May 2017 Dear Potential Candidate: Thank you for your interest in running for elected office in West Point City. This Potential Candidate Guide will provide some basic information about a candidacy and about West Point City’s government. In the 2017 Municipal Election, the Mayoral position and two (2) City Council Member positions are available for election. This Guide will detail the responsibilities and details of each position. There are also references to several forms and documents that you will receive as a candidate. One of these forms is the Campaign Financial Report to be used in reporting your campaign contributions and expenditures. If you do decide to declare your candidacy, I strongly recommend you keep accurate records of your expenditures and donations for this Report. The Candidate filing period begins June 1, 2017 and ends on June 7, 2017, between the hours of 8:00 am and 5:00 pm (except for Saturday or Sunday) (UCA10-3-301). Declaration of Candidacy Forms or Nomination Petition must be filed in person with the West Point City Recorder at 3200 West 300 North, West Point City, UT 84015. West Point City requires a non-refundable Candidate Filing Fee of $25. You may be aware that regular City Hall office hours are Monday – Thursday 7:30 AM to 5:30 PM and Fridays from 7:30 AM to 11:30 AM. However, as the City Recorder, I will be available June 1st – 7th from 8:00 AM to 5:00 PM (except Saturday and Sunday) as required. After the filing period ends, it will be determined whether or not a primary election is needed. The Primary Election will only be held if the number of candidates for the municipal office exceeds twice the number of persons needed to fill that office. The 2017 Municipal Election for West Point will be conducted through a by-mail election. Registered Voters will receive their ballots in the mail 21 days before the election date, and can return them through the US Postal Service (through the Thursday before the election date), at a drop-box at City Hall, or on Election Day at City Hall. A polling location will also be available at City Hall on Election Day at City Hall for voters who were unable to vote by mail.

The Primary Election will be Tuesday, August 15, 201, from 7:00 AM to 8:00 PM (if needed)

The General Election will be Tuesday, November 7, 2017 from 7:00 AM to 8:00 PM

POSITIONS AVAILABLE IN THE 2017 MUNICIPAL ELECTION West Point City was incorporated in 1935 and currently operates as a fourth-class city. West Point City operates under a six-member Council, Manager by Ordinance form of government. As such, the City Council consists of one (1) Mayor and five (5) Councilmembers, and appoints a City Manager to act as the Chief Administrative Officer of the City. The Mayor and City Council are elected at-large by the voters of West Point City for a term of four years. The terms are staggered so only three council members are up for election at one time, and the other two run at the same time in the mayoral election. POSITIONS AVAILABLE FOR THE 2017 CITY COUNCIL - The Mayor position and two (2) Council Member seats, with terms of four years each (2016-2019) are up for election in 2017. Elected officers of this City shall maintain residency within the boundaries of the City during his/her term of office. The responsibilities and duties of each of these positions are as follows:

MAYOR - The Mayor shall be the chief ceremonial officer of the City and shall represent the City in all its external relationships. The Mayor shall have ultimate responsibility to keep the peace and enforce the laws of the City. The Mayor shall preside at all meetings of the City Council. All bonds, notes, contracts, and written obligations of the City shall be executed on its behalf by the Mayor, or in the event of the Mayor’s inability to act, by the Council Member that the City Council shall designate to act as Mayor Pro Tempore. The Mayor shall retain any legislative and judicial powers vested by law. The Mayor shall appoint, with the advice and consent of the City Council, persons to fill Municipal Offices or vacancies on commissions or committees of the City. Any administrative power held previously by the Mayor is now delegated to the City Manager pursuant to the applicable provisions of State Law and the West Point City Code. This section shall have precedence over any section in this chapter in conflict with the provisions of this section. [Code 2000 § 2-4-11]. FIVE-MEMBER CITY COUNCIL (2 positions available)- The City Council shall pass all resolutions, ordinances, appropriate funds and adopt the annual budget, review Municipal Administration as set out herein and perform all duties that may be required of it by law. Any administrative power held previously by the City Council is now delegated to the City Manager pursuant to the applicable provisions of State Law. This section shall have precedence over any other section contained in this chapter which is in conflict with the provisions of this section. [Code 2000 § 2-4-10]. MEETINGS City Council meetings are held on the first and third Tuesday of each month, with the Administrative Session starting at 6:00 pm and the General Session starting at 7:00 pm (the date and time of Council Meetings are subject to change). All City Council Members and the Mayor, along with select Staff Members, are expected to attend each City Council meeting with limited absences. All meetings are held in compliance with the provisions of the Utah Open and Public Meetings Act.

