Dear MeMbers,

I would like you to stop what you are doing and take a moment to check your records and make sure you have

either completed or are signed-up for a Quadrennial Code of Ethics training session. This requirement must be completed by December 31, 2008, as a requirement of membership until the next four-year cycle. Please call the Association to register for one of the “Popcorn & Ethics” sessions that the Association has scheduled, or you can take the course online at www.realtor.org.

We recently held our 2008 RPAC Auction & Texas Hold ‘Em Tournament finale. It was a great success, and I want to personally thank everyone who participated in the planning and set-up for their dedication and efforts. RPAC is near and dear to my heart and I want to make it a part of yours as well. With all the financial upheaval that is going on now, along with

the mortgage crisis, there is no better time than now to get involved with your REALTOR® Political Action Committee and make an impact on the election of officials who will shape the legislation that affects your livelihood and the way real estate professionals do business!

We’ve have had some significant changes at the Association in the past couple of months, and I want to assure our membership that our number one priority is our members, and that we will continue our promise to deliver our commitment to quality customer service. The Board of Directors and I have the utmost confidence in your new Association Executive, Jeri Peyton, and I encourage you to stop by the Association office and say hello to her or send her an email to welcome her in her new position!

I am excited and enthusiastic about all the great things that our members have helped us to accomplish so far this year. As always, I am just a phone call away (407-944-0049) if you would like to talk to me or if you have any issues, concerns or suggestions for your Association. ■

THE PUBLIC POLICY REPORTThe Public Policy committee meets once

a month to review matters that are coming before local government entities that may be of special concern to REALTORS®. The hope is to keep REALTORS® informed of matters upon which they may want to provide input to the local government entities considering these issues. THE POWER OF THE REALTOR® ENDORSEMENT Prior to the election in August, 13 candidates running for office received endorsement from the Osceola County Association of REALTORS®. Of those 13 candidates, 10 of them will be in the November 4th general election.

THE LYNX SUPERSTOP AND KISSIMMEE INTERMODAL STATIONThe Lynx SuperStop and the Kissimmee Intermodal Station will return to their originally planned location in downtown Kissimmee at E. Drury and Neptune Road. This location is within easy walking distance of dining and shopping centers, the Osceola County Courthouse and Government Center, Osceola Regional Medical Center and the Lake Tohopekaliga shore.

Dear MeMbers,

It’s been an incredible inaugural first few weeks as your new Association Executive. I would like to thank you

all for your encouraging words and support.

My main goal, along with the rest of the staff, is to bring the Association back to a membership-driven Association. We work for you! Our doors will always be open to assist you in every way that we can. I plan to work closely with all of our committees and helping them accomplish their goals.

We have heard your requests to cut-down on the amount of emails that you receive and to that end, we have consolidated our eVIEWs so that now Brokers will continue to receive their weekly Statistics report from Bob St. Gordon, our Controller, and the Friday eVIEW which will include all the Education classes, meetings, events, etc., for the coming week. We hope that this eliminates some of the burden from your email in-baskets, while still providing you with

up-to-date information about your Association.

Now, I would like to give you a brief rundown on some “happenings”, present and future, at the Association.

2008 RPAC AUCTION – SATURDAY, SEPTEMBER 6, 2008 – AT THE ASSOCIATION

This year’s auction was highlighted by the final round of our Texas Hold ‘Em Tournament. Chris Zellner walked away with the Grand Prize of a trip to Las Vegas! The event proved to be a huge success thanks to the efforts of our Chairwoman, Carolee Goodwin-Blackmore, and Vice Chair, Christina Gentry. A very special thanks to Debbie Henderson and Linda Goodwin-Nichols for all of their hard work and the RPAC Auction Committee members: Hope Andrews, Terri Carroll, Dave Courtney, Nancy Cuevas, Gwen Dukes, Stephanie Escurra-Hendricks, Sean Ferguson, Jack Frey, Richard Knapp, Todd Kozloski, Daisy Lopez-Cid, Samantha

The event was well attended. There were many silent auction items and a few live auction items that were offered to bidders. Cheryl Grieb was the winner of both the large screen flat television and a GPS navigation system. Our RPAC goal this year was $37,170 and we made goal with the combined dues billing, auction and donations. In fact, we are over goal! Thanks to everyone who helped to support this event. Remember, RPAC is your chance to have a collective statewide and nationwide impact on the election of officials who will shape the legislation that affects your livelihood and the way real estate professionals do business.

