NASCLA President’s Message I am very pleased to report that NASCLA had a very successful and productive 2010 Mid Year Meeting in Indian Wells, California. The dedication and support from our state, associate and business members was evident with over 40 attendees present, which is the largest NASCLA Mid Year Meeting on record. I would like to share some of our accomplishments and goals that we are working towards for FY 2009/2010.

The NASCLA Board of Directors saw the benefit of holding a training seminar for the Mid Year attendees and decided to continue on the path by holding another training seminar this year complimentary for our meeting attendees. NASCLA held a 1-Day Strategic Planning Seminar

presented by Michael Barrett with Resonance, LLC. The seminar consisted of group discussions, brainstorming and round tables. The training provided attendees with new found knowledge, and set direction for growth and development within their state agencies. The Key Discussion Topics included: Doing More with Less: How Members have and can Manage in these Challenging Times & Managing Successful Relationships with Licensees, Legislators and Consumer Groups.

NASCLA accomplishments for Fiscal Year 2009/2010 include: NASCLA Strategic Plan for 2010, 2011 & 2012; the launch of the NASCLA Accredited Examination Program for Commercial General Building Contractors; NASCLA State Members’ Laws, Rules and Regulations on the NASCLA Website; NASCLA Contractors State Licensing Information Directory, 2010 Edition; NASCLA Recovery Fund Booklet, 2010 Edition; NASCLA State Contractor Licensing Research and Acquiring 5 New Memberships...to name a few.

NASCLA Publications, Inc. (NPI) accomplishments include: The State of Rhode Island Building Code Commission and the International Code Council (ICC) development of (7) new state specific code publications; NPI Strategic Plan for 2010, 2011 & 2012 and the NASCLA Contractors Guide to Business, Law and Project Management, Ohio Construction Industry Licensing Board.

I want to thank my devoted colleagues and our loyal members for all of their time and effort spent at our NASCLA Mid Year Meeting. I especially want to thank the NASCLA Program Committee and Staff for all their hard work in putting together the 3-day conference.

I would also like to commend the NASCLA Committee Chairs and Members for the great accomplishments that we have noted above; this would not have been possible without their participation and support.

I am looking forward to seeing you all at the NASCLA 2010 Annual Conference held in my home state of South Carolina! For more details on the 48th Annual Conference, please reference page 8 and 9 of this newsletter.

NASCLA 2010 Mid Year Meeting Overview The NASCLA 2010 Mid Year Meeting was held on March 10-12, 2010 at the Renaissance Esmeralda Resort and Spa in Indian Wells, California. The meeting was a great success thanks to the hard work and dedication of NASCLA’s Executive Committee, Committee Members and Board of Directors! NASCLA continued on the path of expanding our attendance having over 16 contractor state licensing agencies represented, as well as, NASCLA Associate and Business Members.

The Pre-Conference Meetings began on Tuesday, March 9th, with the NASCLA Model Legislation Committee Meeting. The NASCLA Fiscal Policies and Procedures Committee and the NASCLA Executive Committee also met on Tuesday to discuss NASCLA and NASCLA Publications, Inc. interim business.

On Wednesday, March 10th, NASCLA hosted its second 1-Day Training Seminar. This years’ seminar focused on Strategic Planning which was facilitated by Michael Barrett with Resonance, LLC. The seminar was split into two sections where the first half included all NASCLA Mid Year Meeting attendees. The seminar was filled with group discussions, brainstorming and round tables. The goal of this training seminar was for the attendees to leave with a new found knowledge of setting direction for growth and development within their state agencies, as well as having been provided the tools necessary to create their own Strategic Plan Map.

The second half of the seminar was designed for the NASCLA Publications, Inc. Board Members. The focus of this session was to take the feedback that was provided by the morning seminar attendees and further develop the NASCLA Publications, Inc. Strategic Plan. This was an extremely beneficial session for the growth and development of NASCLA Publications, Inc.

