2 more AMSs (i.e., Cambodia and Malaysia) on ATR/NTR architecture and structures, NTM identification, classification and notification procedures, including for purposes of compiling the NTM database;

The IT design of the ATR interface was completed and tested with a number of simulations conducted with the active participation of all AMSs, which largely endorsed the mechanism; and

Initial work was conducted to revamp the SOLVIT-like online facility for the ASEAN Consultations on Trade and Investment (ACT), as requested by ASEAN, with a view to formally launch it at the ASEAN Summit of November 2015 together with the ATR.

Specific Purpose

To assist in and facilitate the strengthening of the ASEAN economic integration process by means of developing an Enhanced AEC Scorecard mechanism that is cost-effective, user-friendly, provides visibility and is timely.

Project status

The Activity Output has been re-defined as supporting the enhancement of a regional integration monitoring system. Work on developing comprehensive ASEAN-specific outcome indicators is ongoing by AIMO with technical support from ARISE. Collaboration with other relevant initiatives, for example the new COMPASS project, has also been initiated in this regard.

A separate process on conceptualising the enhancement ASEAN compliance monitoring mechanism, in the context of post-2015 AEC Vision has been initiated by AIMO, and ARISE is anticipated to be providing technical advice as this moves forward.

ARISE has also contributed to the upcoming flagship ASEAN Integration Report and in particular has provided text on three Priority Integration Sectors, namely Cosmetics, Pharmaceuticals and Electrical and Electronic Equipment as well as being part of the report’s peer review process.

Sub-Project 2.1.1 Implementation of ASEAN Transport Facilitation Agreements

Intermediate Outcome:

Facilitated movement of goods vehicles across ASEAN borders.

Activity 2.1.1.3 Supporting the implementation of protocol 1 of AFAFGIT – Designation of transit routes and facilities

Specific Purpose

To support the implementation of protocol 1 of the ASEAN Framework Agreement on the Facilitation of Goods in Transit (AFAFGIT). This protocol covers the approved transit transport routes and facilities within ASEAN.

Project status

This activity is in progress. Malaysia and Singapore have yet to agree on the designated transport routes under protocol 1 of AFAFGIT. Discussions are on-going, and the issues are reported regularly to meetings of the Transport Facilitation Working Group.

Activity 2.1.1.4 Supporting the Implementation of Protocol 3 of AFAFGIT – Types and Quantity of Road Vehicles

Specific Purpose

To support the implementation of protocol 3 of the ASEAN Framework Agreement on the Facilitation of Goods in Transit (AFAFGIT), namely ‘Type and Quantity of Road Vehicles’. The intention is to facilitate cross-border movement of trucks by the adoption of agreed ASEAN standards for types and quantities of road transport transit vehicles.

Project status

This activity is in progress. Under protocol 3 of AFAFGIT, ASEAN Member States have agreed to allow 500 trucks to be used for transit operations by each Member State. This means that a system must be devised at national level for allocating cross-border permits for transit transport vehicles. This will be the responsibility of the different competent authorities at national level. ARISE efforts have been concentrated on the design of a windscreen sticker which all approved vehicles must carry whilst operating cross-border transport movements in ASEAN.

Summary of results

The design of a standard cross-border vehicle windscreen sticker to complement the cross-border permit has been developed, and is under discussion with ASEAN Member States. The proposed design is at Annex 4 to this report, along with a joint ASEC-ARISE submission at Annex 5 to the Transport Facilitation Working Group in April 2015. Annex 6 gives Malaysia’s proposed Standard Operating Procedures (SOP) and comments from ARISE and ASEC.

Activity 2.2.1.5 Supporting the Implementation Protocol 4 of AFAFGIT – Technical Requirements of Vehicles

Specific Purpose

To support the implementation of protocol 4 of the ASEAN Framework Agreement on the Facilitation of Goods in Transit (AFAFGIT). The objective is to facilitate the cross-border movement of road transit transport vehicles by adopting standard technical specifications among all ASEAN Member States as set out under protocol 4 of AFAFGIT.

