Marin Builders Association and Contractors State License Board Recognizes Senator Mark Leno
March 31st—The Marin Builders Association along with the Contractors State License Board (CSLB) will recognize Senator Leno on Thursday, March 31st, 5:30 P.M. at the Marin Builders Association, 660 Las Gallinas, San Rafael. Senator Leno will be recognized for being a champion of the construction industry. The event is open to the public and refreshments will be provided.
In 2010 Senator Leno authored SB 1254, which was sponsored by the Marin Builders Association. SB 1254 gives the CSLB the tools they need to fight unlicensed contractors by providing the Registrar with the authority to issue administrative Stop Work Orders and an increased number of enforcement officers to ensure compliance. This will help eliminate the unfair advantage unlicensed construction contractors have over legitimate licensees. The bill was signed into law in 2010.
Klif Knoles, Executive Director of the Marin Builders Association said “we became involved with Senator Leno from a grass roots effort brought about by the frustrations our member contractors’ experience due to the increasing unlicensed operators and the ever growing underground economy.” “This legislation puts real teeth in the enforcement ability for the CSLB.”
Immediately following the award ceremony Steve Sands Contractors’ State License Board Registrar; David Fogt, Contractors’ State License Board’s Chief of Enforcement; and Phil Vermeulen, Marin Builders Association’s Legislative Advocate will lead a discussion. The conversation will focus on the construction industry from the state perspective. Topics will include unlicensed contractor enforcement, budget crisis, 2011 legislative agenda and much more.

MBA: Meet Your board members
JEFF GRADYGRADY FINANCIAL, INC.Jeff is a 4th generation Marin county resident. After attending college at Chico State, he went to work in the equipment rental industry from 1990 through 2004. He was the General Manager of Big 4 Rents in 2002 when the company was acquired by Hertz Equipment and stayed with Hertz for two years.
Wanting a change, and to get away from the larger corporation, he went into business for himself in real estate financing and has been helping people with all acets of financing ever since. Occasionally he still does some consulting withinthe rental industry.
Jeff has a son age 11, and is engaged to his elementary school friend, Reina Turner. They plan to be wed later this year. She has two children of her own. Jeff enjoys community involvement, Marin County history and has served on the Board at the MBA since 1997.

State agencies have been granted broad authority to promulgate regulations on a variety of matters with potentially significantimpactsontheregulatedcommunity.Itisvitalthatlegislatorslearnhowtheirlegislativemandateshavebeeninterpreted and carried out, to provide feedback to regulators, hear concerns from regulated parties, and to inspire new legislation, if necessary.
This effort will also support the work of budget subcommittees who will increasingly need policy committee input for effective performance-based budgeting as proposed by other legislation this year.

SAFETY TOPICCal/OSHA Inspections Cal/OSHA inspectors make unannounced visits to ensure California workplaces are safe and healthy. If your business has a documented uncontrolled hazard and, as a result, receives a Cal/OSHA citation, the resulting penalties, legal issues, and lowered employee morale and publicity can have serious financial and business impacts. Managers, supervisors, and employees need to know what to expect during a Cal/OSHA inspection and how to respond appropriately.
Cal/OSHA conducts site inspections in cases of imminent danger or industrial accidents. A fatal injury to one or more employees; a serious injury or illness; a serious exposure; or the inpatient hospitalization, regardless of duration, of three (3) or more employees (a catastrophe) will trigger an accident investigation and must be reported to Cal/OSHA within 8 hours. Inspectors also focus on high-hazard work sites and industries with loss rates at or above Bureau of Labor Statistics averages.
Inspectors will also visit worksites as a response to employee complaints posing an imminent danger. At times, employee complaints may be considered low risk. These are handled with a letter reporting general information and a request to follow-up and report back within a certain time period. Conduct investigations into these complaints, gather documentation, and submit it in writing on time to the Cal/OSHA office. Note that the name of the complaining employee will be kept confidential. It is against the law to retaliate against employees for reporting safety hazards and concerns.
When you work with an inspector, be courteous and friendly. Limit the inspection focus to only the documents and facility areas listed in the opening conference. Accompany the inspector at all times, though private employee interviews can be arranged in controlled access conference rooms. Provide neutral, fact-based answers to the inspector’s questions; don’t offer opinions or guess at answers.
It is okay to offer follow-up at a later date. Don’t argue with an inspector. Also, don’t agree with comments as they may be incorrect. Don’t make jokes about health and safety, worksite, or personnel matters. Keep notes, photos, and records during the visit. If the inspector takes measurements or readings, conduct the same measurements and readings simultaneously.
After the walkthrough, the inspector should conduct a closing conference to provide inspection results, next steps, and timelines. Inspectors may request protocols, work procedures, or other documents. Deadlines for submittal range between 24 hours and 14 days. The Injury and Illness Prevention Program (IIPP) may be required immediately, since it is required to be readily accessible to employees. Conduct follow-up investigations, corrective actions, and gather requested documents and provide them to the inspector by the stated deadline. Missed deadlines can result in further site inspections or citations.
Cal/OSHA inspections are unannounced. Start planning now so you can present a competent, organized, and compliant response to a Cal/OSHA inspection. Designate and train staff to respond to Cal/OSHA inspectors. Maintain your safety programs and employee training procedures at appropriate levels. Keep safety records organized and on site and ensure key staff know how to access them.

Los inspectores de Cal/OSHA hacen visitas sin anunciarse para asegurar que los sitios de trabajo de California sean seguros y saludables. Si su negocio tiene peligros documentados sin controles, y como resultado recibe una infracción de Cal/OSHA, las multas, los problemas legales, la moral disminuida de los empleados y la mala publicidad pueden tener un efecto serio desde el punto de vista económico y comercial. GILEAD HOUSE IN NOVATO IS ASKING FOR HELP!
Gilead House, a transitional house for homeless women and their children, would appreciate your help! We are building
a new home in downtown Novato that will provide shelter and a home for six (6) women and their children.
During their stay at Gilead House, we help the women get jobs, learn how to budget, save, complete their education and
offer other life skills leading to independent living and greater stability.
The new house is over 5,000 square feet and is expected to cost $2.6M. As a non-profit organization we are working to
reduce the overall costs with donations of materials and skilled labor. So far we have received several hundred thousand
dollars. We are privileged to have had McLeran Roofing, Inc. (a Marin Builders Association member)
provide the roof of the house as a donation. According to Brian McLeran, McLeran, Inc. President “this project
touched me and I am pleased to have had the opportunity to support a project that helps the homeless children who so
often fall through the cracks”.
At this time we are looking for a carpet installer, and someone who can volunteer a maximum of one day to assist the
volunteer contractor with finish electrical and/or finish plumbing. We would also appreciate a donation (or provide at
cost) the following: plumbing fixtures, hardscape materials (pavers or concrete), electrical trim (canned light trim, wall
receptacles, wall switches). Gilead House is truly a community project and a labor of love. You can be a part of this
and make a difference in the lives of mothers and their children.