The entire day proved to be truly beneficial for all who attended. Michael Barrett was an excellent top-notch facilitator, but it was the participation and group interaction by the attendees that made the seminar a true success. The seminar was paid for by the association to add benefit and value to all of our attendees.

Thursday, March 11th, was a true working day for all NASCLA Committee Members and others who participated in the six NASCLA Committee Meetings. Some of the key accomplishments from the Committee Meetings included: the NASCLA Accredited Examination Submarketing Program

NASCLA 2010 Mid Year Meeting Overview

Committee for NASCLA’s upcoming meetings in 2010 and 2011. For a full report of accomplishments and projects for each of the NASCLA Committee’s, please see page 4 of this newsletter.

On Thursday afternoon NASCLA was able to bring the California Contractors State License Board and the Nevada State Contractors Board under one forum, where the

boards held a joint Board Meeting. “Our joint meeting was a significant learning

experience and information-sharing opportunity for everyone, and we look forward to having a similar meeting in the future,” California Contractors State License Board Registrar Steve Sands.

Margi Grein, Executive Director for the Nevada State Contractors Board states, “The

opportunity for the neighboring state Boards of California and Nevada to meet in joint session was one of the highlights of the NASCLA mid-year meeting. The meeting afforded the Board Members of each state the ability to share ideas of mutual concern and the benefit of learning about the licensing and enforcement programs each state has developed.” Many of the NASCLA Mid Year attendees had the opportunity to sit in on the Board Meeting. George Whalen, Executive Director of the Rhode Island Contractors’ Registration

and Licensing Board, attended the meeting and said, "It was great to be able to witness

the Nevada Board and the California Board hold a joint Board Meeting in sunny California. It was the first time I have ever seen such an event in my 19 years as a Director of a Board. The open communication facilitated in conjunction with NASCLA can only enhance the construction industry by providing a positive environment of cooperation among states. It was a great learning experience and hope someday our Board, on the other coast, will do the same with our sister states.”

After a long day of meetings, the NASCLA Mid Year attendees, along with the California Contractors State License Board members and the Nevada State Contractors Board members enjoyed an evening reception hosted by the Arbitration Mediation & Conciliation Center (AMCC). AMCC is the sole provider to the California Contractors State License Board (CSLB) Arbitration Program. The NASCLA Executive Committee and Board of Directors would once again like to thank the AMCC for hosting this event. Following the reception all attendees enjoyed an offsite dinner at the Cliffhouse Restaurant in La Quinta, California.

On Friday, March 12th, the NASCLA Mid Year Meeting came to a close with the NASCLA and NASCLA Publications, Inc. Board of Directors Meetings. The NASCLA Committee Chairs reported on their accomplishments and goals to date. The NASCLA Board of Directors discussed the business, financials and special projects that the association has accomplished over the first half of this fiscal year.

NASCLA Committee Meeting Overview NASCLA Accredited Examination Program Committee & Submarketing Committee

▪ The NASCLA Accredited Examination for Commercial General Building Contractors is now available and over 68 people have taken the examination.

▪ The National Examination Database (NED) is up and running on the NASCLA website.

▪ The following states are administering the Accredited Examination: Alabama (September 2009) and South Carolina (April 2010).

▪ The following states are accepting the Accredited Examination: Alabama, Arkansas, North Carolina, South Carolina and Tennessee.

▪ Potential states who have shown interest: Georgia, Louisiana, Mississippi and West Virginia.

▪ NASCLA will be sending Joe Rogers, NASCLA Submarketing Committee Chair, to the West Virginia Contractors Licensing Board Meeting on April 15, 2010 to discuss utilizing the NASCLA Accredited Examination for Commercial General Building Contractors.

NASCLA Education Program Committee

▪ The NASCLA Education Program Committee discussed the development of their strategic plan and developing a state module for pre-licensing and continuing education for contractors.

▪ NASCLA will be a clearinghouse for education and approved education providers for state agencies.

NASCLA Model Legislation Committee

▪ The committee is finalizing the NASCLA Model Legislation for Commercial General Contractors.

▪ The NASCLA Model Legislation for Commercial General Contractors will be ready for the NASCLA 2010 Annual Conference.