BECOMING A CANDIDATE

FILING QUALIFICATIONS - A person filing a Declaration of Candidacy for a City Office shall meet the requirements in UCA 20A-9-203. Requirements include:

Be a United States citizen at the time of filing; Be at least 18 years of age at the time of the next Municipal Election; Be a resident of West Point City or a resident for a period of 12 consecutive months immediately preceding the date of the election; Be a registered voter of West Point City In accordance with the Utah Constitution Article IV, Section 6, any mentally incompetent person, any person convicted of a felony, or any person convicted of treason or a crime against the elective franchise may not hold office in this state until the right to hold elective office is restored under Utah Code Section 20-A-2-101.5

CANDIDATE FILING DATES, TIME AND LOCATION - Any resident wishing to become a candidate of office must personally sign and file the Declaration of Candidacy and other required documents in front of the City Recorder or other authorized employee of the City between June 1, 2017 and June 7, 2017 between the hours of 8:00 am and 5:00 pm (except for Saturday and Sunday). (UCA 10-3-301) at West Point City Hall, 3200 West 300 North, West Point City, UT 84015. Regular City Hall office hours are Monday – Thursday 7:30 AM to 5:30 PM and Fridays from 7:30 AM to 11:30 AM. However, the City Recorder will be available June 1st – 7th from 8:00 AM to 5:00 PM (except Saturday and Sunday) as required. WITHDRAWAL OF CANDIDACY - Any person who files a Declaration of Candidacy may withdraw from the election by filing a written affidavit “Withdrawal of Candidacy” with the West Point City Recorder on or before October 16, 2017 (23 days before the Municipal Election) (UCA 20A-9-203 11).

ELECTION DAY INFORMATION

The 2017 Municipal Election will be a by-mail election. Registered Voters will receive their ballots 21 days before the election date in the mail, and can return them through the US Postal Service, at a drop-box at City Hall, or on Election Day at City Hall. A polling location will be available on Election Day for voters who were unable to vote by mail at:

The General Election will be Tuesday, November 7, 2017 from 7:00 am to 8:00 pm. There will be no early voting. MUNICIPAL CAMPAIGN FINANCE REPORTING

CAMPAIGN FINANCING DISCLOSURE REQUIREMENTS (UCA 10-3-208) State Law requires all candidates report a Campaign Financial Disclosure, listing all contributions and expenditures for their prospective campaigns. Please become familiar with the requirements of UCA 10-3-208 to make sure that you are in compliance. That Code can be found at https://le.utah.gov/xcode/Title10/Chapter3/10-3-S208.html?v=C10-3-S208_2016051020160510

These Disclosures shall include all contributions received on behalf of your campaign, including the name of the contribution donor and the contribution amount; and for all campaign expenditures, the name of the recipients and the amount of the expenditures. Nonmonetary contributions shall be reported in like manner. If a candidate has received no contributions and had no expenditures, they must still file a Financial Disclosure by simply placing a zero in both columns and signing the report. Disclosures shall be filed with the West Point City Recorder in accordance with deadlines set forth above. [Utah Code 10-3-208]. Failure to report Campaign Financial Disclosures by the appropriated deadline will result in the removal of the candidate from the ballot for the General Election.

For your convenience, I have listed these reporting dates as follows:

August 8, 2017 at 5:00 p.m. Financial Disclosures from Candidates in the Primary Election. Each candidate for Municipal Office who has declared candidacy shall file with the City Recorder a Campaign Finance Statement no later than 7 days before the Municipal Primary Election, if necessary. [UCA 10-3-208](3)(b)

September 14, 2017 at 5:00 p.m. Financial Disclosure from Candidates who were eliminated in the Primary Election. Each candidate for Municipal Office who is eliminated at a Municipal Primary Election shall file with the City Recorder a Campaign Finance Statement no later than 30 days after the Municipal Primary Election, if necessary. October 31, 2017 at 5:00 p.m. Financial Disclosure Report #1 from Candidates in the General Election. Each candidate for Municipal office who is not eliminated at the Primary Election shall file with the City Recorder a Campaign Finance Statement no later than 7 days before the Municipal General Election [UCA 10-3-208](3)(c)(i)

December 7, 2017 at 5:00 p.m. Financial Disclosure Report #2 (General Election) – Each candidate for Municipal office, whether eliminated or elected in the General Election, shall file a Campaign Financial Statement with the City Recorder 30 days after the November 7, 2017 Municipal Election. CAMPAIGN SIGNS & REGULATIONS

Candidates are required to comply with West Point City Code 17.090.120(F) when placing campaign signs. Most importantly, candidates must be aware that election signs may NOT be placed on State or City property (freeway exits or entrances, parks, Police or Fire Stations, City Hall or City Operation Centers, etc.), on power poles, street signs, regulatory signs, schools, or in park strips. Also, literature may not be placed into residents’ mailboxes as this is considered a Federal offense and could result in fines.

