SITE INSPECTIONAl l areas rented at ThornCreek Winery & Gardens must be lef t in the same condit ion as before the event. At the conclusion of the event, a

site inspection performed by the on-site manager wi l l be completed to check for any damage to our property. Any damage to ThornCreek

Winery & Garden’s property wi l l result in addit ional charges to the guest.

PROVISIONS� A signed copy of this contract is mandatory to reserve a date for your event.

� A Non-Refundable Deposit equal to the amount of the faci l i ty rental is required to reserve a date for an event.

� ThornCreek faci l i ty management, bar serv ice, non-alcohol ic beverages, alcohol ic beverages, rental fees and labor charges are due as

out l ined in the Payment Schedule sect ion of this document. Acceptable forms of payment include: Cash, Check or Major Credit Card.

� Al l special events include coordinat ion with one of our Preferred Catering Companies and the Rental Company.

BEVERAGE SELECTIONS AND BEVERAGE POLICIES� Prices for wine, beer and l iquor are subject to change.

� ThornCreek Winery alcohol pol icy al lows for alcohol ic serv ice to guests 21 years of age or older, when presenting proper ident if icat ion.

� The select ion of wine, beer, and alcohol ic beverages must be made one month in advance of the event.

� A l l beverages must be purchased through ThornCreek Winery & Gardens.

ThornCreek wi l l provide Event Managers, Bartenders and Support Staff. The Guest agrees to the fol lowing charges for staff:

TERMS AND CONDITIONS

OHIO BEVERAGE AND DRUG LAWSOhio State laws concerning underage consumption of alcohol wi l l be adhered to and enforced. We reserve the r ight to refuse serv ice to any

guest who cannot present proper ident if icat ion, or who is deemed intox icated.

The taking or distr ibut ion of i l legal drugs or paraphernal ia on the premises wi l l result in a non-refunded site fee, and the v io lators wi l l be

asked to leave the property.

BREAKAGE AND DAMAGEGuest is responsible for any breakage of suppl ied items, or any damage to the contents, physical structures, or gardens of ThornCreek

Winery & Gardens. ThornCreek is not responsible for damage or loss of i tems including but not l imited to gif ts, card box, equipment and/or

personal i tems belonging to the guest and or inv itees or independent contractor.

NON-SMOKING FACIL ITYSmoking is str ict ly prohibited at our faci l i ty except for the designated area located near the Tast ing Room entrance. Receptacles are

provided in designated smoking area only. A $250 cigaret te butt clean-up fee wi l l be assessed for any clean up required in non-designated

smoking areas.

SOUND MONITORINGThornCreek reserves the r ight to require guest to cease using any music deemed inappropriate and retains the r ight to reduce volume at

any t ime. ThornCreek retains the r ight to stop music at the specif ic end t ime as control led by the City of Aurora’s noise ordinance.

GUARANTEED GUEST COUNTAl l guests must submit a guaranteed count of at tendees two weeks prior to the event. This wi l l set the charges for the event. No cancel lat ion

of serv ices or reduction of guest count may be made after the guarantee is provided. Addit ional charges wi l l apply when necessary to guest

counts that are greater than the orig inal guaranteed count.

VENDORSGuests are responsible for providing the ThornCreek Winery & Gardens Events Department with a l ist of vendors that are contracted for

their event, along with contact information. ThornCreek wi l l assume the responsibi l i ty of coordinat ing the schedule for al l del iveries, pick-up

and set-up t imes.

PAYMENT SCHEDULEAT CONTRACT SIGNING

One Hundred percent (100%) of the Faci l i ty Rental fee is due in ful l at contract signing and acts as a non-refundable deposit to secure the

event date.

90 DAYS PRIOR TO THE EVENT

A Deposit of F if ty Percent (50%) of the serv ice and consumables est imate plus 20% gratuity and tax shal l be due and be non-refundable.

AT THE CONCLUSION OF THE EVENT

The balance of al l charges including, but not be l imited to, al l remaining consumables, serv ice, tax and gratuit ies shal l be due. Guest agrees

and understands that the f inal bi l l wi l l vary from the proposed est imate as the f inal bi l l is a ref lect ion of the actual serv ice hours worked and

al l f inal event consumables and charges.

Cash, Check, or Major Credit Card are acceptable forms of payment.

Any check retuned for non-suff ic ient funds wi l l incur al l appl icable fees/charges that ThornCreek faces as a result of the insuff ic ient funds.

Any amounts not paid to ThornCreek Winery when due may accrue interest after the date of such payment at a rate of 18% per annum.

Guest wi l l be responsible for any and al l costs and expenses incurred by ThornCreek Winery in the col lect ion of any amounts due from the

guest; including but not l imited to at torney fees, court costs and re lated expenses.

In the event that the Guest /Signee of this contract fai l to make a scheduled payment, ThornCreek at i ts option may cancel th is contract.

SALES TAX AND GRATUITYAl l consumables are subject to a 7.25% sales tax. 20% Gratuity wi l l be added to the f inal bi l l on al l consumables.

CANCELLATION POLICYAl l Cancel lat ions must be received in writ ing.