▪ The committee will begin working on NASCLA rules & regulations for commercial & residential state contractor licensing agencies.

NASCLA Program Committee

▪ The NASCLA 2010 Annual Conference will be held in Charleston, SC on August 22-25, 2010.

▪ The NASCLA 2011 Mid Year Meeting will be held in Seattle, WA in March 2011.

▪ The NASCLA 2011 Annual Conference will be held in Savannah, GA on August 23-26, 2011.

NASCLA Publications Committee

▪ NASCLA Publications, Inc. will be publishing and selling 7 Rhode Island Building Code Commission books in a joint venture with the International Code Council.

▪ NASCLA Publications, Inc. is now selling the NASCLA Contractors Guide to Business, Law and Project Management, Ohio, 1st Edition.

▪ The committee is currently researching E-Publications.

NASCLA Residential Committee

▪ The committee is finalizing the NASCLA Consumer Guide, this will be presented at the NASCLA 2010 Annual Conference.

▪ NASCLA is creating a “State Member Tool Box” which will include press release templates and disaster planning resources for state agencies.

▪ NASCLA State Members’ Laws, Rules & Regulations have been added to the NASCLA Consumer website.

▪ The committee is working on updating the NASCLA Contractor Disciplinary Database.

John Curl Speaks at the National Association of Home Builders (NAHB) State & Local Government Affairs Committee Meeting

Phoenix, AZ—March 2010 The National Association of State Contractors Licensing Agencies (NASCLA) President, John Curl, was personally invited to speak at the National Association of Home Builders (NAHB) State & Local Government Affairs Committee Meeting at the NAHB 2010 Internal Builders Show in Las Vegas, Nevada on January 18th.

The purpose of the meeting on January 18th was to provide an overview of the association history and information on our current residential construction ventures with our state contractor licensing regulatory agencies to the NAHB State & Local Government Affairs Committee Members.

John Curl, NASCLA President, has a unique correlation with the NAHB. Mr. Curl has been a builder for the past 25 years in Florence, South Carolina. Mr. Curl served four terms as the President with the Home Builders Association of the Greater Pee Dee, three terms as District Vice President for the South Carolina Home Builders. He received Builder of the Year in 1991 and 2000. Mr. Curl also received the State Distinguished President Award in 1990 and 1991.

Mr. Curl has been involved with the association for many years and was appointed to the NASCLA Board of Directors in 2003 and now serves as our NASCLA President. Mr. Curl became involved in NASCLA because of his affiliation with the South Carolina Residential Builders Commission. Mr. Curl was first appointed to the South Carolina Residential Builders Commission by Governor David Beasely and was subsequently re-appointed twice for four year terms. He served three years as Vice Chairman, and was on the first Investigative Review Committee. From 2000-2007 he served as Chairman. Mr. Curl now serves as a Hearing Officer for both the South Carolina Residential Builders Commission and the South Carolina Contractors Licensing Board.

NASCLA has a rich history with the NAHB with similar missions and core values. The associations are both trade associations serving our members and we strive for better regulation of the construction industry to protect the health, welfare, and safety of the general public.

NASCLA & NPI Strategic Planning Meeting & Model Legislation Committee Meeting

The NASCLA Executive Committee Members held the Annual Strategic Planning Meeting in Las Vegas, Nevada on January 19 and 20, 2010 at the Mandalay Bay Resort.

The meeting location was determined because the National Association of Home Builders (NAHB) invited both John Curl, NASCLA President, and Angie Whitaker, NASCLA Executive Director, to participate in the NAHB State and Local Government Affairs Committee Meeting. For more information on this meeting, please see the Press Release on page 5 of this newsletter.

During the meeting the committee members worked diligently to finalize and new NASCLA Strategic Plan and Flow Chart for 2010, 2011 and 2012. NASCLA would like to thank all the State Members for submitting your ideal short-term and long-term goals for the association.