CAMPAIGN SIGNS SHALL COMPLY WITH WEST POINT CITY CODE 17.90.120(F)

1. Posting on Public Right-of-Way. It shall not be lawful for any person to post a campaign

sign in the area between the sidewalks and curb and gutter of any public street. No

campaign sign may be attached to any utility pole within a public right-of-way. No

campaign sign may overhang the travel way or sidewalk in a public right-of-way.

2. Repealed by Ord. 01-18-2011.

3. Limitation of Size of Campaign Signs. In any residential zone, said campaign sign shall

not exceed 24 square feet in aggregate on or in front of any parcel and, in any

agricultural zone, said campaign sign and combination of signs shall not exceed 64

square feet in aggregate on or in front of any parcel with a minimum 150-foot frontage

and two acres. If detached, said signs shall not exceed six feet in height in residential

zones and 12 feet in height in agricultural zones. Said sign shall not be erected in such a

manner as to constitute a roof sign. In commercial and industrial zoning districts,

campaign signs shall not exceed 150 square feet in aggregate on or in front of any parcel

and 12 feet in height.

4. Removal of Illegal Campaign Signs. The director of Community Development or

authorized agents are authorized to remove any campaign sign found posted within the

corporate limits of the city when such sign is in violation of the provisions of this section.

For the purpose of removing campaign signs, the director of community development or

authorized agents are empowered to take all steps necessary to remove the

unauthorized sign including but not limited to enlisting the aid or assistance of any other

expeditiously removed from any property where posted.

5. Upon discovery, the Director of Community Development or authorized agents shall

immediately notify by telephone the candidate, committee or person responsible for

the posting of any sign in violation of this section, indicating the location of the sign and

that the sign must be removed within five working days. If the address or phone number

of the person responsible for the violating sign is not known, the sign shall be removed

under the provisions as set forth in subsection (F)(4) of this section.

6. If, after the five-day notice has been given under subsection (F)(5) of this section, any

campaign sign has not been removed, the Community Development Director or

authorized agents shall remove said campaign sign and keep a record of the location

from which the sign was removed. He/she shall store the sign in a safe location for at

least 30 days. The community development director or authorized agents shall return

any campaign sign upon the payment of the fee provided in subsection (F)(7) of this

section.

7. The city shall be entitled to receive the sum of $10.00 for every campaign sign removed

by the Community Development Director or authorized agents to cover the expense of

removal, notice and storage.

8. In a campaign for elective office, the candidate for such office shall be deemed the

person responsible for the posting of campaign signs, unless the candidate first notifies

the City Recorder and the director of community development of another person who is

responsible. In such case, the candidate shall provide the name, address, telephone

number, and signed consent of such other responsible person. In a campaign regarding

a ballot measure, the president of the committee supporting or opposing such ballot

measure shall be deemed responsible, unless said person first notifies the City Recorder

and director of community development of some other person responsible, in the

manner described above. The candidate, or in the case of a ballot measure, the

committee president or other responsible person if so designated, shall be liable to pay

any fees or costs for the removal and storage of illegal signs as set out herein. Further,

such candidate, committee president, or other designated person shall be subject to

prosecution for any violation of this chapter.

9. Illegal Signs – Public Nuisance. Campaign signs in violation of this section are hereby

declared to be public nuisances, and may be abated as such by the City. The collection

of removal fees shall not preclude the city from prosecuting any person for violating this

chapter.

10. Appeal. Any person deemed responsible under this section shall have a right to appeal

any civil penalty levied to the City Manager.

POLLING PLACE– Prohibited Activities UCA 20A-3-501 Candidates are required to adhere to all regulations of UCA 20A-3-501 POLLING PLACE - PROHIBITED ACTIVITIES: (1) As used in this section:

(a) “electioneering” includes any oral, printed, or written attempt to persuade persons to refrain from voting or to vote for or vote against any candidate or issue; and (b) “polling place” means the physical place where ballots and absentee ballots are cast and includes the county clerk’s office or city hall during the period in which absentee ballots may be cast there.

(2)(a) A person may not, within a polling place or in any public area within 150 feet of the building where a polling place is located:

(i) do any electioneering; (ii) circulate cards or handbills of any kind; (iii) solicit signatures to any kind of petition; or

(iv) engage in any practice that interferes with the freedom of voters to vote or disrupts the administration of the polling place.

