Many guardians have asked this question because they are concerned about what would happen to the member and the money in the beneficiary fund or trust, should the guardian pass away.

If you are the guardian or caregiver of a member, make sure your family knows what to do should you die.

Also read the article in this issue, about the importance of having a Will because you can say in your Will who should take over from you as guardian or caregiver.

When a guardian has to change, follow the steps below:Once the family decides who the new guardian/caregiver will be, you must send the beneficiary fund/trust:

• The death certificate of the deceased guardian/caregiver, if the guardian/caregiver died: Or

• If the guardian/caregiver changed: An affidavit from the old guardian/caregiver saying that they no longer take care of the member.

AND

• An affidavit from the new guardian/caregiver saying that they will now be taking care of the member. The affidavit must also indicate who the members are, giving their full names and dates of birth, as well as reasons for change of guardianship/caregiver.

• The new guardian/caregiver’s banking details and original certified identity document/passport,

• An affidavit from a third party, preferably a family member or tribal authority, stating who the new guardian/caregiver is.

For the purpose of this newsletter we use the term members when we refer to both beneficiaries of Trusts and members of Beneficiary Funds. When we use the term guardians, we refer to both guardians and caregivers.

These documents can be emailed, faxed, posted or dropped off at one of Fairheads walk-in client centres or a TEBA Ltd branch.

Most people want to leave their possessions and money to their loved ones. In order to make sure that happens with the least problems and delays, you should draw up a Will.

What happens when you die without a Will? When you die without a Will, you die ‘intestate’ – this means that your possessions are dealt with , according to the laws of our country.

Some problems may arise if you die without leaving a Will, for example:• Your assets may not be left to the person/s you choose.• It can take a longer time to have an executor appointed.• The executor who is appointed may be somebody you would

not have chosen.• There could be extra and unnecessary costs.• There could be unhappiness and conflict among members of

your family as family members that you may not have been close with may inherit.

What makes your Will valid?

The Will must:• Be in writing (handwritten, typed or printed)• Be signed by you at the end of the Will• Must be dated• Be signed in the presence of two or more witnesses (anyone

older than 14 years, if competent to testify in a court of law)• If the Will has more than one page, each page must be signed

Important points• You should have two witness signatures on

each page of the document. • The person who is nominated as Executor

should not sign your Will as a witness. People who stand to inherit should not sign as witnesses, as this will disqualify them from inheriting.

• Update your Will whenever your situation changes – e.g. divorce, children born, financial situation drastically changes, etc.

• If you are the guardian or caregiver of a member of a beneficiary fund or trust, it would be wise to state in your Will who should take over guardianship if you should die.

• Fairheads does not draw up Wills and the beneficiary fund or trust doesn’t either.

• Some banks draw up your Will for free. You can download an example of a last Will and testament from the Legal Aid South Africa website or you can get an easy-to-complete Will form from a stationery shop. If you need help, you may want to consult a lawyer.

• Once you have drawn up your Will, keep it in a safe place, and tell someone that you trust where to find it.

Your reference code is how we identify the member or beneficiary account when you call the contact centre or send in a request.

Write your reference code on all documents you send to Fairheads and include it in your emails so that your requests are not delayed. Some

requests cannot even be considered because there is no name or reference to identify the member or guardian.

Reference codes appear on all documents send from the beneficiary fund or trust. See the example of what it looks like below.
