Berthing Dues, etc.

1. All vessels using the Jetty shall pay berthing dues Ht the follo"'ing rates, namely:

For vessels exceeding 200 tons register, 1d. per ton on all em'go landccl or shipped; minimum, lOs.

Computation of' Berthing Dues. 2. In the computation of berthing dues for cargo­

carrying vessels, the Wharfinger shall hal-e the option of proceeiling on a weight basis of 2,000 01' 2,240lb. to the ton (acconling to trade usage), 01' a measurement basis of 40 cubic fcet to the ton, for the cargo in respect of \\"hich such clucs are Icyiec1, except as J'oJ!O\Ys:-

Hardwood timber, at 33cwt. per load of 50 cubic feet.

1 bullock, co\\', steel', heifer, or such-like animals, 1 ton.

3 cal\-cs or foals, 1 ton. 15 sheep, pigs, goats, or such-like, 1 ton. Cancware-Uhairs, 8 to the ton.

Vessels after haying discharged or taken in their cargo shall rcmove to any berth ~r anchorage pointed out by the Wharfinger or Officer-lU-charge.

All yessels lying alongside the jetty and transhipping cargo to or from lighters or other vessels shall pay the like berthing dues in respect thereof as if the said cargo hall been landed on or taken off the jetties in place of being taken from 01' placed in such lighters or vessels as aforesaid.

Goods for transhipment not trucked to be charged jetty rates one way, those trucked full rates. Wharfin­ger not responsible for goods stacked on jetty.

Payment of' Whal'f'age Dues, etc.

3. All wharfage dues and handling or other charges incurred, payable in respect of cargo discharged or shi pped, shall become payable to the Wharfinger on the discharge or shipment of the said cargo, and shall be pn ill to the "Wharfinger on demand, amI each bill of Jading as sho\\'n on the manifest must be cleared by one payment. No inwarcl cargo shall be delivered to the consignee or owner thereof, nor outward cargo to the vessel in which it is inteJ1cled that same shall be shipped, until the written receipt of the Wharfinger shall ha,'e been presentee] to the consignee or owner, or to the shipper or mastel', of the vessel respectively, for the payment of all wharfage dues and charges as aforesaid in respect of such cargo; pnl\'ic1ec1 always, that it shall be competent, but not compulsory (in the case of out­mud cargo), for the Wharfinger to accept from the agent or the nwstpi' a guarantee, in writing. that such dues shall be paid to him \yithin 24 hours of the clear­ance of the "\'esse!. at the office of the vVharfinger, prior to commencing to discharge cargo, a true, legible, and complete copy of the llHlnifest of the saW "essel, certified to by himself as being true and complete, and shall also furnish, within 48 hours, a certified statement of all alterations (if any) which may be made in such manifest by reason of measurement of goods included therein or otherwise.

6. The master of every \'esse1 shall deliver at the office of the 'iVharfinger prior to the clearance of the ship in \yhich outward cargo is shipped, a certified copy of manifest giYing true, legible, and complete particulars of such goolls as will enable the amolmt of outward wharfage dues payable thereon to be readily computed.

7. N"o person shall enter on any \rhad with goods for shipment without first deliycring to the Wharfinger an oubY31'd ea1'go advice note as 1'cqui1'ed by the De­partment, containing a full and true account, with g1'OSS measuremcnts or ,reights of such goods then under his immediate cont1'ol.

S. All out,,-ard cargo must be delivered into the shed at least not less than four 'YOl'king hours prior to ship's advertised time of sailing.

9. No goods shall be landed or placed on any jetties without the w1'itten authority of the Wha1'finge1' 01' Officer· in-charge. Cargo discha1'ged without such author­ity ha-dng been first obtainec1 shall not be deemed to be ill the custody of the Department, nOlO shall the Depart­ment be held 1'esponsible for any loss or damage that may accrne to any snch cargo from any cause whatever.

10. If it appear that goods are being landed and cannot, in the opinion of the Wharfinger or the Oflicer­in-charge, be remo'-ed in time to prcyent a " block, " the Wharfinger or Officer-in-charge may give notice, in writing, to the masters or persons in charge of ,-essels or lighters from which goods are being discharged to stop discharging em'go, and upon sneh notice being gh-en, no further cargo shall be discharged until such time as the Wharllnger or Officer-in-charge may direct.