(b) A county, municipality, school district, or local district may not prohibit electioneering that occurs more than 150 feet away from the building where a polling place is located, but may regulate the place and manner of that electioneering to protect the public safety.

(3) (a) A person may not obstruct the doors or entries to a building in which a polling place is located or prevent free access to and from any polling place.

(b) A sheriff, deputy sheriff, or municipal law enforcement shall prevent the obstruction of the entrance to a polling place and may arrest any person creating an obstruction. (4) A person may not:

(a) remove any ballot from the polling place before the closing of the polls, except as provided in Section UCA 20A-4-101; or (b) solicit any voter to show his ballot.

(5) A person may not receive a voted ballot from any voter or deliver an unused ballot to a voter unless that person is a poll worker. (6) Any person who violates any provision of this section is guilty of a Class A misdemeanor. (7) A political subdivision may not prohibit political signs that are located more than 150 feet away from a polling place, but may regulate their placement to protect public safety.

small photograph (less than 1MB in size), and type your 200 statement. We recommend saving your 200-word statement in a separate document in case of an error.

20A-7-801 Statewide Electronic Voter Information Website Program -- Duties of the lieutenant governor -- Content -- Duties of local election officials -- Deadlines -- Frequently asked voter questions -- Other elections. (1) There is established the Statewide Electronic Voter Information Website Program administered by the lieutenant governor in cooperation with the county clerks for general elections and municipal authorities for municipal elections. (2) In accordance with this section, and as resources become available, the lieutenant governor, in cooperation with county clerks, shall develop, establish, and maintain a state-provided Internet website designed to help inform the voters of the state of: (a) the offices and candidates up for election; and (b) the content, effect, operation, fiscal impact, and supporting and opposing arguments of ballot propositions submitted to the voters. (3) Except as provided under Subsection (6), the website shall include: (a) all information currently provided in the Utah voter information pamphlet under Title 20A, Chapter 7, Part 7, Voter Information Pamphlet, including a section prepared, analyzed, and submitted by the Judicial Council describing the judicial selection and retention process; (b) all information submitted by election officers under Subsection (4) on local office races, local office candidates, and local ballot propositions; (c) a list that contains the name of a political subdivision that operates an election day voting center under Section 20A-3-703 and the location of the election day voting center; and (d) other information determined appropriate by the lieutenant governor that is currently being provided by law, rule, or ordinance in relation to candidates and ballot questions. (e) any differences in voting method, time, or location designated by the lieutenant governor under Subsection 20A-1-308(2). (4) (a) An election official shall submit the following information for each ballot label under the election official's direct responsibility under this title: (i) a list of all candidates for each office; (ii) if submitted by the candidate to the election official's office on or before at least 45 days before the primary election and 60 days before the general election. (A) a statement of qualifications, not exceeding 200 words in length, for each candidate; (B) the following biographical information if desired by the candidate, current: (I) age; (II) occupation; (III) city of residence; (IV) years of residence in current city; and (V) email address; and (C) a single web address where voters may access more information about the candidate and the candidate's views; and (iii) factual information pertaining to all ballot propositions submitted to the voters, including: (A) a copy of the number and ballot title of each ballot proposition; (B) the final vote cast for each ballot proposition, if any, by a legislative body if the vote was required to place the ballot proposition on the ballot; (C) a complete copy of the text of each ballot proposition, with all new language underlined and all deleted language placed within brackets; and (D) other factual information determined helpful by the election official. (b) The information under Subsection (4)(a) shall be submitted to the lieutenant governor no later than one business day after the deadline under Subsection (4)(a) for each general election year and each municipal election year. (c) The lieutenant governor shall: (i) review the information submitted under this section, to determine compliance under this section, prior to placing it on the website;