2008 FAR CONVENTION & TRADE EXPO

This year’s convention was held in Lake Buena Vista and was packed full of informative and interesting workshops, classes and speakers. It’s also a great opportunity for members to network with each other and share information and ideas. I attended workshops and meetings that helped me gain new insight and knowledge for my new role. I encourage our REALTOR® members to attend the National Association of REALTORS® (NAR) Annual Governance Meetings that are taking place in November, right here in Orlando! LOGGING INTO MLXCHaNGe Is CHaNGING ON OCTOber 7, 2008!

Starting October 7, when you login to MLXchange, you will see a new Sign-In screen that asks for your User ID and password. Depending on what type of user you are, you may have different instructions for logging into MLXchange:

Agent and Broker Accounts

Brokers and Agents will use their User ID and Password. It will be the same number and password you use to login to the MFRMLS Online Payment Center.

Office Staff X Accounts

Office level staff that utilize the “X Account” ID’s will be discontinued. All unlicensed assistants must have their own unique 9 digit ID number.

Multi-Agent Assistant (MAA) Accounts

MAA’s will use their NRDS ID and Password. Assistants that login with a MAA ID will need to follow the procedure for obtaining an assistant ID.

Since the MAA access will change to the NRDS ID and Assistants will need to obtain their own unique login, you will need to utilize the Shared Identity function in MLXchange in order to have access to another member’s MLXchange account. Identity sharing allows you to invite other members of your office, such as an assistant or a team member, to log in and work in MLXchange on your behalf (up to a maximum of 20 users). The invited user will "assume your identity", and, therefore, have the same user

class privileges as you. For example, if you are an office manager with office level privileges, the invited user will also share your office level privileges.

If any modifications are made to listing records, MLXchange will record the User ID of the person who actually made the change (the invited user).

What If I Forgot My Password?

Password Retrieval:

• Prior to changing to the new login system on October 7, MLS will be activating a Password Retrieval system on MLXchange.

• Once the Password Retrieval feature is enabled in MLXchange, the member will automatically be prompted through a setup wizard to create their secret questions and answers.

• Once this has been done, if you forget your password, you will be able to click on the (Forgot your Password) link under the Password field on the login screen. You will be required to answer your secret question, and your password will be emailed to your primary email address.

• To verify or change your primary email address, log into MLXchange and in the upper right corner, click on Settings, click on Personalize, then click on Contact information.

How will I Login to MLX Wireless?

The password change will also apply to logging in to MLX Wireless, as well. Members will not be required to re-register in order to continue using the wireless service. Members can simply login to MLX Wireless with their password.

How Do I Obtain an Assistant ID?

• All unlicensed assistants must complete an Assistant Access Form and have it signed by the Broker/Agent who employs them.

• We will check the assistant’s name and address with the DPBR to ensure they are not actively licensed (in which case they should have their own subscription).

• We will then assign the assistant a 9-digit user ID number.

• Once we have granted access, the assistant must attend the “Introduction to MLXchange” training class within 90 days. (NOTE: We are waiting on confirmation by MLS if existing assistants will be required to take the “Introduction to MLXChange”)

• We have waived the $50.00 Access Set-up fee through October 15, 2008. Starting October

PaINT YOUr HearT OUT!

Don’t you just love this time of the year in Florida? The air smells clean and

fresh. The sky seems to be a little brighter blue. Temperatures are down, spirits are up. Sunsets are glorious! It feels good to be outside for a change, which brings up what I would like to talk to you about.

The Affiliate members, REALTORS® and the Osceola REALTOR® Foundation have adopted a community service project for this fall called “Paint Your Heart Out”.

We have selected the Osceola County Council on Aging to be the recipient of this wonderful endeavor. On Saturday, November 15, 2008, we are going to “Paint Our Hearts Out” (exterior painting only) for the seniors living at Saint Cloud Villas, Kissimmee Park Road, in Kissimmee. We need volunteers to make this a great success. The “T” shirts, materials and supplies will be provided. You don’t have to be a great painter; all you have to do is be willing to share your heart and your time!

Mark your calendars and start recruiting volunteers from your offices. We will start at 8:00 a.m. on Saturday, November 15. More information will be coming to you through email and at our MLS Marketing Meetings on Tuesdays. ■

QUaDreNNIaL CODe OF eTHICs TraINING. THe QUaDreNNIaL eNDs DeCeMber 31, 2008!

According to both the National Association of REALTORS® (NAR) and the Osceola County Association of REALTORS® Bylaws, members who fail to satisfy this requirement shall be considered in violation of membership duty for which REALTOR® membership shall be suspended until such time as the training is completed.