Receipts, etc., for Inwarcl Cargo.

11. If during the progress of discharge of cargo doubt shall he expressed by the Wharfinger as to the condition of any package or pacl,ages, such package or packages shall be phcec1 in a situation apart from other cargo, pending examination, and the Department's tally and receipt for such package or- packages shall be that of a doubtful or damaged package, as circumstances or appearances dictate. Such packages shall be opened and examined by the consignee, but only ill the pl'csence of the Wharfinger and ship's agent, as soon as is pos­sible after being landed. 'Ehe Department will, under no pretence whatsoeYer, be held responsible for the safe custody or the condition of such package or packages, or of it or their contents.

12. In the erent of the ship, by its agent, refusing to accept a receipt as indicated for such cargo, such cargo must immediately be returned on board by the ship, and shall not be again landed until it has been examined by the consignee, \"ho shall take delivery direct from the ship.

Responsibility ot the Department.

] 3. No goods for which receipts have not been given by the Depnl'tment shall be deemed, for any pnrpose, to be ill the custody of the Department as Wharfingers, nor shall the Department be responsible for the safe <oustody, or for any loss or damage that may aCCl'Ue to same, in any manner whatsoever.

Goods to be checked before Delivery.

14. No persoll shall removo any goods or luggage from any \yharf or shod \vithout first satisfying the Wharfinger or Officer-in-charge of his right to do so; and shall, before removing same, sign for such goods or luggage to the Wharfinger or Officer-in-charge.

Delay in Delivery of ({oods.

15. The Department ,vill not be responsible for any claim arising from the delay in the delivery or goods from any cause whatsoever.

Wrollg Dcli1!ery.

16. Tho Department will not be responsible for the wrong or non-delivery of the goods which are erron­eonsly or deficiently marked, or ,,-hich have llUlnerous old or imperfectly erased marks thereon.

Goods not to be removed.

17. No person shall rcmo'-e from one vessel to an­other, or from any part of the ,yhad to any other pnrt thereof, any goods or luggage \yithout the authority of the Wbarfinger first had and obtained. .

Goods not to be Handled in Wet Weather.

18. No goods shall be landed or shipped in wet ,"eather ,yithout the permission, in writing, of the 'iVharfinger at the request of the master or agent of the

, discharging 01' loading yessel; but the giYing of snch permission shall not throw on the Department any liability for damage to such goo<.1s cansed by being so landed 01' shipped or handled in wet ,,-eather. The deter­minatIon of the Wharfinger that the weather is ,,-ct shall be conclusiY8.

Responsibility in case of Fire, eic.

19. '1'he Department shall not be responsible for loss or c1amag(; to goods while in their custody, by fire, 'ratcr used in extinguishing fire, or vermin.

EJ.,tra Charges.

20. The Wharfinger may make extra charges for handling packages O\-e1' one tOll in weight, or of an exceptional shape, or where extra labour is required or ullu~ual risk is invoh-ed.

HIS Excellency the (fo\'el'llor in Council, under the powers conferred upon him by the Sharks Bal' Pearl Shell Fishery Act (55 Yiet., No.9), has boen pleased

, to repeal the Reguhctions approved of on the 11th chy

of May, llll:.ill, and to make tue IUHowing Hegulatio for the control and management of the Sharks Bay Pel Shell Fishery in lieu thereof:-

1. The rent of a General License shall be at the rate of £4 pel' annum pel' boat, payable in a(lYance on the date of application, and the term shall be for any period not less than three months and not exceeding one year. All licenses shall expire on the 31st December.

2. The rent of an Exclusive License shall be at the ra te of not less than Is. per acre pel' annum, minimum rent £1, and shall be payable half-yearly in, advance on the 1st day of January and the 1st day of July in each year. Providec1 that in respect of Exclusive Licenses over any blocl{s now surveyec1 ancl set apart for such licenses, the rent shall be :fixed by the Governor in Coun­cil.