Project status

This activity is in progress. ARISE has clarified with ASEAN Member States the documents that will need to be carried, in English, on the cross-border transit transport vehicle. These will be mutually recognised between ASEAN Member States. The documents are:

a) Motor Vehicle Registration Certificate containing the particulars of the vehicle and the owner – mutually recognised; b) Valid Certificate of Inspection – mutually recognised; c) Motor Vehicle Third Party Liability Insurance Cover; d) Consignment Note/Waybill; e) Customs Transit Document for the Goods – ACTS Transit Accompanying Document (TAD) ; and

f) Carrier's Licence – i.e. the Operator’s Licence

Summary of results

Specific Purpose

To enhance the tourism industries of ASEAN countries by developing guidelines and supporting the implementation of the ASEAN Framework Agreement on the Cross-Border Transport of Passengers in relation to: Harmonised traffic rules and regulations;

Standard application of technical rules for approval road vehicles to be used

for the transit transport of passengers;

The development and application of standard vehicle inspection and

certification procedures;

The designation of approved transport routes; and

The designation of approved entry / exit points.

Project status

This activity is in progress. The latest version of the CBTP agreement and ARISE recommendations for the finalisation of the agreement are under consideration by ASEAN Member States.

Summary of results

The CBTP agreement has been simplified following proposals made by the ARISE expert and prepared for final review by ASEAN Member States. Signature by ASEAN Member States of the final agreement expected to take place later in 2015 at a meeting of the ASEAN Transport Ministers. ARISE will provide resources for any additional support required by AMS for the implementation of aspects of this agreement, depending on the outcomes and needs expressed at the TFWG and TTCB meetings.

To assist the implementation by ASEAN Member States of Protocol 5 (ASEAN scheme of compulsory motor vehicle insurance) of the ASEAN Framework Agreement on the Facilitation of Goods in Transit (AFAFGIT).

Project status

This activity is in progress. An ARISE expert is in the process of assessing the current situation and making recommendations for the way forward. The objective is to develop a suitable method for ASEAN Member States to purchase 3rd party vehicle insurance in the country of departure. The immediate objective is to facilitate the purchase of 3rd party insurance for Thailand in Singapore and Malaysia, and purchase in Thailand of insurance for Malaysia and Singapore.

Summary of results

Revised terms of reference have been produced for this activity, as at Annex 8 to this report;

A proposed way forward has been developed and shared with the Council of Insurance Bureau (COB).

Sub-Project 2.2.2 Implementation of Key Aspects of Customs Integration

Activity 2.2.2.3 Support the Implementation of Mutual Assistance (MA) Arrangements in ASEAN

Specific Purpose

To support the development and implementation of a standard regional agreement among ASEAN Customs Authorities on mutual assistance arrangements (MA) that will enhance bilateral and multilateral cooperation between and amongst Customs Authorities.

Project status

This activity is in progress. The plans for enhanced mutual assistance between ASEAN Member States are set out in a Strategic Plan for Customs Development (SPCD), entitled Customs Enforcement and Mutual Assistance, and ARISE has made further proposals to support AMS activities in these plans. The 2012 ASEAN Customs Agreement provides for mutual assistance among ASEAN national Customs authorities. A formal reply from AMS is awaited. Contact has been made with the regional office of the World Customs Organisation (WCO) in order to coordinate these initiatives with their existing arrangements for the exchange and sharing of intelligence information, specifically via Regional Intelligence Liaison Offices (RILO) such as RILO ASIA-Pacific and RILO Western Europe. Other WCO initiatives are Customs Enforcement Networks (CEN), the WCO Model Agreement on Mutual Assistance Agreements, the Nairobi Convention, the Global Information and Intelligence Strategy and the National Information and Intelligence Strategy.