The NASCLA Model Legislation Committee also held a meeting on January 20 and 21, 2010 in Las Vegas. The meeting provided the committee members with the opportunity to continue to work

on the NASCLA Model Legislation for Commercial Construction

Licensing. The committee members have been assiduously working to complete this model legislation by the NASCLA 2010 Annual Conference in Charleston, South Carolina.

To further protect children from exposure to lead-based paint, the U.S. Environmental Protection Agency (EPA) has issued new rules for contractors who renovate or repair housing, child-care facilities or schools built before 1978. Under the new rules, workers must follow lead-safe work practice standards to reduce potential exposure to dangerous levels of lead during renovation and repair activities. “While there has been a dramatic decrease over the last two decades in the

number of children affected by lead-poisoning, EPA is continuing its efforts to take on this preventable disease,” said James Gulliford, EPA’s Assistant Administrator for Prevention, Pesticides and Toxic Substances. “These new rules will require contractors to be trained and to follow simple but effective lead-safe work practices to protect children from dangerous levels of lead.” The “Lead: Renovation, Repair and Painting Program” rule, which will take effect in April 2010, prohibits work practices creating lead hazards. Requirements under the rule include implementing lead-safe work practices and certification and training for paid contractors and maintenance professionals working in pre-1978 housing, child-care facilities and schools. Beginning October 22, 2009, contractors must take EPA-accredited training before beginning renovation, repair or painting projects as defined in the RR& P rule. The rule covers all rental housing and non-rental homes where children under six and pregnant mothers reside. The new requirements apply to renovation, repair or painting activities where more than six square feet of lead-based paint is disturbed in a room or where 20 square feet of lead-based paint is disturbed on the exterior. The affected contractors include builders, painters, plumbers and electricians. Trained contractors must post warning signs, restrict occupants from work areas, contain work areas to prevent dust and debris from spreading, conduct a thorough cleanup, and verify that the cleanup was effective. Lead is a toxic metal that was used for many years in paint and was banned for residential use in 1978. Exposure to lead can result in health concerns for both children and adults. Children under six years of age are most at risk because their developing nervous systems are especially vulnerable to lead’s effects and because they are more likely to ingest lead due to their more frequent hand-to-mouth behavior. Almost 38 million homes in the United States contain some lead-based paint, 24 million have deteriorated paint. Four million children live in these homes. The major source of lead poisoning is lead paint and lead-contaminated dust from deteriorated paint. These new requirements are key components of a comprehensive effort to eliminate childhood lead poisoning. For more information on this new program visit: www.epa.gov/lead. Whether it is a new home for a family or a commercial business, construction is present in our lives. Think of the home you live in, your work place, and the charities you donate to; those buildings, those places were built by hard working people. It is not just the people that built the building with their own two hands, but the people “behind the scenes,” as well as the state agencies that protect the safety and welfare of all. Let’s honor those people, the construction related associations and the state licensing agencies by nominating them for one of NASCLA’s 2010 National Awards.

The National Association of State Contractors Licensing Agencies (NASCLA) will be presenting the 6th Annual Community Service in Contracting and Innovation in Regulation Awards at the 2010 Annual Conference. These prestigious awards honor those that accomplish tremendous charitable projects within their communities, and the excellence in regulation of the construction industry.

The Community Service in Contracting Award recognizes the positive impact that contractors and construction related associations have on their communities. NASCLA wants to honor those who have unselfishly contributed their time, labor and materials to charities. So many times these people and associations go unnoticed, now is the time for their deserved recognition!

The Innovation in Regulation Award is presented to a public sector contractor licensing agency. This award is designed to recognize a state licensing agency for their innovation, creativity and excellence in the regulation of the contracting /construction industry. Previous winners of this award were: California Contractors State License Board and Arizona Registrar of Contractors. NASCLA looks forward to seeing if your state will have the honor of receiving this year’s award.

The National Association of State Contractors Licensing Agencies (NASCLA) was formed in

Utah in 1962 as a nonprofit organization dedicated to the mutual assistance of its

members in striving for the better regulation of the construction industry to protect the health,

welfare and safety of the general public.
