TWEED RESIDENTS voiced their concerns for the

closure and potential sell off of

the Murwillumbah TAFE site,

which coincided with a visit

from NSW Labor leader Luke

Foley this month.

The State Government has

estimated that the Murwillumbah

TAFE campus site is worth almost

$3 million and is one of 21 regional

towns where TAFE facilities are being closed or sold.

The NSW Coalition Government says it wants to cancel courses at Murwillumbah and consolidate students at the Kingscliff TAFE campus.

The future of the TAFE site rests with National Party Lismore MP Thomas George, who is yet to make a fi nal ruling on the proposed sale.

Mr Foley, who was joined by

Federal Richmond MP Justine Elliot and Shadow Minister for the North Coast Walt Secord, said TAFE was an important stepping stone for many young people.

The Nationals have a clear agenda sell off TAFE, starve TAFE and push vocational funding out to the private providers, he said.

Mr Foleys comments were supported by Mrs Elliot who highlighted a trades and skills

shortage across the State.The Weekly spoke to three locals

protesting against the closure to get their views.

Minjunbal ALP Indigenous branch president Russell Logan said closing the Murwillumbah TAFE campus would disadvantage local Indigenous people.

The TAFE is good for up-skilling especially for those who do not complete high school, he said.

Now theres no motive for Indigenous people to get up-skilled which is a huge issue in this region.

Murwillumbah youngster Elizabeth Kirk said her brothers, who have special needs, were hoping to train at the local TAFE.

Theyre not academics and the TAFE was a way for them to fi nd hands on work as they near the end of high school, she said.

Pottsville resident Jim Banks said TAFE can give young men and women direction, where they previously had none.

Some kids have to have some direction, he said.

TAFE can help these people make something of themselves and contribute back to society.

Residents also expressed concern for local public transport, which they said failed to link Kingscliff TAFE with Murwillumbah.

How to avoid Power of Attorney pitfalls

A NSW parliamentary inquiry was recently told of increasing problems with elderly people granting power of attorney to young relatives who become impatient with getting their hands on what they consider to be their inheritance.

A university expert in elder law said the relatives might not consider it stealing or an abuse of their power of attorney to borrow $10,000 from the estate they are administering to renovate their bathroom, but it is.

They might consider it to be just improving a property they will inherit someday anyway. But what about the elderly person they are supposed to be protecting as their power of attorney? What if they later need that money for medical care or nursing home bills.

The parliamentary inquiry is examining proposals for attorneys to lodge yearly accounts and the establishment of a register of people having power of attorney to provide some basic oversight of the estate management of the booming number of elderly Australians.

Joshua Crowther, a Law Society Accredited Specialist in Wills and Estates at Stacks Law Firm, says there are strict rules governing what a person granted power of attorney over another persons fi nancial matters can do with the money.

The attorney ultimately is liable to criminal ramifi cations if they improperly take your money or transfer your assets. However proving this can be diffi cult if the person has lost capacity because you would have to rely upon knowledge of the breach from other persons.

As Mr Crowther points out, giving power of attorney to someone you trust doesnt mean you have to give them absolute power over all your fi nances.

You can insert clauses that allow a single attorney to withdraw funds less than $500 but two attorneys must sign for anything above that. You can limit an attorneys access to just one of your bank accounts and no control over other assets such as property.

You can appoint two or three people with powers of attorney who all have to sign before a major fi nancial transaction such as selling property to pay for a nursing home.

If relatives or friends are concerned a person is misusing the power of attorney and the person who appointed the attorney has lost capacity, then concerned relatives can make an application to the Guardianship Tribunal to remove the attorney.

They can also sue the attorney for fraud through the courts. That however can be expensive. If they blew it all on the pokies and have no assets there might be no point.

Its best to get expert legal advice before granting a person power of attorney.

WILD WEATHER has wreaked havoc across the Tweed Valley in recent weeks with several locals reporting downed trees and confused livestock.

Crystal Creek local June Birkett said the December 13-14 storm struck her property like a mini tornado (pictured).

A huge tree broke off at its base in the calf yard, she said.

The photo (displayed) gives a small idea of the trees size, the calves were left confused and wondering where their yard had gone.

Meanwhile, the Bureau of Meteorology (BOM) predicts this years El Nino expected to continue into autumn next year is likely to bring drier conditions across Australias southeast.

If the forecast is correct, soil moisture profi les leading into next years season will be low. The reliance on in-crop rain is more critical than

ever should summer rains fall short of providing substantial moisture. temperatures, but if we do get a week of exceptionally high temperatures, it may be problematic.

Mr Schoen said many farmers were hedging their bets and being prepared for the worst.

I think a lot of farmers, especially with the prediction of El Nino weather, are taking a precautionary approach, he said.

People have conserved fodder which will put them in good stead if there is a bad opening to autumn.

A lot of people conserve water and topped up their dams through run off or through irrigation supplies.

Most of the winter crop is already off, but higher temperatures and low humidity increases the fi re danger.

El Nino is a combination of many different forces which will give an eventual outcome. Its important not to panic, but to be prepared.