Summary of results

A risk management workshop was held for ASEAN Member States from 23-25 September 2014. Arising from this workshop a proposal was made by ARISE to the ASEAN Customs Enforcement and Compliance Working Group (CECWG) for ARISE to support the development of standard mutual assistance arrangements among ASEAN Member states, specifically: ARISE, ASEC and AMS to conduct a review of AMS/ASEAN legislative provisions, including Customs Mutual Assistance Agreements, to establish whether new legislative provisions are necessary to cover new risk management procedures. This should be in the form of Customs Mutual Assistance Agreements, which should contain provisions for the routine exchange of data (rather than as a result of a specific request or where there is suspicion of an irregularity).

Specific Purpose

To support AMS in the implementation of Authorised Economic Operators (AEO) programme

Project status

This activity is in progress. The overall strategy for ASEAN Customs Authorities in their development of AEO programmes has been set out in a Strategic Plan for Customs Development (SPCD). The lead country is Malaysia. The needs of ASEAN Member States in the development of AEO programmes have been identified by means of a survey administered by Malaysia. The main needs identified are:

Capacity building in implementation of AEO programmes;

The development of arrangement for mutual recognition of AEO programmes between ASEAN Member States;

Training of AEO trainers, specifically in:

• WCO AEO Implementation Guide; • WCO Guidelines for developing mutual recognition agreements; • Process of authorization (validation and verification); • Post authorization audit.

ARISE has made proposals for further support in these areas, as at Annex 11 to this report.

Summary of results

ARISE ran a workshop designed to support the development of AEO programmes in ASEAN, supported by the World Customs Organisation; the workshop programme and concept note is at Annex 12 to this report;

ARISE ran a workshop for the training of AEO trainers within Customs Authorities of ASEAN Member States; the workshop programme is at Annex 13 to this report, and the workshop report is at Annex 14.

Activity 2.3.1.2 Adoption of the Revised ASEAN Policy on Standards & Conformance, and Support its Implementation

Specific Purpose

To assist working group 1 (WG 1) in revising the ASEAN Policy Guideline on Standards and Conformance (APSGC), and assisting in the dissemination and implementation by ACCSQ and its product working groups.

Project status

Following the approval by WG 1 of the final draft the ASEAN Guidelines for Standards, Technical Regulations, and Conformity Assessment Procedures (AG STRACAP) were endorsed by the ACCSQ.

A preliminary review of the ASEAN Framework Agreement on MRAs was undertaken by ARISE for WG 1. ACCSQ has endorsed WG 1 to proceed with its plans to revise this Agreement. A draft of the revised version, that was developed by ARISE, will be deliberated at the next meeting planned for June 2015.

Upon request of WG 1, two additional parts to “Guidelines for the Development of Mutual Recognition Arrangements have been developed. These are guidance on determining the scope of ASEAN MRAs (Annex 17) the development of a set of terminology for MRAs (Annex 18). The drafts will be discussed at the next WG 1 meeting to be held in June 2015.

Summary of results

A new draft developed for the Framework Agreement has been developed for review by WG 1 (Annex 19) upon approval of this work by ACCSQ.

A compilation of terms and definitions for use in ASEAN MRAs has been developed sent to WG 1 for review.

The supplements to the ‘Guidelines for the Development of Mutual Recognition Arrangements’ on determination of the scope of MRAS have been developed for WG 1

Sub-Project 2.3.2 Post Market Surveillance Policy Development Intermediate Outcome:

Common policy for market surveillance in ASEAN that facilitates implementation of harmonised regulatory schemes.

Activity 2.3.2.2 Development of Post Market Surveillance Policy

Specific Purpose

Assistance for the development of a policy for post market surveillance established in ASEAN to support harmonised regulatory regimes established for the ASEAN Economic Community.

Project status

A workshop held in October 2014 for the ASEAN Cosmetics Committee (ACC) included a one day session on market surveillance. This was in response to a decision of the ACCSQ that market surveillance be discussed with regulators in the specific sectors. The results of the workshop and recommendations (Annex 20) were presented to ACC, WG 2 and to ACCSQ. Based on the recommendation of WG 2, ACCSQ has decided not to pursue the development of a generic ASEAN Guideline for Market Surveillance. The recommendation from the workshop for the ACC to develop a guideline market surveillance applicable specifically to the cosmetics sector is awaiting decision of the ACC.

