Standar Operating Procedure Unruly Passenger

UNRULY PASSENGER
ICAO Annex 17 to the Convention on International Civil Aviation 1944 (the Chicago Convention), Security -Safeguarding International Civil Aviation against Acts of Unlawful Interference, defines a disruptive passenger as:
• A passenger who fails to respect the rules of conduct at an airport or on board an aircraft or to follow the instructions of the airport staff or crew members and thereby disturbs the good order and discipline at an airport or on board the aircraft.1
TOKYO CONVENTION 1963
PILOT AUTHORIZATION:
•Article 1 : Covers acts jeopardizes safety or good order and discipline on board.
•Articles 6 & 7 : Power to restrain an offender until the next landing.
•Articles 8 & 12 : Power to disembark certain persons.
•Articles 9 & 13 : Power to deliver a serious offender to the competent authorities.

• 6.44 Each Contracting State shall, to deterand prevent unruly behaviour, promotepassenger awareness of the unacceptabilityand possible legal consequences of unruly ordisruptive behaviour in aviation facilities andon board aircraft.
• 6.45 Each Contracting State shall takemeasures to ensure that relevant personnelare provided training to identify and manageunruly passenger situations.

Chapter 13.4 – Training Program
13.4.1 An operator shall establish and maintain anapproved security training programme whichensures crew members act in the most appropriatemanner to minimize the consequences of acts ofunlawful interference. As a minimum, thisprogramme shall include the following elements:
a) determination of the seriousness of any occurrence;
b) crew communication and coordination;
c) appropriate self-defense responses;
d) use of non-lethal protective devices assigned to crew members whose use is authorized by the State of the Operator;
e) understanding of behaviour of terrorists so as to facilitate the ability of crew members to cope with hijacker behaviour and passenger responses;
f) live situational training exercises regarding various threat conditions;
g) flight deck procedures to protect the aeroplane; and
h) aeroplane search procedures and guidance on least-risk bomb locations where practicable.

7.4.5 Pendidikan dan pelatihan khusus(specialized training) sebagaimanadimaksud butir 7.4.4 sekurang-kurangnya mencakup:
f. Awak pesawat udara (Flight Crew Compartment dan Cabin Crew)
10. Prosedur penanganan penumpangyang tidak patuh dan mengganggu(unrully and distrubtive passanger);

Pasal 54
Setiap orang di dalam pesawat udara selamapenerbangan dilarang melakukan:
a. perbuatan yang dapat membahayakankeamanan dan keselamatan penerbangan;
b. pelanggaran tata tertib dalampenerbangan;
c. pengambilan atau pengrusakan peralatanpesawat udara yang dapatmembahayakan keselamatan;
d. perbuatan asusila;
e. perbuatan yang menggangguketenteraman; atau
f. pengoperasian peralatan elektronika yang mengganggu
g. navigasi penerbangan.
Pasal 55
Selama terbang, kapten penerbangpesawat udara yang bersangkutanmempunyai wewenang mengambiltindakan untuk menjamin keselamatan, ketertiban, dan keamanan penerbangan.