3. The term of au Exclusive License shall be computed from the :first day of January preceding the date of the approval of the application, and shall be for any period not exceeding fourteen years.

4. Licenses applied for during the year will be charged rent proportionate, calculatec1 from the 1st day of .1 anuary or J'uly last immediately preceding the elate of approyal of the application, as the case may be.

5. AppHcations for general licenses shall be made to the Inspector, as the authorised agent of the Minister, and the applicant shall give the name of the owner and the name of the boat, provided that the Inspector may, in any case in "'hich any boat is disabled 01' unable to \Vol'k, allow another boat to be substituted for the boat so disabled or unable to work:

6. No person shall destroy 01' pre\'entably permit to perish any immature pearl shell, nor shall collect, remove, 01' have in his possession such immature pearl shell, ex­cepting under the conditions coycrecf by Clause 12; and no persoll shall open any pearl shells except at such places as shall h;wo been approved of by the Inspector.

7. 'fhe holder of a general license shall only be ell­title.} to have two men at work in each boat; but if morc are required, the permission of the Inspector in writing shall be necessary; and, if obtained, an a(lc1i­tiona I fce of 5s. per month for each additional man so employed in such boat shall be paid in advance.

S. All boats licensed shall ha\'c a distinguiShing num­ber p:lintc(l on the bolY, above the water-line, and the licensee shall maintain such :figures in a clear and legible Illauner during the currency of the license.

(J. The owner 01' the agent of the owner of any licensed boat, before proceeding to work on any of the waters of Sharks Bay, shall bring the crew of such boat before the Inspector, who shall explain to such crew th e regulations under which they are to work.

10. '1.'he Inspector may, in his discretion, prohibit the use of a dredge on any portion of Sharks Bay, whether held under exclusive license or not, and this prohibition shall be absolute am1 continllous on all shal­low ana so-calle'i « pick-up banks."

11. It shall be lawful for the Inspector at any time to absolutely prohibit the obtaining of pearls and pearl shells, either by dredging, collecting by hand, 01' other­wise, from any portion of Sharks Bay, -whether held under exclush'e license or not, when in his opinion the 'rorking is likely to detrimentally exhaust the ground.

12. No person shall retain any young 01' immature shell, and shall at once return them to the water, unless they are required for planting areas held under exclu· sive licenses; in which case they shall be so dealt with as not to be allowed to perish.

13. The Inspector or other officer may seize and re-1ll0\'C any young 01' immature shell found in possession of any' person.

No person shall trespass, or sail over or anchor on uny Government Reserve, 01' other locality set apart by the .:ifinister for the growth and breeding of any oyster; and no person, except the Inspector or licensee, shall trespass, sail over, or auchor upon any sections heJd under exclusive license.

17. Applications for exelusi,-e licenses shall be made to the Inspector, 38 the authorised agent of the :\Iinister. of areas of from 10 acres upwards, but not exceeding tlYO square miles. Each application shall be accompanied by an accurate description of the area applied for, aml an application fee of £1.

In all ftpplicatiolls for exclusive licenses, the length of the licensed area shall not exceed twice its width.

In those parts of Sharks Bay ,,-hich haye been sur­yeyed into bloc:,8, rarh application must comprise one complete block as sUl'\"eyed. All applications for exclu­sive licenses shall take priority according to the order of their beino' lodged \yith the Inspector. 18. 19. The Minister shall not be bound to entertain any :1pplication, and he may invite tenders for any l~eel1se or licenses, but shall not be bound to accept the lllghest or any ten'der. 20. The light will haye a power of 864,000 candles. It \rill bo 480 feet high above high water, and visible in clear weather at a distance of 30 nautical miles.

Fixed, Occult­ing Light of the Fourth Order will be exhibited from a steel tower (open braced) erected on centre of Bedout Island, Latitude 19deg. 35min. South, Longitude 119deg. 6min, East, the height of. the focal plane above high water being 66 feet, and visible in clear weather about 14 miles.

Special attention is dra,m to the fact that the Light is unwatched, and therefore Shipmasters are cautioned against placing too much reliance on same.