Summary of results

The workshop for the ACC held on Oct 1-2nd 2014 contained several recommendations on the development of Market Surveillance for the cosmetics sector and also for generic guidelines. The decision of ACCSQ, was that market surveillance should be dealt with within sectoral groups. This has made it not possible to continue with ARISE’s proposal for generic guidelines. ARISE experts maintain that there is value in the development of generic guidance as this will provide a basis and for a consistent and more systematic implementation of market surveillance in the harmonised regulatory regimes for the cosmetics, electrical and electronic equipment and other sectors. ARISE will focus to intervene at the sectoral level.

Specific Purpose

The guide on accreditation and conformity assessment provides harmonised requirements to support the implementation of the Sectoral MRAs and the Harmonised Regulatory Regimes that are developed by the Product Working Groups under the ACCSQ.

Project status

The draft ‘Guidelines on Accreditation and Conformity Assessment’ that were developed have been endorsed by the WG2 and subsequently by thee ACCSQ at meeting in April 2015. (Annex 21).

The proposal on the development of ASEAN Guidelines for Laboratory networks has been endorsed by the ACCSQ (Annex 22). The guidelines have been reviewed by WG 2 and decision has been taken to proceed the further consult with other working groups to finalise these.

Work is underway for the development of the harmonised standards database that was proposed in the guidelines. This work entails the development of software and the compilation of the harmonised standards and accompanying information for populating the database.

Activity 2.5.1.5 Development of ASEAN Food Safety Policy Recommendations and Road Map for the Realisation of a Regulatory Framework for Food Safety

Specific Purpose

To assist the Prepared Foodstuffs Product Working Group, the ASEAN Experts Group on Food Safety, and the related working groups under SOM-AMAF to realise the establishment of a Regulatory Framework for Food Safety in ASEAN.

Project status

Work on the formulation of a food safety policy that will support the regional framework for food safety has progressed. A workshop was held in March 23, 2015 in Kuala Lumpur to deliberate on the 2nd draft for the policy that incorporated comments from member states.(Annex 23)

The 3rd draft of the policy has been developed at the workshop. A time line has been established for the endorsement of the policy at the 2015 ASEAN leaders meeting.

A workshop for the development of ASEAN Common Food Control Requirements (ACFCR) and development of new ACFCRs on labelling and for HACCP auditing was conducted in December 2015. This workshop also included a session to deliberate on-going contentious issues that remain in the finalisation of the MRA for prepared foodstuffs.

A workshop was held on the margins of the PFPWG meeting in February 2015 to discuss the development of harmonised requirements for food contact materials in ASEAN.

A workshop was organised for the development of operating procedures for the ASEAN Risk Assessment Centre (ARAC) on March 24-27 2015. This workshop follows the endorsement by SOM-AMAF for the establishment of ARAC in 2014

Work is undergoing on the mapping of ASEAN Member State food safety regulatory profiles by appointed experts.

Summary of results

The 3rd draft of the ASEAN Food Safety Policy developed and circulated.

The workshop in February 2015 resulted in development of draft guidelines for food contact materials for ASEAN (Annex 11RRS).

Specific Purpose

To assist the ASEAN Member States to enhance the implementation of the AHCRS and assist the ASEAN Cosmetics Committee in the coordination and monitoring of the implementation.

Project status

A workshop was organised to inform the AMS of the results of the evaluation and recommendations of the evaluation of the implementation that was undertaken in AWP 1. The recommendations for the follow-up to the evaluation have been explained to the ACC at its meeting in November 2014. The recommended follow-up includes the revision of the ASEAN Cosmetics Directive (ACD), development of a guideline for market surveillance and classifying cosmetics products in risk categories. The ACC has additionally requested for assistance in updating its training modules for Good Manufacturing Practice (GMP).

The updating of the ACD has been endorsed by the ACCSQ and the decisions other recommendations are expected at the next ACC meeting in May 2015.