(ii) refuse to post information submitted under this section on the website if it is not in compliance with the provisions of this section; and (iii) organize, format, and arrange the information submitted under this section for the website. (d) The lieutenant governor may refuse to include information the lieutenant governor determines is not in keeping with: (i) Utah voter needs; (ii) public decency; or (iii) the purposes, organization, or uniformity of the website. (e) A refusal under Subsection (4)(d) is subject to appeal in accordance with Subsection (5). (5) (a) A person whose information is refused under Subsection (4), and who is aggrieved by the determination, may appeal by submitting a written notice of appeal to the lieutenant governor within 10 business days after the date of the determination. A notice of appeal submitted under this Subsection (5)(a) shall contain: (i) a listing of each objection to the lieutenant governor's determination; and (ii) the basis for each objection. (b) The lieutenant governor shall review the notice of appeal and shall issue a written response within 10 business days after the notice of appeal is submitted. (c) An appeal of the response of the lieutenant governor shall be made to the district court, which shall review the matter de novo. (6) (a) The lieutenant governor shall ensure that each voter will be able to conveniently enter the voter's address information on the website to retrieve information on which offices, candidates, and ballot propositions will be on the voter's ballot at the next general election or municipal election. (b) The information on the website will anticipate and answer frequent voter questions including the following: (i) what offices are up in the current year for which the voter may cast a vote; (ii) who is running for what office and who is the incumbent, if any; (iii) what address each candidate may be reached at and how the candidate may be contacted; (iv) for partisan races only, what, if any, is each candidate's party affiliation; (v) what qualifications have been submitted by each candidate; (vi) where additional information on each candidate may be obtained; (vii) what ballot propositions will be on the ballot; and (viii) what judges are up for retention election. Davis County Online Candidate Information

In addition to listing the candidate’s name and contact information, candidates may submit a

photograph and a statement of qualifications to be posted on the Davis County Elections

webpage.

General candidate information including name, address, and contact information will be

acquired from the declaration of candidacy. Candidates wishing to submit a photograph and

statement of qualifications should email these to Brian McKenzie, Davis County Election

Manager.

Guidelines for Photograph: Photographs should be formatted in a JPEG, PNG or GIF format.

Photographs should be of the candidate only; additional persons will be cropped out of the

posted image. Photographs deemed inappropriate or derogatory in any way will not be posted,

but the candidate will be provided an opportunity to submit a new photograph to be posted.

Guidelines for Statement of Qualifications: The statement of qualifications must be submitted

in an electronic format such as a Word document so that the data may be copied and pasted

directly onto the webpage. The statement of qualifications shall be no longer than 200 words.

Submissions that meet these requirements will be posted exactly as they are submitted to the

County and Davis County accepts no responsibility for typos or other errors submitted by the

candidate. Davis County does not validate nor guarantee the accuracy of any statement

provided by the candidate in their submission; the candidate assumes all liability for submitting

false statements. The County reserves the right to refuse posting of any statement deemed

inappropriate or derogatory in any way, the candidate will be provided an opportunity to

submit a new statement if needed if this is the case.

VOTER INFORMATION

Voter Registration

In order to vote, a person must be a registered voter. The requirements to become a registered voter are:

Be a United States Citizen Be a resident of Utah for at least 30 days immediately before the next election; Be at least 18 years old by the next election; and Have your principal place of residence in a specific voting precinct in Utah

Qualified persons can register in person the Davis County Clerk’s Office Monday through Friday, 8:00 a.m. to 5:00 p.m. up until 7 days prior to the date of the next election or online at www.vote.utah.gov. Those registering to vote in person or online 7 or more days before the election will be able to vote on the upcoming election day. Qualified persons may also mail the voter registration form 30 or more days before the election day to the Davis County Clerk, 28 East State Street, PO Box 618, Farmington, UT 84025. The voter registration form can be found online at http://www.daviscountyutah.gov/clerk-auditor/elections2/voter-registration and mail form, or at the Recorder’s Office at West Point City Hall. Qualified persons may also register to vote when applying for or renewing a driver’s license. The Driver License Division will assist applicants in completing the form and will transmit the completed forms to the Davis County Clerk/Auditor Office. Valid Voter Identification Requirements V During the 2009 legislative session HB126S2 made significant changes in voter identification laws. One of those changes is that valid voter identification is now required when voting at the polls on Election Day. Voters who do not have valid voter identification can cast a provisional ballot and then present valid voter identification to the election officer within five (5) business days after the election in order for their provisional ballot to be counted.

Valid Voter ID includes one of the following:

A form of identification that bears the name and photograph of the voter which may include a currently valid identification card that is issued by:

A currently valid Utah driver license; A currently valid ID card issued by the state or a branch, department, or agency of the

United States;

election; A bank or other financial account statement, or a legible copy thereof; A certified birth certificate; A valid Social Security card; A check issued by the state or the federal government, or a legible copy thereof; A paycheck from the voter's employer, or a legible copy thereof; A currently valid Utah hunting or fishing license; Certified naturalization documentation; A currently valid license issued by an authorized agency of the United States

government; A certified copy of court records showing the voter's adoption or name change; A Bureau of Indian Affairs card; A valid Medicaid card, Medicare card, or Electronic Benefits Transfer card; A currently valid ID card issued by a local government within the state; A currently valid ID card issued by an employer; A currently valid ID card issued by a college, university, technical school or professional

school within the state; or A current Utah vehicle registration.