Members suspended for failing to meet the requirement for the second (2005-2008) cycle and subsequent four-year cycles will result in suspension of membership for the first two months (January and February) of the year following the end of any four-year cycle or until the requirement is met, whichever occurs sooner. On March 1 of that year, the membership of a member who is still suspended as of that date will be automatically terminated.

We have added more opportunities for you to fulfill these requirements called “Popcorn & Ethics”. These are non-instructed and no CE credit will be given for attending. We will be showing the NAR Quadrennial Code of Ethics DVD and offering popcorn and soda.

FOLLOWING ARE THE GUIDELINES FOR ON-LINE VOTING:

When a member goes to the Association’s website to view the Committee’s recommendation, they will see the slate with the Nominating Committee recommendations, as well as other nominees running from the floor.

Nominations may still be made for Officer and Director positions by members who have previously been a Board Officer or Director or a member who has completed the Association’s Leadership Academy by submitting a Candidate Form to Jeri Peyton, Association Executive, at the Association by 5:00

p.m. on Friday, October 17, 2008.

The election will open for balloting beginning at 8:00 a.m. Monday, November 3, 2008, through 5:00 p.m. Thursday, November 6, 2008. The results of the election will be captured by the Association’s attorney on Friday, November 7, 2008, to ensure accuracy, accountability and the integrity of the process. The results will be placed on the Associations internet site, emailed to all members, posted in the newsletter and posted in the Association’s lobby. As well, the slate will be presented to the members at the Annual Meeting, Tuesday, December 2, 2008.

It is only about a half-mile from the downtown Kissimmee Amtrak depot, located near the intersection of Broadway Street and Monument Avenue. CODE OF ETHICS Preamble

nder all is the land. Upon its wise utilization and widely allocated ownership depend the survival and growth of

free institutions and of our civilization. REALTORS should recognize that the interests of the nation and its citizens require the highest and best use of the land and the widest distribution of land ownership. They require the creation of adequate housing, the building of functioning cities, the development of productive industries and farms, and the preservation of a healthful environment.

uch interests impose obligations beyond those of ordinary commerce. They

impose grave social responsibility and a patriotic duty to which REALTORS should dedicate themselves, and for which they should be diligent in preparing themselves. REALTORS , therefore, are zealous to maintain and improve the standards of their calling and share with their fellow REALTORS a common responsibility for its integrity and honor.

n recognition and appreciation of their obligations to clients,

customers, the public, and each other, REALTORS continuously strive to become and remain informed on issues affecting real estate and, as knowledgeable professionals, they willingly share the fruit of their experience and study with others. They identify and take steps, through enforcement of this Code of Ethics and by assisting appropriate regulatory bodies, to eliminate practices which may damage the public or which might discredit or bring dishonor to the real estate profession. REALTORS® having direct personal knowledge of conduct that may violate the Code of Ethics involving misappropriation of client or customer funds or property, willful discrimination, or fraud resulting in substantial economic harm, bring such matters to the attention of the appropriate Board or Association of REALTORS .

best interests of those who utilize their services, REALTORS urge exclusive representation of clients; do not attempt to gain any unfair advantage over their competitors; and they refrain from making unsolicited comments about other practitioners. In instances where their opinion is sought, or where REALTORS believe that comment is necessary, their opinion is offered in an objective, professional manner, uninfluenced by any personal motivation or potential advantage or gain.

conduct in business relations. No inducement of profit and no instruction from clients ever can justify departure from this ideal.

n the interpretation of this obligation, REALTORS can take no safer guide than

that which has been handed down through the centuries, embodied in the Golden Rules, “Whatsoever ye would that others should do to you, do ye even so to them.”

ccepting this standard as their own, REALTORS pledge to observe its spirit

in all of their activities and to conduct their business in accordance with the tenets set forth below

Article 1 When representing a buyer, seller, landlord, tenant, other client as an agent, REALTORS pledge themselves to protect and promote the interests of their client. This obligation to the client is primary, but it does not relieve REALTORS of their obligation to treat all parties honestly. When serving a buyer, seller, landlord, tenant or other party in a non-agency capacity. REALTORS remain obligated to treat all parties honestly.

Article 2 REALTORS shall avoid exaggeration, misrepresentation, or concealment of pertinent facts relating to the property or the transaction. REALTORS shall not, however, be obligated to discover latent defects in the property, to advise on matters outside the scope of their real estate license, or to disclose facts which are confidential under the scope of agency or non-agency relationships as defined by state law.

