A318/12 – APPROVED – Oct 11/2012 – To permit Cabana not located in sideyard. Cabana has since moved approximately 6' from the original approved location.
A sketch is attached illustrating the request. This application will be heard by the Committee of Adjustment on the date and time shown below.

Proposal:
1. To permit an accessory structure (cabana) to be located in the interior side yard.
2. To permit a minimum interior side yard setback of 0.6 metres to a proposed covered patio (loggia).
By-Law Requirements:
1. An accessory structure (cabana) shall be located in the rear yard. 2. A minimum interior side yard setback of 1.5 metres is required to a
covered patio (loggia). Staff Comments: Stop Work Orders and Orders to Comply:
Order-to-Comply # 16-159 has been issued for construction without obtaining a building permit.
Building Permits Issued:
A demolition permit (#16-1665) has been issued for the demolition of the existing cabana. A building permit has not been issued. The Ontario Building Code requires a building permit for structures that exceed 10m2.
Other Comments:
1. The Committee of Adjustment previously approved A138/12 to permit a cabana in the side yard. It is our understanding the applicant has moved the cabana to a different location in the side yard.
2. The applicant has not clearly identified the proposed minor variances on the application form. The variances listed above have been added for the cabana and proposed covered patio (loggia) as shown on the Site Plan drawing submitted with this application only. Detailed drawings have not been provided. The applicant is to confirm the proposed variances.
3. The applicant is advised that the minimum interior side yard to the cabana shall be 0.6 metres, and that a maximum height of 2.5 metres measured from the finished grade to highest point of the cabana is permitted. Please also note that the maximum encroachment for eaves and gutters is 0.3 metres.
4. The applicant is advised that the minimum interior side yard setback to the
proposed covered patio (loggia) is measured to the posts and that the maximum encroachment for eaves and gutters is 0.5 metres.

5. The applicant shall be advised that additional variances may be required upon review of detailed drawings for building permit approval. It is the responsibility of the applicant to ensure that any development on the property complies with the decision of the Committee of Adjustment and Zoning By-law 1-88 a.a.

Official Plan: VOP 2010 designation: “Low-Rise Residential”. The proposal conforms to the Official Plan Policies.
Comments: The Owner is proposing to construct a covered patio in the interior side yard and requesting permission to maintain an accessory structure (cabana) with the variances noted above. The Development Planning Department has no concerns with Variance #1. Minor Variance Application A318/12 was previously approved for an accessory structure (cabana) to be located in the interior side yard. The cabana was constructed approximately 1.8 m west of the original proposed location, but still meets all setback, height and area requirements of Zoning By-law 1-88. The Development Planning Department has no concerns with Variance #2. The proposed covered patio is an extension to the existing covered patio in the rear yard. The proposed covered patio is also unenclosed which helps to mitigate the impact of the reduced interior side yard on the adjacent property to the north. The Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Recommendation: The Development Planning Department supports the proposal.

COMMENTS:
PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply
any approval of the project or plan.
All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream’s cost for any relocation work.