The ACCSQ has approved the publication of the Summary report of the evaluation of the ACHRS.

Summary of results

A set of recommendations on the implementation of the Cosmetics Directive elaborated to the ACC.

Evaluation of effectiveness and results of the ASEAN Electrical and Electronic Equipment MRA will provide the Joint Sectoral Committee Electrical and Electronic Equipment and ASEAN Members States with feedback on the level of implementation, benefits, and on any on-going difficulties faced by industry and the regulators. It will assist in the development of recommendations for the AHEEERR and for ASEAN market integration in the sector as envisaged in the AEC Blueprint. The results of the EEE MRA evaluation will be available in June 2015 and will be presented to the JSC EEE.

Project status

Two short term specialist experts have been appointed to undertake this work. This activity is on-going and expected to be completed by end June 2015.

Establishing mutual recognition of Bioequivalence Study Reports for the Pharmaceutical Sector which leads to enhanced trade.

Activity 2.5.5.1 Support for the Development of Mutual Recognition Arrangements for the Pharmaceutical Sector

Specific Purpose

To assist the ASEAN Pharmaceutical Products Working Group (PPWG) to support the development of the Mutual Recognition Arrangement for Bio-equivalence (BE) Study Reports. The support will assist in achieving the AEM Key Deliverables 2015, to support the realization of ASEAN Economic Integration.

Project status

A workshop was held for the PPWG on the 20-21 October 2015 deliberated on the scope, objectives, contents an implementation of the MRA. On-going discussions by the PFPWG on the MRA are continuing. The PPWG has requested continued support from ARISE in development of the MRA. Annex 25 contains the Programme and draft MRA that was developed at the workshop.

Activity 2.6.2.3 Assistance in Development of EEE Legislation in CLM and Transposition of AHEERR

Specific Purpose

The activity is implemented with the objective of:

• enhancing the awareness of policy makers, industry representatives and other stakeholders on regulations for electrical and electronic equipment; and

• assisting Lao PDR and Myanmar to develop regulations for Electrical and Electronic Equipment and assisting Cambodia in upgrading its EEE regulations to prepare implementing the ASEAN Harmonised Electrical and Electronic Equipment Regulatory Regime.

Project status

Implementation of the project is ongoing. After the 2 missions to Lao PDR and Cambodia by the expert in the previous period to undertake a study of the requirements and plan the development of recommendations and conducting workshops, the following has been accomplished:

1. The review of the new Electrical Safety Regulations was completed mission for Cambodia. Cambodia has since finalised these and submitted these to the JSC EEE for acceptance as compliant to the AHEEERR. The review and recommendations are in (Annex 26).

2. Following a visit by the short term expert in November 2914, a workshop was held for stakeholders in the Electrical & Electronic sector in Myanmar on March 10-11, 2015 November 2014. This was followed by in-depth discussions with the authorities on the development of regulations on March 12, 2013.

The work on the development of EEE Safety Regulations will continue in AWP III.

Summary of results

Recommendations have been made to Cambodia on draft regulations for implementing AHEEERR.

Cambodia’s new EEE regulations have been approved by the government and submitted to the JSC EEE for acceptance.

A workshop for stakeholders’ and Electrical Safety regulatory authorities held in Myanmar on the March 10-11, 2015.

Specific Purpose

The activity will map the current situation of consumer participation and empowerment in the 10 ASEAN Member States. The target groups of schools have been identified for this stage. The results of the mapping will be utilised for the development of recommendations for enhanced consumer participation in food safety including development of guidelines.

Project status

The work is undertaken to assist the ASEAN Exerts group on Food Safety (AEGFS). The AEGFS has appointed Indonesia to lead this work. The expert ARISE engaged in October 2014 quit and a new expert was appointed to who is working with the Indonesian agency responsible (BPOM) to implement the programme. Questionnaires for the investigation have been developed and the launching workshop has been planned for May 2015.

Summary of results

Preparatory for the conduct of the study has undertaken by the expert and plans have been made for a workshop for AMS representatives to be held in May 2015.