Article 3 REALTORS shall cooperate with other brokers except when cooperation is not in the client’s best interest. The obligation to cooperate does not include the obligation to share commissions, fees, or to otherwise compensate another broker.

Article 4 REALTORS shall not acquire an interest in or buy or present offers from themselves, any member of their immediate families, their firms or any member thereof, or any entities in which they have any ownership interest, any real property without making their true position known to the owner or the owner’s agent or broker. In selling property they own, or in which they have any interest, REALTORS shall reveal their ownership or interest in writing to the purchaser or the purchaser’s representative.

Article 5 REALTORS shall not undertake to provide professional services concerning a property or its value where they have a present or contemplated interest unless such interest is specifically disclosed to all affected parties.

Article 6 REALTORS shall not accept any commission, rebate, or profit on

expenditures made for their client, without the client’s knowledge and consent.

When recommending real estate products or services (e.g., homeowner’s insurance, warranty programs, mortgage financing, title insurance, etc.), REALTORS shall disclose to the client or customer to whom the recommendation is made any financial benefits or fees, other than real estate referral fees, the REALTOR or REALTOR ’s firm may receive as a direct result of such recommendation.

Article 7 In a transaction, REALTORS shall not accept compensation from more than one party, even if permitted by law, without disclosure to all parties and the informed consent of the REALTOR ’s client or clients.

Article 8 REALTORS shall keep in a special account in an appropriate financial institution, separated from their own funds, monies coming into their possession in trust for other persons, such as escrows, trust funds, clients’ monies, and other like items.

Article 9 REALTORS , for the protection of all parties, shall assure whenever possible that agreements shall be in writing, and shall be in clear and understandable language expressing the specific terms, conditions, obligations and commitments of the parties. A copy of each agreement shall be furnished to each party upon their signing or initialing.

Article 10 REALTORS shall not deny equal professional services to any person for reasons of race, color, religion, sex, handicap, familial status, or national origin. REALTORS shall not be parties to any plan or agreement to discriminate against a person or persons on the basis of race, color, religion, sex, handicap, familial status, or national origin.

REALTORS , in their real estate employment practices, shall not discriminate against any person or persons on the basis of race, color, religion, sex, handicap, familial status, or national origin.

Article 11 The services which REALTORS

provide to their clients and customers shall conform to the standards of practice and competence which are reasonably expected in the specific real estate disciplines in which they engage; specifically, residential real estate brokerage, real property management, commercial and industrial real estate brokerage, real estate appraisal, real estate counseling, real estate syndication, real estate auction, and international real estate.

REALTORS shall not undertake to provide specialized professional services concerning a type of property or service that is outside their field of competence unless they engage the assistance of one who is competent on such types of property or service, or

unless the facts are fully disclosed to the client. Any persons engaged to provide such assistance shall be so identified to the client and their contribution to the assignment should be set forth.

Article 12 REALTORS shall be honest and truthful in their real estate communications and shall present a true picture in their advertising, marketing, and other representations. REALTORS shall ensure that their status as real estate professionals is readily apparent in their advertising, marketing, and other representations, and that the recipients of all real estate communications are, or have been, notified that those communications are from a real estate professional.

Article 13 REALTORS shall not engage in activities that constitute the unauthorized practice of law and shall recommend that legal counsel be obtained when the interest of any party to the transaction requires it.

Article 14 If charged with unethical practice or asked to present evidence or to cooperate in any other way, in any professional standards proceeding or investigation, REALTORS shall place all pertinent facts before the proper tribunals of the Member Board or affiliated institute, society, or council in which membership is held and shall take no action to disrupt or obstruct such processes.

Article 15 REALTORS shall not knowingly or recklessly make false or misleading statements about competitors, their businesses, or their business practices.

Article 16 REALTORS shall not engage in any practice or take any action inconsistent with the agency or other exclusive relationship recognized by law that other REALTORS have with clients.

Article 17 In the event of contractual disputes or specific non-contractual disputes as defined in Standard of Practice 17-4 between REALTORS (principals) associated with different firms, arising out of their relationship as REALTORS , the REALTORS shall submit the dispute to arbitration in accordance with the regulations of their Board or Boards rather than litigate the matter.

In the event clients of REALTORS

wish to arbitrate contractual disputes arising out of real estate transactions, REALTORS shall arbitrate those disputes in accordance with the regulations of their Board, provided the clients agree to be bound by the decision.

The obligation to participate in arbitration contemplated by this Article includes the obligation of REALTORS (principals) to cause their firms to arbitrate and be bound by any award. (12/2007)
